ISSUANCE OF THE REGULATIONS ON THE OPERATIONS OF THE NATIONAL ASSEMBLY STANDING COMMITTEE

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM

On the basis of the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on the Organization of the National AssemblyNo. 57/2014/QH13;

On the basis of the report from the drafting board;

RESOLUTION:

Article 1

The Regulations on the Operations of the National Assembly Standing Committee are hereby promulgated together with this Resolution.

Article 2

The National Assembly Standing Committee, members of the National Assembly Standing Committee, the National Ethnic Council, the National Assembly Committees, the Secretary-General of the National Assembly, the National Assembly Office, agencies under the National Assembly Standing Committee, agencies, organizations, and individuals having work relations with the National Assembly Standing Committee shall be responsible for implementing these Regulations.

Article 3

This Resolution shall take effect from January 1, 2016.

REGULATIONS

OPERATIONS OF THE NATIONAL ASSEMBLY STANDING COMMITTEE
(Issued together with Resolution No. 1075/2015/UBTVQH13)

PART I

GENERAL PROVISIONS

Article 1. Scope and Objects Regulated

1. These Regulations stipulate the principles, working systems, procedures for performing tasks, responsibilities, authorities, and coordination mechanisms in work of the National Assembly Standing Committee.

2. The National Assembly Standing Committee, members of the National Assembly Standing Committee, the National Ethnic Council, the National Assembly Committees, the Secretary-General of the National Assembly, the National Assembly Office, agencies under the National Assembly Standing Committee, Delegations of National Assembly Members, National Assembly Members, and agencies, organizations, and individuals having work relations with the National Assembly Standing Committee shall be subject to these Regulations.

Article 2. Principles and Effectiveness of Activities of the National Assembly Standing Committee

1. The National Assembly Standing Committee operates under a collective system and decides according to the majority.

2. The effectiveness of the activities of the National Assembly Standing Committee is ensured through the effectiveness of its own activities, the activities of the Chairman of the National Assembly, Vice Chairmen of the National Assembly, members of the National Assembly Standing Committee, along with the participation of the National Ethnic Council, National Assembly Committees, the Secretary-General of the National Assembly, the National Assembly Office, agencies under the National Assembly Standing Committee, Delegations of National Assembly Members, and National Assembly Members; and the coordination in work of relevant agencies, organizations, and individuals.

Article 3. Forms of Work of the National Assembly Standing Committee

1. The forms of work of the National Assembly Standing Committee include:

a) Meetings of the National Assembly Standing Committee;

b) Meetings and conferences organized by the National Assembly Standing Committee;

c) Providing opinions in writing.

2. At meetings, the National Assembly Standing Committee discusses and decides on issues within its tasks and powers. The National Assembly Standing Committee decides to organize meetings and conferences based on proposals from members of the National Assembly Standing Committee responsible for the content. The Chairman of the National Assembly decides on requesting opinions from the National Assembly Standing Committee in writing.

Article 4. Information and Propaganda on the Activities of the National Assembly Standing Committee

1. The activities of the National Assembly Standing Committee are published on mass media.

2. News agencies are allowed to attend and report on the activities of the National Assembly Standing Committee in designated areas for the press.

3. The Secretary-General of the National Assembly is the spokesperson for the National Assembly Standing Committee, responsible for organizing the provision of information about the program, content of public meetings, and other activities of the National Assembly Standing Committee.

4. Meeting documents of the National Assembly Standing Committee are published in the meeting proceedings issued by the National Assembly Office.

Chapter II

FORMS OF WORK OF THE NATIONAL ASSEMBLY STANDING COMMITTEE

Section 1. SESSIONS OF THE NATIONAL ASSEMBLY STANDING COMMITTEE

Article 5. Sessions of the National Assembly Standing Committee

1. A session of the National Assembly Standing Committee is the main form of activity of the National Assembly Standing Committee.

2. The National Assembly Standing Committee convenes in public sessions. In cases where the National Assembly Standing Committee convenes in private sessions, such decision shall be made by the Chairman of the National Assembly.

Article 6. Time to Begin a Session of the National Assembly Standing Committee

Regular sessions of the National Assembly Standing Committee are scheduled to begin between the 10th and 15th day of each month, except in special circumstances decided by the Chairman of the National Assembly.

For sessions convened upon the proposal of the State President, the Prime Minister, or at least one-third of the total number of members of the National Assembly Standing Committee, the time for beginning the session shall be determined by the Chairman of the National Assembly.

Article 7. Agenda of a Session of the National Assembly Standing Committee

1. The preparation of the agenda and the decision to convene a session of the National Assembly Standing Committee shall be carried out in accordance with Articles 61 and 62 of the Law on the Organization of the National Assembly.

2. When necessary, based on actual conditions or upon the proposal of a member of the National Assembly Standing Committee, relevant agencies or organizations, the Chairman of the National Assembly may adjust the agenda of a session of the National Assembly Standing Committee.

Article 8. Preparation of Content for Presentation to the National Assembly Standing Committee at a Session

The Chairman of the National Assembly directs the preparation of content for a session of the National Assembly Standing Committee. The Vice Chairmen of the National Assembly and Members of the National Assembly Standing Committee prepare the contents assigned by the National Assembly Standing Committee or the Chairman of the National Assembly.

Article 9. Participants in the Session

1. The participants and invited guests attending a session of the National Assembly Standing Committee are regulated by Article 60 of the Law on the Organization of the National Assembly.

2. Members of the National Assembly Standing Committee have the responsibility to fully participate in all sessions of the National Assembly Standing Committee; if they cannot attend a session, they must report the reasons to the Chairman of the National Assembly for consideration and decision.

Members of the National Assembly Standing Committee who are the Chairperson of the National Ethnic Council, the Head of a National Assembly Committee, the Secretary-General of the National Assembly - Head of the National Assembly Office, or the Head of a Department under the National Assembly Standing Committee may send their deputies to attend the session in their absence. The substitute participant may present the views of the absent Member of the National Assembly Standing Committee in writing; they may also express personal opinions when permitted by the chairperson of the session but do not have voting rights.

3. Representatives of agencies, organizations, or individuals invited to attend the session have the responsibility to attend or send representatives according to the specified composition; if they cannot attend, they must notify the Secretary-General of the National Assembly to report to the Chairman of the National Assembly.

Article 10. Documents and Materials of the Session

1. The Chairman of the National Assembly decides on the documents to be circulated during the session upon the recommendation of the Secretary-General of the National Assembly.

2. Drafting agencies, agencies reviewing draft projects, reports, proposals send electronic and printed versions of the materials serving the session of the National Assembly Standing Committee to the National Assembly Office to compile into files to be sent to members of the National Assembly Standing Committee and to serve the session within the deadlines stipulated in Article 63 of the Law on the Organization of the National Assembly.

3. Session documents are sent to members of the National Assembly Standing Committee and invited guests attending the session; representatives of news agencies and press are provided with documents, except confidential documents.

4. Members of the National Assembly Standing Committee and participants in the session have the responsibility to comply with regulations regarding the use, preservation, and return of confidential documents, and are not allowed to disclose the content of private sessions of the National Assembly Standing Committee.

5. Session documents are stored in accordance with legal provisions on archiving.

Article 11. Chairing the session

1. The Chairman of the National Assembly opens and closes the session, chairs the session of the Standing Committee of the National Assembly; ensures the implementation of the work program of the session and the regulations on the session of the Standing Committee of the National Assembly.

