Regulations on health standards and health examinations

for subjects under the management of the Ministry of National Defense

Pursuant to the Law on Medical Examination and Treatment dated January 9, 2023;

Pursuant to the Law on Officers of the Vietnam People's Army dated December 21, 1999; amended and supplemented in 2008 and 2014;

Pursuant to the Law on Military Service dated June 19, 2015;

Pursuant to the Law on Professional Military Personnel, Workers, and Civil Servants of National Defense dated November 26, 2015;

Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Director of the General Logistics Department;

The Minister of National Defense issues this Circular to regulate health standards and regular health examinations for subjects under the management of the Ministry of National Defense.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Circular stipulates health standards and health examinations for subjects under the management of the Ministry of National Defense, including:

a) Health examination criteria and classification;

b) Military service obligation health examinations;

c) Management and inspection of reserve military personnel health;

d) Military recruitment health examinations;

d) Health examination for recruitment into the cadre corps; training reserve officers called up for active service; recruitment of professional military personnel, workers, and defense civil servants;

e) Responsibilities of agencies, organizations, and individuals in conducting health examinations for subjects under the management of the Ministry of National Defense.

2. Health examination criteria and medical assessment standards for military pilots, airborne assault forces, paratroopers, submarine sailors are not within the scope of adjustment of this Circular.

3. Health standards, regular health examinations, and health examinations based on mission requirements for officers, professional military personnel, non-commissioned officers, and conscripts on active duty; defense civil servants, workers, and defense civil servants shall be implemented according to Circular No. 37/2021/TT-BQP dated April 15, 2021, issued by the Ministry of National Defense, which stipulates classification, health examinations, and hierarchical management tasks for military personnel, defense civil servants, workers, and defense civil servants.

Article 2. Applicability

Relevant agencies, units, organizations, and individuals involved in preliminary health screening, inspection, and health examinations; re-examination and health assessment for subjects under the management of the Ministry of National Defense.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Preliminary military service health screening Preliminary health inspection and evaluation conducted on citizens called for military service health examination before each selection and call-up period for new recruits as prescribed by law on compulsory military service.

2. Military service health examination Health examination and classification conducted by the Military Service Health Examination Board after preliminary health screening for citizens called for compulsory military service.

3. Military Service Health Examination Board is a specialized board operating on a part-time basis established by the Chairman of the People's Committee of districts, towns, cities directly under provinces, or municipalities directly under the Central Government (hereinafter referred to collectively as district level) upon the proposal of the Health Department or the agency assisting the district-level People's Committee in managing health affairs (hereinafter referred to collectively as district-level health agency).

4. Post-recruitment military service health examination Immediate health examination conducted by the unit's health re-examination board after new recruits join the military to reassess their health status according to the health standards for compulsory military service.

5. The Post-recruitment Health Examination Board for Military Service is a specialized board operating on a part-time basis established by the Head of the Receiving Unit (from battalion level and above) upon the proposal of the Chief Medical Officer (in charge of medical affairs).

6. Preliminary military recruitment health examination Health examination and evaluation of candidates (non-military youth or military personnel) applying for military education admissions before the examination or selection process at the district-level military education admission board or equivalent battalion-level units.

7. Military recruitment health examination is the immediate post-enrollment health check of successful candidates to ensure they meet the health standards set by law.

8. The Preliminary Military Recruitment Health Examination Board District-level Military Service Health Examination Board or the Military Hospital Health Examination Board on the local area conducting preliminary health examinations for candidates applying for military education admissions.

9. The Military Recruitment Health Examination Board A specialized board operating on a part-time basis established by the Director of the Military Hospital upon the proposal of the Directors or Principals of military academies and schools (collectively referred to as military schools).

10. Post-recruitment health examination Immediate health examination conducted by the Military Hospital Health Re-examination Board for non-military personnel recruited into the cadre corps; training reserve officers called up for active service; recruitment of professional military personnel, defense workers, and defense civil servants.

11. The Post-recruitment Health Examination Board for Recruitment A specialized board operating on a part-time basis established by the Director of the Military Hospital upon the directive or collaborative proposal of the Head of the Military Medical Department (Chief Medical Officer) of the affiliated unit under the Ministry of National Defense.

12. Medical Assessment Utilizing means, techniques, and procedures to examine and conclude on the health status of citizens performing compulsory military service; applying for military education; recruitment into the cadre corps; training reserve officers called up for active service; recruitment of professional military personnel, defense workers, and defense civil servants when there are complaints about health conditions.

Chapter II

HEALTH STANDARDS AND CLASSIFICATION

Article 4. Health Standards

1. Health standards for performing military service obligations

a) General Standards

Meeting health categories 1, 2, or 3 as stipulated in Article 5 and Article 6 of this Circular;

Citizens addicted to drugs or drug precursors as defined in Decree No. 57/2022/NĐ-CP dated August 25, 2022, of the Government, which lists drug categories and drug precursors, shall not be called up for military service.

b) Special standards: Certain specific health standards for selecting individuals to perform military service obligations shall be prescribed by the Minister of National Defense.

2. Health standards for enrolling in military training programs leading to bachelor's, college, or vocational degree levels; enrolling in military training programs for basic military fields leading to bachelor's or college degrees

a) General Standards: Meeting health categories 1 and 2 as stipulated in Article 5 and Article 6 of this Circular;

b) Special standards: Shall be implemented according to the regulations of the Ministry of National Defense on the admission process for schools within the Military.

