RESOLUTION
REGULATING THE NUMBER OF DEPUTY CHAIRS OF THE PEOPLE'S COUNCIL, DEPUTY HEADS OF THE BOARD
OF THE PROVINCE AND COMMUNE LEVELS AND THE ARRANGEMENT OF PROFESSIONAL REPRESENTATIVES
OF THE PROVINCE AND COMMUNE LEVELS

On the basis of The Constitution of the Socialist Republic of Vietnam has been amended and supplemented with certain articles pursuant to Resolution No. 203/2025/QH15;
On the basis of Law on Local Administration Organization No. 72/2025/QH15;
RESOLUTION:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Resolution regulates the number of Deputy Chairs of the People's Council, Deputy Heads of the Board, and members engaged in professional duties of the Board of the provincial-level People's Council (hereinafter referred to as the provincial level); the number of Deputy Chairs of the People's Council, Deputy Heads of the Board of the commune-level People's Council (hereinafter referred to as the commune level); and the arrangement of professional representatives of the provincial and commune-level People's Councils.
Article 2. Applicability
1. This Resolution applies to the People's Councils at the provincial and commune administrative levels.
2. Administrative units at the provincial and commune levels formed after the reorganization specified in this Resolution include:
a) Provincial administrative units formed after the reorganization specified in Resolution No. 202/2025/QH15 dated June 12, 2025 of the National Assembly on the reorganization of provincial administrative units;
b) Commune administrative units formed after the reorganization specified in the resolutions of the Standing Committee of the National Assembly on the reorganization of commune administrative units in the provinces and cities in 2025.
3. Administrative units at the provincial and commune levels that have not implemented reorganization are not subject to the provisions of Clause 2 of this Article.
Chapter II
THE NUMBER OF DEPUTY CHAIRS OF THE PEOPLE'S COUNCIL,
DEPUTY HEADS OF THE BOARD OF THE PROVINCIAL AND COMMUNE LEVELS
Article 3. Number of Deputy Chairs of the Provincial People's Council
The number of Deputy Chairs of the Provincial People's Council is regulated as follows:
1. A city formed through the reorganization of three provincial administrative units shall have no more than four Deputy Chairs of the People's Council;
2. A city formed through the reorganization of two provincial administrative units shall have no more than three Deputy Chairs of the People's Council;
3. A province formed after reorganization shall have no more than three Deputy Chairs of the People's Council;
4. A provincial administrative unit that has not implemented reorganization shall have no more than two Deputy Chairs of the People's Council.
Article 4. Number of Deputy Heads of the Board of the Provincial People's Council
1. The number of Deputy Heads of the Legal Affairs Board, Economic and Budget Board, and Culture and Social Affairs Board of the Provincial People's Council in administrative units formed after reorganization is regulated as follows:
a) A province or city formed through the reorganization of three provincial administrative units shall have no more than four Deputy Heads of the Board;
b) A province or city formed through the reorganization of two provincial administrative units shall have no more than three Deputy Heads of the Board.
2. The number of Deputy Heads of the Ethnic Minorities Board of the Provincial People's Council in administrative units formed after reorganization is regulated as follows:
a) In cases where the Ethnic Minorities Board is established based on the Ethnic Minorities Board already existing in three provincial administrative units before reorganization, it shall have no more than four Deputy Heads of the Board;
b) In cases where the Ethnic Minorities Board is established based on the Ethnic Minorities Board already existing in two provincial administrative units before reorganization, it shall have no more than three Deputy Heads of the Board;
c) In cases where the Ethnic Minorities Board is established based on the Ethnic Minorities Board already existing in one provincial administrative unit before reorganization, it shall have no more than two Deputy Heads of the Board.
3. The Urban Development Board of the City People's Council formed after reorganization shall have no more than two Deputy Heads of the Board.
4. In provincial administrative units that have not implemented reorganization, each Board of the Provincial People's Council shall have no more than two Deputy Heads of the Board.
Article 5. Number of Vice Chairpersons of the People's Council at the Commune Level
The People's Council at the commune level shall have 01 Vice Chairman of the People's Council.
Article 6. Number of Deputy Heads of Committees of the People's Council at the Commune Level
1. Each Committee of the People's Council at the commune level shall be calculated on average to have 02 Deputy Heads.
2. Based on the natural area, population, administrative unit classification, urban classification, economic scale, actual situation of the locality, and the orientation of the Provincial Party Committee Standing Committee, the Municipal Party Committee Standing Committee, the People's Council Standing Committee at the provincial level shall decide specifically the number of Deputy Heads of the People's Council Committees at each commune-level administrative unit, ensuring that the total number of Deputy Heads of the People's Council Committees at the commune level in the province, city does not exceed the total number calculated according to the average framework prescribed in Clause 1 of this Article.
