DECREE

Guidelines for declaring assets for candidates for People's Council deputies at all levels

THE GOVERNMENT

        Pursuant to the Law on Government Organization dated December 25, 2001;

        Pursuant to the Law on Election of People's Council Deputies dated November 26, 2003;

        Pursuant to Resolution No. 487/2004/NQ-UBTVQH11 dated March 17, 2004 of the Standing Committee of the National Assembly;
        Considering the proposal of the State Auditor General,

DECREE

Article 1. Candidates for People's Council deputies at all levels must fully, accurately, and truthfully declare their types of assets according to the form issued together with Resolution No. 487/2004/NQ-UBTVQH11 dated March 17, 2004 of the Standing Committee of the National Assembly, and shall be responsible for the contents of their declarations.

Article 2. The People's Councils and People's Committees at all levels shall coordinate with the Vietnam Fatherland Front at the same level to direct the election councils to organize asset declarations for candidates for People's Council deputies at their respective levels.

The asset declaration forms shall be submitted along with the candidates' application files and managed and used in accordance with regulations governing the management and use of election files.

Article 3. In cases where there are questions, complaints, or reports regarding the asset declarations of candidates for People's Council deputies at all levels, they shall be resolved in accordance with the provisions of the Law on Election of People's Council Deputies.

Article 4. Strictly prohibited are acts of distorting the contents, loss, damage, provision to unauthorized persons, or illegal exploitation and use of asset declaration forms; violators shall be subject to disciplinary action or criminal liability as provided by law depending on the nature and severity of the violation.

Article 5. This Decree shall take effect fifteen days from the date of publication in the Official Gazette.

Article 6. The People's Councils and People's Committees at all levels are responsible for implementing this Decree.
