THE MINISTER OF TRADE

Pursuant to Decree No. 10/1998/NĐ-CP dated January 23, 1998 of the Government on certain measures to encourage and ensure foreign direct investment activities in Vietnam;

Pursuant to Decision No. 53/1999/QĐ-TTg dated March 26, 1999 of the Prime Minister on certain measures to encourage foreign investment;

Pursuant to Decision No. 254/1998/QĐ-TTg dated December 30, 1998 of the Prime Minister on managing import and export of goods in 1999;

DECISION:

Article 1Now issuing the List of Goods Not Subject to Purchase by Foreign-Invested Enterprises in Vietnam for Export. This list replaces Appendix III attached to Decision No. 0321/1998/QĐ-BTM dated March 14, 1998 of the Minister of Trade on detailed implementation of Decree No. 12/CP dated February 18, 1997 and Decree No. 10/1998/NĐ-CP dated January 23, 1998 of the Government related to import and export, consumption of products in Vietnam, and processing by foreign-invested enterprises and joint ventures based on business cooperation contracts.

Article 2:Enterprises that have been granted Investment License or Business License to produce goods listed herein shall carry out exports according to their Investment License or Business License.

Article 3This Decision takes effect fifteen days from the date of signature.

LIST OF GOODS NOT SUBJECT TO PURCHASE BY FOREIGN-INVESTED ENTERPRISES FOR EXPORT

1- Raw coffee

2- Wild animals for export

3- Forest plants used as seeds

4- Precious stones, precious metals, natural pearls

5- Wood products (except handicrafts, products made from planted forest wood, products made from imported wood, and artificial board products implemented in accordance with the Prime Minister's Decision No. 136/1998/QĐ-TTg dated July 31, 1998)

6- Minerals.
