On the basis of the Constitution of the Socialist Republic of Vietnam;
The National Assembly promulgates the National Assembly Organization Law.
PART I
POSITION, FUNCTIONS, DUTIES, AND LIMITS OF THE NATIONAL ASSEMBLY
Article 1. Position and functions of the National Assembly
1. The National Assembly is the highest representative body of the people and the highest state power organ of the Socialist Republic of Vietnam.
2. The National Assembly exercises constitutional powers, legislative powers, decides on important national issues, and conducts supreme oversight over state activities.
Article 2. Term of the National Assembly
1. The term of each National Assembly session is five years, from the opening day of the first session of that National Assembly to the opening day of the first session of the subsequent National Assembly.
2. Sixty days before the end of its term, the new National Assembly must be elected.
3. In special circumstances, if at least two-thirds of the total number of National Assembly deputies vote in favor, the National Assembly may decide to shorten or extend its term upon the proposal of the Standing Committee of the National Assembly. The extension of a National Assembly term shall not exceed twelve months, except in cases of war.
Article 3. Principles and effectiveness of National Assembly operations
1. The National Assembly operates under a conference system and makes decisions by majority rule.
2. The effectiveness of National Assembly operations is ensured through the effectiveness of its sessions, the activities of the Standing Committee of the National Assembly, the National Ethnic Council, the National Assembly Committees, the Delegations of National Assembly Deputies, the National Assembly Deputies, and the effectiveness of cooperation with the State President, the Government, the Supreme People's Court, the Supreme People's Procuracy, the Central Committee of the Vietnam Fatherland Front, and other agencies and organizations.
Article 4. Making and amending the Constitution
1. The State President, the Standing Committee of the National Assembly, the Government, or at least one-third of the total number of National Assembly deputies have the right to propose to the National Assembly for consideration and decision on making or amending the Constitution.
The National Assembly decides to make or amend the Constitution when at least two-thirds of the total number of National Assembly deputies vote in favor.
2. The National Assembly establishes a Constitutional Drafting Committee. The composition, number of members, tasks, and powers of the Constitutional Drafting Committee are decided by the National Assembly based on the proposal of the Standing Committee of the National Assembly.
3. The Constitutional Drafting Committee drafts, solicits public opinion, and submits the draft Constitution to the National Assembly.
4. The Constitution is adopted by the National Assembly when at least two-thirds of the total number of National Assembly deputies vote in favor. The National Assembly decides to hold a referendum on the Constitution in the cases prescribed in Clause 1 of Article 19 of this Law.
1. The National Assembly decides on the program for drafting laws and ordinances based on the proposal of the Standing Committee of the National Assembly.
2. Draft laws must be reviewed by the National Ethnic Council or the National Assembly Committees and given opinions by the Standing Committee of the National Assembly before being submitted to the National Assembly.
3. The National Assembly discusses, examines, and adopts draft laws at one or more National Assembly sessions based on the content of the draft laws.
Article 6. Supreme oversight of the National Assembly
1. The National Assembly conducts supreme oversight over compliance with the Constitution, laws, and resolutions of the National Assembly.
2. The National Assembly conducts supreme oversight over the activities of the State President, the Standing Committee of the National Assembly, the Government, the Supreme People's Court, the Supreme People's Procuracy, the National Election Council, the State Audit Office, and other agencies established by the National Assembly.
Article 7. Deciding important issues on economy and society
1. The National Assembly decides the goals, targets, policies, and basic tasks for long-term and annual economic and social development of the country; the investment policy for national target programs and important national projects.
2. The National Assembly decides the basic policies on national finance and currency; prescribes, amends, or abolishes taxes; decides the division of revenue and expenditure responsibilities between the central budget and local budgets; decides the safe limits of national debt, public debt, and government debt; decides the state budget estimates and allocation of the central budget, and approves the final accounts of the state budget.
3. The National Assembly decides the ethnic policies, religious policies, and basic foreign policies of the State.
Article 8. Electing positions within the state apparatus
1. The National Assembly elects the Chairman of the National Assembly, Vice Chairmen of the National Assembly, and members of the Standing Committee of the National Assembly from among the National Assembly deputies according to the list of nominations for each position proposed by the Standing Committee of the National Assembly.
At the first session, the National Assembly elects the Chairman of the National Assembly, Vice Chairmen of the National Assembly, and members of the Standing Committee of the National Assembly according to the proposal of the previous term's Standing Committee of the National Assembly.
2. The National Assembly elects the President of the State from among the National Assembly deputies according to the proposal of the Standing Committee of the National Assembly. The National Assembly elects the Vice President of the State from among the National Assembly deputies according to the proposal of the President of the State.
3. The National Assembly elects the Chairman of the National Ethnic Council and the heads of the National Assembly committees from among the National Assembly deputies according to the proposal of the Standing Committee of the National Assembly.
4. The National Assembly elects the Prime Minister from among the National Assembly deputies according to the proposal of the President of the State.
5. The National Assembly elects the Chief Justice of the Supreme People's Court and the Procurator General of the Supreme People's Procuracy according to the proposal of the President of the State.
7. In addition to those nominated by the competent authority as prescribed in Clauses 1, 2, 3, 4, 5, and 6 of this Article, the Standing Committee of the National Assembly shall submit to the National Assembly for decision the list of candidates proposed by National Assembly deputies or introduced by them for election to the positions specified in this Article.
8. After being elected, the President of the State, the Chairman of the National Assembly, the Prime Minister, and the Chief Justice of the Supreme People's Court must take an oath of allegiance to the Homeland, the People, and the Constitution.
Article 9. Approving positions within the state apparatus
1. The National Assembly approves the Prime Minister's proposal regarding the appointment of Deputy Prime Ministers, Ministers, and other members of the Government according to the list of nominations for each position.
2. The National Assembly approves the Chief Justice of the Supreme People's Court's proposal regarding the appointment of Justices of the Supreme People's Court.
3. The National Assembly approves the list of members of the National Defense and Security Council according to the proposal of the President of the State.
4. The National Assembly approves the list of members of the National Election Council according to the proposal of the Chairman of the National Election Council.
Article 10. Resignation of persons elected or approved by the National Assembly
1. Persons elected or approved by the National Assembly may resign if they are unable to perform their duties due to health reasons or other reasons.
2. Resignation letters are submitted to the competent authority or person who proposed the candidate for the position specified in Clauses 1, 2, 3, 4, 5, and 6 of Articles 8 and 9 of this Law. The competent authority or person who proposed the candidate for the position shall submit to the National Assembly for approval of resignation or confirmation of resignation at the nearest session of the National Assembly.
Article 11. Removal, Dismissal, Approval of Resignation Proposals, and Revocation of Positions Held by Individuals Appointed or Approved by the National Assembly
The National Assembly shall remove, dismiss, or approve resignation proposals and revoke positions held by individuals appointed or approved by the National Assembly as stipulated in Articles 8 and 9 of this Law upon the proposal of the agency or person with authority to introduce such individuals for appointment or approval by the National Assembly.
1. The National Assembly shall conduct confidence votes on individuals holding the following positions:
a) President of the State, Vice President of the State;
b) Chairman of the National Assembly, Vice Chairman of the National Assembly, Member of the Standing Committee of the National Assembly, Chairman of the National Ethnic Council, Chairman of the National Assembly's Committees;
c) Prime Minister, Deputy Prime Minister, Minister, other members of the Government;
d) Chief Justice of the Supreme People's Court, Procurator General of the Supreme People's Procuracy, State Auditor General.
2. The time limit, timing, and procedure for conducting confidence votes on individuals subject to such votes by the National Assembly shall be determined by the National Assembly.
1. The National Assembly shall vote on confidence in individuals holding positions appointed or approved by the National Assembly in the following cases:
a) Upon the proposal of the Standing Committee of the National Assembly;
b) Upon the request of at least twenty percent of the total number of National Assembly deputies;
c) Upon the request of the National Ethnic Council or a National Assembly Committee;
d) When the individual subject to a confidence vote under Article 12 of this Law receives a low confidence rating from more than two-thirds of the total number of National Assembly deputies.
2. If an individual put up for a confidence vote receives a non-confidence vote from more than half of the total number of National Assembly deputies, they may resign. In case of refusal to resign, the agency or person with authority to introduce such individual for appointment or approval by the National Assembly as stipulated in Clauses 1, 2, 3, 4, 5, and 6 of Articles 8 and 9 of this Law shall have the responsibility to submit to the National Assembly for consideration and decision on removal or approval of removal of the individual not trusted by the National Assembly.
Article 14. Decision on Establishment, Abolition of Agencies; Establishment, Dissolution, Merger, Division, and Adjustment of Administrative Boundaries
1. The National Assembly shall decide on the establishment, abolition of ministries, agencies equivalent to ministries; establishment, dissolution, merger, division, and adjustment of administrative boundaries of provinces, centrally-administered cities, and special administrative-economic zones upon the proposal of the Government.
2. The National Assembly shall decide on the establishment, abolition of other agencies as prescribed by the Constitution and laws.
Article 15. Abolition of Documents Contrary to the Constitution, Laws, and Resolutions of the National Assembly
1. The National Assembly shall abolish documents issued by the President of the State, the Government, the Prime Minister, the Supreme People's Court, the Supreme People's Procuracy, and other agencies established by the National Assembly that contravene the Constitution, laws, and resolutions of the National Assembly upon the proposal of the Standing Committee of the National Assembly.
2. The National Assembly shall abolish documents issued by the Standing Committee of the National Assembly that contravene the Constitution, laws, and resolutions of the National Assembly upon the proposal of the President of the State.
Article 16. Decision on Amnesty
The National Assembly shall decide on amnesty upon the proposal of the President of the State.
Article 17. Decision on War and Peace Issues
1. The National Assembly shall decide on the state of war or the termination of the state of war upon the proposal of the National Defense and Security Council.
