Regulations on the functions, tasks, powers, and organizational structure of the National Committee for Vietnamese Overseas under the Ministry of Foreign Affairs

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Based on Decree No. 15/2008/NĐ-CP dated February 4, 2008, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;

Considering the proposal of the Minister of Foreign Affairs.

DECISION:

Article 1. Position and Functions

1. The National Committee for Vietnamese Overseas is a general department directly under the Ministry of Foreign Affairs, assisting the Minister of Foreign Affairs in performing state management functions regarding work with overseas Vietnamese.

2. The National Committee for Vietnamese Overseas has legal personality, bears the State Emblem seal, and is entitled to open accounts at the State Treasury in accordance with the law, with its headquarters located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Submit draft laws, ordinances, draft resolutions, decrees of the Government, decisions, directives of the Prime Minister, strategies, programs, long-term plans, five-year plans, annual plans, and other important projects concerning work with overseas Vietnamese to the Minister of Foreign Affairs for submission to competent authorities for decision.

2. Propose the Minister of Foreign Affairs to issue legal regulatory documents concerning work with overseas Vietnamese within their authority.

3. Assist the Minister of Foreign Affairs in directing, guiding, inspecting, urging, and being responsible for organizing the implementation of legal regulatory documents, policies, strategies, planning, programs, and plans concerning work with overseas Vietnamese after approval.

4. Take the lead and coordinate with relevant ministries, sectors, agencies, organizations, and localities to implement measures to help overseas Vietnamese stabilize their lives, integrate into the host society, and maintain ties with the homeland; combat actions detrimental to the common interests of the nation, community, and friendly cooperative relations between the host country and Vietnam.

5. Take the lead and coordinate with relevant ministries, sectors, agencies, and localities to provide information to overseas Vietnamese about the Party's guidelines and the State's policies, the political, economic, cultural, and social situation of the country; support compatriots in preserving the Vietnamese language, cultural identity, and national traditions; support strengthening exchanges in economics, culture, sports, education, training, science, technology, and technology between overseas Vietnamese communities and compatriots in the homeland.

6. Direct and guide overseas representative offices of the Socialist Republic of Vietnam to implement state policies and laws concerning overseas Vietnamese; support and guide overseas Vietnamese communities in organizing and establishing Vietnamese associations in compliance with the laws of the host country and approve lists of executive committees of such organizations introduced by overseas representative offices and associations.

7. Coordinate with relevant ministries, sectors, agencies, organizations, and localities to support overseas Vietnamese in investment, business, economic cooperation, scientific, technological, cultural, and social activities in the homeland; organize, mobilize, and support activities for building and developing the country by overseas Vietnamese.

8. Assist the Minister of Foreign Affairs in directing, guiding, supervising, and inspecting ministries, councils, sectors, provincial people's committees under central cities in implementing approved objectives, programs, and plans concerning work with overseas Vietnamese; summarize, evaluate, and propose necessary recommendations on activities related to overseas Vietnamese and regularly report to the National Committee for Vietnamese Overseas; resolve proposals and complaints from ministries, councils, sectors, provincial people's committees under central cities, and associations in the field of work with overseas Vietnamese in accordance with state management regulations.

9. Study, survey, compile, and assess the situation of overseas Vietnamese communities; advise competent authorities on policies, strategies, and initiatives for work with overseas Vietnamese.

10. Coordinate with relevant ministries, sectors, agencies, organizations, and localities to protect the rights and legitimate interests of overseas Vietnamese in accordance with Vietnamese law, the laws of the host country, and international law.

11. Coordinate with functional agencies to formulate policies on the emigration of Vietnamese citizens and manage state activities related to the emigration of Vietnamese citizens.

12. Implement international cooperation related to work with overseas Vietnamese in accordance with the law.

13. Manage state affairs concerning social organizations related to overseas Vietnamese in accordance with the law.

14. Manage state affairs concerning the organization and activities of the Fund for Supporting and Mobilizing the Overseas Vietnamese Community.

15. Inspect and check the implementation of legal provisions concerning work with overseas Vietnamese; resolve complaints and denunciations; prevent and combat corruption and waste; and handle violations of the law within the scope of the Committee's state management according to the law.

16. Manage organizational structures, staffing, finance, and assets assigned in accordance with the law and the delegation of the Ministry of Foreign Affairs.

17. Perform other tasks and powers delegated or authorized by the Minister of Foreign Affairs and as prescribed by law.

đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;

4. Office of the Committee

5. Inspectorate.

6. Homeland Magazine.

7. Homeland Guesthouse.

8. Fund for Supporting and Mobilizing the Overseas Vietnamese Community.

Organizations specified in Clauses 1 through 5 of this Article are administrative organizations assisting the Director of the Committee in performing state management functions; organizations specified in Clauses 6 through 8 of this Article are affiliated units of the Committee.

The issuance of the operational regulations, specifying the functions, tasks, authorities, organizational structure, appointment, and removal of the heads and deputy heads of units under the Committee shall be carried out in accordance with the provisions of the law and the delegation of authority by the Minister of Foreign Affairs.

The staffing of the State Committee for Vietnamese Citizens Abroad shall be determined by the Minister of Foreign Affairs within the total staffing of the Ministry of Foreign Affairs.

Article 4. Leadership of the Committee

1. The State Committee for Vietnamese Citizens Abroad shall have a Chairman of the Committee and not more than three Deputy Chairmen of the Committee.

2. The Chairman of the Committee shall be appointed and removed by the Minister of Foreign Affairs and shall be responsible to the Minister of Foreign Affairs for all activities of the Committee.

The Minister of Foreign Affairs shall appoint a Vice Minister to serve as the Chairman of the State Committee for Vietnamese Citizens Abroad.

3. Deputy Directors of the Committee shall be appointed and removed by the Minister of Foreign Affairs upon the recommendation of the Director of the Committee and shall be responsible to the Director of the Committee for the areas of work assigned.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision shall take effect fifteen days from the date of publication in the Official Gazette, replacing Decision No. 243/2006/QĐ-TTg dated October 27, 2006 of the Prime Minister on the functions, tasks, authorities, and organizational structure of the Committee for Vietnamese Citizens Abroad.

2. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial and centrally governed city People's Committees, Chairman of the State Committee for Vietnamese Citizens Abroad, and related agencies and organizations shall be responsible for implementing this Decision./.
