amends Ordinance No. 26/2005/PL-UBTVQH11 dated June 29, 2005; and Ordinance No. 04/2012/UBTVQH13 dated July 16, 2012 amending and supplementing certain articles of the Ordinance on Preferential Treatment for Citizens Contributing to the Revolution;

Pursuant to the Law on Government Organization dated June 19, 2015;

Persons who participated in the anti-French and anti-American wars residing abroad, including:

"Based on the proposal of the Minister of National Defense;"

a) Military personnel, defense workers who participated in the anti-French war and were conscripted or recruited into the military before July 20, 1954, and were discharged (demobilized, retired) before December 31, 1960;shall the anti-American war,June 2024;b) Military personnel, public security officers, civil servants receiving salaries equivalent to military personnel who participated in the anti-American war and were conscripted or recruited from April 30, 1975, and were discharged, demobilized, or retired before April 1, 2000 (including those who went abroad for international cooperation study and labor);

Article 1. Scope of Regulation

c) Concentrated militia in the northern region directly engaged in combat and combat support against U.S. war of destruction from August 1964 to January 27, 1973 (for concentrated militia in communes adjacent to the northern bank of the Ben Hai River along the 17th parallel and communes within the demilitarized zone from July 1954 to April 30, 1975);

Article 2. Subjects and Conditions for Application

d) Concentrated guerrillas (including secret forces) participating in revolutionary activities, combat, and combat support in the B, C, K battlefields from July 1954 to April 30, 1975;

đ) Civil officials in the South participating in revolutionary activities, combat, and combat support in the B, C, K battlefields from July 1954 to April 30, 1975;

e) Youth volunteers participating in the anti-war effort from July 1950 to April 30, 1975 (including youth volunteers in the South participating in the anti-war effort from March 1965 to April 30, 1975).

3. Persons who participated in the wars to protect the Fatherland and international missions residing abroad, including:

a) Military personnel, public security officers, civil servants receiving salaries equivalent to military personnel, conscripted or recruited into the military, public security, or civil service after April 30, 1975, directly engaged in combat and combat support at the northern border from February 1979 to December 31, 1988, the southwestern border from May 1975 to January 7, 1979, and anti-Fulro operations from May 1975 to December 1992, in border districts, Central Highlands provinces, and districts adjacent to border districts where combat occurred (including border island districts and areas such as Hoang Sa, Truong Sa, DK 1); or participated in international missions in Cambodia from January 1979 to August 31, 1989, or assisted Laos from May 1975 to December 31, 1988, and were discharged, demobilized, or retired before April 1, 2000, or transferred to another job and then retired before January 1, 1995 (including those who went abroad for international cooperation study and labor);

b) Workers, civil servants in defense, public security, state agencies, experts in various fields; village, town, township militia self-defense cadres, village public security cadres organized and managed by local authorities; concentrated youth volunteers after April 30, 1975, retired before January 1, 1995, with direct participation in combat and combat support at the northern and southwestern borders, anti-Fulro operations, or international missions in Laos and Cambodia within the time frame and areas specified for the subjects defined in point a of this clause.

4. Fireline civilian workers, mobilized and centrally managed by administrative committees or People's Committees at the commune level or higher or competent agencies and units, and assigned tasks to serve combat for military units or serve at battlefields during the following periods and areas, residing abroad:

a) Participating in the anti-French war from September 1945 to July 20, 1954; and the anti-American war from July 21, 1954 to April 30, 1975, operating in the entire country and in Laos and Cambodia;

b) Participating in the wars to protect the Fatherland and international missions within the time frame and areas as prescribed for the subjects in Clause 3 of this Article.

5. Relatives of the subjects defined in Clauses 1, 2, 3, and 4 of this Article, including: biological father, biological mother; wife or husband; biological child, adopted child, or legally recognized foster child under the law.

6. Relatives defined in Clause 5 of this Article residing in the country authorized by the subjects defined in Clauses 1, 2, 3, and 4 of this Article to prepare files and receive benefits and policies (hereinafter referred to collectively as the authorized person).