3. Health standards for recruitment into the cadre corps; training reserve officers to be called upon for active duty service

a) General Standards: Meeting health categories 1 and 2 as stipulated in Article 5 and Article 6 of this Circular;

b) Special standards: For specialized technical positions that are difficult to attract human resources for the military, as prescribed by the Minister of National Defense.

4. Health standards for recruiting professional soldiers, workers, and defense civil servants

a) General Standards: Meeting health categories 1, 2, and 3 as stipulated in Article 5 and Article 6 of this Circular;

b) Specific Standards: For positions recruiting professional military personnel, defense workers, and defense civil servants with narrow technical specialties that are difficult to attract for the military, as specified by the Minister of National Defense.

Article 5. Health Classification Standards

1. Physical classification standards shall be implemented according to the provisions set out in Section I of Appendix I attached to this Circular.

2. Disease and health condition classification standards shall be implemented according to the provisions in Section II of Appendix I attached hereto.

Article 6. Methods for Health Classification

1. Scoring method

Each criterion, after examination, shall be scored with even numbers from 1 to 6 in the "Points" column, specifically:

a) Score 1: Indicates very good health status;

b) Score 2: Indicates good health status;

c) Score 3: Indicates fairly good health status;

d) Score 4: Indicates average health status;

đ) Score 5: Indicates poor health status;

e) Score 6: Only very poor health condition.

2. Health classification method

Based on the scores given to each criterion during the examination, health classification will be carried out as follows:

a) Category 1: All criteria achieve a score of 1;

b) Category 2: At least one criterion receives a score of 2;

c) Category 3: At least one criterion receives a score of 3;

d) Category 4: At least one criterion receives a score of 4;

đ) Category 5: At least one criterion receives a score of 5;

e) Category 6: At least one criterion receives a score of 6.

Chapter III

HEALTH EXAMINATION AND COSTS ASSURED

PART 1: MEDICAL EXAMINATION FOR MILITARY SERVICE OBLIGATION

Article 7. Preliminary Health Screening for Military Service Obligations

1. The commune health station conducts preliminary health screening for military service obligation under the professional guidance and direction of the district health center or the district general hospital; supervised by the Military Command Board of the district.

2. Content of preliminary health screening

a) Collecting personal and family medical history;

b) Identify cases that do not meet physical fitness standards, deformities, and abnormalities as specified in Section I and Section II of Appendix I issued with this Circular; diseases exempted from military service registration as specified in Section III of Appendix I issued with this Circular.

3. Procedure for preliminary health screening

a) Based on the plan for selecting and calling up citizens for conscription by the Military Service Council of the district, the Military Command Board of the commune shall prepare a list and call for preliminary health screening for citizens within their management area who are required to undergo health examination for military service obligation.

b) Organize preliminary health screening according to the provisions of Clause 2 of this Article;

c) Complete the health information of citizens called up for preliminary health screening for military service obligations according to Form 2 of Appendix V attached hereto;

d) Compile a list of citizens suffering from diseases listed in the exemption category for military service registration as stipulated in Section III of Appendix I attached hereto, and report to the Commune Military Service Council;

d) Summarize, compile, and report the results of the preliminary health screening according to Form 2a and Form 2k of Appendix VI issued with this Circular.

Article 8. Military Service Physical Examination

1. Medical examination for military service obligation is conducted by the Military Service Health Examination Council at the district level in accordance with Clause 1 of Article 40 of the Military Service Law 2015, including:

a) The Chairman of the Council is the Director of the District Health Center or the Director of the District General Hospital.

b) The Vice-Chairman of the Council is the Deputy Director responsible for professional matters of the District Health Center or the Deputy Director of the District General Hospital.

c) The Permanent Member and Secretary of the Council is a staff member responsible for state management in the field of health at the district level.

d) Members are officers and staff from relevant agencies and units including: the District Health Center, the District General Hospital (if available), the district health agency, the military medical department of the Military Command Board of the district, and representatives of related units; in necessary cases, additional medical officers and staff from the provincial level or military medical personnel from the Provincial Military Command may be reinforced as decided by the Chairman of the Provincial Military Service Council regarding human resources.

d) Members of the Council must ensure the full range of departments and specialties as stipulated in Clause 5 of this Article and must have a valid practice certificate or license in accordance with the laws on medical examination and treatment.

2. Responsibilities of the Military Service Health Examination Council

a) Be responsible to the Military Service Council at the district level for implementing health examinations, classifying, and concluding health status for each citizen called for conscription.

b) Compile and report the results of health examinations to the Military Service Council at the district level and the Provincial Department of Health (hereinafter referred to as the Provincial Department of Health); hand over all health records to the Military Service Council at the district level (through the same-level health agency).

a) Be responsible to the Military Service Council at the district level for implementing health examinations, classifying, and concluding health status for each citizen called for conscription.

b) Compile and report the results of health examinations to the Military Service Council at the district level and the Provincial Department of Health (hereinafter referred to as the Provincial Department of Health); hand over all health records to the Military Service Council at the district level (through the same-level health agency).

