DECREE

Regulations on Support Policies to Enhance the Efficiency of Livestock Raising

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Livestock Breeding Law on November 19, 2018;

Pursuant to the Law on Veterinary Medicine dated June 19, 2015;

Pursuant to the State Budget Law dated June 25, 2015;

Pursuant to the Law on Public Investment dated June 13, 2019;

Pursuant to the Investment Law dated June 17, 2020;

Pursuant to the Law on Enterprises dated June 17, 2020;

Pursuant to the Environmental Protection Law dated November 17, 2020;

On the basis of Construction Law the Law on Planning dated June 18, 2014; the Law Amending and Supplementing Certain Provisions of the Construction Law dated June 17, 2020;

Pursuant to the Land Law dated January 18, 2024; the Law Amending and Supplementing Certain Provisions of the Land Law No. 31/2024/QH15, the Housing Law No. 27/2023/QH15, the Real Estate Business Law No. 29/2023/QH15, and the Law on Credit Institutions No. 32/2024/QH15 dated June 29, 2024;

At the proposal of the Minister of Agriculture and Rural Development;

The Government issues this Decree to regulate support policies to enhance the efficiency of livestock raising.

 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates certain support policies for developing livestock raising including: producing livestock feed from domestically produced raw materials, developing the market for livestock products, supporting the relocation of livestock-raising facilities; support and encouragement policies to enhance the efficiency of livestock raising including: supporting artificial insemination for cattle, buffalo, pigs, purchasing male breeding animals for cattle, buffalo, goats, sheep, pigs, and saola, purchasing parent stock chickens, ducks, and geese, and encouraging the treatment of livestock waste.

Article 2. Applicability

Organizations, individuals, cooperative groups, cooperatives, cooperative unions, and enterprises engaged in livestock raising as specified in this Decree (hereinafter referred to as organizations and individuals).

Article 3. Explanation of Terms

1. Livestock feed crop cultivation area is an area with a minimum total area of 10 hectares, planted with one type of crop used as livestock feed.

2. Livestock product market development project refers to a project related to the development of infrastructure, capacity, business conditions, brand building and marketing, and training human resources for the development of the livestock product market.

3. Bio-safe livestock raising involves implementing technical and management measures in livestock raising activities to prevent and limit the spread of biological agents that naturally occur or are created by humans, which can harm humans, livestock, and ecosystems.

Article 4. Principles of Implementing Support Policies

1. Support should be focused, time-bound, and appropriate to the development goals and the ability to balance resources.

2. Ensure transparency, non-overlapping, and effectiveness.

a) Publish the list at the competent authority's office (People's Committee headquarters) regarding the supported entities with the following minimum information: name, address, support content, amount of support.

b) When there are complaints or reports about the implementation of support policies, the competent authority shall organize the handling according to the provisions of the law.

3. Construction costs, equipment procurement costs for works and technological equipment, calculated according to the management regulations on construction investment costs under the Construction Law, serve as the basis for considering support from the state budget.

4. Costs for purchasing technology licenses, purchasing bulk feed storage tanks, purchasing seeds for planting feed crops; costs for promoting product brands; costs for relocating livestock; costs for purchasing artificial insemination supplies for livestock, semen doses, nitrogen liquid storage tanks for preserving semen; costs for purchasing male breeding animals for cattle, buffalo, goats, sheep, pigs, saola, and parent stock chickens, ducks, and geese; costs for purchasing livestock waste treatment products, new biogas facility construction materials and equipment, testing costs; training costs... are budgeted according to the State Budget Law and the Ministry of Finance's Guidelines on Building the State Budget, serving as the basis for considering support from the state budget.

5. The level of support from the state budget specified in this Decree is the maximum level of support. The specific level of support for each policy is based on the costs determined in Clause 3 and Clause 4 of this Article and the state budget balancing capability during each period.

6. Annual support is provided for the policies stipulated in Article 8, point a and c, Clause 2, Article 10 of this Decree; one-time support is provided for the policies stipulated in Article 5, Article 6, Article 7, Article 9, and point b, Clause 2, Article 10 of this Decree.

7. Organizations and individuals who have received support from other policies, programs, or projects with the same content at the same time shall not receive support under this Decree. In cases where a support content is regulated by different policies, organizations and individuals may only receive one-time support for the same recipient.