4. Civil fireline workers, who are mobilized, centrally managed, and assigned tasks to serve combat operations for military units or serve at battlefields during the following periods and within the specified areas, and are currently residing abroad:

a) Participating in the anti-French resistance war from September 1945 to July 20, 1954; participating in the anti-American resistance war from July 21, 1954 to April 30, 1975, with the scope of duty performance throughout the country and in Laos and Cambodia;

b) Participating in wars to defend the Fatherland and international missions within the timeframes and areas as prescribed for the subjects under Clause 3 of this Article.

5. Relatives of the subjects prescribed in Clauses 1, 2, 3, and 4 of this Article, including: biological father, biological mother; spouse; biological child, adopted child, or legally recognized foster child in accordance with the law.

6. Relatives prescribed in Clause 5 of this Article residing in the country are authorized by the subjects prescribed in Clauses 1, 2, 3, and 4 of this Article to prepare files and receive benefits and policies (hereinafter referred to collectively as the authorized person).

Article 3. Objects and Conditions Not Subject to Application

This Decree shall not apply to objects meeting one of the following conditions:

1. Not meeting the conditions stipulated in Article 2 of this Decree;

2. Participating in activities aimed at overthrowing the regime, the Party, and the State;

3. Desertion; betrayal; recruitment; having been convicted of one of the offenses related to national security; having had military or police titles revoked, or being dismissed from service;

4. Objects specified in Clause 2, 3, and 4 of Article 2 of this Decree who were receiving pension benefits or monthly disability allowances before settling abroad;

5. Objects who have passed away but do not have or no longer have relatives as defined in Clause 5 of Article 2 of this Decree.

Article 4. Support Regime

1. Objects specified in Clause 1 of Article 2 of this Decree:

a) For living objects: The support regime is calculated from the month and year when the object stopped receiving benefits to the month and year when the competent authority issued the decision to implement the support regime as stipulated in Point a, Clause 1, Article 7 of this Decree. Calculation method: A = (B - C) x D.

In which: A is the level of support; B is the month and year when the support decision was made; C is the month and year when the object stopped receiving monthly allowances; D is the level of allowance in the last month immediately preceding the month when the object stopped receiving benefits (converted according to the corresponding level of benefit at the time of implementing the support regime as prescribed by the Government). A, C, and D mentioned above are uniformly applied in the formulas for calculating the support regime as stipulated in Points b, c, and d of this clause;

b) For deceased objects: Relatives of the objects as defined in Clause 5 of Article 2 of this Decree shall receive the support regime calculated from the month and year when the object stopped receiving monthly allowances to the month and year when the object passed away. Calculation method: A = (G - C) x D; in which: G is the month and year when the object passed away;

c) For legitimate children of martyrs: The support regime is calculated from the month and year when the object stopped receiving monthly allowances to the month immediately preceding the birth month of the year when they turn 18 years old. Calculation method: A = (I - C) x D; in which: I is the month and year immediately preceding the birth month of the year when they turn 18 years old;

d) If an object has already received the support regime as stipulated in Point a of this clause and then passes away, relatives of the objects as defined in Clause 5 of Article 2 of this Decree shall receive the support regime; the period for calculating the support regime this time is from the month immediately following the month and year when the decision to receive the one-time support regime was made, to the month and year when the object passed away. Calculation method: A = (G - K) x D; in which: K is the month and year immediately following the month and year when the decision to receive the one-time support regime was made as stipulated in Point a of this clause.

2. Objects specified in Clauses 2, 3, and 4 of Article 2 of this Decree:

a) They shall be entitled to the support regime, with the level of entitlement calculated based on the actual number of years participating in the resistance war, defending the country, performing international duties, or serving as civilian fireline workers (collectively referred to as the period of service). Specifically:

- For up to two full years of service, the level of support is 4,000,000 VND;

- For more than two years, starting from the third year, each additional year adds 1,500,000 VND.

