Decree No. 01/2022/ND-CP amends and supplements some articles of Decree No. 65/2018/ND-CP dated May 12, 2018, of the Government detailing the implementation of certain provisions of the Law on Railways.

DECREE

AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF THE DECREE NO. 65/2018/NĐ-CP OF MAY 12, 2018 ISSUED BY THE GOVERNMENT PROVIDING DETAILED REGULATIONS ON IMPLEMENTATION OF CERTAIN PROVISIONS OF THE RAILWAY LAW
The Government issues this Decree amending and supplementing certain articles of Decree No. 65/2018/NĐ-CP of May 12, 2018 issued by the Government providing detailed regulations on implementation of certain provisions of the Railway Law.
Article 1. Amends and supplements certain articles of Decree No. 65/2018/NĐ-CP of May 12, 2018 issued by the Government providing detailed regulations on implementation of certain provisions of the Railway Law

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Railway Law dated June 16, 2017;

At the proposal of the Minister of Transport;

1. Amends Clause 3 and supplements Clause 6 of Article 18 as follows:

"3. The provisions on the service life of railway transport vehicles stipulated in Clauses 1 and 2 of this Article shall not apply to rescue and emergency operations; shunting within stations, ports, depots, and within factory premises; transfer between stations and depots; steam locomotives pulling tourist trains; flat cars for special transportation services related to security and defense, and other specialized vehicles moving on railway tracks."

"6. Railway transport vehicles specified in Clauses 1 and 2 of this Article, upon reaching their service life, may be converted into vehicles not subject to the service life provisions set forth in Clause 3 of this Article."

"Article 19. Implementation timeline for the service life of railway transport vehicles

2. Vehicles that have reached their service life from January 1, 2019 to December 31, 2019: Allowed to operate until December 31, 2024.

3. Vehicles that have reached their service life from January 1, 2020 to December 31, 2025: Allowed to operate until December 31, 2025.

4. Vehicles that have reached their service life from January 1, 2026: Not allowed to extend their operating period."

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees, and Heads of relevant agencies are responsible for implementing this Decree./.

4. Means of transport that have exceeded their service life as of January 1, 2026: Shall not be extended for operation.

Article 2. Effective Date

This Decree takes effect from the date of signature.

Article 3. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under central cities, and Heads of related agencies shall be responsible for implementing this Decree./.