3. Responsibilities of members in the Military Service Health Examination Council

a) The Chairman of the Council is responsible to the Military Service Council at the district level for concluding the health status of citizens eligible for military service obligation; managing the activities of the Council, including: developing and disseminating health examination plans; guiding health standards; responsibilities, tasks, principles of work, and assigning tasks to each Council member; organizing consultations and sending citizens undergoing health examinations for military service obligation to medical facilities for further testing when necessary; directly classifying health status and signing the military service health form; organizing lessons learned from health examinations for military service obligation.

b) The Vice-Chairman of the Board substitutes for the Chairman when absent; participates in physical examinations, consultations, and chairs meetings of the Board upon authorization;

c) The Permanent Member and Secretary of the Council is responsible for budgeting, compiling, and settling expenses, medicines, and consumables serving health examinations for military service obligation; coordinating with other Council members to prepare equipment, infrastructure, medical devices, support forces, health records, and documents for the Council to perform its duties; participating in health examinations, consultations, and Council meetings; registering, compiling, and reporting according to Form 2b and Form 21 of Appendix VI issued with this Circular.

d) Council members directly conducting examinations are responsible for the quality of examinations and conclusions on health status based on assigned tasks; proposing to the Chairman to designate further tests as required by specialty to accurately conclude health status; participating in consultations and Council meetings when summoned.

a) The Chairman of the Council is responsible to the Military Service Council at the district level for concluding the health status of citizens eligible for military service obligation; managing the activities of the Council, including: developing and disseminating health examination plans; guiding health standards; responsibilities, tasks, principles of work, and assigning tasks to each Council member; organizing consultations and sending citizens undergoing health examinations for military service obligation to medical facilities for further testing when necessary; directly classifying health status and signing the military service health form; organizing lessons learned from health examinations for military service obligation.

The Chairman of the Board may use the seal of his/her own agency or unit during the performance of duties;

4. Principles of operation of the Military Service Health Examination Council

a) The Board operates on a collective basis, deciding issues by majority rule;

b) In cases where Council members do not agree on health classification, the Chairman of the Council will record the conclusion on the health form according to the majority opinion. In case of a tie vote, the decision will follow the side with the Chairman's vote. Dissenting opinions must be fully recorded in the minutes, signed by each Council member.

5. Content of Physical Examinations

a) Physical examination; clinical examination according to specialties: Ophthalmology, otolaryngology, dentistry, internal medicine, neurology, psychiatry, surgery, dermatology, obstetrics and gynecology (for females);

b) Clinical laboratory examination: Blood formula; blood type (ABO); liver function (AST, ALT); kidney function (Urea, Creatinine); blood sugar; hepatitis B virus (HBsAg); hepatitis C virus (Anti-HCV); HTV; complete urinalysis (10 parameters); abdominal ultrasound; electrocardiogram; chest X-ray; drug test. The Chairman of the Council may order additional tests as required by specialty to accurately conclude health status.

6. Examination Process

a) Prepare a list of citizens to be examined;

b) Announce the time and place for organizing the physical examination (Order to attend the physical examination);

c) Organize health examinations according to the contents stipulated in Clause 5 of this Article and implement in two rounds: Physical and clinical examination, and clinical laboratory examination, HIV screening, and drug testing. During physical and clinical examination, if a citizen does not meet any of the health standards specified in Clause 1 of Article 4 of this Circular, the Council member conducting the examination reports to the Chairman to decide to stop the examination. Only proceed with blood and urine tests, HIV and drug tests for citizens who meet health standards after physical and clinical examination, ultrasound, electrocardiogram, and chest X-ray.

Organize counseling and HIV testing in accordance with the laws on prevention and control of HIV/AIDS for those who meet health standards;

đ) Complete the Military Service Health Record according to Model 3 of Appendix V issued together with this Circular;

đ) Summarize and report the results of the military service physical examination according to Model 2b of Appendix VI issued together with this Circular;

7. Time for Physical Examination: From November 1st to December 31st every year. The Ministry of National Defense may adjust the time if necessary;

8. Organization of Health Examination Rooms

a) The arrangement of examination rooms must follow the principle of one-way flow, closed loop, convenient for examinees, and ensuring minimum conditions for examination for each specialty: Physical, ophthalmology, otolaryngology, stomatology, internal medicine, neurology, psychiatry, surgery, dermatology, obstetrics and gynecology (for females). Each specialty should have at least one room. Examination rooms for mental health, surgery, dermatology, and obstetrics and gynecology must ensure privacy, seriousness, and avoid noise.

The sequence of the health checkup chain is as follows: Waiting area; registration; physical examination; pulse and blood pressure measurement; electrocardiogram; ultrasound; surgery; dermatology; ophthalmology; otolaryngology; stomatology; internal medicine; neurology; psychiatry; obstetrics and gynecology (if there are female subjects); conclusion. Laboratory tests and X-ray examinations are arranged in separate areas but must ensure results are available before the Chairman of the Council concludes.

b) The minimum medical equipment and supplies of the health checkup Council shall be provided according to the List attached as Appendix IV of this Circular.

9. For localities with district general hospitals, such hospitals shall be responsible for implementing the contents prescribed in this Article.

Article 9. Classification of Military Service Health Status

1. Military service health classification shall be carried out in accordance with the provisions of Articles 5 and 6 of this Circular.

2. Recording of the Military Service Health Status Form

a) After examining each specialty, members of the Council shall record the points for the examination content in the "Points" column; briefly state the reasons for the points in the "Reasons" column; sign and clearly write their full name in the "Signature" column.

b) The Chairman of the Military Service Health Checkup Council shall base on the points at each criterion to conclude the health classification, recording it both numerically and in words (the word part within parentheses) in the "Conclusion Section".