In cases where the object passed away before this Decree took effect, relatives of the objects as defined in Clause 5 of Article 2 of this Decree shall be entitled to a one-time support of 6,000,000 VND.

b) Period for calculating the support regime:

- For military personnel, public security officers, and civil servants enjoying military salary, it is the total actual period of service in the military, public security, or civil service (excluding time spent working abroad under international cooperation programs). For other objects, it is the direct participation in combat or combat support during the periods and in the areas specified in Clauses 2, 3, and 4 of Article 2 of this Decree;

- In cases where an individual has participated in the resistance war, defending the country, performing international duties, and serving as a civilian fireline worker under different categories of objects as defined in Clauses 2, 3, and 4 of Article 2 of this Decree, or during different periods, such time can be accumulated. However, time already counted for one-time or monthly allowances under decisions of the Prime Minister and decrees of the Government (Annex I attached to this Decree) shall not be included;

- If the period for calculating the one-time support regime includes a partial year, it will be counted as a full year if it is six months or more, and as half a year if it is less than six months.

3. Objects specified in Clause 1, while also falling under the objects specified in Clauses 2, 3, and 4 of Article 2 of this Decree, shall be entitled to both the support regime as stipulated in Clause 1 and Clause 2 of this Article.

Article 5. Certain other preferential regimes

1. The subjects specified in Clauses 2, 3, and 4 of Article 2 of this Decree, when having a decision to enjoy the support regime prescribed in this Decree, shall be issued a "Certificate" as a participant in the war against France, the United States, the defense of the Fatherland, or international missions.

Subjects entitled to the support regime as stipulated in Clause 3 of Article 4 of this Decree shall not be issued the aforementioned "Certificate".

2. In cases of returning to settle in the country: Subjects who have already enjoyed the support regime prescribed in Point a, Clause 2 of Article 4 of this Decree, from the month they return to settle in the country, shall enjoy health insurance benefits as prescribed for revolutionary meritorious persons and former soldiers under the laws on health insurance; upon death, the person handling the funeral shall be entitled to funeral allowance as prescribed under the current laws on social insurance.

Article 6. Documents for Processing Support Regimes

1. For the subjects specified in Clause 1 of Article 2 of this Decree, the documents include:

a) One original application form of the subject according to Form No. 1A (original) or the application form of the subject's relative (for deceased subjects) according to Form No. 1B (original) attached as Appendix II to this Decree;

b) Original documents or related documents (originals or copies from the original register or copies accompanied by originals for verification or certified copies issued by competent authorities in Vietnam or abroad) proving that the subject is a revolutionary meritorious person or a relative of烈士或每月享受抚恤金和补助金但已停止享受该制度的人;

c) A copy of the passport or identity document of the subject;

d) For deceased subjects, additional documents are required: Death certificate or documents proving the subject has passed away (originals or copies accompanied by originals for verification or certified copies issued by diplomatic missions or consular offices of Vietnam abroad).

2. For the case specified in Point d, Clause 1 of Article 4 of this Decree, the documents include:

a) One original application form of the subject's relative according to Form No. 1C (original) attached as Appendix II to this Decree;

b) The decision to enjoy the support regime as stipulated in Point a, Clause 1 of Article 4 of this Decree (certified copy issued by diplomatic missions or consular offices of Vietnam abroad).

3. For the subjects specified in Clauses 2, 3, and 4 of Article 2 of this Decree, the documents include:

a) One original application form of the subject according to Form No. 2A (original) or the application form of the subject's relative (for deceased subjects or relatives in Vietnam authorized by the subject) according to Form No. 2B (original) attached as Appendix II to this Decree;

b) Original documents or related documents (originals or copies from the original register or copies accompanied by originals for verification or certified copies issued by competent authorities in Vietnam or abroad) proving that the subject participated in anti-French and anti-American wars, the defense of the Fatherland, international missions, or fireline civilian support;

c) If a relative in Vietnam authorized by the subject to prepare the documents and receive the benefits, an additional authorization letter from the subject (original) confirmed by a diplomatic mission or consular office of Vietnam abroad is required;

d) For deceased subjects, additional documents as specified in Point d, Clause 1 of this Article are required.

