Amending and supplementing certain Articles of Circular No. 105/2023/TT-BQP dated December 6, 2023, issued by the Minister of National Defense, stipulating health standards and health examinations for subjects under the management of the Ministry of National Defense

Pursuant to the Law on Medical Examination and Treatment dated January 9, 2023;

Pursuant to the Law on Officers of the Vietnam People's Army dated December 21, 1999; the Law Amending and Supplementing Certain Provisions of the Law on Officers of the Vietnam People's Army dated June 3, 2008; the Law Amending and Supplementing Certain Provisions of the Law on Officers of the Vietnam People's Army dated November 27, 2014; the Law Amending and Supplementing Certain Provisions of the Law on Officers of the Vietnam People's Army dated November 28, 2024;

Pursuant to the Law on Professional Military Personnel, Workers, and Civil Servants of National Defense dated November 26, 2015;

Pursuant to the Law on Military Service dated June 19, 2015;

Pursuant to the Law Amending and Supplementing Certain Provisions of 11 Laws on Military and National Defense dated June 27, 2025;

Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense; Decree No. 03/2025/NĐ-CP dated February 28, 2025 of the Government amending and supplementing certain provisions of Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

In accordance with the proposal of the Director of the General Logistics Department - Technical Service;

The Minister of National Defense issues this Circular amending and supplementing certain Articles of Circular No. 105/2023/TT-BQP dated December 6, 2023, issued by the Minister of National Defense, stipulating health standards and health examinations for subjects under the management of the Ministry of National Defense.

Article 1. Amending and supplementing certain Articles of Circular No. 105/2023/TT-BQP dated December 6, 2023, issued by the Minister of National Defense, stipulating health standards and health examinations for subjects under the management of the Ministry of National Defense

1. Amend and supplement Clause 3 of Article 3 as follows:

"3. The regional health examination board is a specialized board operating on a part-time basis, established by the Chairman of the Provincial People's Committee (hereinafter referred to collectively as provincial level) upon the proposal of the Department of Health. The regional health examination board organizes military service health examination teams, ensuring full membership and conducting military service health examinations in accordance with Article 8 of this Circular; among which, the Team Leader is the Deputy Chairman of the Regional Health Examination Board."

2. Amending and supplementing certain Points and Clauses of Article 7 as follows:

a) Amend and supplement Clause 1 as follows:

"1. The commune health station conducts preliminary health screening for military service under the guidance and direction of the Department of Health or hospitals, centers directly under the Department of Health; supervised by the Commune Military Command and the Defense Area Command."

b) Amending and supplementing Point a Clause 3 as follows:

"a) Based on the plan for selecting and calling up citizens for conscription of the Commune Military Service Council, the Commune Military Command compiles a list and advises the Chairman of the Commune People's Committee to call for preliminary health screening for citizens within the management area who need to undergo military service health examinations;"

3. Amending and supplementing certain Points and Clauses of Article 8 as follows:

a) Amend and supplement Clause 1 as follows:

"1. Military service health examinations are conducted by the Regional Health Examination Board established in accordance with Clause 16, Article 4 of the Law Amending and Supplementing Certain Provisions of 11 Laws on Military and National Defense in 2025, including:

a) The Chairman of the Board is the Director of the hospital or the Center for Health Care directly under the Department of Health;

b) The Deputy Chairman is the Deputy Director of the hospital or the Center for Health Care directly under the Department of Health;

c) The Standing Member and Secretary of the Board is a staff member of the hospital, center, or health agency directly under the Department of Health;

d) Members are staff from various agencies and units including hospitals, centers, health agencies directly under the Department of Health; health stations; military medical personnel from the Defense Area Command, and representatives from related units; if necessary, additional medical staff from the provincial level or military medical personnel from the Provincial Military Command may be added at the discretion of the Chairman of the Provincial Military Service Council;

đ) Members of the Regional Health Examination Board must ensure full representation of departments and specialties as stipulated in Clause 5 of this Article and must hold a valid practice certificate or license in accordance with the laws on medical examination and treatment."

b) Amending and supplementing Point b Clause 2 as follows:

"b) Summarize and report the results of military service health examinations to the Provincial Military Service Council (through the Provincial Military Command) and the Department of Health; hand over all health records to the Commune Military Service Council (through the local health agency) and inform the Defense Area Command of the results of the military service health examinations;"