The Vice-Chairman of the National Assembly opens and closes the session according to the authorization of the Chairman of the National Assembly in case the Chairman of the National Assembly is absent; manages the session according to the division of labor by the Chairman of the National Assembly.

2. The chairperson of the session has the following tasks and powers:

a) Determine the legality of the session based on the composition of participants in the session and the content of the files and documents submitted to the Standing Committee of the National Assembly;

b) Propose the content for the Standing Committee of the National Assembly to focus on discussing;

c) Invite members of the Standing Committee of the National Assembly to speak in the order of registration or invite representatives attending the session to express their opinions;

d) Decide to extend or shorten the time for discussion on a particular content of the session;

đ) Summarize the opinions expressed, if necessary, propose the Standing Committee of the National Assembly to vote on the content within the agenda for consideration and opinion;

e) Summarize the opinions expressed, propose the content for the Standing Committee of the National Assembly to vote on the content within the agenda for approval;

g) Sign the minutes of the session.

Article 12. Reporting at the session

1. Members of the Government, Chief Justice of the Supreme People's Court, Procurator General of the Supreme People's Procuracy, State Auditor General, heads of agencies, organizations, individuals presenting projects, reports, proposals directly report to the Standing Committee of the National Assembly at the session. In special cases, the head of the agency or organization may authorize a deputy to report instead and must obtain the consent of the Chairman of the National Assembly.

2. Representatives of agencies, organizations, individuals presenting projects, reports, proposals at the session present their reports within no more than 20 minutes. Based on the content and actual situation, the chairperson of the session decides to increase the presentation time or request additional reporting and explanation.

Article 13. Discussion at the session

1. The chairperson managing the session determines the purpose, requirements, and content of the discussion; invites each member of the Standing Committee of the National Assembly to speak. When necessary, the chairperson of the session may invite representatives attending the session to express their opinions. The speaking time once is not more than 10 minutes.

2. For projects, proposals, reports for preliminary comments before submitting to the National Assembly, the Standing Committee of the National Assembly focuses on discussing major viewpoints, policies, or contents with many differing opinions proposed by the presenting agency and the reviewing agency; progress and conditions for submission to the National Assembly.

For projects, proposals, reports decided upon authority, the Standing Committee of the National Assembly comprehensively examines and discusses viewpoints, policies, and contents before making a decision.

3. In necessary cases, the Chairman of the National Assembly decides to seek the Standing Committee of the National Assembly's opinion in writing regarding the content stipulated in Clause 2 of this Article.

Article 14. Conclusion of the Standing Committee of the National Assembly at the session

1. Based on the opinions discussed and the summary of the chairperson of the session, the Permanent Delegation of the National Ethnic Council, the Permanent Delegation of the National Assembly's Committees, the Secretary-General of the National Assembly, the agency under the Standing Committee of the National Assembly in charge, coordinating with relevant agencies and organizations prepare the draft Notification of the Standing Committee of the National Assembly's conclusion on the assigned content, seek the opinions of the Standing Committee of the National Assembly's members to complete the document and submit it to the National Assembly Leadership for decision.

2. The Secretary-General of the National Assembly sends the Notification of the Standing Committee of the National Assembly's conclusion on projects, proposals, reports to relevant agencies and organizations for further study, adoption, and implementation.

If the presenting agency of the project, proposal, or report has a different opinion from the Standing Committee of the National Assembly's conclusion, it must report to the Standing Committee of the National Assembly in writing.

Article 15. Voting at the Standing Committee of the National Assembly meeting

1. The Standing Committee of the National Assembly decides to apply one of the following voting methods:

a) Secret ballot voting;

b) Show of hands voting.

2. Secret ballot voting shall be conducted in the following sequence:

a) The chairperson of the meeting clearly states the content of the vote;

b) The Delegation Work Committee presents to the Standing Committee of the National Assembly the number and personnel of the Vote Counting Board;

c) The Standing Committee of the National Assembly discusses and votes to approve the Vote Counting Board through a show of hands method;

d) The Vote Counting Board announces the rules for voting and distributes ballots;

e) Members of the Standing Committee of the National Assembly present at the meeting cast their votes;

f) The Vote Counting Board conducts the vote counting and reports the results to the Standing Committee of the National Assembly;

g) The Standing Committee of the National Assembly decides on the adoption of the vote counting results.

3. Show of hands voting shall be conducted in the following sequence:

a) The chairperson of the meeting clearly states the content of the vote;

b) Members of the Standing Committee of the National Assembly present at the meeting vote; they have the right to vote in favor, against, or abstain;

c) The chairperson of the meeting announces the voting result.

4. Ordinances, resolutions, and conclusions of the Standing Committee of the National Assembly are adopted when more than half of the total number of members of the Standing Committee of the National Assembly vote in favor.

5. In cases where it is necessary to re-vote on an issue that has already been voted through by the Standing Committee of the National Assembly, the Standing Committee of the National Assembly will discuss collectively and the chairperson of the meeting will decide on the re-voting.

Article 16. Announcing ordinances, resolutions, and reporting conclusions of the Standing Committee of the National Assembly

1. The announcement of ordinances and resolutions containing legal regulations shall be carried out in accordance with Article 80 of the Law on Enacting Legal Documents.

2. For resolutions not covered by paragraph 1 of this Article, the Secretary-General of the National Assembly shall announce the resolution no later than five working days from the date of its adoption.

3. For contents on which the Standing Committee of the National Assembly provides opinions, the Secretary-General of the National Assembly shall report the conclusions of the Standing Committee of the National Assembly no later than three working days from the end of the meeting.

4. The results of the Standing Committee of the National Assembly meetings shall be reported to the National Assembly Delegations, National Assembly deputies, and relevant agencies, organizations, and individuals.

Article 17. Meeting Minutes

1. The Standing Committee of the National Assembly meetings are recorded in minutes, audio recorded, and video taped. The meeting minutes must fully record the proceedings of the meeting, statements, conclusions, and voting results of the Standing Committee of the National Assembly; signed by the chairperson of the meeting and the Secretary-General of the National Assembly.

2. The Secretary-General of the National Assembly organizes the recording of minutes, audio recording, and video taping of the Standing Committee of the National Assembly meetings.

Section 2. OTHER FORMS OF ACTIVITY

Article 18. Specialized National Assembly Deputies Conference

1. The Standing Committee of the National Assembly decides to convene and preside over the Specialized National Assembly Deputies Conference to discuss and provide opinions on draft projects, proposals, and reports.

2. The Specialized National Assembly Deputies Conference is organized with the participation of specialized National Assembly deputies, representatives of agencies submitting and reviewing draft projects, reports, and proposals. Non-specialized National Assembly deputies have the right to register to attend and speak at the Conference. Managers, experts, and scientists may be invited to participate in the Conference.

3. Based on the planned agenda of the National Assembly session and the work program of the Standing Committee of the National Assembly, upon the proposal of the Permanent Committee of the National Ethnic Council and the Permanent Committee of the National Assembly, the Secretary-General of the National Assembly builds a plan to organize the Specialized National Assembly Deputies Conference for approval by the Standing Committee of the National Assembly.