3. Points to Note

a) In cases where the subject is currently suffering from acute illness, illness that may improve or worsen over time or after treatment, the point must be accompanied by the letter "T" (meaning "temporary") next to it. The examiner must write a brief summary of the disease name in Vietnamese next to it (it can be written in international terms between parentheses). When concluding, if the letter "T" is present at the criterion with the highest score, the letter "T" must be written in the health classification section.

b) In cases where there is doubt about scoring or making a conclusion, the Military Service Health Checkup Council shall send the citizen to a specialist examination at another healthcare facility to obtain an accurate conclusion. The maximum time allowed for this is 10 days and it should only be done when necessary.

c) In cases where the health form has the letter "T" recorded, the Military Service Health Checkup Council shall have the responsibility to guide citizens to healthcare facilities for treatment.

d) In cases where the citizen suffers from diseases not classified under Section II of Appendix I issued together with this Circular, the Health Checkup Council shall evaluate comprehensively the functions of the affected organs, the degree of impact on military training, work, daily life, and the prognosis of the disease progression to make a health classification conclusion.

1. The provincial medical examination board shall conduct a medical examination of military service health status when there is a complaint related to the health status of citizens called up for military service or reserve military personnel, upon request by the Military Service Council of the commune or the Local Defense Command.

1. The provincial Medical Appraisal Council shall appraise the military service health status when there are complaints related to the health of citizens called up for military service or reserve military personnel proposed by the county-level Military Service Council.

a) Individual Request for Examination Form (according to Model 8 of Appendix V issued with this Circular);

b) Written request from the Military Service Council of the commune or the Local Defense Command;

c) A certified copy of the Military Service Health Status Form, Reserve Military Personnel Health Check Form, or Military Service Health Status Recheck Form (depending on the content of the requested examination).

b) The request document of the county-level Military Service Council;

c) A valid copy of the Military Service Health Form, Reserve Military Personnel Health Examination Form, or Re-examination Military Service Health Form (depending on the content of the requested appraisal);

4. Within 15 days from the date of receiving complete and valid files, the provincial Medical Appraisal Council must issue a health appraisal conclusion for citizens performing military service and send the file and appraisal results to the county-level Military Service Council.

5. The decision of the Provincial Medical Appraisal Board is the final conclusion regarding the health complaints of citizens fulfilling military service obligations.

Article 11. Military Service Physical Fitness Recheck Examination

1. The military service physical fitness recheck examination shall be conducted by the Military Service Physical Fitness Recheck Examination Board at regiment level and above; the members of the Board include:

a) The Chairman of the Board is the Medical Department Head (responsible for medical affairs) of the regiment-level unit or higher;

b) The Vice-Chairman of the Board is an internist or surgeon;

c) The Permanent Member and Secretary of the Board is a doctor or medical staff member of the unit receiving new recruits;

d) Members who are medical officers and staff of units receiving new recruits; reinforced medical officers and staff; medical or civilian officers and staff from healthcare facilities in the area where the unit receiving new recruits is stationed;

đ) Members of the Council must ensure sufficient departments and specialties as stipulated in Clause 5 of this Article and hold a practice certificate or license appropriate to their tasks in accordance with the law on medical examination and treatment.

2. Responsibilities of the Military Service Physical Fitness Recheck Examination Board

a) To be responsible to the Unit Commander for organizing the recheck examination, classifying, and concluding the health status of each new recruit received by the unit;

b) To compile the results of the recheck examination, report to the Unit Commander and the superior medical department.

3. Responsibilities of the members of the Military Service Physical Fitness Recheck Examination Board

a) The Chairman of the Council is responsible to the head of the unit receiving new recruits regarding the health conclusion of new recruits; manages the activities of the Council, including: Developing and disseminating plans for re-examination of health; guiding regulations on health standards; responsibilities, tasks, working principles, and task assignments for Council members; organizing consultations and sending new recruits to healthcare facilities for examination when necessary; classifying health status and signing the re-examination Military Service Health Form; organizing meetings to review experiences in re-examination of military service health; reporting to the head of the unit receiving new recruits and higher-level military health authorities;

b) The Vice-Chairman of the Board substitutes for the Chairman when absent; participates in health examinations, consultations; organizes Board meetings when authorized;

c) The Standing Member and Secretary of the Council is responsible for budgeting, summarizing, and settling expenses, medicines, and consumables serving the cooperation in re-examination of military service health; leading and coordinating with other Council members to prepare means, material infrastructure, equipment, support forces, health records, and documents for the Council to perform its tasks; participating in health examinations, consultations, and Council meetings; registering, statistics, and reporting according to Model 2i of Appendix VI issued together with this Circular;

d) Council members directly examine; are responsible for the quality of the examination and health conclusions assigned; propose additional tests to the Chairman of the Council based on professional requirements to accurately conclude health status; participate in consultations and Council meetings when summoned.

4. The working principles of the Council for re-examination of military service health shall be implemented in accordance with the provisions of Clause 4 of Article 8 of this Circular.

5. Content of the Military Service Physical Fitness Recheck Examination

The physical examination; clinical examination; and paraclinical examination content shall be carried out in accordance with the provisions of Clause 5 of Article 8 of this Circular.

6. Procedure for the Military Service Physical Fitness Recheck Examination

a) The process of re-examination of military service health shall be carried out in accordance with the provisions of Clause 6 of Article 8 of this Circular;

b) Complete the Military Service Physical Fitness Recheck Form according to Model 4 Appendix V issued together with this Circular;

c) Compile and report the results of the Military Service Physical Fitness Recheck Examination according to Model 2i Appendix VI issued together with this Circular.