4. Amending and supplementing Point a Clause 4 of Article 13 as follows:

"a) Within no more than 15 days from the end of the military service health examinations, the local health agency will cooperate with the Regional Health Examination Board to complete a list of citizens meeting the health standards stipulated in this Circular, finalize the military service health record, and hand it over to the Commune Military Service Council;"

5. Amending and supplementing Point b Clause 2 of Article 14 as follows:

"b) In cases where the health standards are not met, the Department of Health will notify the Defense Area Command in writing to remove them from the reserve cadre list of the locality;"

6. Amending and supplementing Clause 1 of Article 15 as follows:

"1. The health check team for reserve military personnel is established by the hospital, center, or health agency directly under the Department of Health assigned by the Department of Health. The health check team consists of at least three members: one doctor as the team leader and two healthcare workers from the hospital, center, health agency directly under the Department of Health, or health stations; their duties include health checks, issuing health certificates, summarizing, and reporting results to the hospital, center, health agency directly under the Department of Health assigned by the Department of Health and the Defense Area Command; informing the local health agency of the results according to regulations;"

7. Amending and supplementing Point b Clause 2 of Article 26 as follows:

"b) Direct, authorize the Area Defense Command of the People's Militia and Self-defense Force at the commune level and the Commune Health Station to conduct preliminary health screenings for military service obligations; supervise the Regional Health Examination Board conducting health examinations to fulfill military service obligations and preliminary health screenings for military recruitment as stipulated in Articles 7, 8, 9, 13, and Article 16 of this Circular and the guidance of the Military Medical Department under the General Logistics Department - Technical Service; compile and report according to Model 2e, 2g, 2l in Appendix II issued together with this Circular; receive and manage the results of preliminary health screenings for military recruitment from the Regional Health Examination Board; manage the health of reserve military personnel, supervise the Health Check Teams for reserve military personnel as stipulated in Articles 14 and 15 of this Circular;"

8. Amend and supplement some sub-items in Section IV of Appendix I promulgated along with Circular No. 105/2023/TT-BQP as follows:

a) Amend and supplement Sub-item 2 as follows:

"* Number 1: Visual acuity: Visual acuity is a basic criterion for assessing the vision of each eye. To accurately measure visual acuity, it is required that:

- Professional staff: Must directly guide the method of reading and perform the technique prescribed by Ophthalmology. Pay attention to detect cases where the reader is not honest or does not know how to read according to the instructions, then use an automatic refractometer to check.

- The visual acuity chart must:

+ Be black letters on a white background, with rows 7/10 to 8/10 hung at eye level.

+ Have sufficient light (approximately 400 - 700 lux) to avoid any glare, excessive brightness, or direct light into the reader's eyes, or darkness affecting the reader's vision.

+ Maintain the correct distance between the chart and the reader as specified by the chart.

+ The reader must cover one eye with a hard piece of cardboard (not by hand) and read both eyes simultaneously (one eye open after the cardboard cover).

+ The examiner points to each letter below, the reader must finish reading the letter within about 10 seconds. For rows 8/10, 9/10, 10/10, each row can only have one incorrect letter to be counted as passing that row.

- Calculation of total visual acuity of both eyes: If visual acuity is higher than 10/10, it is still counted as 10/10.

Example: Right eye 12/10, left eye 5/10, the total visual acuity of both eyes is 15/10.

- When calculating total visual acuity for classification, note the visual acuity of the right eye. The visual acuity of the left eye cannot compensate for the right eye, and the visual acuity of the right eye must still meet the specified standard.

- When checking visual acuity without glasses, if the visual acuity of both eyes does not reach 19/10, the professional staff must continue to check visual acuity after correction. Typically, the corrected visual acuity of both eyes must reach 19/10 or more. In cases where the maximum correction does not achieve 19/10, the ophthalmologist must evaluate and find the cause of reduced visual acuity. Score visual acuity:

+ If uncorrected visual acuity of both eyes reaches 19/10 or more: Score based on uncorrected visual acuity.

+ If uncorrected visual acuity of both eyes does not reach 19/10: Score based on maximum corrected visual acuity.

* Number 5: Pterygium

Grade pterygium according to the degree of invasion into the cornea.

- Degree 1: Pterygium begins to invade the edge of the cornea about 1mm.

- Degree 2: Pterygium invades the cornea larger than degree 1 but less than or equal to half the radius of the cornea.

- Degree 3: Pterygium invades the cornea more than degree 2 but has not reached the center of the cornea.

- Degree 4: Pterygium invades through the center of the cornea.