8. In cases where multiple organizations and individuals meet the support conditions of the policies stipulated in this Decree, priority will be given to organizations and individuals based on the following criteria: production of key local products; application of high technology; remote areas, islands, or economically disadvantaged regions; ability to create jobs for vulnerable people; young entrepreneurs; women as leaders.

Chapter II

SUPPORT POLICIES FOR DEVELOPING LIVESTOCK RAISING

Article 5. Support for production, processing, preservation, and consumption of domestic raw materials for animal feed production

1. Recipients of support

Organizations, individuals, cooperative groups, cooperatives, cooperative unions, enterprises that have investment projects for facilities producing, processing, preserving, and consuming domestic raw materials for animal feed production, and operate farms as specified in points a, b, and c of Clause 2, Article 21 of Government Decree No. 13/2020/NĐ-CP dated January 21, 2020, guiding detailed implementation of the Livestock Law.

2. Content and level of support

a) Support organizations and individuals to construct planting areas for feed crops with infrastructure costs including main field roads, irrigation systems, water supply and drainage systems, electricity, and product collection areas after harvest. The investment support level shall not exceed 50% of the total project cost and a maximum of VND 50 billion per project.

b) Support organizations and individuals for purchasing materials and equipment for collecting, packaging, transporting, preliminary processing, processing, and preserving industrial and agricultural by-products as raw materials for animal feed for projects with a minimum designed annual production capacity of 100,000 tons. The investment support level shall not exceed 50% of the total project cost and a maximum of VND 1 billion per project.

c) Support organizations and individuals for purchasing equipment from abroad to produce single feed ingredients domestically for supplementary feed for projects with a minimum designed annual production capacity of 30 tons. The investment support level shall not exceed 50% of the total project cost and a maximum of VND 2 billion per project.

d) Support organizations and individuals for purchasing technology licenses from abroad to produce single feed ingredients domestically for supplementary feed for projects with a minimum designed annual production capacity of 30 tons. The investment support level shall not exceed 50% of the total project cost and a maximum of VND 2 billion per project.

đ) Support organizations and individuals for purchasing silos for storing bulk animal feed at medium and large-scale farms. The investment support level shall not exceed 50% of the total project cost and a maximum of VND 100 million per project.

e) Support organizations and individuals for purchasing planting seeds for feed crops for projects with a minimum land area of 10 hectares. The investment support level shall not exceed 50% of the total project cost and a maximum of VND 200 million per project.

3. Conditions for receiving support

a) The production location must be consistent with local socio-economic development plans for the support content specified in point a of Clause 2 of this Article.

b) Meet the conditions for animal feed production facilities as stipulated in Article 38 of the Livestock Law, guiding documents for the Livestock Law, and related legal regulations for the support content specified in points c and d of Clause 2 of this Article.

c) Meet the conditions for livestock farming facilities as stipulated in Article 55 of the Livestock Law, guiding documents for the Livestock Law, and related legal regulations for the support content specified in point đ of Clause 2 of this Article.

d) Investment projects must comply with laws on investment and be accepted upon completion for the support content specified in points a, b, and c of Clause 2 of this Article.

đ) Have invoices and relevant documents for the expenses incurred.

Article 6. Support for developing livestock product markets

1. Recipients of support

Organizations and individuals implement projects to develop livestock product markets.

2. Content and level of support

a) Support investment not exceeding 50% of the total construction costs for cold storage facilities to preserve livestock and poultry meat products; the maximum support level is three billion VND per cold storage facility.

b) Support not exceeding 30% of the total costs for promoting the brand of livestock products; the maximum support level is one billion VND per project.

c) Support not exceeding 30% of the total costs for training and developing market development strategies for livestock products; the maximum support level is not more than 100 million VND per project.

3. Conditions for receiving support:

a) Developing livestock product markets in accordance with local socio-economic development plans.

b) Establishing and developing markets for livestock products that have value chains from breeding - slaughtering - processing or breeding - slaughtering - processing - consumption.

c) Investment projects must be implemented in accordance with laws on investment and the results must be inspected as stipulated in point a, Clause 2 of this Article.

d) Having invoices and relevant documents related to the cost items incurred.