7. Timeframe for the Military Service Physical Fitness Recheck Examination: Completed within 10 days from the date of troop transfer.

8. Organize re-examination health examination rooms in accordance with the provisions of Clause 8 of Article 8 of this Circular.

9. Classify the health status of re-examination of military service health in accordance with the provisions of Clause 1 and Clause 2 of Article 9 of this Circular.

Article 12. Health Examination in the Military after Military Service Physical Examination Review

1. Military service health appraisal in the Army shall be conducted by the Medical Appraisal Councils of the lower-tier military hospitals of the units receiving new recruits when there are complaints about the health of new recruits, upon the proposal of the head of the unit receiving new recruits.

2. The Medical Appraisal Council of Military Hospital 103 shall appraise for subjects belonging to units from Military Region 4 northward; the Medical Appraisal Council of Military Hospital 175 shall appraise for subjects belonging to units from Military Region 5 southward.

b) Written request from the Military Service Council of the commune or the Local Defense Command;

a) An individual's request for examination (in Model 8 of Appendix V issued together with this Circular);

b) A written request from the unit commander receiving new recruits;

c) A valid copy of the Military Service Health Status Form and the Military Service Physical Examination Review Form.

4. Within fifteen days from the date of receiving complete valid files, the Medical Appraisal Board must issue a conclusion; compile and report according to Model 2m Appendix VI issued together with this Circular.

5. The decision of the Medical Appraisal Board of Military Hospital 103 or the Medical Appraisal Board of Military Hospital 175 is the final conclusion regarding health complaints of newly enlisted soldiers within the Military.

Article 13. Military Service Health Status Form

1. Contents of the Military Service Health Status Form

a) The section on brief biographical information and medical history: The section on brief biographical information shall be recorded and responsible for by the Military Command Board of the commune; the medical history section shall be recorded and responsible for by the Health Station of the commune.

b) The health examination section shall be recorded and responsible for by the Military Service Obligation Health Examination Board at the district level.

2. Management of the Military Service Health Status Form

a) Before enlistment, the military service obligation health record shall be managed by the Military Command Board at the district level.

c) Upon discharge, the Military Service Health Status Form is returned to the Regional Defense Command

c) Upon discharge, the military service obligation health record shall be handed over to the Military Command Board at the district level for management.

3. The Military Service Health Status Form is only valid when:

a) It conforms to the prescribed model;

b) It is written in blue ink pen, not pencil;

c) The handwriting is clear, without erasures or abbreviations;

d) All contents in the Military Service Health Status Form are fully recorded;

d) Not more than six months from the date the Military Service Obligation Health Examination Board concludes on the health status, except in cases of special health developments.

4. Handover of the Military Service Health Status Form for Enlisted Citizens

a) Within no more than fifteen days from the end of the military service obligation health examination, the district-level health authority must complete the list of citizens meeting the health standards stipulated in this Circular, finalize the military service obligation health record, and hand it over to the Military Command Board at the district level;

b) Based on the agreement plan between the unit receiving troops and the locality, the Military Command Board at the district level shall hand over the military service obligation health record of citizens meeting the health criteria to the unit receiving troops;

c) Citizens who do not meet the health criteria after a re-examination of their health status shall be returned to their place of origin according to regulations of the Ministry of National Defense. The health file of such citizens must include the military service obligation health record of the local Military Service Obligation Health Examination Board and the re-examination health record of the unit's Health Re-examination Board.

Section 2: MANAGEMENT AND HEALTH CHECKS OF RESERVE MILITARY PERSONNEL

Article 14. Management of Reserve Military Personnel's Health

1. Prior to returning to the place of origin (discharge, retirement, transfer to another profession), the military medical personnel of the unit shall be responsible for providing a valid copy of the annual health record to be kept in the soldier's file. When returning to the place of origin, soldiers within the reserve age group shall be responsible for submitting a copy of the annual health record to the Military Command Board at the district level for management.

2. Reserve soldiers shall undergo health checks before each training session, exercise, or readiness inspection, according to the decision allocating training, exercise, and readiness inspection quotas annually by the competent authority.

a) Reserve military personnel who meet the health standards shall continue to be assigned to reserve mobilization units.

b) In cases where the health standards are not met, the district-level health authority shall notify in writing the Military Command Board at the district level to remove them from the local reserve mobilization list.

3. During training sessions, exercises, and concentrated readiness checks for reserve military personnel, the medical staff of the reserve mobilization unit shall be responsible for closely monitoring the health of the reserve military personnel.

4. Upon receipt of a mobilization order, the Military Command Board at the district level shall be responsible for handing over the entire health file of reserve soldiers to the unit receiving reserve soldiers for management.

Article 15. Health Checks of Reserve Military Personnel

1. The health check team for reserve soldiers shall be established by the District Health Center. The health check team shall consist of at least three members: one doctor as team leader and two healthcare staff from the commune Health Station or the District Health Center; their tasks include conducting health checks, preparing health check records, and compiling and reporting results as prescribed.

a) Collecting personal and family medical history;

c) Pulse and blood pressure measurement;

d) Internal medicine, surgery, and specialty examinations.

a) Based on the training plan for reserve military personnel, the Health Examination Team shall prepare a health examination form for 100% of the reserve military personnel according to Model 1 of Appendix V issued together with this Circular;

3. Health Check Process:

a) Based on the training plan for reserve military personnel, the health check team shall issue health check forms for 100% of reserve military personnel according to Model 1 of Appendix V attached to this Circular;

b) Develop plans and conduct health checks according to the content stipulated in Clause 2 of this Article;

c) Compile, statistically analyze, and report results according to Models 1a and 1c of Appendix VI attached to this Circular.