2. In the event of war, the National Assembly shall decide to entrust the National Defense and Security Council with special tasks and powers.
3. The National Assembly shall regulate the state of emergency and other special measures to ensure national defense and security.
Article 18. Approval, decision to join or terminate the effect of international treaties
The National Assembly approves, decides to join or terminate the effect of international treaties related to war, peace, national sovereignty, membership of the Socialist Republic of Vietnam in important international and regional organizations, international treaties on human rights, basic rights and obligations of citizens, and other international treaties contrary to laws and resolutions of the National Assembly upon the proposal of the State President.
Article 19. Referendum
1. The National Assembly decides to hold a referendum on the Constitution or on other important issues upon the proposal of the Standing Committee of the National Assembly, the State President, the Government, or at least one-third of the total number of National Assembly deputies.
2. The results of the referendum have decisive value for the issue put to the referendum.
Article 20. Examination of reports on the synthesis of opinions, petitions, and the handling of petitions from voters nationwide
1. The National Assembly examines the report on the synthesis of opinions and petitions from voters nationwide presented by the Central Committee of the Vietnam Fatherland Front in coordination with the Standing Committee of the National Assembly.
2. The National Assembly examines the report on supervising the handling of voter petitions by state agencies with competent authority presented by the Standing Committee of the National Assembly.
3. When necessary, the National Assembly adopts a resolution on the handling of voter petitions.
4. State agencies and relevant organizations are responsible for studying, handling, replying to voter petitions, and reporting to the National Assembly and the Standing Committee of the National Assembly on the results of handling.
Chapter II
NATIONAL ASSEMBLY DEPUTY
Article 21. Position and role of National Assembly deputies
1. National Assembly deputies represent the will and aspirations of the people in their constituencies and of the entire nation; they act on behalf of the people to exercise state power in the National Assembly.
2. National Assembly deputies are accountable to voters and the National Assembly for the performance of their duties and powers as deputies.
3. National Assembly deputies are equal in discussion and decision-making on matters within the tasks and powers of the National Assembly.
Article 22. Standards for National Assembly deputies
2. Possess good moral qualities, diligence, thrift, honesty, integrity, impartiality, setting an example in complying with the law; having firmness, resolutely fighting against corruption, waste, all manifestations of bureaucracy, arrogance, abuse of power, and other violations of the law.
3. Have cultural and professional qualifications, sufficient capacity, health, work experience, and reputation to perform the duties of a National Assembly deputy.
4. Maintain close contact with the people, listen to the opinions of the people, and be trusted by the people.
5. Have conditions to participate in the activities of the National Assembly.
Article 23. Number of National Assembly deputies
1. The total number of National Assembly deputies shall not exceed five hundred, including full-time and part-time deputies.
Article 24. Working time of National Assembly deputies
1. Full-time National Assembly deputies dedicate all working time to performing their duties and powers as deputies at the National Assembly's agency or at the National Assembly delegation in their locality.
2. Part-time National Assembly deputies must allocate at least one-third of their working time in a year to perform their duties and powers as deputies. The head of the agency, organization, or unit where the National Assembly deputy works has the responsibility to arrange time and work, creating necessary conditions for the National Assembly deputy to perform their duties and powers.
Article 25. Term of Office of National Assembly Deputies
The term of office of National Assembly deputies corresponds to the term of the National Assembly.
The term of office of National Assembly deputies elected to fill vacancies begins on the opening day of the next session following the supplementary election and ends on the opening day of the first session of the subsequent National Assembly term.
Article 26. Responsibilities in Participating in Activities of the National Assembly and its Organs
1. National Assembly deputies have the responsibility to fully participate in all sessions and plenary meetings of the National Assembly; engage in activities of the National Assembly delegation; discuss and vote on issues within the mandate and powers of the National Assembly.
2. National Assembly deputies who are members of the National Ethnic Councils and Committees of the National Assembly have the responsibility to attend meetings and other activities of these councils and committees; discuss and vote on issues within the mandate and powers of the National Ethnic Councils and Committees they belong to.
Article 27. Responsibility towards Voters
1. National Assembly deputies must maintain close contact with voters, be subject to voter supervision, regularly meet with voters, understand their aspirations and wishes; collect and truthfully reflect the opinions and petitions of voters to the National Assembly, relevant agencies and organizations; disseminate and mobilize the people to implement the Constitution and laws.
Article 28. Responsibility for Receiving Citizens, Handling and Processing Complaints, Petitions, and Suggestions from Citizens
1. National Assembly deputies have the responsibility to receive citizens in accordance with the provisions of the law.
2. Upon receiving complaints, accusations, or suggestions from citizens, National Assembly deputies have the responsibility to study them, promptly transfer them to the competent authority for resolution, and inform the complainants, accusers, or suggesters; urge, monitor, and supervise the resolution process. The competent authority must inform the National Assembly deputy of the results of resolving complaints, accusations, or suggestions from citizens within the time limit prescribed by law.
3. In cases where the resolution of complaints, accusations, or suggestions is found to be inconsistent with the law, National Assembly deputies have the right to meet with the heads of relevant agencies, organizations, or units to inquire and request reconsideration; if necessary, National Assembly deputies can request the head of the higher-level agency, organization, or unit to resolve the matter.
Article 29. Right to Propose Draft Laws and Ordinances and Suggestions on Laws and Ordinances
1. National Assembly deputies have the right to propose draft laws and ordinances, and suggestions on laws and ordinances before the National Assembly and the Standing Committee of the National Assembly in accordance with the procedures and formalities stipulated by law.
2. National Assembly deputies are advised and supported in preparing and perfecting the documentation for draft laws and ordinances, and suggestions on laws and ordinances in accordance with the provisions of the law.
Article 30. Right to participate as a member and engage in activities of the National Assembly's Ethnic Council and Committees
1. Members of the National Assembly have the right to participate as members of the National Assembly's Ethnic Council or Committees.
Based on their professional expertise and work experience, members of the National Assembly may register to participate as members of the Ethnic Council or one of the Committees. On the basis of the registration of the members of the National Assembly, the Chairman of the Ethnic Council, the Head of the Committee shall establish a list of members of the Council and Committee for approval by the Standing Committee of the National Assembly.
2. Members of the National Assembly who are not members of the Ethnic Council or Committees have the right to register to attend meetings organized by the Council or Committee to discuss matters of interest to them.
Article 31. Right to nominate candidates for positions elected by the National Assembly
1. Members of the National Assembly have the right to nominate themselves or introduce candidates for positions elected by the National Assembly as stipulated in Article 8 of this Law.
2. Candidates introduced have the right to withdraw from the list of candidates.
Article 32. Right to question
1. Members of the National Assembly have the right to question the President of the State, the Chairman of the National Assembly, the Prime Minister, Ministers, other members of the Government, the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, and the Auditor General.
2. The person being questioned must answer before the National Assembly at its session or before the Standing Committee of the National Assembly during the period between two sessions of the National Assembly; if necessary, the National Assembly or the Standing Committee of the National Assembly may allow the response to be given in writing.
3. In case a member of the National Assembly does not agree with the content of the response to questioning, they have the right to re-question at a session of the National Assembly or the Standing Committee of the National Assembly or submit a written question to the person being questioned.
Article 33. Right to propose of members of the National Assembly
1. Members of the National Assembly have the right to propose the National Assembly to draft the Constitution, amend the Constitution, hold a referendum, establish a temporary committee of the National Assembly, conduct a vote of confidence in persons holding positions elected or approved by the National Assembly, convene an extraordinary session, a closed session of the National Assembly, and propose other issues that they deem necessary.
2. Proposals of members of the National Assembly shall be submitted in writing to the Standing Committee of the National Assembly, clearly stating the reasons and content of the proposal.
The Standing Committee of the National Assembly has the responsibility to compile and process proposals of members of the National Assembly within its authority and report to the National Assembly in cases prescribed in Clause 3 of this Article or in other cases deemed necessary by the Standing Committee of the National Assembly.
3. If one-third or more of the total number of members of the National Assembly propose the National Assembly to draft the Constitution, amend the Constitution, hold a referendum, establish a temporary committee of the National Assembly, decide to convene an extraordinary session, or convene a closed session, or if twenty percent or more of the total number of members of the National Assembly propose the National Assembly to conduct a vote of confidence in a person holding a position elected or approved by the National Assembly, then the Standing Committee of the National Assembly shall report to the National Assembly for consideration and decision.
4. The required number of proposals specified in Clause 3 of this Article is the total number of proposals received by the Standing Committee of the National Assembly from the date of opening this session to the day before the opening of the next session or to the day before the convening of a National Assembly session on the relevant issue in case a member of the National Assembly proposes the National Assembly to convene a closed session.
5. Members of the National Assembly have the right to propose agencies, organizations, and individuals to take necessary measures to implement the Constitution and laws, protect the rights and interests of the State, human rights, and legitimate rights and interests of citizens.
Article 34. Right to Request Upon Discovery of Law Violations
1. When discovering acts violating the law that cause damage to the interests of the State, the rights and legitimate interests of organizations and individuals, members of the National Assembly have the right to request relevant agencies and organizations to take necessary measures to promptly stop such violations of the law.
2. Within fifteen days from the date of receiving the request of a member of the National Assembly, the agency or organization must resolve the matter and notify the member of the National Assembly in writing. If the agency or organization fails to respond beyond this period, the member of the National Assembly has the right to request the head of the superior agency or organization to examine and resolve the matter.
Article 35. Right to Request Provision of Information
1. When performing their duties and powers, members of the National Assembly have the right to request agencies, organizations, and individuals to provide information and documents related to the tasks of those agencies, organizations, and individuals.
2. The heads of agencies, organizations, or individuals are responsible for answering questions raised by members of the National Assembly in accordance with the provisions of the law.