Article 7. Policy for relocating livestock farms out of prohibited areas

1. Recipients of support

Organizations and individuals with livestock farms established and operating before the Livestock Law comes into effect and currently operating in prohibited areas shall be supported to relocate to new suitable locations or cease operations and switch industries.

2. Content and level of support

a) Supporting the allocation of land funds for building livestock farms for relocated entities: based on the Resolution of the Provincial People's Council on relocation support policies, provincial planning, and approved regional planning, the Provincial People's Committee and District People's Committee allocate land funds for relocated entities according to the provisions of the Land Law.

b) Supporting up to 50% of the costs for purchasing equipment and technology for livestock farming based on the current area of livestock farm buildings of entities required to relocate; the maximum support level is ten billion VND per farm.

c) Supporting up to 50% of the costs for relocating animals to new suitable locations; the maximum support level is five hundred million VND per farm.

d) Supporting 100% of the costs for training and retraining to switch from livestock farming to other professions; the maximum support level is three months' basic salary per person.

3. Conditions for receiving support

a) Livestock farms established and operating before the Livestock Law comes into effect and currently operating in prohibited areas must be relocated according to current regulations.

b) Individuals trained and retrained to switch from livestock farming to other professions must have a completion certificate issued by the training institution and commit to practicing the newly learned profession for at least five years after receiving support.

c) The support for the contents specified in points b, c, and d of Clause 2 of this Article will be provided after the livestock farm has completed relocation from the prohibited area or ceased operations and switched industries, confirmed by the Commune People's Committee.

Chapter III

SUPPORT AND INCENTIVE POLICIES TO IMPROVE THE EFFECTIVENESS OF LIVESTOCK FARMING

Article 8. Support for artificial insemination of cattle, buffalo, and pigs

1. Recipients of support

Organizations and individuals engaged in livestock farming as stipulated in point d, Clause 2, Article 21 of Decree No. 13/2020/NĐ-CP dated January 21, 2020, guiding detailed implementation of the Livestock Law, and assigned tasks to implement the artificial insemination support program for livestock.

2. Content and level of support:

a) Supporting 100% of the costs for artificial insemination materials for cattle and buffalo including frozen semen, liquid nitrogen, gloves, and insemination tools; up to three doses of semen per pregnancy for dairy cattle and two doses of semen per pregnancy for beef cattle.

b) Supporting 100% of the costs for semen doses for artificial insemination of sows; the maximum support level is two doses of semen per mating and six doses of semen per sow per year.

c) Supporting the actual costs for individuals trained in artificial insemination techniques for cattle and buffalo, up to two months' basic salary per person per course.

d) Supporting once up to 30% of the costs for purchasing liquid nitrogen storage tanks for individuals providing artificial insemination services for cattle and buffalo; the maximum support level is five million VND per tank per person.

đ) Supporting artificial insemination services for cattle and buffalo up to a maximum of 300,000 VND per successful insemination.

3. Conditions for receiving support:

Meeting the requirements of Articles 56 and 57 of the Livestock Law and having completed the inspection of artificial insemination results.

Article 9. Support for purchasing male breeding animals of cattle, buffalo, goat, sheep, pig, sao deer, and parent stock chickens, ducks, and geese

1. Recipients of support

Organizations and individuals engaged in household livestock farming as stipulated in point d, Clause 2, Article 21 of Decree No. 13/2020/NĐ-CP dated January 21, 2020, guiding in detail the Law on Livestock.

2. Content and level of support

a) Provide support once, not exceeding 30% of the purchase value of one male breeding animal of cattle, buffalo, goat, sheep, pig, or sao deer for mating purposes, with the maximum support level as follows: VND 15 million per male breeding animal for cattle or buffalo aged 12 months or older; VND 3 million per male breeding animal for goats or sheep aged six months or older; VND 10 million per male breeding animal for pigs aged six months or older and having completed individual productivity testing; VND 10 million per male breeding animal for sao deer aged six months or older; not more than two male breeding animals per household.

b) Provide support once, not exceeding 30% of the purchase value of one day-old parent stock chicken, duck, or goose for breeding purposes, with the maximum support level being VND 15,000 per bird; each livestock farming household can be supported up to a maximum of 500 parent stock chickens, 500 parent stock ducks, or 500 parent stock geese one day old.