Section 3: HEALTH EXAMINATIONS FOR MILITARY ADMISSIONS

a) The Military Service Obligation Health Examination Board at the district level shall conduct preliminary health examinations for candidates who are young people outside the Military or military personnel stationed in the area; the composition of the Board shall follow the provisions of Clause 1, Article 8 of this Circular;

b) The Military Hospital Health Examination Board shall conduct preliminary health examinations for candidates who are young people outside the Military in the area or military personnel stationed in the area or under its jurisdiction; the composition of the Board includes: the Chairman of the Board is the Director of the Military Hospital; the Vice-Chairman of the Board is the Deputy Director in charge of professional matters of the Military Hospital; the Permanent Member and Secretary of the Board is the commander or staff member in charge of planning and consolidation work of the Military Hospital; other members of the Board shall be undertaken by staff and personnel of the Military Hospital. Members of the Board shall comply with the provisions of Point d, Clause 1, Article 8 of this Circular.

2. Responsibilities of the Preliminary Health Examination Board for Military Admissions

a) Be responsible for conducting health examinations, classifying, and concluding on the health status of candidates (young people outside the military, military personnel) applying for military admissions;

b) Compile the results of health examinations and hand over health files to the Military Recruitment Board at the district level for candidates who are young people outside the Military in the locality or hand over to the requesting unit for candidates who are military personnel.

3. The duties of members and working principles of the Board shall be carried out according to the provisions of Clause 3 and Clause 4, Article 8 of this Circular.

4. The content of health examinations, organization of examination rooms, and procedures for preliminary health examinations for candidates applying for military recruitment shall be implemented according to the provisions of Clauses 5, 6, and 8, Article 8 of this Circular; complete the preliminary health examination record for military recruitment according to Model 5 Appendix V and statistics and report according to the provisions of Model 3a Appendix VI issued together with this Circular.

Article 17. Military Recruitment Health Examination

1. Military recruitment health examinations shall be conducted by the Military Hospital Health Examination Board according to the assignment of the Military Health Department/Logistics General Department.

a) The composition of the Medical Examination Board shall be established by the Director of the Military Hospital, including staff from the Military Hospital and the Military Chief (responsible for military medicine) of the military recruitment school.

b) The Chairman of the Board shall be assumed by the Director or Deputy Director of the hospital.

c) Two Vice Chairmen of the Board: The permanent Vice Chairman shall be the hospital commander; the other Vice Chairman shall be the Military Chief (responsible for military medicine) of the military recruitment school.

d) The Standing Member兼任秘书由医院指挥官或负责医院计划综合工作的干部担任。

e) Members of the Board shall be staff from the Military Hospital.

e) Members of the Board shall comply with the provisions of Point d, Clause 1, Article 8 of this Circular.

2. Duties of the Medical Examination Board

a) To be responsible before the Military Recruitment Board of the school for conducting health examinations, classifying, and concluding on the health status of successful candidates admitted to the school.

b) To compile and report the results of the military recruitment health examination and hand over the health records to the Military Recruitment Board of the school.

3. Duties of members of the Medical Examination Board

a) The Chairman of the Board shall be responsible to the Military Recruitment Board of the school for the health conclusions of admitted candidates; manage the activities of the Board, including: developing and disseminating the health examination plan; guiding health standards; responsibilities, tasks, working principles, task assignments for Board members; organizing consultations and sending for further examination at other healthcare facilities when necessary; classifying health statuses and signing the military recruitment health record; organizing meetings to review military recruitment health examination work.

The Chairman of the Board may use the seal of his/her own agency or unit during the performance of duties;

b) The permanent Vice Chairman shall replace the Chairman when absent; participate in health examinations and consultations; chair Board meetings when authorized.

c) The Vice Chairman of the Board: To direct the activities of successful candidates admitted participating in health examinations according to the approved plan; participate in concluding and classifying health status.

d) The Standing Member兼任秘书负责编制预算,汇总和决算经费、药品和消耗物资,以支持军事招生体检工作;主持与各委员合作准备设备、物质基础、设施、支援力量、健康档案和资料供委员会执行任务;参加体检、会诊和委员会会议;按照本通函附件VI附表3c的规定进行登记、统计并报告。

đ) 各委员会成员直接进行体检,并对其质量及健康结论承担责任;根据专业要求向委员会主席建议增加必要的检查项目以确保健康结论的准确性;在被召集时参加会诊和委员会会议。

4. 军队医院体检委员会的工作原则应按照本通函第8条第4款的规定执行。

5. 对于录取新生的体检内容、组织、科室设置和体检流程,应遵循本通函第8条第5、6和8款的规定;完成军事招生健康表格(见本通函附件V附表6),并按照本通函附件VI附表3b和附表3c的规定进行统计和报告。

6. Timeframe for military recruitment health examinations: Completed within ten days from the date of admission of successful candidates (as stated in the admission notice).