4. The Chairman of the National Assembly chairs the Conference. Depending on the nature and content of the draft project, proposal, or report, the Chairman of the National Assembly may delegate the Vice-Chairman of the National Assembly or a member of the Standing Committee of the National Assembly to manage the content of the Conference.

5. The Permanent Committee of the National Ethnic Council, the Permanent Committee of the National Assembly, the Committees under the Standing Committee of the National Assembly, and the agencies submitting draft projects, proposals, and reports prepare materials and report at the Conference on the contents to be discussed and seek opinions; compile and study opinions at the Conference to revise draft projects, proposals, and reports.

6. The Secretary-General of the National Assembly - the Director of the National Assembly Office leads and coordinates with related agencies to build a plan to organize services for the Conference.

Article 19. Meetings and Conferences Organized by the Standing Committee of the National Assembly

1. The Standing Committee of the National Assembly organizes conferences to implement or conclude the enforcement of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; organizes specialized conferences, coordination conferences with relevant agencies and organizations, and other conferences to implement its tasks and powers.

2. The Chairman of the National Assembly, Vice Chairmen of the National Assembly, and members of the Standing Committee of the National Assembly preside over meetings with relevant agencies and organizations to implement assigned tasks.

3. The Secretary-General of the National Assembly presides over and coordinates with relevant agencies and organizations to develop plans for organizing and serving conferences and meetings.

Chapter III

PROCEDURES AND FORMALITIES FOR THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY TO REVIEW AND DECIDE ON CONTENTS WITHIN ITS AUTHORITY

Section 1. IN THE FIELD OF LEGISLATION

Article 20. Reviewing Proposals for Law and Ordinance Construction, Suggestions on Laws and Ordinances; Reviewing and Approving Draft Ordinances and Resolutions; Interpreting the Constitution, Laws, and Ordinances; Providing Opinions, Incorporating Feedback, and Amending Draft Laws and Resolution Drafts

The Standing Committee of the National Assembly reviews proposals for law and ordinance construction, suggestions on laws and ordinances; reviews and approves draft ordinances and resolution drafts; interprets the Constitution, laws, and ordinances; provides opinions, incorporates feedback, and amends draft laws and resolution drafts in accordance with the Law on Enacting Legal Normative Documents.

Article 21. Adjusting the Program for Law and Ordinance Construction

1. Based on reviewing the preparation status of projects and drafts from relevant agencies, organizations, or upon the proposal of agencies, organizations, or National Assembly deputies presenting law and ordinance projects between two sessions of the National Assembly, the Standing Committee of the National Assembly adjusts the Program for Law and Ordinance Construction according to the following procedures:

a) Agencies, organizations, or National Assembly deputies submit to the Standing Committee of the National Assembly regarding the adjustment of the Program for Law and Ordinance Construction;

b) The Committee for Legal Affairs of the National Assembly submits a report on examination and a draft resolution;

c) The Standing Committee of the National Assembly discusses;

d) The chairperson of the session summarizes opinions expressed, presents the content for the Standing Committee of the National Assembly to vote on;

e) The Standing Committee of the National Assembly votes to approve the resolution.

2. At the most recent session of the National Assembly, the Standing Committee of the National Assembly reports to the National Assembly on the adjustment of the Program for Law and Ordinance Construction. The Standing Committee of the Legal Affairs bears responsibility for preparing the draft Report of the Standing Committee of the National Assembly.

Article 22. Organizing Public Opinion Solicitation on Law Projects

1. Based on the nature and content of the law project, the Standing Committee of the National Assembly decides on organizing public opinion solicitation, the content, scope, format, and time for soliciting public opinion on the law project.

2. Agencies, organizations, or National Assembly deputies presenting law projects prepare documentation on organizing public opinion solicitation on the law project to submit to the Standing Committee of the National Assembly. The documentation includes:

a) Memorandum;

b) The draft resolution of the Standing Committee of the National Assembly;

c) Documentation of the law project.

3. At the session, the Standing Committee of the National Assembly reviews and decides on organizing public opinion solicitation on the law project according to the following procedures:

a) Agencies, organizations, or National Assembly deputies presenting the law project submit a proposal and a draft resolution;

b) The agency responsible for examining the law project submits opinions on the proposal and draft resolution;

c) The Standing Committee of the National Assembly discusses;

d) The chairperson of the session summarizes opinions expressed, presents the content for the Standing Committee of the National Assembly to vote on;

e) The Standing Committee of the National Assembly votes to approve the resolution.

Article 23. Providing opinions on the issuance of decrees regulating necessary issues within the jurisdiction of the National Assembly and the Standing Committee of the National Assembly but not yet meeting the conditions to be enacted as laws or ordinances

The Standing Committee of the National Assembly provides opinions on the issuance of decrees regulating necessary issues within the jurisdiction of the National Assembly and the Standing Committee of the National Assembly but not yet meeting the conditions to be enacted as laws or ordinances to meet the requirements for state management, economic management, and social management according to the following procedures:

1. The Government submits a proposal;

2. The National Ethnic Council and the Committees of the National Assembly assigned to take the lead in reviewing submit a report on their review;

3. The Standing Committee of the National Assembly discusses;

Article 24. Reviewing ordinances that have been adopted when requested by the President of the State

The Standing Committee of the National Assembly reviews ordinances that have been adopted when requested by the President of the State according to the following procedures:

1. The President of the State submits the request;

2. The agency assigned by the Standing Committee of the National Assembly reports its opinion on the request of the President of the State;

3. The agency responsible for drafting and the agency responsible for reviewing the ordinance project report their opinions;

4. The Standing Committee of the National Assembly discusses;

5. The chairperson of the session summarizes the discussion opinions and presents the content for the Standing Committee of the National Assembly to vote;

6. The Standing Committee of the National Assembly votes.

Article 25. Completing texts already approved by the Standing Committee of the National Assembly

1. For ordinances and resolutions containing legal provisions that have been approved by the Standing Committee of the National Assembly, the Vice Chairman of the National Assembly in charge of the content directs the agency responsible for reviewing to take the lead, coordinating with the Standing Committee of the National Assembly's Legal Committee, the drafting agency, and the Secretary-General of the National Assembly to complete the text. The Secretary-General of the National Assembly submits it to the Chairman of the National Assembly for signature and issuance.

The file submitted for signing must include the opinion sheet of the Vice Chairman of the National Assembly in charge of the content, the Vice Chairman of the National Assembly in charge of the law, the head of the drafting agency, the head of the agency responsible for reviewing, the Chairman of the National Assembly's Legal Committee, and the Secretary-General of the National Assembly.

2. For other resolutions that have been approved by the Standing Committee of the National Assembly, the drafting agency takes the lead, coordinating with the Secretary-General of the National Assembly to finalize the final text for submission to the Vice Chairman of the National Assembly in charge of the field for preliminary examination before submitting to the Chairman of the National Assembly for signature and issuance.

Section 2. IN THE FIELD OF SUPERVISION

Article 26. Supervisory activities of the Standing Committee of the National Assembly

The Standing Committee of the National Assembly conducts supervisory activities according to the provisions of Section 2 Chapter 2 of the Law on the Supervisory Activities of the National Assembly and People's Councils.

The Standing Committee of the National Assembly supervises the handling of citizens' complaints and denunciations according to the Law on the Supervisory Activities of the National Assembly and People's Councils, the Law on Complaints, and the Law on Denunciations.