3. Conditions for receiving support

a) Complying with the provisions of Article 56 and Clause 2, Article 57 of the Law on Livestock.

b) Purchasing breeding animals with clear origins and ensuring quality according to the provisions of the Law on Livestock, the Law on Animal Health, and guiding documents for these laws.

c) Each livestock farming household can only receive support once under the provisions of point a, Clause 2, or point b, Clause 2 of this Article.

Parent stock chickens, ducks, and geese must be inspected after 38 weeks of age.

Article 10. Policies Encouraging the Treatment of Livestock Waste

1. Recipients of support

Organizations and individuals engaged in livestock activities as defined in Clause 2, Article 21 of Decree No. 13/2020/NĐ-CP dated January 21, 2020, guiding in detail the Law on Livestock.

2. Content and level of support

a) Provide support not exceeding 50% of the value of livestock waste treatment products to encourage their application in treating livestock waste. The maximum support level is as follows: VND 5 million per facility (household livestock farming); VND 50 million per facility (small and medium-sized farm-scale livestock farming); VND 100 million per facility (large-scale farm-scale livestock farming).

b) Provide support not exceeding 50% of the value of biogas facilities to encourage the treatment of livestock waste. The maximum support level is as follows: VND 7 million per facility (household livestock farming); VND 300 million per facility (small and medium-sized farm-scale livestock farming); VND 1 billion per facility (large-scale farm-scale livestock farming).

c) Provide support not exceeding 30% of the cost of purchasing materials, equipment, and testing fees to encourage the implementation of livestock farming according to biosecurity and disease safety criteria. The maximum support level is as follows: VND 20 million per facility (household livestock farming); VND 50 million per facility (small-scale farm-scale livestock farming); VND 70 million per facility (medium-scale farm-scale livestock farming); VND 200 million per facility (large-scale farm-scale livestock farming).

3. Conditions for receiving support

a) Complying with the provisions of Article 55, Article 56, and Clause 2, Article 57 of the Law on Livestock.

b) Engaging in livestock farming and constructing new biogas facilities that comply with technical guidance from the Ministry of Agriculture and Rural Development on livestock waste treatment or using livestock waste treatment products published on the Ministry of Agriculture and Rural Development's website or constructing new biogas facilities and using livestock waste treatment products recognized as agricultural technology advancements in the livestock sector for the support provisions under point a and point b, Clause 2 of this Article.

Chapter IV

SOURCES OF FUNDS AND MECHANISMS

Article 11. Sources of Capital

1. State budget (including central state budget and local state budget) according to the current budget classification.

a) Utilize public investment capital for policies specified in points a, b, and c Clause 2 Article 5; point a Clause 2 Article 6; point b Clause 2 Article 7 and large-scale livestock farms stipulated in point b Clause 2 Article 10 of this Decree. The subjects utilizing this public investment capital are other policy targets specified in Clause 6 Article 5 of the Public Investment Law.

b) Utilize regular operating funds for policies specified in Chapters II and III of this Decree, except for the cases specified in point a of this clause.

2. Other legitimate sources of funding as provided by law.

3. The preparation of budgets, execution of budgets, and settlement of accounts for implementing the policies under this Decree shall be carried out in accordance with the provisions of the State Budget Law, the Public Investment Law, and guiding documents of these laws.

Article 12. Mechanism

1. Post-investment support mechanism

a) The state budget will provide post-investment support when the investment project meets the conditions for support and the project's investment items have been accepted as completed, with 100% of the support capital from the state budget disbursed.

b) Assets formed after investment support as prescribed in this Decree belong to organizations and individuals receiving investment support, not public assets.

2. Mechanism for support related to operational funds shall be implemented in accordance with the State Budget Law and guiding documents for the implementation of the State Budget Law.

Chapter V

PROCEDURES AND FORMALITIES FOR SUPPORT

Article 13. Procedures and formalities for supporting investment policies under the Public Investment Law

The procedures and formalities for supporting investment for the contents specified in points a, b, and c Clause 2 Article 5; point a Clause 2 Article 6; point b Clause 2 Article 7 and large-scale livestock farms stipulated in point b Clause 2 Article 10 of this Decree shall be carried out as follows:

1. Submission of application documents:

a) For the Application for Investment Support: Organizations and individuals submit one set of the application for investment support to the Department of Agriculture and Rural Development where the project is to be implemented.

b) For the Request for Acceptance: After the construction works or parts of the project expected to receive support are completed, organizations and individuals submit one set of the request for acceptance to the Department of Agriculture and Rural Development where the project is to be implemented.

c) Regulations on submission of documents are as follows:

In case of direct submission or through postal service: all components of the documents must be original or certified copies or unauthenticated photocopies accompanied by originals for verification.