Article 36. Right to Attend Sessions of People's Councils
Article 37. Immunity of Members of the National Assembly
1. Members of the National Assembly may not be arrested, detained, or prosecuted without the consent of the National Assembly or, during periods when the National Assembly is not in session, without the consent of the Standing Committee of the National Assembly. Proposals for arrest, detention, prosecution, and search of the residence and workplace of a member of the National Assembly fall within the purview of the Procurator General of the Supreme People's Procuracy.
In cases where a member of the National Assembly is temporarily detained due to being caught committing a crime, the detaining authority must immediately report to the National Assembly or the Standing Committee of the National Assembly for examination and decision.
2. A member of the National Assembly cannot be dismissed, demoted, forced to resign, or fired from their position by the agency, organization, or unit where they work without the approval of the Standing Committee of the National Assembly.
Article 38. Transfer of Work and Resignation from Duties as a Member of the National Assembly
1. During their term, if a member of the National Assembly transfers work to another centrally governed province or city, they will be transferred to the National Assembly Delegation where they accept new work.
2. A member of the National Assembly may resign from their duties as a member due to health reasons or other reasons. Acceptance of a member of the National Assembly's resignation from their duties is decided by the National Assembly; during periods when the National Assembly is not in session, it is decided by the Standing Committee of the National Assembly and reported to the National Assembly at the nearest session.
3. A member of the National Assembly ceases to perform the duties of a member from the date the National Assembly or the Standing Committee of the National Assembly passes a resolution approving the resignation from the duties of a member.
Article 39. Suspension or Loss of National Assembly Delegate Status
1. In cases where a National Assembly delegate is indicted, the Standing Committee of the National Assembly shall decide to temporarily suspend the performance of their duties and powers as a National Assembly delegate.
A National Assembly delegate may resume their duties and powers and restore legitimate benefits when the competent authority suspends the investigation or prosecution against them, or from the date the court's judgment or decision becomes legally effective, declaring the delegate not guilty or exempting them from criminal responsibility.
2. A National Assembly delegate who is convicted by a court's judgment or decision shall automatically lose their status as a National Assembly delegate from the date the court's judgment or decision becomes legally effective.
Article 40. Removal of National Assembly Delegates
1. A National Assembly delegate who no longer deserves the trust of the people shall be removed by the National Assembly or voters.
2. In cases where the National Assembly removes a National Assembly delegate, the removal must be approved by at least two-thirds of the total number of National Assembly delegates.
3. In cases where voters remove a National Assembly delegate, the removal process shall be conducted according to procedures prescribed by the Standing Committee of the National Assembly.
Article 41. Allowances and Other Benefits for National Assembly Delegates
1. Allowances and other benefits for full-time National Assembly delegates, allowances for part-time National Assembly delegates who do not receive salary from the state budget shall be prescribed by the Standing Committee of the National Assembly.
2. National Assembly delegates shall be provided with monthly activity fees, funds to implement the system of hiring experts and secretaries, and other activities to serve the work of the delegates as prescribed by the Standing Committee of the National Assembly.
Article 42. Conditions Ensuring for National Assembly Delegates
1. The time spent by full-time National Assembly delegates on their duties shall be counted towards continuous working time. When a full-time National Assembly delegate ceases their duties as a delegate, the competent authority shall be responsible for arranging work for the delegate.
The time spent annually by non-full-time National Assembly delegates on performing their delegate duties as stipulated in Clause 2 of Article 24 of this Law shall be counted towards their working time at the agency, organization, or unit where they work.
2. Full-time National Assembly delegates shall be provided with workplaces and necessary material and technical means to serve their activities.
3. National Assembly delegates shall be given priority in purchasing train, car, ship, and airplane tickets; and priority when crossing bridges and ferries. In case of illness, National Assembly delegates who are not mid-level or senior officials shall be examined and treated according to the standards prescribed for mid-level officials. National Assembly delegates and former National Assembly delegates who are not officials, civil servants, or public employees shall be entitled to funeral arrangements similar to those for officials and civil servants upon death.
Article 43. National Assembly Delegation
1. The National Assembly delegation is an organization of National Assembly delegates elected in a province or centrally governed city or transferred to work in a province or centrally governed city.
2. The National Assembly delegation has the following tasks and powers:
a) Organizing National Assembly delegates to meet citizens; coordinating with the Standing Committee of the People's Council, People's Committee, and the United Front Organization at the local level to organize and ensure conditions for National Assembly delegates to meet voters through appropriate forms;
b) Organizing discussions among National Assembly delegates on draft laws, ordinances, and other projects, and proposing the agenda for National Assembly sessions as required by the Standing Committee of the National Assembly;
c) Organizing the supervision activities of the National Assembly delegation and organizing National Assembly delegates within the delegation to perform supervisory tasks at the local level; participating and coordinating with the Ethnic Councils and Committees of the National Assembly in local supervision activities; monitoring and urging the resolution of complaints, petitions, and suggestions from citizens that have been referred to competent authorities, organizations, units, or individuals for handling; requesting relevant agencies, organizations, or individuals to provide information and reports on issues of concern to the National Assembly delegation;
d) Reporting to the Standing Committee of the National Assembly on the operation of the National Assembly delegation and National Assembly delegates;
The Head of the National Assembly delegation organizes and directs the activities of the delegation.
The Deputy Head assists the Head in performing tasks as assigned by the Head. When the Head is absent, the Deputy Head shall act on behalf of the Head to perform the Head's duties.
Chapter III
THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY AND THE CHAIRPERSON OF THE NATIONAL ASSEMBLY
1. The Standing Committee of the National Assembly is the permanent body of the National Assembly.
2. The Standing Committee of the National Assembly consists of the Chairman of the National Assembly, the Vice Chairmen of the National Assembly, and the members of the Standing Committee of the National Assembly, with the Chairman of the National Assembly serving as the Chairman and the Vice Chairmen of the National Assembly serving as Vice Chairmen. Members of the Standing Committee of the National Assembly are full-time representatives of the National Assembly and cannot concurrently be members of the Government. The number of Vice Chairmen of the National Assembly and the number of members of the Standing Committee of the National Assembly are determined by the National Assembly.
3. The term of office of the Standing Committee of the National Assembly begins when it is elected by the National Assembly and ends when the new National Assembly elects a new Standing Committee of the National Assembly.
Article 45. Responsibilities of members of the Standing Committee of the National Assembly
1. Members of the Standing Committee of the National Assembly are collectively responsible for the performance of the tasks and powers of the Standing Committee of the National Assembly; they are individually responsible before the Standing Committee of the National Assembly for matters assigned by the Standing Committee of the National Assembly; they participate in sessions of the Standing Committee of the National Assembly, discuss and vote on issues within the tasks and powers of the Standing Committee of the National Assembly.
2. In cases where authorized by the Standing Committee of the National Assembly, members of the Standing Committee of the National Assembly represent the Standing Committee of the National Assembly in working with ministries, sectors, agencies, organizations, and report the results of such work to the Standing Committee of the National Assembly.
Article 46. Coordination of work between the Standing Committee of the National Assembly and other agencies, organizations, units, and individuals
1. When performing its tasks and powers, the Standing Committee of the National Assembly coordinates its work with the State President, the Government, the Prime Minister, the Supreme People's Court, the Supreme People's Procuracy, the National Audit Office, the National Election Council, the Central Steering Committee of the Vietnam Fatherland Front; it requests the participation of representatives of other agencies and organizations and citizens when necessary.
2. The Government, the Supreme People's Court, the Supreme People's Procuracy, other state agencies, political-social organizations, social organizations, socio-professional organizations, economic organizations, people's armed forces units, and citizens have the responsibility to implement the requirements of the Standing Committee of the National Assembly.
1. Proposes the agenda for the session; decides to convene the session of the National Assembly.
2. Directs, coordinates, and coordinates the activities of relevant agencies in preparing the content of the session; examines and gives opinions on the preparation of draft laws, draft resolutions, reports, and other projects to be submitted to the National Assembly; examines the consolidated report on the results of discussions by the National Ethnic Council, the Committees of the National Assembly, and National Assembly deputies at the Delegation of National Assembly Deputies; proposes issues to be discussed at the plenary session of the National Assembly.
3. Organizes and ensures the implementation of the agenda of the session of the National Assembly, and proposes adjustments to the agenda when necessary.
4. Organizes for the National Assembly to vote on draft laws, draft resolutions, and other contents within the tasks and powers of the National Assembly.
5. Coordinates with the Central Committee of the Vietnam Fatherland Front to submit to the National Assembly a consolidated report on the opinions and petitions of voters nationwide; proposes issues to be discussed and resolved by the National Assembly through resolutions addressing voter petitions.
6. Decide on other issues related to the National Assembly session.
Article 48. Law and Ordinance Construction
1. The Standing Committee of the National Assembly establishes projects on the program for law and ordinance construction and submits them to the National Assembly for decision; directs the implementation of the program for law and ordinance construction; adjusts the program for law and ordinance construction and reports to the National Assembly at the nearest session; establishes drafting committees, assigns agencies to examine draft laws and ordinances according to the provisions of the law; provides opinions on draft laws before submitting them to the National Assembly; directs the study of adoption and explanation of the opinions of National Assembly deputies to revise and perfect the draft law and submit it to the National Assembly for examination and approval.
2. The Standing Committee of the National Assembly issues ordinances on matters assigned by the National Assembly.
Draft ordinances must be examined by the National Ethnic Council or the National Assembly's Committee before being submitted to the Standing Committee of the National Assembly. When necessary, the Standing Committee of the National Assembly decides to send draft ordinances to solicit opinions from National Assembly deputies before passing.
