RESOLUTION
ON THE IMPLEMENTATION OF THE LEGAL REGIME OF SUBSTITUTED PERFORMANCE
OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM
On the basis of the Constitution of the Socialist Republic of Vietnam;
Based on the consideration of Report No. 538/BC-CP dated October 19, 2015 of the Government on the summary of the continued implementation of the pilot of the substituted performance regime pursuant to Resolution No. 36/2012/QH13 of the National Assembly and the Proposal No. 584/TTr-CP dated October 27, 2015 of the Government regarding the draft Resolution of the National Assembly on implementing the substituted performance regime, the Audit Report No. 2974/BC-UBTP13 dated September 14, 2015, and the Audit Report No. 3085/BC-UBTP13 dated November 8, 2015 of the National Assembly's Committee for Legal Affairs, and the opinions of the National Assembly deputies;
RESOLUTION:
Article 1
Acknowledging the achievements made in the implementation of the pilot of the substituted performance regime pursuant to Resolution No. 24/2008/QH12 and Resolution No. 36/2012/QH13 of the National Assembly. Ending the pilot and implementing the substituted performance regime nationwide from January 1, 2016.
Article 2
The Government is tasked with organizing the implementation of the substituted performance regime within the scope of practice as currently defined based on the actual situation in localities, making necessary amendments and supplements to address the shortcomings and limitations in the operation of substituted performance, and taking responsibility for organizing vocational training for substituted performance.
Organizations established under Resolution No. 24/2008/QH12 and Resolution No. 36/2012/QH13 of the National Assembly shall continue their operations according to the provisions of this Resolution until the National Assembly enacts the Substituted Performance Law.
Article 3
The Government shall coordinate with the Supreme People's Court and the Supreme People's Procuracy to implement this Resolution and prepare the draft Substituted Performance Law, reporting to the National Assembly for consideration and inclusion in the legislative program of the 14th National Assembly term. This Resolution was adopted by the 13th National Assembly, 10th Session of the Socialist Republic of Vietnam on November 26, 2015.