Article 7. Competence and Procedures, Responsibilities for Resolving Support Benefits

1. Competence to resolve support benefits:

a) For Provincial People's Committees (hereinafter referred to as Provincial People's Committee):

Issue decisions on receiving support benefits for subjects specified in Clause 1, Article 2; Clause 3, Article 4 of this Decree; compile and report to the Ministry of Labor, Invalids and Social Affairs to request the Ministry of Finance to ensure funding; implement payment of support benefits for subjects or relatives of subjects within their jurisdiction.

b) For the Ministry of National Defense:

Issue decisions on receiving support benefits and sign "Certificate" for subjects specified in Clauses 2, 3, and 4, Article 2 of this Decree; compile and request the Ministry of Finance to ensure funding; implement payment of support benefits and issue "Certificate" for subjects or relatives of subjects within their jurisdiction.

2. Procedures and responsibilities for resolving support benefits

a) Subjects specified in Clauses 1, 2, 3, and 4 of Article 2 of this Decree shall not authorize relatives in Vietnam to prepare applications and receive support benefits:

The subject or relative of the subject (in case of deceased subject) shall submit directly or through postal service one application package according to Clause 1, Clause 2, or Clause 3 of Article 6 of this Decree to the Diplomatic Representative Office or Consular Representative Office of Vietnam abroad where the subject resides.

In cases where the host country has an Association of Former Combatants or Overseas Vietnamese Association (collectively referred to as association) recognized by the Diplomatic Representative Office or Consular Representative Office of Vietnam, the subject or relative of the subject shall submit the application to the association at the place of residence. The association shall receive, compile, and transfer the application (along with a list of subjects) to the Diplomatic Representative Office or Consular Representative Office of Vietnam abroad.

The Consular Representative Office of Vietnam shall be responsible for receiving applications from subjects or relatives of subjects or organizations transferred by the Consular Representative Office or associations; organize review, compilation, and transfer of applications (along with a list of subjects) to the Diplomatic Representative Office of Vietnam abroad.

The Diplomatic Representative Office abroad shall be responsible for directing subordinate agencies to receive applications from subjects or relatives of subjects or organizations transferred by the Consular Representative Office or associations (hereinafter collectively referred to as organizations and individuals).

Within twenty working days from the date of receipt of complete valid applications from organizations and individuals (by batches), complete the compilation, review, and classification of applications of subjects requesting support benefits according to groups of subjects and residential areas before emigration abroad or before national border demarcation; prepare lists according to Form No. 3 or Form No. 3A, and draft letters requesting resolution of support benefits according to Form No. 2 in Appendix II issued together with this Decree; transfer applications of subjects or relatives of subjects (including lists and letters requesting resolution) to the Provincial People's Committee directly managing the subjects before emigration abroad (through the Department of Labor, Invalids and Social Affairs) or to the Ministry of National Defense through the Policy Bureau, General Political Department of the Vietnam People's Army (hereinafter abbreviated as the Policy Bureau, General Political Department) according to the competence to resolve support benefits stipulated in Clause 1 of this Article.

The Ministry of National Defense and Provincial People's Committees shall be responsible for directing subordinate agencies to receive applications transferred by the Diplomatic Representative Office of Vietnam abroad. By batches, within twenty working days from the date of receipt of complete valid applications, complete the examination, verification, issuance of support benefit decisions according to Form No. 4 (accompanied by a list of subjects Form 3B or Form 3C) and sign "Certificate" according to Form No. 6 in Appendix II issued together with this Decree for subjects within their jurisdiction as stipulated in Clause 1 of this Article.

b) For subjects specified in Clauses 2, 3, and 4 of Article 2 of this Decree who authorize relatives in Vietnam to prepare applications and receive support benefits:

- The authorized person shall submit one application package according to Clause 3, Article 6 of this Decree to the People's Committee of the commune, ward, town (hereinafter collectively referred to as Commune People's Committee) where the authorized person resides.

- The Chairman of the Commune People's Committee shall be responsible for directing subordinate agencies to receive applications transferred by the authorized person. By batches, within five working days from the date of receipt of complete valid applications, organize meetings to examine and approve; complete applications for each eligible subject (two copies per subject); prepare minutes of the examination meeting according to Form No. 5, draft letters requesting according to Form No. 2, and lists of subjects according to Form No. 3C in Appendix II issued together with this Decree, report to the District People's Committee (hereinafter collectively referred to as District People's Committee) through the Military Command of the district.