Article 49. Interpretation of the Constitution, Laws, and Ordinances
1. The Standing Committee of the National Assembly itself or upon the proposal of the State President, the Government, the Supreme People's Court, the Supreme People's Procuracy, the National Ethnic Council, the National Assembly's Committee, the Central Committee of the Vietnam Fatherland Front, central agencies of member organizations of the Fatherland Front, or the suggestion of National Assembly deputies decides on the interpretation of the Constitution, laws, and ordinances.
2. Depending on the nature and content of the issue requiring interpretation, the Standing Committee of the National Assembly assigns the Government, the Supreme People's Court, the Supreme People's Procuracy, or the National Ethnic Council, the National Assembly's Committee to draft resolutions interpreting the Constitution, laws, and ordinances to be submitted to the Standing Committee of the National Assembly for consideration and decision.
3. Draft resolutions interpreting the Constitution, laws, and ordinances must be examined by the National Ethnic Council and the National Assembly's Committee regarding the consistency of the draft resolution interpreting the Constitution, laws, and ordinances with the spirit and content of the provisions being interpreted in the Constitution, laws, and ordinances.
Article 50. Supervision by the Standing Committee of the National Assembly
1. The Standing Committee of the National Assembly organizes the implementation of the National Assembly's supervision program, adjusts the National Assembly's supervision program during periods when the National Assembly is not in session and reports to the National Assembly at the nearest session.
2. The Standing Committee of the National Assembly supervises the enforcement of the Constitution, laws, National Assembly resolutions, ordinances, Standing Committee resolutions; supervises the activities of the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Agency, and other agencies established by the National Assembly.
Article 51. Suspension and Revocation of Central Government Agency Documents
1. The Standing Committee of the National Assembly suspends or upon the proposal of the National Ethnic Council, the National Assembly's Committee, or a National Assembly deputy suspends the enforcement of documents issued by the Government, Prime Minister, Supreme People's Court, Supreme People's Procuracy, and other agencies established by the National Assembly that contravene the Constitution, laws, and National Assembly resolutions and submits to the National Assembly for decision on revoking such documents at the nearest session.
2. The Standing Committee of the National Assembly revokes or upon the proposal of the National Ethnic Council, the National Assembly's Committee, or a National Assembly deputy revokes documents issued by the Government, Prime Minister, Supreme People's Court, Supreme People's Procuracy, and other agencies established by the National Assembly that contravene ordinances and Standing Committee resolutions.
Article 52. The Standing Committee of the National Assembly directs, coordinates, and cooperates in the activities of the National Ethnic Council and the Committees of the National Assembly.
1. Assigns the National Ethnic Council and the Committees of the National Assembly to review draft laws, ordinances, draft resolutions, and other reports and projects, except for cases decided by the National Assembly; assigns the National Ethnic Council and the Committees of the National Assembly to implement contents within the National Assembly's oversight program and other contents as required by the National Assembly; entrusts the National Ethnic Council and the Committees of the National Assembly to oversee certain issues within the Standing Committee of the National Assembly's oversight program.
2. Requires the National Ethnic Council and the Committees of the National Assembly to regularly report on their programs, plans of activities, and the implementation of these programs and plans.
3. Coordinates the activities of the National Ethnic Council and the Committees of the National Assembly taking place in the same locality or concerning the same agency or organization.
4. Considers and responds to the petitions of the National Ethnic Council and the Committees of the National Assembly.
5. When necessary, the Chairman and Vice Chairmen of the National Assembly work with the Chairperson of the National Ethnic Council, the Head of the Committees of the National Assembly, the Standing Body of the National Ethnic Council, and the Standing Body of the Committees of the National Assembly regarding matters within the duties and powers of the National Ethnic Council and the Committees of the National Assembly.
Article 53. Responsibilities of the Standing Committee of the National Assembly in the election, appointment, removal, and approval of positions in the state apparatus.
1. Proposes to the National Assembly to elect, appoint, and remove the President of the State, the Chairman of the National Assembly, the Vice Chairmen of the National Assembly, members of the Standing Committee of the National Assembly, the Chairperson of the National Ethnic Council, the Head of the Committees of the National Assembly, the Chairperson of the National Election Council, the General Auditor of the State, and the Secretary-General of the National Assembly.
3. Approves the Prime Minister's proposal on the appointment and removal of special envoys of the Socialist Republic of Vietnam.
Article 54. Responsibilities of the Standing Committee of the National Assembly towards the activities of National Assembly deputies and Delegations of National Assembly deputies.
2. Receives questions from National Assembly deputies to transfer to the person being questioned and decides the deadline and form of answering questions; receives and compiles suggestions from National Assembly deputies; submits to the National Assembly for consideration the suggestions of National Assembly deputies as stipulated in Clause 3, Article 33 of this Law; examines and answers other suggestions of National Assembly deputies; when necessary, dispatches inspection teams or working groups to localities to examine issues suggested by National Assembly deputies and Delegations of National Assembly deputies.
4. Examines the proposal of the Procurator General of the Supreme People's Procuracy on the arrest, detention, prosecution of National Assembly deputies, candidates elected as National Assembly deputies, and searches of the residence and workplace of National Assembly deputies during the period when the National Assembly is not in session; decides to temporarily suspend the performance of duties and powers of National Assembly deputies in cases where they are indicted; reports to the National Assembly about the loss of deputy status by National Assembly deputies.
5. Examines and decides on transferring National Assembly deputies to participate in other Delegations of National Assembly deputies in cases where deputies have transferred to work in another province or centrally-administered city; examines proposals from agencies, organizations, units where National Assembly deputies work on the removal, dismissal, or termination of employment of National Assembly deputies.
6. Decides to submit to the National Assembly for removal or to voters who elected them for removal of National Assembly deputies upon the proposal of the Central Committee of the Vietnam Fatherland Front, the Vietnam Fatherland Front Committee of provinces and centrally-administered cities; decides to accept the resignation of National Assembly deputies from their duties during the period when the National Assembly is not in session and reports to the National Assembly at the nearest session.
Article 55. The Standing Committee of the National Assembly supervises and guides the activities of the People's Council.
1. Supervise and guide the activities of the People's Council.
2. Decide to revoke or, upon the proposal of the Prime Minister, the National Ethnic Council, Committees of the National Assembly, or National Assembly deputies, revoke resolutions of provincial or centrally-administered city People's Councils that contravene the Constitution, laws, and higher-level state agency documents.
3. Decide to dissolve or, upon the proposal of the Government, decide to dissolve provincial or centrally-administered city People's Councils in cases where such councils cause serious damage to the interests of the people.
Article 56. Establishment, dissolution, merger, division, and adjustment of administrative unit boundaries below the provincial and centrally-administered city levels.
1. The Standing Committee of the National Assembly decides on the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries below the provincial and centrally-administered city levels based on the proposal of the Government.
2. Proposals for the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries below the provincial and centrally-administered city levels must be reviewed by the National Assembly's Committee before being submitted to the Standing Committee of the National Assembly for consideration and decision.
Article 57. Deciding on a state of war, deciding on general mobilization or partial mobilization; declaring and lifting a state of emergency.
1. In cases where the National Assembly cannot convene, the Standing Committee of the National Assembly decides on a state of war based on the proposal of the National Defense and Security Council and reports to the National Assembly at its next session; decides on general mobilization or partial mobilization based on the proposal of the National Defense and Security Council or the Prime Minister.
2. The Standing Committee of the National Assembly decides to declare a state of emergency nationwide or in specific localities when there is a large-scale natural or human-caused disaster, a dangerous epidemic spreading widely, threatening seriously the assets of the State and organizations, the lives, health, and assets of the people, or situations threatening seriously national security and social order and safety, based on the proposal of the Prime Minister. When the state of emergency no longer exists, the Standing Committee of the National Assembly decides to lift the state of emergency based on the proposal of the Prime Minister.
Article 58. Responsibilities of the Standing Committee of the National Assembly in implementing foreign relations of the National Assembly.
1. Report to the National Assembly on issues related to the country's foreign policy concerning relations with foreign national assemblies, world and regional inter-parliamentary organizations, and other international organizations. During periods when the National Assembly is not in session, review the Government's report on foreign affairs work; provide opinions on fundamental issues of the country's foreign policy before submitting them to the National Assembly.
2. Decide to host meetings of world and regional inter-parliamentary organizations in Vietnam.
3. Decide on the establishment, organizational structure, and operation of the Vietnam Friendship Parliamentarian Organization.
4. Approve the annual foreign affairs and international cooperation program of the Standing Committee of the National Assembly; direct, coordinate, and harmonize foreign affairs and international cooperation activities of the National Ethnic Council, Committees of the National Assembly, friendship parliamentary groups, agencies of the Standing Committee of the National Assembly, the State Audit Office, and the National Assembly Office.
5. Review and evaluate the results of the annual foreign affairs and international cooperation program of the National Assembly; review reports on the outcomes of visits and working trips of the National Assembly delegation abroad and foreign National Assembly delegations and international organizations visiting and working with the Vietnamese National Assembly; review reports on the outcomes of international conferences hosted by the National Assembly.
1. The Standing Committee of the National Assembly shall organize a referendum pursuant to the decision of the National Assembly.
2. The Standing Committee of the National Assembly shall specify the form of referendum ballots, voting procedures, and ballot counting procedures; decide on the specific time for conducting the referendum, the contents recorded on the referendum ballots based on the resolution of the National Assembly regarding the referendum; supervise and monitor the referendum process.
3. The Standing Committee of the National Assembly shall be responsible for announcing the results of the referendum to the National Assembly at the nearest session.
Article 60. Sessions of the Standing Committee of the National Assembly
1. The Standing Committee of the National Assembly shall discuss and decide on issues within its duties and powers at sessions of the Standing Committee of the National Assembly.
A session of the Standing Committee of the National Assembly must have at least two-thirds of the total number of members of the Standing Committee of the National Assembly present.