In case of submission through electronic environment: the components of the documents shall be carried out in accordance with the provisions of Government Decree No. 45/2020/ND-CP dated April 8, 2020, on administrative procedures in the electronic environment.

2. Contents of the application documents:

a) For the Application for Investment Support:

An application for investment support according to Model No. 01 attached as an appendix to this Decree;

Proposal for an investment project in accordance with the laws on investment or a preliminary feasibility report of the project in accordance with the laws on construction;

Approval document for the investment proposal for projects specified in Articles 30, 31, and 32 of the Investment Law or Investment Registration Certificate for projects specified in Clause 1 Article 37 of the Investment Law;

Certificate of compliance with conditions for producing animal feed for the support content specified in point c Clause 2 Article 5 of this Decree;

Document proving eligibility for relocation for the support content specified in point b Clause 2 Article 7 of this Decree;

Certificate of compliance with breeding conditions for the support content specified in point b Clause 2 Article 10 of this Decree.

b) For the Request for Acceptance:

A request for acceptance according to Model No. 03 attached as an appendix to this Decree;

Independent audit report on construction costs, equipment procurement costs, and technological equipment costs of the works or parts of the works expected to receive support according to this Decree;

Settlement documents for the works or parts of the works expected to receive support;

Report on production and business operations in the most recent quarter if currently engaged in production and business activities.

3. Method of accepting and responding to applications:

Directly accept and deliver results of administrative procedures at the place of receipt of applications or through postal services or electronic environment.

In case of direct submission: upon receipt of the application, the administrative procedure handling agency checks the completeness of the application and accepts it if complete; if incomplete, the agency guides the organization or individual to supplement and complete the application.

In case of submission through postal services or electronic environment: within three working days from the date of receipt of the application, the administrative procedure handling agency examines the completeness of the application; if incomplete, the agency notifies the organization or individual to supplement and complete the application.

4. Procedures and formalities for handling administrative procedures:

a) For the compilation of investment support proposals:

Within fifteen days from the date of receipt of a complete application, the Department of Agriculture and Rural Development, in coordination with the Department of Planning and Investment, the Department of Finance, and relevant agencies, reviews the conditions for support and estimates the amount of support funding for the project. If the application meets the conditions, the Department of Agriculture and Rural Development sends the review document for investment support according to Model No. 02 attached as an appendix to this Decree to the organization or individual. If the application does not meet the conditions, the Department of Agriculture and Rural Development sends a document to the organization or individual stating the reasons.

Based on the needs for socio-economic development, the situation of livestock farming in the locality, and the results of the review of investment support proposals (if any), the Department of Agriculture and Rural Development compiles the needs for investment support proposals from organizations and individuals investing in livestock farming and reports to the Department of Planning and Investment for consideration and decision-making on the annual public investment plan using state budget funds in accordance with the laws on public investment.

The Department of Planning and Investment is responsible for sending the decision on the annual public investment plan to the Department of Finance and the organizations or individuals proposing investment support.

b) Regarding the investment support decision:

Within seven days from the date of receiving all the documents for project acceptance submitted by organizations or individuals, the Department of Agriculture and Rural Development shall establish an Acceptance Committee with representatives from the Department of Planning and Investment, the Construction Department, and other relevant departments, agencies, and localities if necessary.

The content of the acceptance includes the completion level of the supported construction works and sub-works, the operational status of the project, compliance with support conditions, and the support amount as stipulated in this Decree.

Construction works and sub-works will be supported when they meet the support principles specified in Article 4 of this Decree and the corresponding support conditions and amounts for the subjects as provided in Articles 5, 6, 7, and 10 of this Decree.

The Acceptance Committee organizes on-site inspections of the project if necessary. Based on the acceptance content, the Acceptance Committee determines the supported construction works and sub-works, the support amount, and prepares the Acceptance Record according to Model No. 04 of the Appendix accompanying this Decree within twenty days from the date of issuing the Decision to establish the Committee.

