Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;
Pursuant to Decision No. 99/1998/QĐ-TTg dated May 26, 1998 of the Prime Minister on price and postal and telecommunications tariff management;
Pursuant to Circular No. 03/1999/TT-TCBĐ dated May 11, 1999 of the General Director of the Posts and Telecommunications Administration guiding the implementation of Decree No. 109/CP dated November 12, 1997 of the Government on postal and telecommunications services and Decision No. 99/1998/QĐ-TTg dated May 26, 1998 of the Prime Minister on price and rate management for postal and telecommunications services;
At the proposal of the Director of the Department of Planning and Finance,
DECISION:
Article 1. Issuing temporarily the maximum rates for broadband ADSL Internet access services provided by service providers as follows:
1. Initial connection and network integration fees shall be determined by the service provider based on cost.
2. Usage fee: Maximum rate: 909,091 VND/month, corresponding to a data download speed from the Internet Service Provider to the subscriber (Down-Link) up to 2 Mb/s, and a data upload speed from the subscriber to the Internet Service Provider (Up-Link) up to 640 Kb/s.
3. The service provider offering broadband ADSL Internet access may establish other billing methods and collection procedures on the principle that the total usage fee for the month does not exceed the maximum rate specified in Clause 2 of Article 1 of this Decision.
4. In conditions where technology and practical circumstances permit, the ADSL service provider may set rates for access speeds (Down-Link) above 2 Mb/s, but such rates must not exceed twice the maximum rate for speeds (Down-Link) up to 2 Mb/s as stipulated in Clause 2 of Article 1 of this Decision.
5. The aforementioned rates do not include local telephone subscription fees, domestic and international telephone call charges for fixed-line subscribers, and value-added services on the ADSL/SHDSL network.
6. The aforementioned rates do not include value-added tax.
Article 2. This Decision takes effect from July 1, 2003.
Article 3. The Head of the Office, Heads of Planning and Finance Department, Ministers of units under the Posts and Telecommunications Ministry; General Directors, Directors of telecommunications and Internet service providers, and Heads of related units are responsible for implementing this Decision.