2. The Chairman of the National Assembly shall preside over the session of the Standing Committee of the National Assembly. The Vice Chairmen of the National Assembly shall assist the Chairman in managing the session according to the Chairman's assignment.
3. Members of the Standing Committee of the National Assembly shall be responsible for fully attending all sessions; in case they cannot attend a session, they must report the reasons to the Chairman of the National Assembly for consideration and decision.
4. The State President has the right to attend sessions of the Standing Committee of the National Assembly; the Prime Minister, the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy, the Chairman, and Vice Chairmen of the National Ethnic Council, the Chairmen, and Vice Chairmen of the Committees of the National Assembly may be invited to attend sessions of the Standing Committee of the National Assembly.
Permanent members and specialized members of the National Ethnic Council, Committees of the National Assembly may be invited to attend sessions of the Standing Committee of the National Assembly to discuss matters within their respective fields of responsibility.
5. Representatives of relevant agencies and organizations may be invited to attend sessions of the Standing Committee of the National Assembly when discussing related matters.
Article 61. Time for Holding Sessions of the Standing Committee of the National Assembly
1. The Standing Committee of the National Assembly shall hold regular meetings once a month.
2. When necessary, the Standing Committee of the National Assembly may convene a meeting upon the decision of the Chairman of the National Assembly or when requested by the State President, the Prime Minister, or at least one-third of the total number of members of the Standing Committee of the National Assembly.
Article 62. Drafting the Agenda and Deciding to Summon a Session of the Standing Committee of the National Assembly
1. The Chairman of the National Assembly shall direct the preparation for sessions of the Standing Committee of the National Assembly; draft the agenda, decide on the meeting time, and ensure measures. The Vice Chairmen of the National Assembly and members of the Standing Committee of the National Assembly shall prepare the assigned contents by the Chairman of the National Assembly.
2. According to the Chairman of the National Assembly's instructions, based on the work program of the Standing Committee of the National Assembly, the National Ethnic Council, and the Committees of the National Assembly, and the situation and progress in preparing the contents scheduled to be presented to the Standing Committee of the National Assembly, the Secretary-General of the National Assembly - Director of the National Assembly Office shall prepare the draft agenda for the session of the Standing Committee of the National Assembly no later than thirty days before the start of the session. The draft agenda must be sent to the members of the Standing Committee of the National Assembly, the Permanent Delegation of the National Ethnic Council, and the Permanent Delegation of the Committees of the National Assembly for comments before being submitted to the Chairman of the National Assembly for consideration and decision.
3. The Secretary-General of the National Assembly - Director of the National Assembly Office shall send the draft agenda for the session approved by the Chairman of the National Assembly to the agencies and organizations with matters to be presented to the Standing Committee of the National Assembly no later than twenty days before the start of the session; send the draft agenda along with the decision to summon the session to the members of the Standing Committee of the National Assembly no later than seven days before the start of the session.
4. The Government, the Supreme People's Court, the Supreme People's Procuracy, the National Ethnic Council, the Committees of the National Assembly, and relevant agencies and organizations shall be responsible for preparing and reviewing draft projects and reports within the agenda of the session according to the assignment of the Standing Committee of the National Assembly or according to their duties and powers prescribed by law.
Article 63. Documents for National Assembly Standing Committee Meetings
1. The National Assembly Standing Committee shall only consider issues on the meeting agenda when all necessary documents are available.
2. Documents serving the National Assembly Standing Committee meetings must be sent to members of the National Assembly Standing Committee at least five days before the start of the meeting. In cases where the meeting is convened according to the provisions of Clause 2, Article 61 of this Law, the documents must be sent to members of the National Assembly Standing Committee at least two days before the start of the meeting.
Article 64. Duties and Powers of the Chairman of the National Assembly
1. Chair meetings of the National Assembly, ensure compliance with regulations on the activities of National Assembly deputies and sessions of the National Assembly; sign to authenticate the Constitution, laws, and resolutions of the National Assembly.
2. Lead the work of the National Assembly Standing Committee; direct the preparation of draft agendas, convening, and chairing meetings of the National Assembly Standing Committee; sign ordinances and resolutions of the National Assembly Standing Committee.
3. Chair specialized meetings of National Assembly deputies and other meetings organized by the National Assembly Standing Committee.
4. Convene and chair meetings of the Chairman of the National Ethnic Council and the Heads of National Assembly Committees to discuss the program of activities of the National Assembly, the National Ethnic Council, and the National Assembly Committees; attend meetings of the National Ethnic Council and National Assembly Committees when necessary.
5. Maintain relations with National Assembly deputies.
6. Direct the implementation of the budget for the activities of the National Assembly.
7. Direct and organize the implementation of the National Assembly's foreign affairs work; represent the National Assembly in its external relations; lead the activities of the Vietnam National Assembly Delegation in world and regional inter-parliamentary organizations.
Article 65. Duties and Powers of Deputy Chairmen of the National Assembly
Deputy Chairmen of the National Assembly assist the Chairman of the National Assembly in performing duties as assigned by the Chairman. When the Chairman of the National Assembly is absent, a Deputy Chairman of the National Assembly appointed by the Chairman shall perform the duties and powers of the Chairman of the National Assembly.
Chapter IV
THE NATIONAL ETHNIC COUNCIL AND THE NATIONAL ASSEMBLY'S COMMITTEES
Article 66. The National Ethnic Council and National Assembly Committees
1. The National Ethnic Council and National Assembly Committees are organs of the National Assembly, responsible and report their work to the National Assembly; during periods when the National Assembly is not in session, they report their work to the National Assembly Standing Committee.
2. National Assembly Committees include:
a) Legal Affairs Committee;
b) Judicial Committee;
c) Economic Committee;
d) Finance and Budget Committee;
đ) National Defense and Security Committee;
h) Science, Technology, and Environment Committee;
i) Foreign Relations Committee.
3. The National Assembly establishes a temporary committee of the National Assembly as provided for in Articles 88 and 89 of this Law.
Article 67. Organizational Structure of the National Ethnic Council and National Assembly Committees
1. The National Ethnic Council consists of the Chairman, Deputy Chairmen, Standing Members, Specialized Members, and other Members. National Assembly Committees consist of the Head, Deputy Heads, Standing Members, Specialized Members, and other Members.
2. The Chairman of the National Ethnic Council and the Head of National Assembly Committees are elected by the National Assembly. Deputy Chairmen, Standing Members, Specialized Members, and other Members of the National Ethnic Council; Deputy Heads, Standing Members, Specialized Members, and other Members of National Assembly Committees are approved by the National Assembly Standing Committee.
The Standing Body of the National Ethnic Council includes the Chairman, Deputy Chairmen, and Standing Members. The Standing Body of National Assembly Committees includes the Head, Deputy Heads, and Standing Members.
4. The National Ethnic Council and National Assembly Committees establish sub-committees to study and prepare issues within the scope of their activities. The head of a sub-committee must be a member of the Council or Committee, while other members may not necessarily be members of the Council or Committee or National Assembly deputies.
Article 68. Principles of Work, Term of Office, and Reporting Obligations of the National Assembly's Ethnic Council and Committees
1. The National Assembly's Ethnic Council and Committees operate under a collective system and make decisions by majority rule.
2. The term of office of the National Assembly's Ethnic Council and Committees follows the term of the National Assembly.
3. At the final session of the National Assembly in each year, the National Assembly's Ethnic Council and Committees submit their work reports to National Assembly deputies and the National Assembly Standing Committee. At the final session of each term of the National Assembly, the National Assembly's Ethnic Council and Committees submit their comprehensive activity reports for the term to National Assembly deputies.
Article 69. Duties and Authorities of the National Assembly's Ethnic Council
1. Review draft laws and ordinances on ethnic policies; review other drafts assigned by the National Assembly and the National Assembly Standing Committee; review the implementation of ethnic policies in draft laws and ordinances before they are submitted to the National Assembly and the National Assembly Standing Committee.
2. Participate in opinions on the issuance of regulations implementing ethnic policies by the Government.
3. Supervise the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the National Assembly Standing Committee in the field of ethnicity; supervise the enforcement of ethnic policies, programs, and plans for economic and social development in mountainous areas and among ethnic minority groups.
4. Supervise documents issued by the Government, the Prime Minister, Ministers, and heads of ministerial-level agencies related to ethnic affairs.
5. Submit draft laws to the National Assembly and draft ordinances to the National Assembly Standing Committee on matters within the purview of the Ethnic Council.
6. Propose issues regarding state ethnic policies, organizational and operational issues of relevant agencies, and other issues related to ethnic affairs.
Article 70. Duties and Authorities of the Legal Affairs Committee
1. Review draft laws and ordinances on civil and administrative matters, and on the organization of state machinery, excluding judicial bodies; review other drafts assigned by the National Assembly and the National Assembly Standing Committee; review proposals from agencies, organizations, and National Assembly deputies for law and ordinance drafting, and National Assembly deputies' suggestions on laws and ordinances; assist the National Assembly Standing Committee in planning the legislative agenda.
2. Ensure the constitutionality, legality, and consistency of the legal system for draft laws and ordinances before they are submitted to the National Assembly and the National Assembly Standing Committee for approval; review the suggestions of the Ethnic Council and the National Assembly's Committees, the President's recommendations, the Government's recommendations, the Supreme People's Court, the Supreme People's Procuracy, the Central Committee of the Vietnam Fatherland Front, central agencies of member organizations of the Fatherland Front, or National Assembly deputies regarding documents that appear to violate the Constitution.
3. Chair the review of proposals for establishing, abolishing ministries, ministerial-level agencies, and other agencies established by the National Assembly; chair the review of proposals for establishing, dissolving, merging, dividing, and adjusting the boundaries of administrative units; chair the review of the Government's report on citizens' complaints and appeals resolution work.
