Pursuant to the Law on Fees and Registration Fees dated November 25, 2015;
Pursuant to the State Budget Law dated June 25, 2015;
Pursuant to Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Fees and Charges;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Implementing Directive No. 26/CT-TTg dated June 6, 2017 of the Prime Minister on continuing to effectively implement Resolution No. 35/NQ-CP dated May 16, 2016 in the spirit of the Government accompanying businesses;
The Minister of Finance hereby issues this Circular amending and supplementing Article 3 of Circular No. 187/2016/TT-BTC dated November 8, 2016 regarding the level of collection, collection regime, payment, exemption, management, and use of fees for the exploitation and utilization of national remote sensing data.
At the proposal of the Director of the Department of Tax Policy,
Article 1. Amend and supplement Article 3 of Circular No. 187/2016/TT-BTC dated November 8, 2016 as follows:
1. The level of fees for the exploitation and utilization of national remote sensing data is specified in the Fee Collection Table attached to this Circular. In cases where the remote sensing data is three years (36 months) or more from the date of provision, the fee level shall be 50% of the corresponding level specified in the Fee Collection Table attached to this Circular.
"Article 3. Level of Fees and Exemptions
2. The fee level for the exploitation and utilization of national remote sensing data for purposes of security, defense, or in emergency situations shall be 60% of the fee level stipulated in Clause 1 of this Article.
3. Exemption from the fee for the exploitation and utilization of national remote sensing data for direct requirements of Party and State leadership.
1. This Circular takes effect from December 1, 2017.
Article 2. Implementation
This Circular takes effect from December 1, 2017.
During implementation, if any difficulties arise, organizations and individuals are requested to promptly reflect them to the Ministry of Finance for study and supplementary guidance./.
