RESOLUTION

On the functions, tasks, powers, and organizational structure of theLegislative Research Institute

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM

On the basis of the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on the Organization of the National Assembly No. 57/2014/QH13;

Pursuant to the Law on Science and Technology No. 29/2013/QH13;

Considering the proposal of the Director of the Legislative Research Institute at Report No. 165/TTr-VNCLP dated July 28, 2015 regarding the draft Resolution on the functions, tasks, powers, and organizational structure of the Legislative Research Institute;

RESOLUTION:

Article 1. Position and Functions of the Legislative Research Institute

The Legislative Research Institute is an agency under the Standing Committee of the National Assembly with the function of conducting legislative scientific research and organizing legislative scientific information to advise policy, provide consultation, support, and serve the National Assembly, its agencies, agencies under the Standing Committee of the National Assembly, and National Assembly deputies in performing their functions, tasks, and powers; assisting the Standing Committee of the National Assembly in managing scientific research activities in the agencies of the National Assembly, agencies under the Standing Committee of the National Assembly, and the National Assembly Office.

Article 2. Tasks and Powers of the Legislative Research Institute

1. Conducting and organizing research to advise and serve the National Assembly, its agencies, agencies under the Standing Committee of the National Assembly, and National Assembly deputies in reforming the organizational structure and operational methods of the National Assembly.

2. Initiating or upon request from the National Assembly, its agencies, agencies under the Standing Committee of the National Assembly, and National Assembly deputies, conducting and organizing theoretical and practical research on issues related to the National Assembly's exercise of constitutional, legislative, and important national decision-making powers, and its highest supervisory power over state activities.

3. Advising and supporting National Assembly deputies in exercising their right to propose laws, ordinances, and draft laws and ordinances before the National Assembly and the Standing Committee of the National Assembly.

4. Initiating or upon request from the National Assembly, its agencies, agencies under the Standing Committee of the National Assembly, and National Assembly deputies, organizing the provision of legislative scientific information and research results to serve the National Assembly, its agencies, agencies under the Standing Committee of the National Assembly, and National Assembly deputies in performing their assigned tasks and powers.

5. Receiving, managing, exploiting, and disseminating legislative scientific research results, documents, and products containing legislative scientific information from domestic and foreign agencies, organizations, and individuals for provision to serve the National Assembly, its agencies, agencies under the Standing Committee of the National Assembly, and National Assembly deputies.

6. Publishing the Journal of Legislative Research to publish, provide, and exchange legislative scientific information, and to publicize and disseminate legislative scientific information, legislative practice, and regulatory legal documents issued by the National Assembly and the Standing Committee of the National Assembly.

7. Assisting the Standing Committee of the National Assembly in managing scientific research activities in the agencies of the National Assembly, agencies under the Standing Committee of the National Assembly, and the National Assembly Office according to the Law on Science and Technology.

8. Implementing cooperative activities to conduct and disseminate legislative scientific information with domestic and foreign research and information agencies; attracting scientists and experts to participate in legislative scientific research and information organization.

9. Performing other tasks and powers as prescribed by law or assigned by the National Assembly, the Standing Committee of the National Assembly, or the leadership of the National Assembly.

Article 3. Organizational Structure of the Legislative Research Institute

1. The Legislative Research Institute shall have a Director, Deputy Directors, civil servants, staff members, and workers.

2. The number of civil servant positions, total number of staff members and workers working at the Legislative Research Institute shall be decided by the Standing Committee of the National Assembly.

3. The Legislative Research Institute shall have the following units equivalent to department level:

a) Scientific Research Center for Legislation;

b) Information Center for Legislative Science;

c) Journal of Legislative Research;

d) Scientific Management Board;

đ) Office of the Legislative Research Institute.

Article 4. Duties and Authorities of the Director and Deputy Directors of the Legislative Research Institute

1. The Director and Deputy Directors of the Legislative Research Institute shall be appointed, relieved of duty, or dismissed by the Standing Committee of the National Assembly. The Director of the Legislative Research Institute shall be responsible to the Standing Committee of the National Assembly for the organization and operation of the Institute.

2. The Director of the Legislative Research Institute shall have the following duties and authorities:

a) Leading, directing, organizing management and operational activities of the Legislative Research Institute;

b) Being subject to the direction of the Standing Committee of the National Assembly, leadership of the National Assembly; maintaining relations with the Permanent Council of Ethnic Minorities, Permanent Committees of the National Assembly, leadership of agencies under the Standing Committee of the National Assembly, the National Assembly Office, and related agencies and organizations;

c) Representing the Legislative Research Institute in international cooperation within the scope of the Institute's authority;

d) Deciding on recruitment, utilization, management, rewards, and handling violations of civil servants, staff members, and workers working at the Legislative Research Institute according to the provisions of the law, except for cases stipulated in Clause 1 of this Article;

đ) Specifying the organizational structure, functions, duties, authorities, and activities of subordinate units of the Legislative Research Institute; mechanisms for coordination and work relationships within the Institute and with related agencies and organizations;

e) Deciding on the establishment of the Scientific Council of the Legislative Research Institute;

g) Implementing other tasks and authorities assigned by the Standing Committee of the National Assembly and the leadership of the National Assembly.

3. Deputy Directors of the Legislative Research Institute shall assist the Director in performing tasks as delegated by the Director. When the Director is absent, one Deputy Director shall be authorized by the Director to perform the Director's tasks and authorities.

Article 5. Budget and Assurance Conditions

1. The Legislative Research Institute is a public service unit, having its own seal and separate account.

2. Regular operating funds and regular task implementation funds according to the functional responsibilities of the Legislative Research Institute shall be guaranteed from the state budget within the National Assembly's operating funds. Material infrastructure and operational conditions of the Legislative Research Institute shall be ensured by the National Assembly Office.

3. Civil servants, staff members, and workers working at the Legislative Research Institute shall enjoy appropriate systems and policies suitable for the special nature of the National Assembly's operations as prescribed by the Standing Committee of the National Assembly.

Article 6. Implementation Provisions

1. This Resolution shall take effect from January 1, 2016.

2. This Resolution replaces Resolution No. 614/2008/UBTVQH12 dated April 29, 2008 of the Standing Committee of the National Assembly.

3. The Director of the Legislative Research Institute, Head of the National Assembly Office, Chairman of the Delegation Work Committee, and relevant agencies, organizations, and individuals shall be responsible for implementing this Resolution.
