RESOLUTION
Eighth session, Fourteenth National Assembly
OF THE NATIONAL ASSEMBLY
On the basis of the Constitution of the Socialist Republic of Vietnam;
Based on the Law on the Organization of the National Assembly No. 57/2014/QH13;
Based on the results of the session from October 21 to November 27, 2019;
In accordance with the proposal of the Standing Committee of the National Assembly and the opinions of the National Assembly deputies;
RESOLVED:
Article 1
The National Assembly has completed the eighth session's program with the following contents reviewed and decided:
1. Adopted 11 laws and codes: Labor Code; Securities Law; Library Law; Law on Reserve Forces; Law on Militia and Self-Defense Forces; Law on Exit and Entry of Vietnamese Citizens; Law Amending and Supplementing Certain Provisions of the Law on the Organization of the Government and the Law on Local Administration; Law Amending and Supplementing Certain Provisions of the Law on Civil Servants and the Law on Public Officials; Law Amending and Supplementing Certain Provisions of the State Audit Law; Law Amending and Supplementing Certain Provisions of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam; Law Amending and Supplementing Certain Provisions of the Law on Management and Use of Weapons, Explosives, and Supporting Tools.
Did not adopt the draft Law Amending and Supplementing Certain Provisions of the Law on the Organization of the National Assembly at the eighth session. Entrust the Standing Committee of the National Assembly to continue directing the study and incorporation of the opinions of National Assembly deputies to perfect this legislative project, to be submitted for review and adoption at the ninth session (May 2020).
2. Adopted 17 resolutions: Resolution approving the Supplementary Treaty to the 1985 Border Delimitation Treaty and the 2005 Supplementary Treaty and Protocol on Land Boundary Marker Posts between the Socialist Republic of Vietnam and the Kingdom of Cambodia; Resolution on freezing tax debts, waiving late payment penalties, and overdue interest for taxpayers who are unable to pay the state budget; Resolution piloting the organization of urban administrative models in Hanoi City; Resolution on questioning activities during the eighth session, Fourteenth National Assembly; Resolution on crime prevention and control work, the operation of the People's Procuracy, the People's Court, and enforcement of judgments; Resolution on continuing to improve and enhance the effectiveness of policies and laws on fire prevention and firefighting; Resolution on the plan for socio-economic development in 2020; Resolution on the state budget estimate for 2020; Resolution on the allocation of the central budget for 2020; Resolution approving the overall development plan for ethnic minority and mountainous areas from 2021 to 2030; Resolution on the feasibility study report of the Long Thanh International Airport construction investment project phase 1; Resolution approving the investment decision for the Kapet Reservoir Project in Ham Thuong Nam District, Binh Thuan Province; Resolution on the removal of members of the Standing Committee of the Fourteenth National Assembly and the Chairman of the Committee for Legal Affairs of the Fourteenth National Assembly; Resolution electing members of the Standing Committee of the Fourteenth National Assembly; Resolution electing the Chairman of the Committee for Legal Affairs of the Fourteenth National Assembly; Resolution approving the Prime Minister's proposal to remove the Minister of Health for the term 2016-2021 and Resolution of the eighth session, Fourteenth National Assembly.
3. Provided comments on 10 draft laws: Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents; Youth Law (amended); Investment Law (amended); Enterprise Law (amended); Law Amending and Supplementing Certain Provisions of the Law on the Organization of the National Assembly; Law Amending and Supplementing Certain Provisions of the Law on Judicial Appraisal; Law Amending and Supplementing Certain Provisions of the Law on Natural Disaster Prevention and Flood Control; Law Amending and Supplementing Certain Provisions of the Construction Law; Law on Public-Private Partnership Investment; Law on Mediation and Dialogue in Courts.
4. Reviewed reports: evaluating the results of implementing the socio-economic development plan and the state budget for 2019; summarizing the opinions and suggestions of voters and citizens sent to the eighth session; results of supervising the handling and responding to voter suggestions sent to the seventh session; results of receiving citizens, processing letters, and supervising the handling of complaints and denunciations sent to the National Assembly in 2019, and other reports from relevant agencies and organizations.
5. Entrust the Government to base on the socio-economic development situation, study and propose reducing normal working hours for workers below 48 hours per week and report to the National Assembly for consideration at an appropriate time.
6. Not to collect fees for granting mineral exploitation rights as stipulated in the Minerals Law No. 60/2010/QH12 from July 1, 2011 to December 31, 2013; not to collect fees for granting water resource exploitation rights as stipulated in the Water Resources Law No. 17/2012/QH13 from January 1, 2013 to August 31, 2017.
7. Permitted 11 provinces and cities to extend the period for paying medical equipment and patient transport vehicle purchases from the 20% surplus health insurance fund revenue of 2015 until June 30, 2020, totaling VND 518,389 billion (including: Hanoi: VND 116,562 billion; Cao Bang: VND 10,983 billion; Lang Son: VND 23,589 billion; Lai Chau: VND 2,357 billion; Quang Ngai: VND 699.5 million; Long An: VND 19,119 billion; Dong Nai: VND 67,655 billion; Binh Duong: VND 101,579 billion; Tuyen Quang: VND 623.5 million; Binh Phuoc: VND 3,900 billion; Ho Chi Minh City: VND 171,322 billion). After June 30, 2020, the unused funds will be remitted to the Central Government to be recorded in the contingency reserve fund according to the provisions of the Health Insurance Law No. 25/2008/QH12 amended and supplemented by Law No. 46/2014/QH13. Entrust the Government to direct implementation and report to the National Assembly at the tenth session (October 2020).
8. Cease annual reporting on the implementation of the following Resolutions of the National Assembly: Resolution No. 40/2009/QH12 on the investment policy for the Lai Chau Hydropower Project, Resolution No. 39/2012/QH13 on further enhancing the effectiveness of policies and laws in handling citizens' complaints and denunciations regarding administrative decisions on land, Resolution No. 62/2013/QH13 on strengthening management of planning, investment construction, operation, and exploitation of hydropower projects; Resolution No. 15/2008/QH12 on adjusting the administrative boundaries of Hanoi City and related provinces. Suspend reporting to the National Assembly on the enforcement of the Law on the Capital during the implementation of Resolution No. 97/2019/QH14 on piloting the organization of urban administration models in Hanoi City, except where requested by the National Assembly or the Standing Committee of the National Assembly.
Article 2
1. The Standing Committee of the National Assembly, the Government, the Vietnam Fatherland Front Central Committee, the Supreme People's Court, the Supreme People's Procuracy, the National Ethnic Council, the Committees of the National Assembly, the State Audit Office, and local authorities at all levels shall organize the effective implementation and enhance the dissemination, popularization, and education of laws to ensure that newly enacted laws and resolutions are promptly implemented in society; study, explain, and incorporate the opinions of National Assembly deputies to improve draft laws that have been reviewed by the National Assembly; urgently prepare contents for submission to the National Assembly at its ninth session to ensure quality and progress.
2. The Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegations of National Assembly members, and individual National Assembly deputies shall supervise the implementation of laws and resolutions of the National Assembly.
The Vietnam Fatherland Front Central Committee and member organizations of the Front shall supervise and encourage all strata of the people to implement laws and resolutions of the National Assembly.
This Resolution was adopted by the XIVth Session of the National Assembly of the Socialist Republic of Vietnam on November 27, 2019.