Within five working days from the date of the Acceptance Committee's Acceptance Record, the Department of Agriculture and Rural Development shall submit to the Chairman of the Provincial People's Committee for consideration and issuance of the Investment Support Decision for organizations and individuals according to Model No. 05 of the Appendix accompanying this Decree.

The Department of Agriculture and Rural Development sends the Investment Support Decision to the Department of Planning and Investment, the Finance Department, and the organizations and individuals concerned to proceed with the support payment procedures.

5. Payment of support funds

Based on the annual public investment plan and the investment support decision, organizations and individuals submit a request for payment of support funds to the Finance Department where the project is implemented or send it through postal services or electronic environment to have the support capital disbursed. The request for payment of support funds follows Model No. 06 of the Appendix accompanying this Decree.

The Finance Department shall carry out the procedure to register the use of accounts in accordance with administrative procedures in the State Treasury sector to make payments of support funds to organizations and individuals.

Within fifteen days from the date of receipt of the request for payment of support funds from organizations and individuals, the Finance Department shall take the lead and coordinate with the supported entities to review and prepare the Disbursement File to be sent to the Provincial State Treasury. The Disbursement File includes: the annual public investment plan assigned by the Provincial People's Committee; the Investment Support Decision of the Provincial People's Committee Chairman; the Request for Payment of Support Funds, and the Bank Transfer Voucher as prescribed in Government Decree No. 99/2021/NĐ-CP dated November 11, 2021 on management, payment, and settlement of projects using public investment capital.

The Provincial State Treasury is responsible for disbursing the support fund to organizations and individuals within three working days from the date of receipt of complete and valid files.

6. Settlement of support funds:

Settlement of sources: The Provincial People's Committee shall organize the settlement of projects supporting organizations and individuals investing in livestock breeding under the scope regulated by this Decree annually (settlement of sources by fiscal year) as prescribed in Government Decree No. 99/2021/NĐ-CP dated November 11, 2021 on management, payment, and settlement of projects using public investment capital.

Projects receiving support shall implement the settlement of construction investment projects in accordance with laws on construction. The person deciding to approve the investment project (or the person authorized according to regulations) shall base their approval of the final settlement of the project investment capital on the audit results of the independent auditing unit (or the state audit report, conclusions of the inspection agency).

Article 14. Procedures and formalities for supporting policies on the use of state budget funds for public services

1. The procedures and formalities for supporting the contents specified in Points d, đ, and e Clause 2 Article 5; Point b, c Clause 2 Article 6; Point c Clause 2 Article 7; Point a, b Clause 2 Article 9 and Point a, b (for small and medium-scale farm households and farms) Clause 2 Article 10 of this Decree shall be implemented as follows:

a) Submitting application forms: Organizations and individuals submit one set of application forms to the Department of Agriculture and Rural Development at the location where the livestock breeding facility requests support.

The submission of application forms is regulated as follows:

In case of direct submission or through postal service: all components of the documents must be original or certified copies or unauthenticated photocopies accompanied by originals for verification.

In cases of submitting application forms through electronic environment: the components of the application forms shall comply with the provisions stipulated in Decree No. 45/2020/NĐ-CP dated April 8, 2020 of the Government on implementing administrative procedures in an electronic environment.

b) Components of the application forms:

For the policy content specified in Points d, đ, and e Clause 2 Article 5, the components of the application forms include: Request for financial support according to Model No. 07 Appendix issued together with this Decree; invoices and relevant documents related to cost items.

For the policy content specified in Points b, c Clause 2 Article 6; Point c Clause 2 Article 7; Point a, b (for small and medium-sized livestock farms) Clause 2 Article 10, the components of the application forms include: Request for financial support according to Model No. 07 Appendix issued together with this Decree; invoices and relevant documents related to cost items.

For the policy content specified in Points a, b Clause 2 Article 9, the components of the application forms include: Request for financial support according to Model No. 07 Appendix issued together with this Decree; Certificate regarding the origin or pedigree of livestock; Animal quarantine certificate (if applicable); Purchase receipts or sales contracts for livestock breeds or settlement contracts for livestock breed purchases; Inspection report on parent stock chickens, ducks, and geese after 38 weeks of age.

c) Time limit for response and completeness of the application forms:

In case of direct submission: upon receipt of the application, the administrative procedure handling agency checks the completeness of the application and accepts it if complete; if incomplete, the agency guides the organization or individual to supplement and complete the application.