Article 27. Reviewing ordinances and resolutions of the Standing Committee of the National Assembly when signs of contravention against the Constitution, laws, and resolutions of the National Assembly are discovered

The Standing Committee of the National Assembly reviews its ordinances and resolutions that show signs of contravention against the Constitution, laws, and resolutions of the National Assembly according to the following procedures:

1. Agencies, organizations with authority, and National Assembly deputies submit requests to review ordinances and resolutions of the Standing Committee of the National Assembly that show signs of contravention against the Constitution, laws, and resolutions of the National Assembly;

2. The National Ethnic Council and the Committees of the National Assembly assigned report their opinions; for requests to review ordinances and resolutions of the Standing Committee of the National Assembly that show signs of contravention against the Constitution, the National Assembly's Legal Committee reports the review report.

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly votes.

Section 3. CONSIDERATION OF PERSONNEL AND ORGANIZATIONAL ISSUES OF THE STATE ADMINISTRATION WITHIN AUTHORIZED LIMITS

Article 28. Proposing the National Assembly to elect, remove from office, or dismiss the President of the State, the Chairman of the National Assembly, the Vice Chairmen of the National Assembly, members of the Standing Committee of the National Assembly, the Chairman of the National Ethnic Council, the Heads of the National Assembly Committees, the Chairman of the National Election Council, the Auditor General, and the Secretary-General of the National Assembly

1. The Delegation Work Board assists the Standing Committee of the National Assembly in preparing personnel files and draft reports of the Standing Committee of the National Assembly, as well as draft resolutions of the National Assembly on the list proposed for the National Assembly to elect, remove from office, or dismiss the President of the State, the Chairman of the National Assembly, the Vice Chairmen of the National Assembly, members of the Standing Committee of the National Assembly, the Chairman of the National Ethnic Council, the Heads of the National Assembly Committees, the Chairman of the National Election Council, the Auditor General, and the Secretary-General of the National Assembly.

2. The Standing Committee of the National Assembly considers the list proposed for the National Assembly to elect, remove from office, or dismiss according to the following procedures:

a) The Head of the Delegation Work Board presents the draft report and draft resolution;

b) The Standing Committee of the National Assembly discusses;

c) The chairperson of the session summarizes the opinions expressed and states the content for the Standing Committee of the National Assembly to vote on;

d) The Standing Committee of the National Assembly votes to approve the list proposed.

Article 29. Giving Opinions on Matters Related to the Proposal to the National Assembly for the Election, Removal from Office, or Dismissal of the Prime Minister of the Government, the Vice President of the State, the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy; Approving the Proposal for the Appointment, Removal from Office, or Dismissal of Deputy Prime Ministers, Ministers, and Heads of Ministries Equivalent to Ministries, Judges of the Supreme People's Court; Approving the List of Members of the National Defense and Security Council, the National Election Council

The Standing Committee of the National Assembly considers and gives opinions on matters related to the proposal to the National Assembly for the election, removal from office, or dismissal of the Prime Minister of the Government, the Vice President of the State, the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy; approving the proposal for the appointment, removal from office, or dismissal of Deputy Prime Ministers, Ministers, and Heads of Ministries Equivalent to Ministries, Judges of the Supreme People's Court; approving the list of members of the National Defense and Security Council, the National Election Council according to the following procedures:

1. The President of the State, the Prime Minister of the Government, the Chief Justice of the Supreme People's Court, the Chairman of the National Election Council present the report, personnel files, and draft resolution of the National Assembly;

2. For the approval of the proposal for the appointment, removal from office, or dismissal of Judges of the Supreme People's Court, the Legal Affairs Committee of the National Assembly presents the review report;

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed.

Article 30. Deciding the Number of Vice Chairmen of the National Ethnic Council, Deputy Heads of Committees, Regular Members, Specialized Members, and Other Members of the National Ethnic Council, Committees of the National Assembly

The Standing Committee of the National Assembly decides the number of Vice Chairmen of the National Ethnic Council, Deputy Heads of Committees, Regular Members, Specialized Members, and other members of the National Ethnic Council, Committees of the National Assembly according to the following procedures:

1. The Chairman of the National Ethnic Council, the Head of the Committee of the National Assembly presents the report and draft resolution;

2. The Standing Committee of the National Assembly discusses;

3. The chairperson of the session summarizes the opinions expressed and states the content for the Standing Committee of the National Assembly to vote on;

4. The Standing Committee of the National Assembly votes to approve the resolution.

Article 31. Approval of the list of Vice Chairpersons of the National Assembly's Ethnic Council and Standing Committees; regular members, specialized members, and other members of the National Assembly's Ethnic Council and Committees; approval of the termination of membership in the Council and Committee

The Standing Committee of the National Assembly shall approve the list of Vice Chairpersons of the National Assembly's Ethnic Council and Standing Committees; regular members, specialized members, and other members of the National Assembly's Ethnic Council and Committees; and the termination of membership in the Council and Committee according to the following procedures:

1. The Chairman of the National Ethnic Council, the Head of the Committee of the National Assembly presents the report and draft resolution;

2. The Standing Committee of the National Assembly discusses;

3. The chairperson of the session summarizes the opinions expressed and states the content for the Standing Committee of the National Assembly to vote on;

4. The Standing Committee of the National Assembly votes to approve the resolution.

Article 32. Approval of the results of electing the Heads and Deputy Heads of Delegations of the National Assembly; Chairpersons and Deputy Chairpersons of Provincial People's Councils

1. The Representative Work Committee shall be responsible for compiling the results of electing the Heads and Deputy Heads of Delegations of the National Assembly, and Chairpersons and Deputy Chairpersons of Provincial People's Councils; preparing files, reports, draft resolutions of the Standing Committee of the National Assembly, and submitting them for the opinions of Standing Committee members.

2. The Representative Work Committee shall consolidate the opinions of Standing Committee members and submit them for consideration and decision by the National Assembly leadership; in case there are still differing opinions, it shall report to the Standing Committee of the National Assembly for consideration and decision.

Article 33. Examination of the Prosecutor General’s proposal regarding the arrest, detention, prosecution of National Assembly deputies, persons elected as National Assembly deputies, and searches of their residences and workplaces

1. The Standing Committee of the National Assembly shall examine the Prosecutor General’s proposal regarding the arrest, detention, prosecution of National Assembly deputies, persons elected as National Assembly deputies, and searches of their residences and workplaces during periods when the National Assembly is not in session according to the following procedures:

a) The Prosecutor General shall present a report and draft resolution;

b) The National Assembly's Justice Committee shall present a review report;

c) The Standing Committee of the National Assembly discusses;

d) The chairperson of the session summarizes opinions expressed, presents the content for the Standing Committee of the National Assembly to vote on;

e) The Standing Committee of the National Assembly votes to approve the resolution.

2. At the nearest session, the Standing Committee of the National Assembly shall report to the National Assembly on the approval of the Prosecutor General’s proposal regarding the arrest, detention, prosecution of National Assembly deputies, persons elected as National Assembly deputies, and searches of their residences and workplaces. The Representative Work Committee shall be responsible for preparing the draft report of the Standing Committee of the National Assembly.

