On Direct Support Policies for Poor Households in Difficult Areas

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Resolution No. 20/2007/NQ-CP dated April 11, 2007 on the regular meeting of the Government in March 2007;
Considering the proposal of the Minister, Chairman of the National Ethnic Minorities Committee,
DECISION:
Article 1. Issuing direct support policies for poor households in difficult areas:
1. The beneficiaries of support are individuals belonging to poor households according to the national poverty standard in difficult areas as stipulated in Decision No. 30/2007/QĐ-TTg dated March 5, 2007 of the Prime Minister promulgating the List of Administrative Units in Difficult Areas.
2. Objectives of the direct support policy for poor households in difficult areas:
a) To support the livelihoods of people, contributing to reducing poverty and developing the economy and society in difficult areas;
b) To assist people to improve productivity and quality of agricultural products and gradually approach commodity production through support for high-quality crop and livestock seeds.
3. Principles of support: accurate targeting, timely; transparent, democratic, objective, and effective.
Article 2. Methods and forms of support
1. Method of support: direct support.
2. Forms of support: monetary or in-kind support
a) Monetary support at the rate specified in Article 5 of this Decision for beneficiaries to purchase materials and supplies suitable for their production and living conditions;
b) In-kind support for production and living of poor households; may choose from the following list: crop seeds; livestock seeds; veterinary drugs; iodized salt.
3. Based on the list of poor people established, confirmed by the People's Committee of communes in difficult areas and the provisions of Clause 1 and Clause 2 of this Article, the People's Committee of districts will compile and submit to the People's Committee of provinces for decision on the form and list of support items suitable for local requirements and actual conditions.
Article 3. Budget allocation for support
1. For individuals in poor households in Commune Zone II, border communes, coastal communes, and island communes in difficult areas, the amount is VND 80,000/person/year.
2. For individuals in poor households in Commune Zone III in difficult areas, the amount is VND 100,000/person/year.
Article 4. Source of funds
1. The funds for direct support for poor households in difficult areas are allocated within the regular budget of local governments.
2. For the year 2010 during the period of stabilizing local budgets from 2007 to 2010, additional funds exceeding those previously allocated for price and freight subsidies in local budgets will be supplemented by the central government for local budgets with specific purposes.
Article 5. Implementation period of the support policy
The direct support policy for poor households in difficult areas as stipulated in this Decision shall take effect from January 1, 2010.
Article 6. Implementation
1. Ethnic Minority Committee:
a) Take the lead and coordinate with relevant ministries and sectors to guide the implementation of the direct support policy for poor households in difficult areas as stipulated in this Decision;
b) Inspect, evaluate, and compile reports The Prime Minister on the results of implementing the policy by localities regarding the use of direct support funds for poor households in difficult areas in accordance with current regulations;
c) Based on the requirements for economic and social development in difficult areas, upon the request of the Chairman of the Provincial People's Committees and the Central City People's Committees, the Ethnic Minority Committee will take the lead and coordinate with relevant agencies to submit to the Prime Minister for decision on adjusting the budget allocation for support to suit actual conditions.
2. Ministry of Finance:
a) Guide localities in preparing budgets, managing, disbursing, and settling accounts for direct support funds;
b) Take the lead and coordinate with the Ministry of Planning and Investment to arrange funds for provinces to implement the direct support policy for poor households in difficult areas as stipulated in Article 4 of this Decision;
c) Coordinate with the Ethnic Minority Committee, the Ministry of Planning and Investment, and relevant ministries and sectors to inspect the use of funds by localities.
3. The Ministry of Planning and Investment:
a) Coordinate with the Ministry of Finance to ensure sufficient funding for the direct support policy for poor households in difficult areas from the central budget, balanced within the local budget estimates;
b) Coordinate with the Ethnic Minority Committee, the Ministry of Finance, and relevant ministries and sectors to inspect the use of funds by localities.
4. The Ministry of Labor, Invalids and Social Affairs, the Ministry of Industry and Trade, and the Ministry of Agriculture and Rural Development, in accordance with their assigned functions and tasks, are responsible for coordinating with the Ethnic Minority Committee to implement related tasks as prescribed in this Decision.
5. The People's Committees of provinces and centrally governed cities that have communes in difficult areas as stipulated in Decision No. 30/2007/QĐ-TTg dated March 5, 2007 of the Prime Minister promulgating the List of Administrative Units in Difficult Areas shall be responsible for:
a) Directing and organizing the implementation of support for people in accordance with the objectives, targets, and contents of support as stipulated in this Decision;
b) Inspecting, evaluating, and compiling reports to the Ethnic Minority Committee, the Ministry of Finance, and the Ministry of Planning and Investment on the results of implementing the direct support policy for poor households in difficult areas in their locality in accordance with current regulations.
Article 7. Effectiveness
This Decision takes effect from September 20, 2009.
Article 8. Responsibility for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