* Number 12: Diseases of the eyelids and orbit.

Measure ptosis by measuring the margin reflex distance 1 (MRD1) from the corneal reflection to the upper eyelid margin.

- Degree 1: MRD1 ≈ 3mm

- Degree 2: MRD1 ≈ 2mm

- Degree 3: MRD1 ≈ 1mm

- Degree 4: MRD1 ≤ 0mm

* Number 13: Color blindness

Measure color blindness using the Ishihara 24 plates chart, grade mild and severe levels according to shapes 16, 17 as directed by the chart.

- Each shape must be read within a maximum time of 3 seconds.

- Read from shape 1 to 15, if correctly read 13 shapes, it is normal.

- Correctly read 9 shapes or fewer is abnormal."

b) Amend and supplement Sub-item 5 as follows:

"Use the Quick Diagnosis Form for Common Mental Disorders according to the model in Appendix III issued together with this Circular. The scoring method for the quick diagnosis form is as follows:

a) Mania:

Scoring method: Frequently 1 point; Not or occasionally 0 points

Evaluation result: Normal 0-2 points; Suspected 3-4 points;

Diagnosed ≥ 5 points

b) Depression:

Scoring method: Frequently 1 point; Not or occasionally 0 points.

Evaluation result: Normal 0-2 points; Suspected 3-4 points;

Diagnosed ≥ 5 points.

c) Schizophrenia:

Scoring method: Frequently or occasionally 1 point; Not 0 points.

Evaluation result: Normal 0 points; Diagnosed ≥ 1 point."

Article 2. Replacing and abolishing certain phrases, clauses, and Appendices of Circular No. 105/2023/TT-BQP dated December 6, 2023, issued by the Minister of National Defense, stipulating health standards and health examinations for subjects under the management of the Ministry of National Defense.

1. Replacing and abolishing certain phrases as follows:

a) Replacing the phrase "Military Service Council at the district level" with the phrase "Military Service Council at the provincial level" in Point a, Clause 2 and Point a, Clause 3 of Article 8;

b) Replacing the phrase "Military Recruitment Board at the district level" with the phrase "Military Recruitment Board at the commune level" in Clause 6 of Article 3; Point b, Clause 2 of Article 16; Points a, b, and c, Clause 1 of Article 18;

c) Replacing the phrase "Military Command at the district level" with the phrase "Regional Defense Command" in Points a and c, Clause 2 and Point b, Clause 4 of Article 13; Clauses 1 and 4 of Article 14;

d) Replacing the phrase "Military Service Health Examination Council at the district level" with the phrase "Regional Health Examination Council" in Clause 8 of Article 3; Point b, Clause 1 of Article 13; Point a, Clause 1 of Article 16;

đ) Replacing the phrase "Military Service Health Examination Council" with the phrase "Regional Health Examination Council" in Clause 2 of Article 3; the title of Clause 2 and Clause 3 of Article 8; Point b, Clause 2; Points b and c, Clause 3 of Article 9; Point đ, Clause 3 and Point c, Clause 4 of Article 13;

e) Replacing the phrase "Health Examination Council" with the phrase "Regional Health Examination Council" in Point b, Clause 8 of Article 8; Point d, Clause 3 of Article 9;

g) Replacing the phrase "Military Service Council at the district level" with the phrase "Military Service Council at the commune level or Regional Defense Command" in Clause 1; Point b, Clause 3; and Clause 4 of Article 10;

h) Replacing the phrase "Logistics" with the phrase "Logistics - Engineering" in Clause 1 of Article 17; the title of Article 25; Clause 1 of Article 26; Clause 1 of Article 29; Article 34;

i) Replacing the phrase "Schools Bureau" with the phrase "Training and Schools Bureau" in Clause 2 of Article 23;

k) Abolishing the phrase "People's Committee at the district level" in Clause 1 of Article 26.

2. Abolishing Clause 9 of Article 8.

3. Replacing Appendix V and Appendix VI promulgated together with Circular No. 105/2023/TT-BQP with Appendix I and Appendix II promulgated together with this Circular.

Article 3. Effectiveness

This Circular takes effect from September 30, 2025.

Article 4. Responsibilities for Implementation

The Chief of the General Staff of the Vietnam People's Army; the Director of the Political General Department of the Vietnam People's Army; the Director of the Logistics - Engineering General Department; the Chairpersons of the People's Committees of provinces and centrally governed cities; Heads of agencies, units, and individuals related to this Circular are responsible for its implementation./.