Article 34. Decision to temporarily suspend and resumption of duties and powers of National Assembly deputies; reporting to the National Assembly on the loss of deputy status by National Assembly deputies

1. The Standing Committee of the National Assembly shall decide to temporarily suspend the performance of duties and powers of National Assembly deputies in cases where they are indicted as suspects according to the following procedures:

a) The Prosecutor General shall report on the indictment of National Assembly deputies as suspects;

b) The Representative Work Committee shall present a draft resolution;

c) The Standing Committee of the National Assembly discusses;

d) The chairperson of the session summarizes opinions expressed, presents the content for the Standing Committee of the National Assembly to vote on;

e) The Standing Committee of the National Assembly votes to approve the resolution.

2. The Standing Committee of the National Assembly shall decide on the resumption of duties by National Assembly deputies after temporary suspension according to the following procedures:

a) The Prosecutor General shall report on the decision of competent authorities to terminate the investigation, terminate the case against the deputy, or the effective court judgment declaring the deputy not guilty or exempt from criminal responsibility;

b) The Representative Work Committee shall present a draft resolution;

c) The Standing Committee of the National Assembly discusses;

d) The chairperson of the session summarizes opinions expressed, presents the content for the Standing Committee of the National Assembly to vote on;

e) The Standing Committee of the National Assembly votes to approve the resolution.

3. In cases where National Assembly deputies lose their status due to conviction by a court judgment or decision, the Standing Committee of the National Assembly shall report to the National Assembly at the nearest session. The Representative Work Committee shall be responsible for preparing the draft report of the Standing Committee of the National Assembly.

Article 35. Consideration and Decision on the Transfer of National Assembly Deputies to Participate in Sessions of Other National Assembly Delegation Units

1. In cases where deputies transfer their work to another centrally governed province or city, the deputy may submit a request to the Standing Committee of the National Assembly, the National Assembly delegation unit, and the Provincial or Municipal United Front Committee that elected them, as well as the National Assembly delegation unit and the Provincial or Municipal United Front Committee of the province or city where they will participate in sessions, to transfer their participation in the National Assembly delegation unit.

2. The Deputy Affairs Board collects the requests from National Assembly deputies, opinions from the National Assembly delegation units, and the Provincial or Municipal United Front Committees that elected the deputies, as well as the National Assembly delegation units and the Provincial or Municipal United Front Committees of the provinces or cities where the deputies will participate in sessions. They prepare the dossier, report, and draft resolution of the Standing Committee of the National Assembly and send it for the opinion of the Standing Committee members.

3. The Deputy Affairs Board compiles the opinions of the Standing Committee members and submits them for consideration and decision by the National Assembly leadership; in cases where there are differing opinions, they report to the Standing Committee of the National Assembly for consideration and decision.

Article 36. Consideration of Proposals from Agencies, Organizations, or Units Where National Assembly Deputies Work Regarding the Removal, Dismissal, Compulsory Resignation, or Termination of National Assembly Deputies

The Standing Committee of the National Assembly considers proposals from agencies, organizations, or units where National Assembly deputies work regarding the removal, dismissal, compulsory resignation, or termination of National Assembly deputies according to the following procedures:

1. The Deputy Affairs Board presents a consolidated report on the proposals from agencies, organizations, or units where National Assembly deputies work; a detailed report from the deputy; and a verification report from the competent authority, if applicable;

2. The Standing Committee of the National Assembly discusses;

3. The chairperson of the session summarizes the opinions expressed and states the content for the Standing Committee of the National Assembly to vote on;

4. The Standing Committee of the National Assembly votes.

Article 37. Consideration for the National Assembly to Remove National Assembly Deputies

1. The Standing Committee of the National Assembly considers for the National Assembly to remove National Assembly deputies according to the following procedures:

a) The Central Committee of the Vietnam Fatherland Front presents the proposal to remove National Assembly deputies;

b) The Deputy Affairs Board presents a consolidated report on the dossier of the National Assembly deputy and the draft resolution;

c) The Standing Committee of the National Assembly discusses;

d) The chairperson of the session summarizes opinions expressed, presents the content for the Standing Committee of the National Assembly to vote on;

e) The Standing Committee of the National Assembly votes to approve the resolution.

2. In cases where the Standing Committee of the National Assembly decides to propose the National Assembly to remove National Assembly deputies, at the National Assembly session, the Standing Committee of the National Assembly proposes the National Assembly to remove National Assembly deputies according to the provisions of Article 41 of the Rules of Procedure of the National Assembly Session.

Article 38. Decision on Submitting National Assembly Deputies for Removal by Voters in Their Electing Constituencies

The Standing Committee of the National Assembly decides to submit National Assembly deputies for removal by voters in their electing constituencies according to the provisions of Articles 40 and 54 of the Law on the Organization of the National Assembly.

Article 39. Decision on Accepting National Assembly Deputies' Requests to Resign from Their Duties

1. During periods when the National Assembly is not in session, National Assembly deputies who wish to resign from their duties must submit a request to the Standing Committee of the National Assembly.

2. The Standing Committee of the National Assembly considers and decides according to the following procedures:

a) The Deputy Affairs Board presents the report and draft resolution;

b) The Standing Committee of the National Assembly discusses;

c) The chairperson of the session summarizes the opinions expressed and states the content for the Standing Committee of the National Assembly to vote on;

d) The Standing Committee of the National Assembly votes to approve the resolution.

3. At the nearest National Assembly session, the Standing Committee of the National Assembly reports to the National Assembly on accepting the request to resign from duties submitted by National Assembly deputies. The Deputy Affairs Board is responsible for preparing the draft report of the Standing Committee of the National Assembly.

Article 40. Appointment, removal, and dismissal of Deputy Directors of the National Assembly Office, Deputy Secretaries-General of the National Assembly, and leaders of agencies under the Standing Committee of the National Assembly; approval of members of the Secretariat

The Standing Committee of the National Assembly shall examine and decide on the appointment, removal, and dismissal of Deputy Directors of the National Assembly Office, Deputy Secretaries-General of the National Assembly, and leaders of agencies under the Standing Committee of the National Assembly; approval of members of the Secretariat according to the following procedures:

1. The competent authority shall submit a proposal and draft resolution;

2. The Standing Committee of the National Assembly discusses;

3. The chairperson of the session summarizes the opinions expressed and states the content for the Standing Committee of the National Assembly to vote on;

4. The Standing Committee of the National Assembly votes to approve the resolution.

Article 41. Appointment, removal, and dismissal of Deputy State Auditor

The Standing Committee of the National Assembly shall examine and decide on the appointment, removal, and dismissal of Deputy State Auditor according to the following procedures:

1. The State Auditor shall submit a proposal and draft resolution;

2. The Standing Committee of the National Assembly discusses;

3. The chairperson of the session shall synthesize opinions from the discussion and present the content for the Standing Committee of the National Assembly to vote;

4. The Standing Committee of the National Assembly votes to approve the resolution.

Article 42. Approval of the Prime Minister's proposal regarding the appointment and removal of special envoys of the Socialist Republic of Vietnam

The Standing Committee of the National Assembly shall examine and approve the Prime Minister's proposal regarding the appointment and removal of special envoys of the Socialist Republic of Vietnam according to the following procedures:

1. The Prime Minister shall submit a proposal and draft resolution;

2. The Foreign Affairs Committee of the National Assembly shall submit a report on examination;

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Article 43. Establishment, dissolution, merger, division, adjustment of administrative boundaries below provincial level and centrally governed cities; setting standards, criteria, authority, and procedures for classifying administrative units; naming and renaming county-level and commune-level administrative units; resolving disputes related to county-level and commune-level administrative boundaries

