DECREE
Regulations on the number of Vice Chairpersons and the structure of members of People's Committees at all levels
THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Article 122 of the Law on the Organization of People's Councils and People's Committees dated November 26, 2003;
At the request of the Minister of Home Affairs,
DECREE
PART I
GENERAL PROVISIONS
Article 1. Pursuant to the Law on the Organization of People's Councils and People's Committees in 2003 which stipulates the number of members of People's Committees at each level; the provisions of this Decree and local realities, the Chairman of the People's Committee shall submit to the People's Council at his own level for determination of the number of members of the People's Committee.
Article 2. In addition to the general criteria for cadres, members of the People's Committee must be individuals with state management capabilities, economic and social management capabilities at the local level; effectively implement resolutions of the same-level People's Council and state laws and policies; in their work, they must promote the initiative and creativity of the locality and strictly comply with the centralized and unified management of the Central Government. At all levels, the People's Committees need to have female members, and in places with many ethnic minorities, there should be members from ethnic minority groups.
Article 3. The People's Committees at all levels operate under the principle of collective leadership. The Chairman is the head of the People's Committee who provides overall direction and is responsible before the same-level People's Council and the higher-level People's Committee. The Chairman of the People's Committee of a provincial-level city directly under the Central Government is responsible before the same-level People's Council and the Government. Each member of the People's Committee is individually responsible for their own area of work before the People's Council, the People's Committee, and the same-level Chairman of the People's Committee.
Article 4. The People's Committees at all levels establish and implement working regulations, clearly defining the relationships regarding division of responsibilities and working principles between the People's Committee and specialized agencies under the People's Committee; the relationship between the People's Committee and the same-level People's Council and the same-level Vietnam Fatherland Front Committee.
Chapter II
THE NUMBER OF VICE CHAIRPERSONS AND THE STRUCTURE OF MEMBERS OF PEOPLE'S COMMITTEES AT ALL LEVELS
Article 5. The People's Committee of Hanoi City and Ho Chi Minh City has 13 members including 1 Chairman, 5 Vice Chairmen, and 7 members. Members of the People's Committee are assigned to oversee the following areas of work:
1. The Chairman of the People's Committee oversees general affairs, internal security, socio-economic development planning, urban planning, construction, and architecture.
2. The Vice Chairmen of the People's Committee:
a) One Vice Chairman oversees economy, trade, tourism development, foreign economic relations, investment cooperation; reform and development of enterprises.
b) One Vice Chairman oversees construction, industry, small-scale industry, transportation, postal and telecommunications services, urban technical infrastructure, fire prevention and firefighting.
c) One Vice Chairman oversees agriculture and rural development, water resource management, land and natural resources - environment management.
d) One Vice Chairman oversees finance, state management over budget revenue and expenditure activities; organization of financial markets, management and policy formulation for capital mobilization, directing capital management in enterprises, public assets, and compensation policies for land clearance.
đ) One Vice Chairman oversees culture - society and other social fields.
The specific assignment of tasks to each Vice Chairman of the People's Committee is decided by the Chairman of the People's Committee based on the cadre's capability and local reality.
3. The members of the People's Committee:
a) One member oversees public security.
b) One member oversees military affairs.
c) One member oversees internal affairs.
d) One member oversees the office.
đ) One member oversees planning.
e) One member oversees finance.
g) One member oversees labor - war invalids and social affairs.
Article 6. The People's Committees of provinces with a population of 2 million people or more, or an area of 10,000 square kilometers or more, and central cities classified as type I (excluding Hanoi and Ho Chi Minh City) have 11 members including 1 Chairman, 4 Vice Chairmen, and 6 members. Members of the People's Committee are assigned to oversee the following areas of work:
1. The Chairman of the People's Committee oversees general affairs, internal security, socio-economic development planning, urban and rural planning.
2. The Vice Chairmen of the People's Committee:
a) One Vice Chairman oversees economy, finance, enterprises, trade, tourism, foreign economic relations.
b) One Vice Chairman oversees industry, transportation, construction, postal and telecommunications services, science and technology.
c) One Vice Chairman oversees agriculture, rural development, forestry, fisheries, water resources, land and natural resources - environment.
d) One Vice Chairman oversees culture - society and other social fields.
The specific assignment of tasks to each Vice Chairman of the People's Committee is decided by the Chairman of the People's Committee based on the cadre's capability and local reality.
3. The members of the People's Committee:
a) One member oversees public security.
b) One member oversees military affairs.
c) One member oversees internal affairs.
d) One member oversees the office.
đ) One member oversees finance.
e) One member oversees planning.
Article 7. The People's Committees of provinces and centrally-administered cities not covered by Article 6 of this Decree have 9 members including 1 Chairman, 3 Vice Chairmen, and 5 members. Based on the areas of work specified in Article 6 of this Decree, the Chairman of the Provincial People's Committee assigns members to oversee work suitable to the locality.
During the term of the provincial-level People's Council, it may determine additional members of its own People's Committee but the total number shall not exceed 11 members and must be approved by the Prime Minister.