4. Supervise the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the National Assembly Standing Committee on civil and administrative matters, and on the organization of state machinery, excluding judicial bodies; supervise the activities of the Government and ministries, ministerial-level agencies within the purview of the Committee.
5. Supervise documents issued by the Government, the Prime Minister, Ministers, and heads of ministerial-level agencies within the purview of the Committee.
6. Submit draft laws to the National Assembly and draft ordinances to the National Assembly Standing Committee on matters within the purview of the Committee; propose necessary measures to improve the organization of state machinery, protect the Constitution and laws, and ensure the consistency of the legal system.
Article 71. Duties and powers of the Committee on Justice
1. Review draft laws and ordinances concerning criminal matters, criminal procedure, civil procedure, administrative procedure, enforcement of judgments, judicial assistance, anti-corruption measures, organization of judicial bodies, and other projects assigned by the National Assembly and the Standing Committee of the National Assembly.
2. Review reports of the Government on prevention and suppression of law violations and crimes, enforcement of judgments; review reports of the President of the Supreme People's Court and the Procurator General of the Supreme People's Procuracy; chair the review of the Government’s report on anti-corruption efforts.
3. Review proposals of the President of the Supreme People's Court for approval of appointment, dismissal, or removal from office of Supreme People's Court judges; proposals of the State President for amnesty.
4. Supervise the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly concerning criminal matters, criminal procedure, civil procedure, administrative procedure, enforcement of judgments, judicial assistance, anti-corruption measures, and organization of judicial bodies; supervise activities of the Government, the Supreme People's Court, the Supreme People's Procuracy, ministries, and agencies at the ministerial level in investigation, prosecution, trial, enforcement of judgments, and judicial assistance; supervise the detection and handling of acts of corruption.
5. Supervise documents issued by the Government, Prime Minister, Ministers, Heads of agencies at the ministerial level, the Supreme People's Court, and the Supreme People's Procuracy within the Committee's jurisdiction.
6. Submit draft laws to the National Assembly and draft ordinances to the Standing Committee of the National Assembly within the Committee's jurisdiction; propose issues related to the organization and operation of judicial bodies and relevant agencies, and issues concerning criminal matters, criminal procedure, civil procedure, administrative procedure, enforcement of judgments, judicial assistance, and anti-corruption measures.
Article 72. Duties and powers of the Economic Committee
1. Review draft laws and ordinances in the economic management field, land, currency, banking, business operations, and other projects assigned by the National Assembly and the Standing Committee of the National Assembly.
2. Chair the review of programs, projects, plans regarding objectives, indicators, basic policies, and main tasks for national socio-economic development; reports of the Government on the implementation of objectives, indicators, basic policies, and main tasks for national socio-economic development; review the basic policy on national currency.
3. Supervise the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly in the economic management, land, currency, banking, and business operations fields; chair the supervision of activities of the Government, ministries, and agencies at the ministerial level in implementing programs, projects, plans regarding objectives, indicators, basic policies, and main tasks for national socio-economic development and the implementation of economic policies.
4. Supervise documents issued by the Government, Prime Minister, Ministers, and Heads of agencies at the ministerial level within the Committee's jurisdiction.
5. Submit draft laws to the National Assembly and draft ordinances to the Standing Committee of the National Assembly within the Committee's jurisdiction.
6. Propose issues related to the organization and operation of relevant agencies and issues concerning economic management, land, currency, banking, and business operations.
Article 73. Tasks and powers of the Finance and Budget Committee
1. Review draft laws and ordinances in the fields of finance, budget, state audit, and other projects assigned by the National Assembly and the Standing Committee of the National Assembly.
2. Review fundamental financial policies of the country, the division of revenue and expenditure responsibilities between the central and local budgets, the safe limits of national debt, public debt, and government debt; take the lead in reviewing the State budget estimates, the allocation plan for the central budget, and the final settlement of the State budget.
3. Supervise the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly in the fields of finance, budget, and state audit; supervise the activities of the Government and ministries and ministerial-level agencies in implementing the State budget estimates and financial and budgetary policies.
4. Supervise documents issued by the Government, Prime Minister, Ministers, and Heads of agencies at the ministerial level within the Committee's jurisdiction.
5. Submit draft laws to the National Assembly and draft ordinances to the Standing Committee of the National Assembly within the Committee's jurisdiction.
6. Propose issues related to the organization and operation of relevant agencies and issues concerning finance, budget, and state audit.
Article 74. Tasks and powers of the National Defense and Security Committee
1. Review draft laws and ordinances in the fields of national defense and security, social order and safety, and other projects assigned by the National Assembly and the Standing Committee of the National Assembly.
2. Supervise the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly in the fields of national defense and security, social order and safety; supervise the activities of the Government and ministries and ministerial-level agencies in performing national defense and security tasks and ensuring social order and safety.
3. Supervise documents issued by the Government, the Prime Minister, ministers, and heads of ministerial-level agencies within the Committee's jurisdiction.
4. Submit draft laws to the National Assembly and draft ordinances to the Standing Committee of the National Assembly on matters within the Committee's jurisdiction.
5. Propose issues related to the organization and operation of relevant agencies and issues concerning national defense and security, social order and safety.
1. Review draft laws and ordinances in the fields of culture, education, information, communication, beliefs, religion, tourism, sports, youth, children, adolescents, and other projects assigned by the National Assembly and the Standing Committee of the National Assembly.
2. Supervise the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly in the fields of culture, education, information, communication, beliefs, religion, tourism, sports, youth, children, adolescents; supervise the activities of the Government and ministries and ministerial-level agencies in implementing cultural, educational, informational, communicational, religious, tourism, and sports policies in national socio-economic development plans and programs; supervise the implementation of policies towards youth, children, and adolescents.
3. Supervise documents issued by the Government, the Prime Minister, ministers, and heads of ministerial-level agencies within the Committee's jurisdiction.
4. Submit draft laws to the National Assembly and draft ordinances to the Standing Committee of the National Assembly on matters within the Committee's jurisdiction.
5. Propose issues related to the organization and operation of relevant agencies and issues concerning cultural, educational, informational, communicational, religious, tourism, sports development, and policies towards youth, children, and adolescents.
1. Review draft laws and ordinances in the fields of labor, employment, health care, population, social security, gender equality, commendation, prevention of social evils, and other projects assigned by the National Assembly and the Standing Committee of the National Assembly.
2. Review the integration of gender equality issues in draft laws, ordinances, and draft resolutions submitted to the National Assembly and the Standing Committee of the National Assembly.
3. Supervise the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly in the fields of labor, employment, health care, population, social security, gender equality, commendation, prevention of social evils; supervise the activities of the Government and ministries and equivalent agencies in implementing policies on labor, employment, health care, population, social security, gender equality, commendation, prevention of social evils within national socio-economic development plans and programs.
4. Supervise documents issued by the Government, Prime Minister, Ministers, and Heads of agencies at the ministerial level within the Committee's jurisdiction.
5. Submit draft laws to the National Assembly and draft ordinances to the Standing Committee of the National Assembly within the Committee's jurisdiction.
6. Propose issues related to the organization and operation of relevant agencies and policies and measures to address issues concerning labor, employment, health care, population, social security, gender equality, commendation, prevention of social evils.
Article 77. Tasks and Authorities of the Committee on Science, Technology, and Environment
1. Review draft laws and ordinances in the fields of science, technology, natural resources, environmental protection, climate change response, disaster prevention, and other projects assigned by the National Assembly and the Standing Committee of the National Assembly.
2. Supervise the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly in the fields of science, technology, natural resources, environmental protection, climate change response, disaster prevention; supervise the activities of the Government and ministries and equivalent agencies in implementing policies on the development of science, technology, natural resources, environmental protection, climate change response, disaster prevention within national socio-economic development plans and programs.
3. Supervise documents issued by the Government, the Prime Minister, ministers, and heads of ministerial-level agencies within the Committee's jurisdiction.
4. Submit draft laws to the National Assembly and draft ordinances to the Standing Committee of the National Assembly on matters within the Committee's jurisdiction.
5. Propose issues related to the organization and operation of relevant agencies and issues concerning the development of science, technology, natural resources, environmental protection, climate change response, disaster prevention.
Article 78. Tasks and Authorities of the Committee on Foreign Affairs
1. Review draft laws and ordinances in the field of foreign affairs of the State and other projects assigned by the National Assembly and the Standing Committee of the National Assembly.
2. Chair the review of international treaties within the authority to approve, decide to join or terminate their effect by the National Assembly; review reports of the Government on foreign affairs work; review proposals of the Prime Minister regarding the approval of appointment and dismissal of special envoys of the Socialist Republic of Vietnam.
3. Supervise the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly in the field of foreign affairs; supervise the activities of the Government and ministries and equivalent agencies in implementing the State's foreign policy; supervise the signing, joining, and implementation of international treaties and agreements; supervise the foreign affairs and foreign economic activities of sectors and localities; supervise the implementation of the State's policy towards overseas Vietnamese and foreigners in Vietnam.
4. Supervise documents issued by the Government, Prime Minister, Ministers, and Heads of agencies at the ministerial level within the Committee's jurisdiction.
5. Implement external relations with the National Assemblies of other countries, world and regional inter-parliamentary organizations according to the guidance of the Standing Committee of the National Assembly and the Chairman of the National Assembly.
6. Submit draft laws to the National Assembly and draft ordinances to the Standing Committee of the National Assembly in the fields under its responsibility; propose issues related to the organization and operation of relevant agencies and issues concerning the State's foreign policy, relations with the National Assemblies of other countries, world and regional inter-parliamentary organizations, other international organizations, the signing, joining, and implementation of international treaties and agreements, and the State's policy towards overseas Vietnamese and foreigners in Vietnam.