- The Chairman of the District People's Committee shall direct the Military Command, within ten working days from the date of receipt of complete valid applications reported by the Commune People's Committee (by batches), complete the review, comparison, compilation, and completion of applications; draft letters requesting according to Form No. 2, lists of subjects according to Form No. 3C in Appendix II issued together with this Decree, along with applications of eligible subjects (one copy per subject) and lists of subjects according to Form No. 3C in Appendix II issued together with this Decree, report to the Provincial People's Committee through the Military Command of the province or the Political Department of the Hanoi Capital Military Command.

- The Military Region Command shall direct the Provincial Military Command within ten working days from the date of receipt of complete valid applications (by batches) reported by the District Military Command, complete the examination, compilation, and completion of applications of subjects; draft letters requesting according to Form No. 2, lists of subjects according to Form No. 3C in Appendix II issued together with this Decree, along with applications of subjects (one copy per subject), report to the Head of the Military Region Command through the Political Department of the Military Region.

The Political Department of the Military Region shall complete the examination and issue a decision on the support regime, sign the "Certificate" for the relevant subjects after receiving the examination opinion from the Policy Bureau of the General Political Department within ten working days from the date of receipt of the complete and valid dossier reported by the Provincial Military Command; retain one set of dossier for each subject.

The Hanoi Military Command shall direct the Political Department to complete the examination and issue a decision on the support regime, sign the "Certificate" for the relevant subjects after receiving the examination opinion from the Policy Bureau of the General Political Department within ten working days from the date of receipt of the complete and valid dossier reported by the County Military Command; retain one set of dossier for each subject.

Article 8. Dossier, procedure, responsibility for issuing health insurance cards; handling funeral allowance

The dossier, procedure, and responsibility for issuing health insurance cards; handling funeral allowance for the subjects specified in Clause 2 of Article 5 of this Decree shall be implemented similarly according to the current laws on health insurance and social insurance for persons who have rendered meritorious service to the revolution, those who participated in the resistance war, the defense of the Fatherland, and international missions within the country.

Article 9. Method of disbursing the support regime and issuing "Certificates"; source of funds for implementation

1. Method of disbursing the support regime and issuing "Certificates":

Upon notification of the Ministry of Finance ensuring the funding for implementing the support regime, the authority responsible for resolving the support regime for the subjects specified in Clause 1 of Article 7 of this Decree shall proceed as follows:

a) For cases not authorized as stipulated in Point a, Clause 2 of Article 7 of this Decree

- The Ministry of National Defense (Policy Bureau, General Political Department) or the People's Committee of the province (Department of Labor - Invalids and Social Affairs) shall process the transfer of support funds into the account of the diplomatic representative office of Vietnam abroad, along with the support decision, "Certificate", and list of beneficiaries; simultaneously, transfer the decision and list of beneficiaries to the Ministry of Foreign Affairs for monitoring and checking the implementation of the support regime for the subjects.

- In each batch, within twenty working days from the date of receipt of the support funds, support decision, "Certificate", and list of beneficiaries transferred by the Ministry of National Defense or the provincial People's Committee to the diplomatic representative office of Vietnam abroad, the diplomatic representative office shall, in conjunction with relevant agencies abroad, organize the disbursement of the support regime and hand over the "Certificate" to the subjects or their relatives; in each batch, complete the list of payments with the signatures of the subjects or their relatives (in case of payment through personal bank accounts or via postal services, attach the money transfer documents from the competent authority); send back to the Ministry of National Defense (through the Policy Bureau, General Political Department) or the provincial People's Committee (through the Department of Labor - Invalids and Social Affairs) for settlement according to regulations.

b) For cases authorized to relatives in the country as stipulated in Point b, Clause 2 of Article 7 of this Decree, in each batch, within twenty working days from the date of receipt of the funds, support decision, "Certificate", and list of beneficiaries from the competent authority, the County Military Command shall complete the disbursement of the support regime and hand over the "Certificate" to the relatives of the subjects; complete the procedures and dossier for settlement according to regulations.

