NATIONAL SCIENCE AND TECHNOLOGY POLICY COUNCIL

 PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decision No. 1077/1997/QĐ-TTg dated December 12, 1997 of the Prime Minister on the establishment of the National Science and Technology Policy Council;

Approves the Agreement between the Government of the Socialist Republic of Vietnam and the Government of the Argentine Republic on cooperation in the use of nuclear energy for peaceful purposes, signed in Hanoi on November 19, 2001.

DECISION:

Article 1. Approves the Regulation on the Organization and Operation of the National Science and Technology Policy Council.

Article 2. This Decision takes effect from the date of signature. The Decision No. 105/CT dated March 30, 1992 regarding the appointment of the Chairman and Vice Chairmen of the National Science and Technology Policy Council and the approval of the Regulation on the Organization and Working Procedures of the National Science and Technology Policy Council is hereby abolished.

Article 3. The National Science and Technology Policy Council, Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the central city administrations related to this matter shall be responsible for implementing this Decision./.

REGULATIONS

ORGANIZATION AND OPERATION OF THE NATIONAL SCIENCE AND TECHNOLOGY POLICY COUNCIL
NATIONAL SCIENCE AND TECHNOLOGY

(Approved by Decision No. 1078-1997/QĐ-TTg
dated December 12, 1997 of the Prime Minister)

 

PART I
FUNCTIONS, DUTIES, AND LIMITS OF THE NATIONAL SCIENCE AND TECHNOLOGY POLICY COUNCIL

NATIONAL SCIENCE AND TECHNOLOGY

Article 1. The National Science and Technology Policy Council is an advisory body to the Prime Minister on important issues related to the development of science and technology.

Article 2. The National Science and Technology Policy Council has the duty to provide opinions to the Prime Minister before making decisions on:

1. Directions and strategies for the development of science and technology, priority fields of science and technology at each period.

2. Major policies to promote the development of science and technology.

3. Draft regulatory documents of the State on science and technology.

4. Major targets of the five-year and annual science and technology plans.

5. National-level science and technology programs.

6. Other important issues related to science and technology requested by the Prime Minister to participate in providing opinions or deemed necessary by the Council to recommend to the Prime Minister.

Article 3. The term of office of the National Science and Technology Policy Council is five years. The appointment and change of members of the Council are decided by the Prime Minister.

Article 4. The National Science and Technology Policy Council consists of a Chairman, one Vice Chairman, and members.

Duties of the Chairman of the Council:

Lead the Council's activities according to the functions, duties, and powers stipulated in Article 1 and Article 2 of Chapter I of this Regulation.

Prepare the content of issues to be discussed at the Council.

Convene and chair meetings of the Council.

Duties of the Vice Chairman of the Council:

Assist the Chairman in leading the general work of the Council and bear responsibility to the Chairman for the part of work assigned to him/her.

Represent the Chairman in managing and resolving matters within the Chairman's authority when the Chairman is absent.

Duties of Council Members:

Fully participate in all sessions of the Council.

Prepare well to contribute opinions on issues put forward for discussion at Council sessions or provide opinions on documents sent by the Chairman and Vice Chairman of the Council.

Safeguard all confidential materials and data according to the common regulations of the State and the Council.

Article 5. Powers of Council Members.

1. To be provided with necessary information about national economic and social issues, science and technology, and to have access to relevant documents and data related to the content of Council sessions.

2. To be guaranteed necessary working conditions according to the prescribed regime to fulfill the duties stipulated in Article 1 and Article 2 of Chapter I of this Regulation.

Article 6. The National Science and Technology Policy Council has an office assisting its work located at the Ministry of Science, Technology, and Environment with a lean staff included in the total staffing of the Ministry of Science, Technology, and Environment.

Duties of the Office of the National Science and Technology Policy Council:

Prepare the content, program, and working documents for Council sessions according to the guidance of the Chairman.

Record minutes of Council sessions.

Carry out tasks related to Council work between sessions as assigned by the Council.

Maintain records and perform clerical work for the Council.

 

PART II

METHODS OF OPERATION AND WORKING RELATIONSHIPS
OF THE NATIONAL SCIENCE AND TECHNOLOGY POLICY COUNCIL

, Clause 1, Clause 2 Article 7a of this Regulation.Members of the National Science and Technology Policy Council operate as individual scientists, not representing the agencies or organizations where they work.

Article 8. The method of operation of the National Science and Technology Policy Council is to discuss, provide opinions, and vote to select the opinion that receives majority support as the Council's general recommendation; at the same time, other opinions must also be fully recorded in the session minutes.

Recommendations and minutes of Council sessions are fully transmitted to the Prime Minister with the signature of the Chairman and the secretary of the session.

Article 9. The National Science and Technology Policy Council convenes regularly once every six months.

When there is necessary work according to the request of the Prime Minister, the Chairman may convene extraordinary sessions.

Article 10. A session of the National Science and Technology Policy Council must have at least two-thirds of the total number of Council members present.

When necessary, the Prime Minister, Deputy Prime Minister in charge of science and technology, and the Minister of Science, Technology, and Environment will attend Council sessions.

Depending on the content of the session, the Chairman may invite representatives of related agencies to attend. These representatives do not participate in voting on Council issues.

Article 11. Documents of National Science and Technology Policy Council sessions are transferred by the Council Office to Council members for study at least two weeks before the meeting; for extraordinary sessions, at least two days before the meeting.

Article 12. As the advisory body to the Prime Minister, the National Science and Technology Policy Council carries out its activities in close coordination with the Ministry of Science, Technology and Environment and other state management agencies regarding national issues related to the development of science and technology, particularly those affecting the development of the national economy.

Article 13The operating budget of the National Science and Technology Policy Council is allocated from the portion designated for scientific endeavors in the State Budget, channeled through the Ministry of Science, Technology and Environment.

 

CHAPTER III
FINAL PROVISIONS

Article 14Any amendments or supplements to this Regulation shall be proposed by the National Science and Technology Policy Council, submitted by the Minister of Science, Technology and Environment for consideration and approval by the Prime Minister.

Article 15. This Regulation takes effect from the date of signature, all provisions contrary to this Regulation are hereby abolished./.