In case of submission through postal services or electronic environment: within three working days from the date of receipt of the application, the administrative procedure handling agency examines the completeness of the application; if incomplete, the agency notifies the organization or individual to supplement and complete the application.

d) Procedures and formalities for handling administrative procedures:

Within twenty days from the date of receipt of complete and valid application forms, the Department of Agriculture and Rural Development shall establish an Appraisal Board and organize the appraisal of the application forms.

The Appraisal Board consists of seven to nine members including the leader of the Department of Agriculture and Rural Development as Chairman, other members being representatives of the Department of Planning and Investment, the Department of Finance, the Department of Natural Resources and Environment, relevant departments and agencies, and leaders of district People's Committees related to the matter.

The Appraisal Board reviews the authenticity and content of the application form components as stipulated in Clause 2 of this Article; conducts on-site inspections if necessary.

If the appraisal results meet the requirements, the Department of Agriculture and Rural Development will advise the provincial People's Committee to issue a decision approving the financial support; in case of rejection, a written response must be provided with clear reasons stated.

đ) Method of delivering the result of administrative procedure: deliver the result of the administrative procedure directly at the place where the application forms were received or through postal service or through electronic environment.

e) Payment of support

Based on the decision approving the financial support, the recipient submits a request for payment of the financial support at the provincial Department of Finance where the livestock breeding facility requested support or sends it through postal service or through electronic environment to have the financial support disbursed. The request for payment of the financial support follows Model No. 06 Appendix issued together with this Decree.

The provincial Department of Finance shall carry out the procedures for registering the use of accounts according to the regulations on administrative procedures in the State Treasury sector to make payments of the financial support to the recipients.

On the basis of the request for payment of the financial support submitted by the recipient, the provincial Department of Finance shall take the lead and coordinate with the recipient to review and prepare the Disbursement File to be sent to the provincial State Treasury within fifteen days from the date of receipt of the request for payment of the financial support from the recipient.

The Disbursement File includes: Decision on investment support by the Chairman of the provincial People's Committee; Request for payment of the financial support; Transfer vouchers in accordance with the regulations.

The provincial State Treasury is responsible for disbursing the support to the recipients within three working days from the date of receipt of the complete and valid Disbursement File.

g) Organizations and individuals are responsible for the legality of the submitted application forms.

2. Procedures and formalities for supporting the policies specified in Points a, b, and đ Clause 2 Article 8 of this Decree

a) Components of the application forms:

Decision assigning tasks by the provincial People's Committee or the Department of Agriculture and Rural Development to organizations assigned to implement artificial insemination support programs for livestock.

Contract for providing artificial insemination materials between the organization assigned to implement the artificial insemination support program for livestock and the selected supplier of artificial insemination materials for livestock.

List of livestock subjected to artificial insemination with confirmation by the commune People's Committee according to Model No. 08 (for cattle) or Model No. 09 (for pigs) Appendix issued together with this Decree.

Inspection report on the results of artificial insemination of livestock that has been carried out.

b) Procedures and formalities:

Financial support for artificial insemination materials for livestock breeders as stipulated in Points a, b, and đ Clause 2 Article 8 of this Decree shall be provided through organizations assigned to implement artificial insemination support programs for livestock.

The artificial insemination service provider prepares a list of livestock subjected to artificial insemination with confirmation by the commune People's Committee and submits it to the organization assigned to implement the artificial insemination support program for livestock.

The organization assigned to implement the artificial insemination support program for livestock compiles the list of livestock submitted and reports it to the specialized agency at the district level every three months. The specialized agency at the district level checks the application forms according to the provisions of Point a Clause 2 of this Article.

Within ninety days from the end date of the submission period, the district People's Committee organizes the appraisal of the application forms; coordinates with relevant agencies at the local level to inspect the results of artificial insemination of livestock according to the regulations.

In case the review and acceptance results meet the requirements, the People's Committee of the district shall provide financial support to the unit that has supplied artificial insemination breeding materials for livestock and performed artificial insemination services for livestock (cattle, buffalo) in accordance with the State Budget Law; in case of refusal, it must respond in writing and specify the reasons.