Article 79. Responsibilities for participating in scrutiny and coordination between the National Assembly's Ethnic Council and Committees
Within their respective duties and powers, the National Assembly's Ethnic Council and Committees shall have the following responsibilities:
2. Participate with the Finance and Budget Committee in scrutinizing the state budget estimates, central budget allocation schemes, and final settlement of the state budget;
3. Participate with the Legal Committee in scrutinizing proposals from agencies, organizations, and National Assembly deputies on law and ordinance drafting; recommendations from National Assembly deputies on laws and ordinances; draft projects on establishing, abolishing ministries, ministerial-level agencies, and other agencies established by the National Assembly; reports from the Government on citizen complaint resolution work;
4. Participate with the Justice Committee in scrutinizing the Government’s report on anti-corruption work;
5. Coordinate with the Foreign Affairs Committee to implement external relations and international cooperation of their own Councils and Committees; participate with the Foreign Affairs Committee in scrutinizing international treaties within the authority to approve, join, or terminate their validity by the National Assembly; participate with the Foreign Affairs Committee in implementing the National Assembly’s external information work;
6. Supervise the implementation of the state budget, anti-corruption work, thrift and waste prevention, citizen complaint resolution, suggestions, and reflections within the areas under their Councils and Committees' responsibility.
Article 80. Responsibilities of the National Assembly's Ethnic Council and Committees in protecting the Constitution
2. The Legal Committee shall be responsible for scrutinizing recommendations from the National Assembly's Ethnic Council and Committees, proposals from the State President, the Government, the Supreme People's Court, the Supreme People's Procuracy, the Vietnam Fatherland Front Central Committee, central agencies of member organizations of the Fatherland Front, or National Assembly deputies on documents that appear to violate the Constitution to submit to the National Assembly or the Standing Committee of the National Assembly for examination and handling according to their authority.
Article 81. Requests for Reports, Provision of Documents, and Assignment of Members to Examine and Verify
1. The National Assembly's Ethnic Council and Committees have the right to request members of the Government, the Chief Justice of the Supreme People's Court, the Prosecutor General of the Supreme People's Procuracy, the State Auditor General, and relevant individuals to report and provide documents on issues necessary within the areas under their Councils and Committees' responsibility. The person requested has the responsibility to comply with the requests of the National Assembly's Ethnic Council and Committees.
2. When necessary, the National Assembly's Ethnic Council and Committees may assign their members to relevant agencies and organizations to examine and verify issues of concern to their Councils and Committees. Relevant agencies and organizations have the responsibility to create conditions for the members of the Councils and Committees to perform their tasks.
Article 82. Explanation at the National Assembly Ethnic Council and Committee Meetings
1. The National Assembly Ethnic Council and Committee have the right to request members of the Government, the President of the Supreme People's Court, the Procurator-General of the Supreme People's Procuracy, the State Auditor General, and relevant individuals to explain issues within the scope of the National Assembly Ethnic Council and Committee.
2. The person requested to explain shall be responsible for reporting and explaining at the meeting of the National Assembly Ethnic Council and Committee.
3. The National Assembly Ethnic Council and Committee must conclude on the issue explained. The conclusion of the Council and Committee shall be sent to the Standing Committee of the National Assembly, National Assembly deputies, and relevant agencies and organizations.
Article 83. Coordination with Local Agencies and Organizations
1. The National Assembly Ethnic Council and Committee maintain contact with the People's Councils and corresponding committees of provincial and centrally-administered city People's Councils.
2. When conducting activities in localities, the National Assembly Ethnic Council and Committee shall notify the People's Councils, People's Committees, and Delegations of the National Assembly of the province or centrally-administered city to coordinate their activities.
3. Within the scope of their duties and powers, the People's Councils, People's Committees, and Delegations of the National Assembly of the province or centrally-administered city shall participate in the activities of the National Assembly Ethnic Council and Committee in the locality when requested.
Article 84. Foreign Relations and International Cooperation
1. The National Assembly Ethnic Council and Committee implement foreign relations with relevant agencies of foreign national assemblies, other foreign agencies, and international organizations to study and exchange professional experiences, contributing to enhancing foreign relations and international cooperation according to the State's foreign policy.
2. The National Assembly Ethnic Council and Committee propose and plan the annual foreign relations and international cooperation program of the Council and Committee. The Foreign Affairs Committee reviews the proposed annual foreign relations and international cooperation program of the Council and Committee and submits it to the Standing Committee of the National Assembly for consideration and decision.
3. The National Assembly Ethnic Council and Committee are responsible for reporting the results of foreign relations and international cooperation to the Standing Committee of the National Assembly. Annually, the Foreign Affairs Committee coordinates with the National Assembly Office to compile the report on the results of foreign relations and international cooperation of the National Assembly Ethnic Council and Committee.
Article 85. Duties and Powers of the Chairman of the National Assembly Ethnic Council and the Head of the National Assembly Committee
1. The Chairman of the National Assembly Ethnic Council and the Head of the National Assembly Committee have the following duties and powers:
a) To convene and chair meetings of the National Assembly Ethnic Council and Committee;
b) To manage the work of the National Assembly Ethnic Council and Committee;
c) To propose to the Standing Committee of the National Assembly to approve the Vice Chairmen, Standing Members, Specialized Members, and other Members of the National Assembly Ethnic Council; the Deputy Heads, Standing Members, Specialized Members, and other Members of the Committee that he/she chairs;
d) To maintain regular contact with members of the National Assembly Ethnic Council and Committee;
đ) To attend sessions of the Standing Committee of the National Assembly; the Chairman of the National Assembly Ethnic Council may be invited to attend sessions of the Government discussing the implementation of ethnic policies;
e) To represent the National Assembly Ethnic Council and Committee in maintaining contact with relevant agencies and organizations;
g) To perform other tasks assigned by the Standing Committee of the National Assembly.
2. The Vice Chairman of the National Assembly Ethnic Council assists the Chairman in performing tasks as delegated by the Chairman. In the absence of the Chairman of the National Assembly Ethnic Council, a Vice Chairman appointed by the Chairman shall perform the Chairman's duties and powers.
The Deputy Head of the National Assembly Committee assists the Head in performing tasks as delegated by the Head. In the absence of the Head of the National Assembly Committee, a Deputy Head appointed by the Head shall perform the Head's duties and powers.
Article 86. Tasks and Authorities of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the National Assembly’s Committees
1. Propose the program and plan of activities of the Ethnic Council and the National Assembly’s Committees for consideration and decision by the Council and the Committees.
2. Organize the implementation of the program and plan of activities and decisions, conclusions of the Council and the Committees.
3. Prepare content and materials to serve the activities of the Council and the Committees; provide necessary information and materials for members of the Council and the Committees; based on the results of the Council and Committee meetings, prepare reports for review, other reports of the Council and the Committees to be submitted to the National Assembly and the National Assembly’s Standing Committee.
4. Preliminarily review draft laws, draft resolutions, reports, and other projects to be submitted to the National Assembly’s Standing Committee for consideration before submission to the National Assembly.
5. Prepare opinions on contents in the agenda of the National Assembly’s Standing Committee meetings when invited to attend; participate in other activities of the Council and the Committees and of relevant agencies and organizations; organize inspection delegations and working groups of the Council and the Committees; receive citizens, study and handle complaints, denunciations, petitions, and reflections sent to the Council and the Committees.
6. Implement the guidance, coordination, and cooperation of the National Assembly’s Standing Committee regarding the activities of the Council and the Committees; periodically report to the Council and the Committees on the activities of the Standing Committee of the Council and the Standing Committee of the Committees.
7. Coordinate with the Secretary-General of the National Assembly - Director of the National Assembly Office in defining the organizational structure, tasks, and authorities of specialized units directly assisting the Council and the Committees.
8. Coordinate with the Secretary-General of the National Assembly - Director of the National Assembly Office in the recruitment, appointment, reward, and disciplinary measures for civil servants and the implementation of policies for civil servants belonging to specialized units directly assisting the Council and the Committees.
9. Direct the professional work of specialized units directly assisting the Council and the Committees; decide on the use of funds allocated to the Council and the Committees.
10. Before the end of the term, propose the composition and number of members of the next term Council and Committees and report to the National Assembly’s Standing Committee.
11. Resolve other matters of the Council and the Committees and report to the Council and the Committees at the nearest meeting.
Article 87. Plenary Meetings of the National Assembly's Ethnic Council and Committees
3. The Chairperson and Vice-Chairpersons of the National Assembly have the right to attend and make guiding statements at plenary meetings of the Council and the Committees.
4. The Ethnic Council and the National Assembly’s Committees may invite non-member National Assembly deputies, representatives of relevant agencies and organizations, and experts to participate in the activities of the Council and the Committees. Relevant agencies and organizations have the responsibility to create conditions for those invited to participate in the activities of the Council and the Committees.
5. When the Ethnic Council discusses ethnic policy, the Chairperson of the Ethnic Council invites representatives of ethnic minorities not represented in the National Assembly as People's Council deputies to attend.
Article 88. Establishment of the Temporary Committee
1. The Temporary Committee shall be established by the National Assembly in the following cases:
a) Reviewing draft laws, draft resolutions, or reports, other projects submitted to the National Assembly by the Standing Committee of the National Assembly, or those related to the areas under the responsibility of the National Ethnic Council and multiple Committees of the National Assembly;
b) Investigating a specific issue when deemed necessary.
2. The Standing Committee of the National Assembly shall submit to the National Assembly for consideration and decision on the establishment of the Temporary Committee upon the proposal of the National Ethnic Council, a Committee of the National Assembly, or at least one-third of the total number of National Assembly deputies.
Article 89. Structure, Tasks, and Authorities of the Temporary Committee
1. The Temporary Committee consists of the Chairperson, Deputy Chairpersons, and Members. Members of the Temporary Committee are National Assembly deputies. The composition, number of members, specific tasks, and authorities of the Temporary Committee shall be decided by the National Assembly based on the proposal of the Standing Committee of the National Assembly.