Article 18. Medical Examination for Military Recruitment Candidates

1. Provincial Medical Examination Board

a) 省级医学鉴定委员会在接到县级招生办公室关于非军人考生健康问题的申诉请求时,对军事招生的健康状况进行鉴定;

b) 申请健康鉴定的文件包括:考生的申请书(见本通函附件V附表8);县级招生办公室的鉴定请求公文;考生(非军人)健康档案的有效副本;

c) 自收到完整的健康鉴定申请文件之日起15日内,省级医学鉴定委员会必须出具非军人考生的健康鉴定结论,并将文件和鉴定结果发送给县级招生办公室;

a) The medical examination boards of Military Hospital 103 and Military Hospital 175 shall accept and examine the health of candidates upon request from the military recruitment boards of military schools or unit heads for preliminary health examinations of military personnel. The medical examination board of Military Hospital 103 shall examine for schools, units, or candidates residing in areas northward from Military Region 4; the medical examination board of Military Hospital 175 shall examine for schools, units, or candidates residing in areas southward from Military Region 5.

b) The application file for health examination for military recruitment candidates includes: The candidate's application form (in accordance with Model 8 Appendix V issued together with this Circular); the examination request document from the military recruitment boards of military schools or units with military personnel; a valid copy of the candidate's health record.

The Military Medicine Department under the Ministry of National Defense shall organize health reexaminations for recruitment candidates into officer ranks; training of reserve officers for military service; recruiting of professional soldiers, military workers and defense civil servants at the hospital medical examination board, following the provisions of Clauses 1, 2, 3, and 4 of Article 17;

2. The content, examination procedures, and organization of examination rooms shall be carried out according to Clause 5 of Article 17;

complete the health reexamination form according to Model 7 Appendix V and compile statistics and reports according to the regulations in Model 4b Appendix VI issued together with this Circular.

Article 20. Medical examination for recruitment into the cadre corps; training of reserve officers called up for active service; recruitment of professional soldiers, workers, and defense civil servants.

1. 第103军队医院医学鉴定委员会和第175军队医院医学鉴定委员会接受并处理干部录用、预备军官入伍前培训、专业军人和国防职员招聘的健康申诉,依据录用、培训单位的请求。第103军队医院医学鉴定委员会为北方第四军区及其以北地区的单位提供鉴定服务;第175军队医院医学鉴定委员会为南方第五军区及其以南地区的单位提供鉴定服务。

2. 申请鉴定的文件包括:个人申请书(见本通函附件V附表8);录用、培训单位的鉴定请求文件;部队医院复检健康档案的有效副本。

3. 鉴定结论必须明确疾病状态和健康分类(见本通函附件I附表I和II)。自收到完整有效文件之日起15日内,医学鉴定委员会必须出具健康鉴定结论,并将文件和鉴定结果发送给录用、培训单位;按本通函附件VI附表2m的规定汇总并报告。

Section 5: HEALTH EXAMINATION FEES

Article 21. Consumption quotas and costs for conducting health examinations

The consumption quota of materials and costs for conducting military service health examinations, military recruitment, and reserve military personnel; health examinations during the recruitment of cadres, training of reserve officers to be called up for active duty service, recruitment of professional soldiers, workers, and defense civil servants shall be carried out in accordance with the provisions set forth in Appendix II attached to this Circular.

Article 22. Sources of funding assurance

1. Funding for local health examinations for fulfilling military service obligations and health checks for reserve military personnel shall be carried out in accordance with Article 53 of the 2015 Military Service Law.

2. The funds to ensure the operation of re-examination and post-re-examination health assessment activities for military service obligations; preliminary examination and health examination for military recruitment; re-examination and health assessment for recruitment of cadres, training of reserve officers to be called up for active duty service, recruitment of professional soldiers, workers, and defense civil servants shall be provided from the regular national budget allocated for national defense. Accounted under Section 7000; Subsection 7001; Item 10 (Medicines and bandages), Item 30 (Equipment), Item 90 (Other); Industry 53.

Chapter IV

RESPONSIBILITIES OF THE ORGANIZATIONS AND UNITS UNDER THE MINISTRY OF NATIONAL DEFENSE

Article 23. General Staff Department

1. Coordinate with the Ministry of Health to direct military agencies at all levels to cooperate with local health agencies to plan and implement medical examinations for fulfilling military service obligations as prescribed.

2. Entrust the Military Affairs Department, the Cadre Training Department, and the Militia and Self-Defense Department to direct and guide relevant agencies and units to organize the implementation of health standards and health examinations for fulfilling military service obligations; military recruitment; recruitment of professional soldiers, workers, and defense civil servants.

Article 24. Political General Department

1. Entrust the Cadre Department to direct and guide relevant agencies and units to organize the implementation of health standards and health examinations for military recruitment; recruitment of cadres; recruitment for cadre training of reserve officers to be called up for active duty service.

2. Entrust the Propaganda Department to direct and guide relevant agencies and units to widely implement propaganda on health standards and health examinations for individuals within the management scope of the Ministry of National Defense.

Article 25. General Logistics Department

1. Take the lead and coordinate with relevant agencies and units to advise the Minister of National Defense to amend, supplement, or replace health standards and health examinations for individuals within the management scope of the Ministry of National Defense if difficulties and obstacles arise during the implementation of this Circular.

