Pursuant to the Law on Technical Standards and Regulations No. 68/2006/QH11 dated June 29, 2006;

Pursuant to the Law on Product Quality and Commodities No. 05/2007/QH12 dated November 21, 2007;

Pursuant to the Ordinance on Plant Seeds No. 15/2004/PL-UBTVQH11 dated March 24, 2004;

Pursuant to the Ordinance on Food Safety and Hygiene No. 12/2003/PL-UBTVQH11 dated July 26, 2003;

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Technical Standards and Regulations;

Pursuant to the Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government on Amending and supplementing certain articles of the Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production and trade;

At the proposal of the Director of the Crop Production Department and the Director of the Quality Management Department for Agriculture, Forestry, and Fisheries Products,

DECISION:

Article 1. The accompanying this Decision are the Regulations on the designation and management of activities of sample collectors, inspectors, testing laboratories, organizations certifying the quality of plant seeds, crop products, and fertilizers.

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette. This Decision replaces Decision No. 66/2004/QĐ-BNN dated November 22, 2004 of the Ministry of Agriculture and Rural Development promulgating the Rules on Recognition, Management, and Supervision of Testing Laboratories, Sample Collectors, and Inspectors of Agricultural Plant Seeds and Decision No. 33/2007/QĐ-BNN dated April 23, 2007 of the Ministry of Agriculture and Rural Development promulgating the Regulations on Recognition of Testing Laboratories, Sample Collectors, and Inspectors of Fertilizers.

Article 3. The Head of the Ministry's Office; the Director of the Crop Production Department; the Director of the Quality Management Department for Agriculture, Forestry, and Fisheries Products; the Heads of units under the Ministry of Agriculture and Rural Development; the Directors of Departments of Agriculture and Rural Development of provinces/cities directly under the central government, relevant organizations, and individuals are responsible for implementing this Decision./.