3. The procedures and formalities for providing support under the policy stipulated in Point d, Clause 2, Article 7; Points c and d, Clause 2, Article 8 of this Decree.

a) Components of the application forms:

A request for financial support according to Model No. 07 attached hereto; a certificate of completion of training courses issued by the training institution; invoices and related documents; a commitment letter to practice the profession obtained through training for at least five years after receiving financial support (applicable to occupational change when implementing relocation of animal husbandry facilities); a commitment letter to perform artificial insemination services for livestock for at least five years after receiving support (applicable to artificial insemination technical training).

b) Procedures and formalities:

The recipient of support shall submit one set of application documents to the People's Committee of the district before the 25th day of the last month of each quarter.

Within twenty days from the date of receipt of complete and valid documents, the People's Committee of the district shall review the documents. If the review results meet the requirements, the People's Committee of the district shall issue a decision approving the financial support; in case of refusal, it must respond in writing to the recipient of support and specify the reasons.

Within twenty days from the date of the decision approving the financial support, the People's Committee of the district shall provide financial support to the recipient of support in accordance with the State Budget Law.

Chapter VI

IMPLEMENTATION AND EFFECTIVE PROVISIONS

Article 15. Responsibilities of Ministries and Equivalent Agencies

1. The Ministry of Agriculture and Rural Development:

a) Take the lead and coordinate with the Ministry of Planning and Investment, the Ministry of Finance, and relevant agencies to guide, inspect, and supervise localities in organizing the implementation of this Decree.

b) Promote and disseminate the contents of this Decree to entities affected by this Decree.

c) Take the lead and aggregate the sources of funds for implementation; compile reports on the implementation status and outcomes of this Decree, promptly propose solutions to address difficulties and issues to ensure effective implementation of the policy.

2. Ministry of Finance:

a) Coordinate with the Ministry of Agriculture and Rural Development to allocate regular budget funds for the implementation of this Decree in accordance with the State Budget Law, guiding documents of the Law, and provisions of this Decree, and submit to the competent authority for approval.

b) Coordinate with the Ministry of Agriculture and Rural Development, the Ministry of Planning and Investment, and the People's Committees of provinces to inspect and supervise the organization of implementation of this Decree.

3. The Ministry of Planning and Investment:

a) Take the lead and coordinate with the Ministry of Agriculture and Rural Development, the Ministry of Finance to aggregate and report annual and medium-term capital sources to the Prime Minister for decision.

b) Coordinate with the Ministry of Agriculture and Rural Development, the Ministry of Finance, and the People's Committees of provinces to inspect and supervise the organization of implementation of this Decree.

4. Other ministries and equivalent agencies shall implement in accordance with their assigned functions and tasks.

Article 16. Responsibilities of Provincial People's Committees and People's Committees of centrally governed cities

1. Direct and organize the implementation; inspect, supervise, evaluate, and periodically report on the implementation results of the policies stipulated in this Decree.

2. Direct and delegate authorized agencies at the locality level to aggregate demand, review applications, approve financial support, inspect, and supervise the implementation of the policy.

3. Allocate local government budgets and integrate various sources of funding (central budget, local budget, and other sources) to ensure the implementation of support programs within the province in accordance with this Decree and relevant current laws.

4. Strengthen promotional activities to disseminate the contents of the policies stipulated in this Decree to all levels, sectors, organizations, and individuals involved in animal husbandry activities within the province.

5. Implement support policies accurately targeting beneficiaries, ensuring transparency.

6. Annually compile and report on the implementation status and outcomes of the policy in the locality, and propose recommendations to relevant ministries and sectors for solutions to address issues arising during the implementation of the policy.

Article 17. Effective Date

1. This Decree takes effect from September 20, 2024.

2. For support measures to enhance the efficiency of animal husbandry approved before the effective date of this Decree, they shall be implemented according to the approved content. In cases where applications have been submitted to the competent authority for benefits prior to the effective date of this Decree, they shall continue to complete and supplement documents in accordance with this Decree.

3. Ministers, Heads of Equivalent Agencies, Heads of Government Agencies, Chairmen of Provincial People's Committees, and related agencies, organizations, and individuals are responsible for enforcing this Decree.