The Standing Committee of the National Assembly shall examine and decide on the establishment, dissolution, merger, division, and adjustment of administrative boundaries below provincial level and centrally governed cities; setting standards, criteria, authority, and procedures for classifying administrative units; naming and renaming county-level and commune-level administrative units; resolving disputes related to county-level and commune-level administrative boundaries according to the following procedures:

1. The Government shall submit a proposal and draft resolution;

2. The Legal Affairs Committee of the National Assembly shall submit a report on examination;

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Article 44. Decision to dissolve the People's Council at the provincial level; approval of the dissolution of the People's Council at the district level

The Standing Committee of the National Assembly shall itself or upon the proposal of the Government examine and decide on the dissolution of the People's Council at the provincial level; approve the dissolution of the People's Council at the district level according to the following procedures:

1. The Government, the Delegation Work Committee of the Standing Committee of the National Assembly, and the People's Council at the provincial level shall submit a proposal and draft resolution;

2. The Legal Affairs Committee of the National Assembly shall submit a report on examination;

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Article 45. Decision and announcement of the election date for People's Council representatives in cases of dissolving the People's Council at the provincial level

The Standing Committee of the National Assembly shall decide and announce the election date for People's Council representatives in cases of dissolving the People's Council at the provincial level as stipulated in Clause 6, Article 139 of the Law on Organization of Local Administration according to the following procedures:

1. The Government shall submit a proposal and draft resolution;

2. The Standing Committee of the National Assembly discusses;

Article 46. Guidance on the organization and operation of the People's Council in special circumstances

The Standing Committee of the National Assembly shall designate the convocation of the first session of the People's Council at the provincial level in cases where there is a vacancy in the Chairperson or Vice-Chairperson of the People's Council; the first session of the newly established People's Council at the provincial level; designate the acting Chairperson of the People's Council in cases of establishing a new administrative unit based on the adjustment of part of the administrative boundaries of other units according to the following procedures:

1. The Standing Committee of the People's Council at the provincial level of the previous term, the Standing Committee of the People's Council at the provincial level where the administrative boundary has been adjusted shall submit a proposal and draft resolution;

2. The Standing Committee of the National Assembly discusses;

3. The chairperson of the session summarizes the opinions expressed and states the content for the Standing Committee of the National Assembly to vote on;

4. The Standing Committee of the National Assembly votes to approve the resolution.

Article 47. Decisions on organizational and operational issues of the People's Court

The Standing Committee of the National Assembly approves the organizational structure; tasks and powers of units within the machinery assisting the Supreme People's Court; decides on the establishment and dissolution of the High People's Court, Provincial People's Court, City People's Court directly under the central government, District People's Court, County People's Court, City People's Court under a province and equivalent courts, Military Regional Court, Military Area Court, other specialized courts under the People's Court, territorial jurisdiction scope of the High People's Court; number of senior judges, intermediate judges, primary judges and the ratio structure of each rank of judges at each level of court, total staffing of the People's Court and Military Court; list of members of the Selection and Supervision Council for National Judges; operation regulations of the Selection and Supervision Council for National Judges; salary system, allowances, uniform samples, distribution and use of uniforms for judges and associate judges; Judge Identification Card, Associate Judge Identification Card; salary system, allowances for Court Secretaries, Reviewers; Regulations on coordination between the Supreme People's Court and the Ministry of National Defense in managing military courts regarding organization according to the following procedures:

1. The President of the Supreme People's Court submits a proposal and draft resolution;

2. The Committee for Judicial Affairs of the National Assembly submits a report on examination;

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Article 48. Decisions on organizational and operational issues of the People's Procuracy

The Standing Committee of the National Assembly decides on the establishment and dissolution of the High People's Procuracy, Provincial People's Procuracy, County People's Procuracy, Military Regional Procuracy and equivalent procuracies, Military Area Procuracy; working machinery of the Supreme People's Procuracy, Central Military Procuracy; total staffing, number of Prosecutors; ratio structure of each rank of Prosecutor at each level of People's Procuracy, Military Procuracy; ratio structure of each rank of Investigators of the Supreme People's Procuracy, Central Military Procuracy; list of members of the Selection Council for Prosecutors of the Supreme People's Procuracy, members of the Inspection Committee of the Supreme People's Procuracy; appointment criteria, promotion conditions for Investigating Officers of the People's Procuracy; salary system for Prosecutors, Investigators, Investigating Officers of the People's Procuracy; distribution and use system of uniforms of the People's Procuracy sector, insignia, badges of leaders of People's Procuracies at all levels, of Prosecutors, Investigators, Investigating Officers; form, size, color of Prosecutor Identification Card according to the following procedures:

1. The Chief of the Supreme People's Procuracy submits a proposal and draft resolution;

2. The Committee for Judicial Affairs of the National Assembly submits a report on examination;

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Article 49. Decisions on the number of subordinate units of the State Audit Office; staffing and establishment, merger, dissolution of subordinate units of the State Audit Office

The Standing Committee of the National Assembly examines and decides on the number of subordinate units of the State Audit Office; staffing and establishment, merger, dissolution of subordinate units of the State Audit Office according to the following procedures:

1. The State Auditor shall submit a proposal and draft resolution;

2. The Legal Affairs Committee of the National Assembly shall submit a report on examination;

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Article 50. Provisions on the organizational structure, tasks, and powers of the National Assembly Office, the Secretariat, and agencies under the Standing Committee of the National Assembly; reviewing and deciding on the staffing of cadres and civil servants in the National Assembly Office; reviewing and deciding on the staffing of civil servants, the total number of officials and employees working at the Institute for Legislative Research.

The Standing Committee of the National Assembly reviews and decides on the organizational structure, tasks, and powers of the National Assembly Office, the Secretariat, and agencies under the Standing Committee of the National Assembly; reviews and decides on the staffing of cadres and civil servants in the National Assembly Office; reviews and decides on the staffing of civil servants, the total number of officials and employees working at the Institute for Legislative Research according to the following procedures:

1. The Secretary-General of the National Assembly - Head of the National Assembly Office, the head of the agency under the Standing Committee of the National Assembly submits the proposal and draft resolution.

2. The Legal Affairs Committee of the National Assembly shall submit a report on examination;

Section 4. REVIEWING AND DECIDING ON IMPORTANT MATTERS WITHIN THE AUTHORITY OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

Article 51. Organizing public opinion polls

The Standing Committee of the National Assembly organizes public opinion polls according to the decision of the National Assembly in accordance with the procedures and formalities prescribed in the Law on Public Opinion Polls.

Article 52. Giving opinions on negotiations, signing, and ratifying international treaties

1. The Standing Committee of the National Assembly gives opinions on signing international treaties that contain provisions contrary to ordinances, resolutions of the Standing Committee of the National Assembly, international treaties whose implementation requires amendments, supplements, abolition, issuance of ordinances, and resolutions of the Standing Committee of the National Assembly according to the following procedures:

a) The authority with the power to decide on signing international treaties submits the proposal on signing the international treaty.

b) The Foreign Affairs Committee of the National Assembly submits the report on examination.

c) The Standing Committee of the National Assembly discusses;

d) The chairperson of the session summarizes the opinions expressed.