2. Direct the Military Medical Department

b) Monitor and inspect the implementation of health standards, health examinations, re-examinations, and health assessments at medical agencies and units in managing the health of military personnel, defense civil servants, workers, and defense civil servants;

c) Summarize and conclude the situation of health examinations for individuals within the management scope of the Ministry of National Defense and promptly report any difficulties and obstacles arising during the implementation, proposing solutions.

Direct the Provincial Military Command to advise the provincial People's Committee to direct the Health Departments and district-level People's Committees, commune-level People's Committees to organize health examinations for fulfilling military service obligations, preliminary health examinations for military recruitment, and health checks for reserve military personnel according to Articles 7, 8, 9, 13, 14, 15, and 16 of this Circular and the guidance of the Military Medical Bureau/TCHC.

2. Entrust the Provincial Military Command to coordinate with the Health Departments

a) Coordinate with the provincial Medical Examination Board to organize health assessments for military service obligations and military recruitment according to Articles 10 and 18 of this Circular;

b) Direct the County Military Command to coordinate with local health authorities to implement health examinations for fulfilling military service obligations and preliminary health examinations for military recruitment according to Articles 7, 8, 9, 13, and 16 of this Circular and the guidance of the Military Medical Bureau/TCHC; manage and check the health of reserve military personnel according to Articles 14 and 15 of this Circular;

c) Direct the Commune Military Command to coordinate with local health authorities to organize preliminary health examinations for fulfilling military service obligations according to Articles 7 and 13 of this Circular; manage and check the health of reserve military personnel according to Articles 14 and 15 of this Circular.

3. Direct receiving units to organize re-examinations and post-re-examination health assessments for fulfilling military service obligations according to Articles 11 and 12 of this Circular.

4. Direct the General Staff, Political Department to cooperate with the Logistics and Technical Department to organize re-examinations and health assessments for cadre recruitment; training of reserve officers to be called up for active duty service; recruitment of professional soldiers, workers, and defense civil servants according to Articles 19 and 20 of this Circular.

Article 27. Other agencies and units directly under the Ministry of National Defense

1. Direct, guide, and inspect subordinate receiving units to organize re-examinations and health assessments according to Articles 11 and 12 of this Circular.

2. Coordinate with military hospitals to organize re-examinations for recruited individuals and trained reserve officers to be called up for active duty service; health examinations for successful military recruitment candidates; resolve health assessments for cases of health complaints according to Articles 17, 18, 19, and 20 of this Circular.

Article 28. Military academies and schools

1. Coordinate with military hospitals to organize health examinations and health assessments for successful military recruitment candidates according to Articles 17 and 18 of this Circular.

2. For cases that do not meet the health requirements for military recruitment, the Military Recruitment Boards of military schools shall handle rejection according to the regulations of the Ministry of National Defense, without affecting the rights of candidates.

Article 29. Military hospitals

1. Organize and implement health examinations for individuals within the management scope of the Ministry of National Defense according to Articles 11, 12, 16, 17, 18, 19, and 20 of this Circular and the guidance and task allocation of the Military Medical Bureau/TCHC.

2. Military Hospital 103 and Military Hospital 175 shall organize and implement post-re-examination health assessments for fulfilling military service obligations according to Article 12; health assessments for military recruitment according to Article 18; and health assessments for recruitment and training of reserve officers according to Article 20 of this Circular.

3. Annually prepare budgets to ensure health examinations for individuals according to this Circular, submit to the financial agency of the superior unit up to the Financial Department/BQP for consolidation and reporting to the Ministry of National Defense to ensure funding; manage and use funds according to current regulations.

Article 30. Financial Department/Ministry of National Defense

Consolidate and review health examination funds according to Clause 2, Article 22 of this Circular, report to the Ministry of National Defense to ensure funding for agencies and units to manage, use, and settle accounts according to state and Ministry of National Defense regulations.

Chapter V

IMPLEMENTING PROVISIONS

Article 31. Implementation organization

1. Ministries, sectors, localities coordinate with the Ministry of National Defense to monitor and inspect the implementation of this Circular. Timely identify issues during implementation to amend and supplement.

2. The People's Committee of the province shall implement in accordance with the provisions of Article 58 of the Military Service Law 2015; direct relevant departments, agencies, and localities under its jurisdiction to carry out military service health examinations; preliminary military recruitment health examinations; reserve military personnel health checks; and health assessments in accordance with the provisions of Articles 7, 8, 9, 10, 14, 15, 16, 18, 21, and 22 of this Circular.

Article 32. Transitional Provisions

1. Preliminary health examination results, health examinations, re-examinations, and pre-assessments conducted before the effective date of this Circular shall continue to be implemented in accordance with the Joint Circular No. 16/2016/TTLT-BYT-BQP dated June 30, 2016, issued by the Ministry of Health and the Ministry of National Defense on the implementation of military service health examinations.

2. The preliminary health screening, health examination, re-examination, and pre-service health assessment after the effective date of this Circular shall be carried out in accordance with the provisions of this Circular.

Article 33. Effective Date

1. This Circular takes effect from January 1, 2024.

2. The Joint Circular No. 16/2016/TTLT-BYT-BQP dated June 30, 2016, issued by the Ministry of Health and the Ministry of National Defense on the implementation of military service health examinations shall cease to be effective from the date this Circular takes effect.

Article 34. Responsibility for Implementation

Deputy Chief of General Staff; Director of the Political General Department; Director of the Logistics General Department; Chairmen of the People's Committees of provinces and centrally governed cities; Heads of agencies, units, and individuals related to this matter are responsible for implementing this Circular./.