2. Source of funds for implementation

a) The funds for disbursing the support regime for the subjects specified in Article 4 of this Decree shall be guaranteed by the central budget;

b) The funds for implementing the health insurance and funeral allowance regimes for the subjects returning to settle in the country as specified in Clause 2 of Article 5 of this Decree shall be guaranteed by the local budget;

c) The funds for ensuring the reception, examination, and verification of dossiers; transferring dossiers from abroad to the country, from the country to abroad; costs for transferring money abroad and disbursing the support regime as specified in Article 4 of this Decree shall be 4% of the total funds for disbursing the support regime for the subjects, guaranteed by the central budget;

d) The funds for ensuring the operations of the delegations traveling abroad to implement tasks of deployment, guidance, and inspection of the implementation of the regime and policies for the subjects as stipulated in this Decree shall be allocated from the regular annual budget of the Ministry of National Defense.

đ) The funds for disbursing the support regime for the subjects specified in Clause 1, 2, 3, and 4 of Article 2 of this Decree, who are not authorized to relatives in the country, shall be converted into US dollars (USD) at the corresponding exchange rate at the time when the Ministry of Finance ensures the funds for disbursing the support regime for the subjects.

Article 10. Responsibility for Implementation

1. The Minister of National Defense shall be responsible for:

a) Directing the departments and units under his/her jurisdiction to organize the examination, verification, issuance of decisions on the support regime, disbursement of the support regime, and issuance of "Certificates" for the subjects within the authority's resolution as stipulated in Point b, Clause 1 of Article 7 of this Decree, ensuring strictness, timeliness, accuracy, and compliance with the subjects and policies;

b) Taking the lead and coordinating with central ministries and sectors to organize inspections of the implementation of the regime and policies as stipulated in this Decree; resolving any difficulties and issues arising during the implementation process. If beyond authority, report to the Government for consideration and decision.

2. The Minister of Labor - Invalids and Social Affairs shall be responsible for directing the Labor - Invalids and Social Affairs sector in the provinces to organize the examination, verification, issuance of decisions on the support regime, and disbursement of the support regime for the subjects within the authority's resolution of the provincial People's Committee as stipulated in Point a, Clause 1 of Article 7 of this Decree; guiding and directing the implementation of the health insurance and funeral allowance regimes for the subjects returning to settle in the country as stipulated in Clause 2 of Article 5 of this Decree.

3. The Minister of Foreign Affairs shall be responsible for directing the diplomatic missions and consular posts of Vietnam abroad to organize propaganda, dissemination, and implementation of the regime and policies towards the subjects; signing confirmation of power of attorney for cases where authorization is given to relatives in Vietnam to establish files and receive support benefits as prescribed in this Decree.

4. The Minister of Finance shall be responsible for annually allocating the budget to implement the support regime and funding to ensure the work of disbursing the benefits stipulated in this Decree in accordance with the provisions of the State Budget Law.

5. The Ministry of Information and Communications and other relevant ministries and sectors within their respective functions and tasks assigned by the Government shall be responsible for directing and organizing propaganda; coordinating the implementation of regimes and policies towards the subjects as prescribed in this Decree.

6. The Chairman of the People's Committee at the provincial level shall be responsible for directing competent agencies and localities under his/her jurisdiction to organize the examination, verification, and issuance of decisions on enjoying support benefits for the subjects within the scope of resolution as prescribed in point a, Clause 1, Article 7 of this Decree; strictly, accurately, promptly, and in accordance with the regimes and policies for the subjects when returning to settle in Vietnam as prescribed in Clause 2, Article 5 of this Decree.

7. It is recommended that the Vietnam Fatherland Front and its member organizations; related associations strengthen propaganda, mobilization, and supervision of the implementation and organization of the regimes and policies towards the subjects as prescribed in this Decree.

8. Any person who falsifies or forges documents to enjoy benefits or abuses their position or authority for personal gain shall be subject to disciplinary action or criminal prosecution and must return the amount received; compensate for losses (if any) in accordance with the law.

Article 11. Effective Date

This Decree takes effect from September 5, 2018.

Article 12. Responsibility for Implementation

1. The Minister of National Defense shall be responsible for guiding the implementation of this Decree for the subjects as prescribed.

2. Ministers, heads of ministerial-level agencies, heads of government agencies, and chairpersons of provincial people's committees directly under the central government are responsible for implementing this Decree./.