2. The Standing Committee of the National Assembly gives opinions on presenting to the National Assembly for approval, decision to join or terminate the effect of international treaties according to the following procedures:

a) The Government submits the proposal.

b) The Foreign Affairs Committee of the National Assembly submits the report on examination.

c) The Standing Committee of the National Assembly discusses;

d) The chairperson of the session summarizes the opinions expressed.

Article 53. Reviewing the Government's report on foreign affairs work

The Standing Committee of the National Assembly reviews the Government's report on foreign affairs work according to the following procedures:

1. The Government submits the report.

2. The Foreign Affairs Committee of the National Assembly shall submit a report on examination;

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed.

Article 54. Giving opinions on issues related to fundamental foreign policy of the State

The Standing Committee of the National Assembly gives opinions on issues related to fundamental foreign policy of the State before presenting to the National Assembly according to the following procedures:

1. The Government submits the report.

2. The Foreign Affairs Committee of the National Assembly shall submit a report on examination;

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed.

Article 55. Deciding to host the organization of conferences of world and regional inter-parliamentary organizations in Vietnam; deciding on the establishment, organization, and operation of the Vietnam Friendly Parliamentarian Organization

The Standing Committee of the National Assembly reviews and decides to host the organization of conferences of world and regional inter-parliamentary organizations in Vietnam; decides on the establishment, organization, and operation of the Vietnam Friendly Parliamentarian Organization according to the following procedures:

1. The Foreign Affairs Committee of the National Assembly submits the proposal and draft resolution.

2. The Standing Committee of the National Assembly discusses;

3. The chairperson of the session summarizes the opinions expressed and states the content for the Standing Committee of the National Assembly to vote on;

4. The Standing Committee of the National Assembly votes to approve the resolution.

Article 56. Reviewing the results of foreign affairs activities and international cooperation; approving the annual foreign affairs and international cooperation program of the Standing Committee of the National Assembly

1. The Foreign Affairs Committee compiles the results of visits and work of the National Assembly Delegation abroad and foreign National Assembly Delegations, international organizations visiting and working with the Vietnamese National Assembly, and reports to the Standing Committee of the National Assembly in the annual report on the results of foreign affairs activities of the National Assembly. In cases of necessity, the Foreign Affairs Committee reports to the Standing Committee of the National Assembly about important foreign affairs activities at the nearest session.

2. The Standing Committee of the National Assembly reviews and approves the report evaluating the results of foreign affairs activities; proposes the annual foreign affairs program of the Standing Committee of the National Assembly at the end-of-year session according to the following procedures:

a) The Foreign Affairs Committee of the National Assembly submits the Report on Evaluating the Results of Foreign Affairs Activities; proposes the annual foreign affairs program of the Standing Committee of the National Assembly.

b) The National Assembly Office submits the Report on Evaluating the Implementation of the International Cooperation Program; proposes the annual international cooperation program of the Standing Committee of the National Assembly.

c) The Standing Committee of the National Assembly discusses;

d) The chairperson of the session summarizes opinions expressed, presents the content for the Standing Committee of the National Assembly to vote on;

d) The Standing Committee of the National Assembly votes to approve the annual foreign affairs program and the annual international cooperation program of the Standing Committee of the National Assembly.

Article 57. Deciding on the principles, criteria, and budget allocation standards for state budgets; supplementing the budget estimate for increased state budget revenues; allocating and using increased revenues and savings from central government expenditures.

The Standing Committee of the National Assembly shall examine and decide on the principles, criteria, and budget allocation standards for state budgets; supplementing the budget estimate for increased state budget revenues; allocating and using increased revenues and savings from central government expenditures according to the following procedures:

1. The Government shall submit a proposal and draft resolution;

2. The Finance and Budget Committee of the National Assembly shall submit a report on examination.

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Article 58. Deciding on adjustments to medium-term and annual investment plans for state budget capital, national treasury capital, and government bond capital among ministries, sectors, and localities.

The Standing Committee of the National Assembly shall examine and decide on adjustments to medium-term and annual investment plans for state budget capital, national treasury capital, and government bond capital among ministries, sectors, and localities according to the following procedures:

1. The Government shall submit a proposal and draft resolution;

2. The Finance and Budget Committee of the National Assembly shall submit a report on examination.

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Article 59. Giving opinions on important budget expenditure systems with wide-ranging impacts related to the implementation of national socio-economic tasks.

The Standing Committee of the National Assembly shall give opinions on important budget expenditure systems with wide-ranging impacts related to the implementation of national socio-economic tasks according to the following procedures:

1. The Government submits a proposal;

2. The Finance and Budget Committee of the National Assembly shall submit a report on examination.

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed.

Article 60. Declaring a state of war.

1. The Standing Committee of the National Assembly shall declare a state of war when the National Assembly cannot convene according to the following procedures:

a) The National Defense and Security Council shall submit a proposal and draft resolution;

b) The National Defense and Security Committee of the National Assembly shall submit a report on examination.

c) The Standing Committee of the National Assembly discusses;

b) The Chairperson of the session shall synthesize the opinions expressed and present the content for the Standing Committee of the National Assembly to vote on.

e) The Standing Committee of the National Assembly votes to approve the resolution.

2. The Secretary-General of the National Assembly shall organize a press conference to announce the resolution of the Standing Committee of the National Assembly.

Article 61. Deciding on military ranks and the highest rank for positions and titles of officers at the general level in newly established units.

The Standing Committee of the National Assembly shall decide on military ranks and the highest rank for positions and titles of officers at the general level in newly established units according to the following procedures:

1. The Government shall submit a proposal and draft resolution;

2. The National Defense and Security Committee of the National Assembly shall submit a report on examination.

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Article 62. Deciding on general mobilization or partial mobilization; declaring and lifting a state of emergency nationwide or in specific localities.

1. The Standing Committee of the National Assembly shall decide on general mobilization or partial mobilization according to the following procedures:

a) The National Defense and Security Council or the Prime Minister shall submit a proposal and draft resolution;

b) The National Defense and Security Committee of the National Assembly shall submit a report on examination;

c) The Standing Committee of the National Assembly discusses;

d) The chairperson of the session summarizes opinions expressed, presents the content for the Standing Committee of the National Assembly to vote on;

e) The Standing Committee of the National Assembly votes to approve the resolution.

2. The Standing Committee of the National Assembly shall declare and lift a state of emergency nationwide or in specific localities according to the following procedures:

a) The Prime Minister shall submit a proposal and draft resolution;

b) The Ethnic Council, the Committee of the National Assembly assigned to lead the examination shall submit a report on examination;

c) The Standing Committee of the National Assembly discusses;

d) The chairperson of the session summarizes opinions expressed, presents the content for the Standing Committee of the National Assembly to vote on;

e) The Standing Committee of the National Assembly votes to approve the resolution.

3. The Secretary-General of the National Assembly shall organize a press conference to announce the resolution of the Standing Committee of the National Assembly.

Article 63. Directing and ensuring conditions for the operation of National Assembly deputies.