Article 8. The People's Committee of a district with a population of 150,000 people or more, or an area of 1,000 square kilometers or more, and a district with 30 or more commune-level administrative units, has 9 members including 1 Chairman, 3 Vice Chairmen, and 5 members of the People's Committee. Members of the People's Committee are assigned to oversee the following areas of work:
1. The Chairman oversees general affairs, internal security, socio-economic development planning, district planning, land and natural resources - environment.
2. The Vice Chairmen of the People's Committee:
a) One Vice Chairman oversees economy, finance, enterprises, trade, tourism.
b) One Vice Chairman oversees agriculture, forestry, water resources, fisheries, industry, science and technology, and rural construction.
c) One Vice Chairman oversees culture - society and other social fields.
The specific assignment of tasks to each Vice Chairman of the People's Committee is decided by the Chairman of the People's Committee based on the cadre's capability and local reality.
3. The members of the People's Committee:
a) One member oversees public security.
b) One member oversees military affairs.
c) One member oversees the office.
d) One member oversees inspection.
đ) One member oversees agriculture, land, and construction.
Article 9. The People's Committee of a district, town, or provincial city not covered under Article 8 of this Decree shall have seven members including one Chairman, two Vice Chairmen, and four members. Based on the fields of work specified in Article 8 of this Decree, the Chairman of the People's Committee of a district shall assign the members to be responsible accordingly to suit the locality.
During the term of the People's Council at the district level, the number of members of the People's Committee at that level may be increased but shall not exceed nine members and must be approved by the Chairman of the higher-level People's Committee.
Article 10. The People's Committee of a district or provincial city classified as a second-tier urban area shall have nine members including one Chairman, three Vice Chairmen, and five members. The members of the People's Committee shall be assigned to be responsible for the following areas of work:
1. The Chairman of the People's Committee shall be responsible for general affairs, internal security, economic development planning, social development, and urban planning.
2. The Vice Chairmen of the People's Committee:
a) One Vice Chairman shall be responsible for the economy, industry, public works transportation, infrastructure construction, science and technology, real estate, and natural resources - environment.
b) One Vice Chairman shall be responsible for finance, business management, and urban management.
c) One Vice Chairman oversees culture - society and other social fields.
The specific assignment of tasks for each Vice Chairman of the People's Committee shall be decided by the Chairman of the People's Committee based on the capabilities of the cadres and the actual situation of the locality.
3. The members of the People's Committee:
a) One member oversees public security.
b) One member oversees military affairs.
c) One member oversees the office.
d) One member oversees inspection.
đ) One member oversees agriculture, land, and construction.
Article 11. The People's Committee of a mountainous, island, or border commune with a population of 5,000 people or more; a plain or midland commune with a population of 8,000 people or more shall have five members including one Chairman, two Vice Chairmen, and two members. The members of the People's Committee shall be assigned to be responsible for the following areas of work:
1. The Chairman shall be responsible for general affairs, internal security, planning, and socio-economic development planning of the commune.
2. The Vice Chairmen of the People's Committee:
a) One Vice Chairman shall be responsible for the economy - finance sector, construction, transportation, real estate, and natural resources - environment.
b) One Vice Chairman shall be responsible for the culture - society sector and other social sectors.
3. The members of the People's Committee:
a) One member oversees public security.
b) One member oversees military affairs.
Article 12. The People's Committee of a commune not covered under Article 11 of this Decree shall have three members including one Chairman, one Vice Chairman, and one member. Based on the fields of work specified in Article 11 of this Decree, the Chairman of the People's Committee of a commune shall assign the members to be responsible accordingly to suit the locality.
During the term of the People's Council at the commune level, the number of members of the People's Committee at that level may be increased but shall not exceed five members and must be approved by the Chairman of the higher-level People's Committee.
Article 13. The People's Committee of a ward or town shall have five members including one Chairman, two Vice Chairmen, and two members. The members of the People's Committee shall be assigned to be responsible for the following areas of work:
1. The Chairman shall be responsible for general affairs, internal security, and urban planning management.
2. The Vice Chairmen of the People's Committee:
a) One Vice Chairman shall be responsible for the economy - finance sector, infrastructure construction, science and technology, real estate, and natural resources - environment.
b) One Vice Chairman shall be responsible for the culture - society sector and other social sectors.
3. Members of the People's Committee:
a) One member oversees public security.
b) One member oversees military affairs.
Chapter III
IMPLEMENTING PROVISIONS
Article 14. This Decree shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decree No. 174/CP dated September 29, 1994. Any previous regulations contrary to this Decree shall be abolished. In the course of implementing this Decree, any cases arising in practice shall be reported by the Chairman of the People's Committee of a province or centrally-administered city directly to the Prime Minister for decision.
Article 15. The Minister of Home Affairs shall be responsible for overseeing, directing, inspecting the implementation of this Decree and reporting to the Prime Minister for decision on any issues arising during its implementation.
Article 16. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of People's Councils, and Chairmen of People's Committees at all levels shall be responsible for enforcing this Decree.