Chapter III
THE ARRANGEMENT OF DELEGATES OF THE PEOPLE'S COUNCIL AT THE PROVINCIAL AND COMMUNE LEVELS ENGAGED IN SPECIALIZED WORK
PROVINCE-LEVEL, COMMUNE-LEVEL SPECIALIZED RESPONSIBILITY ACTIVITIES
Article 7. Principles for Arranging Delegates of the People's Council at the Provincial and Commune Levels Engaged in Specialized Work
1. The People's Council at the provincial level may arrange delegates engaged in specialized work for the following positions:
a) Chairman of the People's Council;
b) Vice Chairman of the People's Council;
c) Head of the People's Council Committee;
d) Deputy Head of the People's Council Committee;
đ) Member of the People's Council Committee.
2. The People's Council at the commune level may arrange delegates engaged in specialized work for the following positions:
a) Chairman of the People's Council;
b) Vice Chairman of the People's Council;
c) Head of the People's Council Committee;
d) Deputy Head of the People's Council Committee.
3. The arrangement of delegates of the People's Council at the provincial and commune levels engaged in specialized work as stipulated in Clause 1 and Clause 2 of this Article shall be implemented in accordance with this Resolution and the regulations of the competent authority.
4. In cases where the Chairman of the People's Council at the provincial level is arranged as a delegate engaged in specialized work, the number of Vice Chairmen of the People's Council at the provincial level as prescribed in Article 3 of this Resolution shall correspondingly decrease by 01 person.
5. In cases where the Head of the People's Council Committee at the provincial and commune levels is arranged as a delegate engaged in specialized work, the number of Deputy Heads of the People's Council Committees at the provincial and commune levels as prescribed in Article 4 and Article 6 of this Resolution shall correspondingly decrease by 01 person.
Article 8. Arrangement of Members of the People's Council Committees at the Provincial Level and Deputy Heads of the People's Council Committees at the Commune Level as Delegates Engaged in Specialized Work
1. Each People's Council Committee at the provincial level shall be calculated on average to have 01 Member who is a delegate engaged in specialized work.
2. Each People's Council Committee at the commune level shall be calculated on average to have 01 Deputy Head who is a delegate engaged in specialized work.
3. The People's Council Standing Committee at the provincial level shall decide the number of Members who are delegates engaged in specialized work of each People's Council Committee at its own level, the number of Deputy Heads who are delegates engaged in specialized work of the People's Council at the commune level of subordinate administrative units, ensuring that it does not exceed the total number of Members of the People's Council Committees at the provincial level who are delegates engaged in specialized work and the total number of Deputy Heads who are delegates engaged in specialized work at the commune level calculated according to the average level throughout the province, city.
4. The Government shall submit to the National Assembly Standing Committee guidelines for implementing allowances and other policies for the position of Member of the People's Council Committee at the provincial level who is a delegate engaged in specialized work.
Chapter IV
IMPLEMENTING PROVISIONS
Article 9. Effective Date
This Resolution shall take effect from the date of its adoption.
Article 10. Transitional Provisions
1. At provincial administrative units formed after restructuring in 2025 pursuant to the Resolution of the National Assembly, if the number of Vice Chairmen of the People's Council and Deputy Heads of the People's Council Committees at the provincial level at the end of the 2021-2026 term exceeds the number prescribed in Clause 1 of Article 3 and Clause 1 of Article 4 of this Resolution, then at the beginning of the 2026-2031 term, they may retain the number of Vice Chairmen of the People's Council and Deputy Heads of the People's Council Committees at the provincial level as at the end of the 2021-2026 term. The People's Councils of the provinces, cities must have a roadmap to gradually reduce the number of Vice Chairmen of the People's Council and Deputy Heads of the People's Council Committees at the provincial level so that by July 2030, the number of Vice Chairmen of the People's Council and Deputy Heads of the People's Council Committees at the provincial level complies with the provisions of this Resolution, except in cases where the competent authority has different regulations.
2. The arrangement of delegates engaged in specialized work, the number of Vice Chairmen of the People's Council, the number of Deputy Heads of the People's Council Committees, and the number of delegates engaged in specialized work of the People's Council of Hanoi City shall be implemented in accordance with the provisions of the Law on the Capital.
This Resolution was adopted by the Standing Committee of the National Assembly of the Socialist Republic of Vietnam, Session 50, on October 16, 2025.