The Standing Committee of the National Assembly shall adopt a resolution directing and ensuring conditions for the operation of National Assembly deputies according to the following procedures:

1. The main drafting agency shall submit a proposal and draft resolution;

2. The Ethnic Council, the Committee of the National Assembly assigned to lead the examination shall submit a report on examination;

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Article 64. Regulations on the system, policies, and conditions to ensure the operation of National Assembly delegates

The Standing Committee of the National Assembly shall examine and establish the system, policies, and conditions to ensure the operation of National Assembly delegates according to the following procedures:

1. The Government shall submit a proposal and draft resolution;

2. The Finance and Budget Committee of the National Assembly shall submit a report on examination.

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Article 65. Decision on the system and policies for the cadre, civil servants, public officials, and other employees of the National Assembly Office and agencies under the Standing Committee of the National Assembly

The Standing Committee of the National Assembly shall examine and decide on the system and policies for the cadre, civil servants, public officials, and other employees of the National Assembly Office and agencies under the Standing Committee of the National Assembly according to the following procedures:

1. The National Assembly Office shall submit a proposal and draft resolution;

2. The Finance and Budget Committee of the National Assembly shall submit a report on examination.

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Article 66. Regulations on salary, allowances, uniforms, and preferential treatment for cadres and civil servants of the State Audit Agency

The Standing Committee of the National Assembly shall examine and establish regulations on salary, allowances, uniforms, and preferential treatment for cadres and civil servants of the State Audit Agency according to the following procedures:

1. The State Audit Agency shall submit a proposal and draft resolution;

2. The Finance and Budget Committee of the National Assembly shall submit a report on examination.

3. The Standing Committee of the National Assembly discusses;

4. The chairperson of the session summarizes the opinions expressed and presents the content for the Standing Committee of the National Assembly to vote;

5. The Standing Committee of the National Assembly shall vote to pass the resolution;

Section 5. IN OTHER AREAS

Article 67. Decision on the annual work program of the Standing Committee of the National Assembly

The Standing Committee of the National Assembly shall decide on the annual work program at the last session of the previous year according to the following procedures:

1. The Secretary-General of the National Assembly shall submit the draft program;

2. The Standing Committee of the National Assembly discusses;

3. The chairperson of the session summarizes the opinions expressed and states the content for the Standing Committee of the National Assembly to vote on;

4. The Standing Committee of the National Assembly shall vote to approve the program.

Article 68. Preparation of the agenda for the National Assembly sessions

1. The Standing Committee of the National Assembly shall examine the preparation of the proposed agenda for the National Assembly sessions according to the following procedures:

a) The Secretary-General of the National Assembly shall submit a proposal and the proposed agenda for the National Assembly sessions;

b) The Standing Committee of the National Assembly discusses;

c) The chairperson of the meeting shall compile the opinions expressed.

2. The preparation of the proposed agenda for the National Assembly sessions shall be examined by the Standing Committee of the National Assembly regarding the content; details about the duration, timing of consideration, and decision-making for specific contents; the incorporation of opinions from the Delegations of National Assembly deputies and National Assembly deputies to revise the proposed agenda for the National Assembly sessions.

The Secretary-General of the National Assembly shall organize the incorporation and revision of the proposed agenda and send it to solicit opinions from the Delegations of National Assembly deputies and National Assembly deputies no later than 30 days before the opening day of the session.

3. The Standing Committee of the National Assembly shall submit the work program of the session to the National Assembly for approval at the preparatory session of the National Assembly and organize its implementation according to the procedures and formalities stipulated in the Rules of Procedure of the National Assembly Session.

Article 69. Summary of the National Assembly session

1. The Standing Committee of the National Assembly shall organize the summary of the National Assembly session according to Article 13 of the Rules of Procedure of the National Assembly Session.

2. The Standing Committee of the National Assembly shall summarize the National Assembly session according to the following procedures:

a) The Secretary-General of the National Assembly shall submit the draft Report on the summary of the National Assembly session;

b) The Standing Committee of the National Assembly discusses;

c) The chairperson of the meeting shall compile the opinions expressed.

3. The Secretary-General of the National Assembly shall organize the incorporation and revision of the Report on the summary of the National Assembly session according to the opinions of the Standing Committee of the National Assembly, submit it for examination and signature issuance by the Chairman of the National Assembly.

4. The report of the Standing Committee of the National Assembly on the summary of the National Assembly session shall be sent to National Assembly deputies, relevant agencies, and organizations.

Article 70. Guidance, coordination, and cooperation in the activities of the Ethnic Councils and Committees of the National Assembly

The Standing Committee of the National Assembly shall guide, coordinate, and cooperate in the activities of the Ethnic Councils and Committees of the National Assembly according to Article 52 of the Law on the Organization of the National Assembly.

Chapter IV

RELATIONSHIP OF WORK OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

Article 71. Working Relations with the President

The President has the right to attend sessions of the Standing Committee of the National Assembly and express opinions on issues within the session's agenda.

When necessary, the Chairman of the National Assembly works with the President to coordinate work in the performance of their duties and powers.

Article 72. Working Relations with the Government and the Prime Minister

1. The Prime Minister may be invited to attend sessions of the Standing Committee of the National Assembly and express opinions on issues within the session's agenda. Ministers and other members of the Government may be invited to attend sessions of the Standing Committee of the National Assembly and express opinions on issues related to their assigned areas of responsibility.

2. The Standing Committee of the National Assembly informs the Prime Minister about its program of activities, resolutions, decisions, and conclusions of the National Assembly and the Standing Committee of the National Assembly that fall under the responsibility of the Government and the Prime Minister.

3. The Government reports to the Standing Committee of the National Assembly on its work program and the implementation thereof on a monthly, quarterly, and annual basis.

4. When necessary, the Chairman of the National Assembly works with the Prime Minister regarding the implementation of laws, ordinances, and resolutions of the National Assembly and the Standing Committee of the National Assembly, and other related issues.

Article 73. Working Relations with the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, and the State Auditor General

1. The Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, and the State Auditor General may be invited to attend sessions of the Standing Committee of the National Assembly and express opinions on related issues.

2. The Standing Committee of the National Assembly informs the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, and the State Auditor General about its program of activities, resolutions, decisions, and conclusions of the National Assembly and the Standing Committee of the National Assembly that fall under the responsibility of the Supreme People's Court, the Supreme People's Procuracy, and the State Audit Office.

3. Annually, the Supreme People's Court, the Supreme People's Procuracy, and the State Audit Office report to the Standing Committee of the National Assembly on their work programs and the implementation thereof.

4. When necessary, the Chairman of the National Assembly works with the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, and the State Auditor General regarding the implementation of laws, ordinances, and resolutions of the National Assembly and the Standing Committee of the National Assembly, and other related issues.

Article 74. Working Relations with the Chairman of the Central Committee of the Vietnam Fatherland Front and Heads of Member Organizations of the Front

1. The Chairman of the Central Committee of the Vietnam Fatherland Front and heads of member organizations of the Front may be invited to attend sessions of the Standing Committee of the National Assembly on related issues and have the right to express opinions.

2. The Standing Committee of the National Assembly coordinates with the Central Committee of the Vietnam Fatherland Front to receive and compile opinions of voters sent by National Assembly deputies, National Assembly Delegations, Vietnam Fatherland Front Committees at all levels, and member organizations of the Front for reporting to the National Assembly.

3. When necessary, the Standing Committee of the National Assembly requests the Central Committee of the Vietnam Fatherland Front and member organizations of the Front to cooperate in organizing public opinion surveys on draft Constitutions, laws, and ordinances.

4. When necessary, the Chairman of the National Assembly works with the Chairman of the Central Committee of the Vietnam Fatherland Front to coordinate work in the performance of their duties and powers.
