THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

WHEREAS, Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulates the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

WHEREAS, Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and distribution, and Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and distribution;

WHEREAS, Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government on state management of product quality;

WHEREAS, Decision No. 36/2007/QĐ-BNN dated April 24, 2007 of the Minister of Agriculture and Rural Development on regulations for fertilizer production, distribution, and use;

At the proposal of the Director of the Crop Production Department,

DECISION:

Article 1. ATTACHED TO THIS DECISION IS THE SUPPLEMENTARY LIST OF FERTILIZERS PERMITTED FOR PRODUCTION, DISTRIBUTION AND USE IN VIETNAM, INCLUDING 226 TYPES, DIVIDED INTO:

1. MICRONUTRIENT FERTILIZERS (14 TYPES);

2. ORGANIC FERTILIZERS (4 TYPES);

3. BIOLOGICAL ORGANIC FERTILIZERS (24 TYPES);

4. MINERAL ORGANIC FERTILIZERS (32 TYPES);

5. MICROBIAL ORGANIC FERTILIZERS (18 TYPES);

6. MICROBIAL FERTILIZERS (1 TYPE);

7. LEAF FERTILIZERS (133 TYPES);

Article 2. Organizations and individuals permitted to produce, distribute, and use fertilizers listed in this supplementary list must meet the conditions stipulated in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and distribution, and Clause 4, Article 1 of Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and distribution. amending and supplementing some articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production and business.

Article 3. This Decision shall take effect fifteen days from the date of publication in the Official Gazette. The types of fertilizers listed below shall be removed from the list of fertilizers permitted for production, distribution, and use in Vietnam from the date this Decision takes effect. (attached list) from the date this Decision takes effect.

Article 4. The Director of the Ministry's Office, the Director of the Crop Production Department, the Director of the Science, Technology and Environment Department, the Directors of the Departments of Agriculture and Rural Development of the provinces and centrally-administered cities, the Heads of units, organizations, and individuals related to fertilizer production, distribution, and use in Vietnam are responsible for implementing this Decision./.
