CIRCULAR

GUIDELINES ON THE REGIME OF COLLECTION, SUBMISSION, MANAGEMENT AND USE OF FEES AND DUES FOR QUALITY CONTROL AND FOOD SAFETY IN AQUATIC PRODUCTS

and aquatic product hygiene safety

WHEREAS, Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Dues;

WHEREAS, Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government amending and supplementing certain articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002;

WHEREAS, Decree No. 163/2004/NĐ-CP dated September 7, 2004 of the Government detailing the implementation of certain articles of the Ordinance on Food Safety and Hygiene, certain Articles of the Ordinance on Animal Health, the Ordinance on Livestock Breeds, and the Ordinance on Plant Protection and Quarantine;

Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

After receiving the opinion of the Ministry of Agriculture and Rural Development at Circular No. 805/BNN-TC dated March 22, 2012;

Considering the proposal of the Director of the Tax Policy Department;

The Minister of Finance hereby issues this Circular guiding the regime of collection, submission, management and use of fees and dues for quality control and food safety in aquatic products as follows:

Article 1. Applicability

Organizations and individuals, both domestic and foreign, engaged in production, business, export, import, and domestic consumption of aquatic products and aquatic product derivatives; production and business of veterinary drugs, feed, chemicals, and biological preparations used in aquaculture in Vietnam, when being subject to quality and food safety management activities carried out by competent state agencies under the Ministry of Agriculture and Rural Development according to the provisions of the law, must pay fees and dues as stipulated in Article 2 of this Circular.

Fees and dues for quality control and food safety in aquatic products shall be collected in Vietnamese Dong. In case foreign organizations and individuals have the need to pay fees and dues in foreign currency, they shall be collected in US Dollars (USD) based on the average exchange rate in the inter-bank foreign exchange market published by the State Bank of Vietnam at the time of payment.

Article 2. Level of Collection of Fees and Taxes

The level of collection of fees and dues for quality control and food safety in aquatic products shall be implemented according to the Fee and Due Table attached to this Circular.

Article 3. Collection, Submission, Management and Use of Fees and Dues

1. State management agencies responsible for quality control and food safety in aquatic products (including the Directorate of Quality Assurance for Agricultural and Forestry Products and Aquatic Products, the Veterinary Directorate, the General Fisheries Department, subordinate units, and local food safety and aquatic product hygiene management agencies) performing the fee and due collection tasks specified in Article 2 of this Circular shall be responsible for organizing the collection, submission, management and use of fees and dues in accordance with this Circular (hereinafter referred to as the fee and due collection agency).

2. Fees and dues related to quality control and food safety in aquatic products are revenue items belonging to the state budget, which shall be managed and used as follows:

2.1. The fee and due collection agency shall retain 85% of the amount of fees and dues collected to cover expenses for fee and due collection activities according to the expenditure items prescribed in Decree No. 24/2006/NĐ-CP.

a) Fee and due collection agencies under the Directorate of Quality Assurance for Agricultural and Forestry Products and Aquatic Products, the Veterinary Directorate, and the General Fisheries Department shall base their retained income to allocate funds for subordinate fee and due collection units (including the Directorate's Office) that lack sufficient funds to ensure minimum wage for staff involved in fee and due collection and other expenses supporting food safety and aquatic product hygiene management activities of the Directorate and the General Fisheries Department.

b) The Directorate of Quality Assurance for Agricultural and Forestry Products and Aquatic Products, the Veterinary Directorate, and the General Fisheries Department shall prepare annual revenue and expenditure budgets for approval by the Ministry of Finance; open separate accounts at the State Treasury where transactions take place to monitor revenue and expenditure for funds allocated to balance surplus payments from fee and due collection units to those in deficit. At the same time, they must maintain separate accounting records, and if not fully utilized by year-end, the remaining funds may be carried over to the next year for continued use and must be settled annually with the Ministry of Finance.

2.2. The remaining 15% of the amount collected by the fee and due collection agency must be submitted to the state budget according to the corresponding chapters, types, sections, sub-sections, and sub-subsections of the current State Budget Classification.

Article 4. Organization of Implementation

1. This Circular takes effect from August 15, 2012. This Circular replaces Circular No. 199/2010/TT-BTC dated December 13, 2010 of the Ministry of Finance guiding the management and use of fees and dues for quality control, food safety, and animal health in aquatic products.

2. Other contents related to the collection, submission, management, use, and public disclosure of non-guided fee regimes in this Circular shall be implemented in accordance with Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and dues; Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002; and Circular No. 28/2011/TT-BTC dated February 28, 2011 of the Ministry of Finance guiding the implementation of certain provisions of the Law on Tax Administration, guiding the implementation of Decree No. 85/2007/NĐ-CP dated May 25, 2007 and Decree No. 106/2010/NĐ-CP dated October 28, 2010 of the Government.

3. During the implementation process, if there are any difficulties, please promptly report them to the Ministry of Finance for research and supplementary guidance.