2. The Temporary Committee shall report to the Standing Committee of the National Assembly and the National Assembly on the results of its assigned tasks and authorities. The investigation results of the Temporary Committee must be reviewed by the National Ethnic Council or a Committee of the National Assembly. The National Assembly shall consider and adopt a resolution on the investigation results of the Temporary Committee.
3. The Temporary Committee ceases operations after completing its assigned tasks.
Chapter V
SESSIONS OF THE NATIONAL ASSEMBLY
Article 90. Sessions of the National Assembly
1. The National Assembly convenes in public sessions.
In case of necessity, upon the proposal of the State President, the Standing Committee of the National Assembly, the Prime Minister, or at least one-third of the total number of National Assembly deputies, the National Assembly decides to convene in closed sessions.
2. The National Assembly convenes two regular sessions each year.
If the State President, the Standing Committee of the National Assembly, the Prime Minister, or at least one-third of the total number of National Assembly deputies request it, the National Assembly may convene extraordinary sessions.
3. At the session of the National Assembly, the National Assembly discusses and decides on issues within its tasks and authorities according to the procedures stipulated in the Rules of Procedure of the National Assembly Session and other relevant laws.
Article 91. Agenda of the National Assembly Session
1. Based on the National Assembly's resolution, proposals from the State President, the Prime Minister, the Central Committee of the Vietnam Fatherland Front, the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, the Auditor General, the National Ethnic Council, Committees of the National Assembly, and National Assembly deputies, the Standing Committee of the National Assembly forecasts the agenda of the National Assembly session.
The Standing Committee of the previous term forecasts the agenda of the first session of the new term of the National Assembly.
2. The forecasted agenda of the National Assembly session shall be announced through mass media channels at least 15 days before the opening date of the regular session and at least 4 days before the opening date of the extraordinary session.
3. The National Assembly decides on the agenda of the National Assembly session. In case of necessity, based on the proposals of the State President, the Prime Minister, the Central Committee of the Vietnam Fatherland Front, the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, the Auditor General, the National Ethnic Council, Committees of the National Assembly, National Assembly deputies, the Standing Committee of the National Assembly shall submit to the National Assembly for decision on amending or supplementing the agenda of the session.
Article 92. Summoning National Assembly Sessions
1. The Standing Committee of the National Assembly decides to summon regular sessions of the National Assembly at least 30 days before the opening day of the session and extraordinary sessions at least seven days before the opening day of the session.
2. The first session of the new term of the National Assembly shall be summoned by the Standing Committee of the previous term of the National Assembly at least 60 days from the date of the election of National Assembly deputies.
3. The decision to summon the session together with the proposed agenda of the session shall be sent to National Assembly deputies.
Article 93. Persons Invited to Attend National Assembly Sessions; Listening to Plenary Sessions of the National Assembly
1. The President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, members of the Government, the State Auditor General, and heads of agencies established by the National Assembly that are not National Assembly deputies shall be invited to attend National Assembly sessions; they have the responsibility to attend plenary sessions of the National Assembly when discussing issues related to their sectors or fields. Persons invited to attend National Assembly sessions may express opinions on issues within their sectors or fields if approved by the Chairman of the National Assembly or have the responsibility to express opinions according to the request of the Chairman of the National Assembly.
2. Representatives of state agencies, central agencies of political organizations, political-social organizations, social organizations, economic organizations, people's armed units, press agencies, and international guests may be invited to attend public plenary sessions of the National Assembly.
3. Citizens may be allowed to listen to public plenary sessions of the National Assembly.
Article 94. Forms of Work at National Assembly Sessions
1. Plenary sessions of the National Assembly.
2. Sessions organized by the Standing Committee of the National Assembly for discussion and consideration of contents included in the session program.
3. Sessions organized by the National Assembly Ethnic Councils and Committees for discussion and consideration of contents included in the session program within their respective fields.
4. Sessions of National Assembly Delegation and Delegation Groups to discuss contents included in the session program.
5. In cases of necessity, the Chairman of the National Assembly may invite the Heads of National Assembly Delegations, the Chairperson of the National Assembly Ethnic Council, the Chairpersons of National Assembly Committees, and other relevant National Assembly deputies to exchange views on issues to be submitted to the National Assembly for consideration and decision.
6. Opinions expressed by National Assembly deputies at plenary sessions, delegation sessions, and group sessions, and written opinions of National Assembly deputies have equal value and shall be fully compiled and summarized to report to the National Assembly.
Article 95. Responsibility to Chair National Assembly Sessions
1. The Chairman of the National Assembly chairs National Assembly sessions, ensuring the implementation of the session program and regulations on National Assembly sessions. The Vice Chairmen of the National Assembly assist the Chairman in managing the session according to the Chairman's assignment.
2. At the first session of each term of the National Assembly, the Chairman of the previous term of the National Assembly opens and chairs National Assembly sessions until the National Assembly elects the Chairman of the new term.
Article 96. Voting at Plenary Sessions
1. The National Assembly decides issues at plenary sessions through voting. National Assembly deputies have the right to vote in favor, against, or abstain.
2. The National Assembly decides to apply one of the following voting methods:
a) Public voting;
b) Secret ballot.
3. Laws and resolutions of the National Assembly are adopted when more than half of the total number of National Assembly deputies vote in favor, except in cases provided for in Clause 3, Article 2, Clause 4, Article 4, and Clause 2, Article 40 of this Law.
Article 97. Documents for National Assembly Sessions
1. The Chairman of the National Assembly decides on the official documents to be used at the session upon the proposal of the Secretary-General of the National Assembly - Head of the National Assembly Office.
2. Draft laws, draft resolutions, and other projects must be sent to National Assembly deputies at least twenty days before the opening date of the National Assembly session; other documents must be sent to National Assembly deputies at least ten days before the opening date of the National Assembly session.
3. National Assembly deputies are responsible for implementing regulations regarding the use and preservation of documents during the session.
4. The Secretary-General of the National Assembly - Head of the National Assembly Office decides on reference materials to serve National Assembly deputies at the session.
Chapter VI
SECRETARY-GENERAL OF THE NATIONAL ASSEMBLY, NATIONAL ASSEMBLY OFFICE,
ORGANIZATIONS UNDER THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
AND OPERATING EXPENSES OF THE NATIONAL ASSEMBLY
Article 98. Secretary-General of the National Assembly
1. The Secretary-General of the National Assembly is elected, relieved, or removed from office by the National Assembly. The Secretary-General of the National Assembly is responsible for advising and serving the activities of the National Assembly, the Standing Committee of the National Assembly, and National Assembly deputies, and performs the following duties and powers:
a) Advising the Chairman of the National Assembly and the Standing Committee of the National Assembly on the proposed work program of the National Assembly and the Standing Committee; on procedures and processes for conducting the activities of the National Assembly and the Standing Committee;
b) Coordinating with the National Ethnic Council, the Committees of the National Assembly, and relevant agencies and organizations to draft resolutions on matters assigned by the National Assembly and the Standing Committee;
c) Serving as the spokesperson for the National Assembly and the Standing Committee; organizing information provision, press, publishing, library, museum, and information technology application services to support the activities of the National Assembly, its agencies, and National Assembly deputies;
d) Organizing secretarial operations during National Assembly sessions and Standing Committee meetings; compiling and summarizing the opinions of National Assembly deputies; signing session minutes and meeting minutes;
e) Performing other tasks and powers assigned by the Chairman of the National Assembly and the Standing Committee of the National Assembly.
2. The Secretariat assists the Secretary-General of the National Assembly. The organizational structure, duties, and powers of the Secretariat are specified by the Standing Committee of the National Assembly.
Article 99. National Assembly Office
1. The National Assembly Office is an administrative advisory body that serves the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, and National Assembly deputies. The National Assembly Office has the following duties and powers:
a) Organizing service for National Assembly sessions, Standing Committee meetings, and other activities of the National Assembly, the Standing Committee, the National Ethnic Council, and the Committees of the National Assembly;
b) Managing civil servants and other staff serving the National Assembly and its agencies;
c) Managing the operating budget of the National Assembly;
2. The Secretary-General of the National Assembly concurrently serves as the Head of the National Assembly Office and is accountable to the National Assembly and the Standing Committee of the National Assembly for the activities of the National Assembly Office.
Deputy Heads of the National Assembly Office are appointed, relieved, or dismissed by the Standing Committee of the National Assembly upon the recommendation of the Secretary-General of the National Assembly - Head of the National Assembly Office.
3. The Standing Committee of the National Assembly specifies the organizational structure, duties, and powers of the National Assembly Office; determines staffing levels for the cadre, civil servants, and other employees of the National Assembly Office, and establishes systems and policies applicable to these personnel consistent with the unique nature of the National Assembly's activities.
Article 100. Agencies under the Standing Committee of the National Assembly
1. The Standing Committee of the National Assembly establishes agencies under the Standing Committee of the National Assembly to provide advisory services and assist the Standing Committee of the National Assembly in specific areas of work.
2. The Standing Committee of the National Assembly shall stipulate the organizational structure, tasks, authorities, systems, and policies applicable to the cadre, civil servants, officials, and other workers employed at these agencies, in accordance with the special characteristics of the activities of the National Assembly.
Article 101. Operating Expenses of the National Assembly
2. The preparation of budgets, management, allocation, and utilization of the operating expenses of the National Assembly shall be carried out in accordance with the laws on the state budget.
Chapter VII
IMPLEMENTING PROVISIONS
Article 102. Effective Date
1. This Law shall take effect from January 1, 2016.
2. The Law on the Organization of the National Assembly No. 30/2001/QH10, amended and supplemented by Law No. 83/2007/QH11, shall cease to be effective from the date this Law takes effect./.
