DECISION OF THE PRIME MINISTER
Regarding the establishment of standards and quotas for the use of passenger cars in the People's Public Security force
The People's Public Security force is equipped with passenger cars for use in combat and work tasks, including:
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Decree No. 14/1998/NĐ-CP dated March 6, 1998 on state asset management;
Pursuant to Decision No. 122/1999/QĐ-TTg dated May 10, 1999 of the Government Chairman regarding the establishment of standards and quotas for the use of passenger cars in administrative agencies, public service organizations, and state-owned enterprises;
At the proposal of the Minister of Public Security,
DECISION:
Article 1. Units within the People's Public Security force that are equipped with passenger cars are those units specified in the Government's Decree on the functions, tasks, authorities, organizational structure of the Ministry of Public Security, and other Government Decrees related to the organization of the Public Security force (referred to as the People's Public Security force).
Article 2. Passenger cars provided for the People's Public Security force to perform combat and work tasks include:
1. Passenger cars with up to 15 seats: Cars used to serve leaders (service cars); Cars used to ensure command tasks (command cars); Cars used to serve officers and soldiers on business trips (business cars).
2. Passenger cars for operational work, specialized vehicles, and transport vehicles. These types of passenger cars are purchased from state budget funds, originating from the state budget (including aid and gifts from domestic and foreign organizations and individuals, or established as state property according to the provisions of the law, completed programs and projects, transfers), and purchased using state-owned enterprise funds.
Article 3.
1. Passenger cars in the People's Public Security force are managed and used under the state asset management system and in accordance with the standards and quotas prescribed in this Decision.
2. Units equipped with passenger cars may not sell, give away, or transfer ownership or usage rights to other organizations or individuals without permission from the Minister of Public Security.
Article 4.
1. Officials holding the following positions are entitled to use one small passenger car during their term of office:
Minister.
Deputy Minister.
Director General.
Officials holding the rank of general who do not hold the aforementioned management positions.
2. Scientists meeting the criteria set forth in Decision No. 33/2001/QĐ-TTg dated March 13, 2001 of the The Prime Minister.
These passenger cars will be replaced when they have been used to a wear rate of 70% or more, or when they have been used for over 100,000 kilometers and are no longer safe to operate.
Article 5. Commanding officials holding the positions of Deputy Director General, Director, Deputy Director, Department Head, Deputy Department Head, Bureau Chief, Deputy Bureau Chief, Provincial Public Security Director, Deputy Provincial Public Security Director; University President, Deputy University President; Police Academy President; and equivalent positions are allocated passenger cars for business trips but are not provided with cars for daily transportation between home and workplace.
Article 6. Units within the People's Public Security force that are equipped with passenger cars to serve leadership, command, combat, and work tasks are listed in the attached table accompanying this Decision.
Article 7. Based on the functions, tasks, and operational requirements of each force and unit, the Minister of Public Security shall specify in detail the allocation of operational passenger cars, specialized vehicles, and transport vehicles within the People's Public Security force.
Article 8. The purchase of new passenger cars shall be carried out at the purchase price stipulated in Decision No. 122/1999/QĐ-TTg dated May 10, 1999 of the Government Chairman and the regulations of the Ministry of Finance.
When there is a need to purchase imported passenger cars, the Minister of Public Security shall submit the Prime Minister for decision.
Article 9. State-owned enterprises within the People's Public Security force are equipped with passenger cars in accordance with the standards and quotas prescribed in Article 15 of Decision No. 122/1999/QĐ-TTg dated May 10, 1999 of the Government Chairman.
Article 10. Annually, based on the number of existing passenger cars and the standards and quotas for their use as prescribed herein, the Minister of Public Security shall determine the needs and prepare budgets to purchase new, supplementary, and replacement passenger cars according to the regulations.
Article 11. Based on current regulations and the provisions of this Decision, the Minister of Public Security shall be responsible for:
1. Determining the level of allocation of passenger cars suitable for the operational requirements of each unit and locality within the Public Security force.
2. Adjusting and reallocating the existing passenger cars used by units in accordance with the provisions of this Decision.
3. Issuing regulations on the management and use of passenger cars throughout the Public Security force in accordance with the standards and quotas prescribed in this Decision.
Article 12. Individuals who issue procurement and usage decisions for passenger cars beyond their authority, not in accordance with standards, quotas, types, or value limits shall be subject to legal penalties depending on the severity of the violation.
Article 13. This Decision shall take effect fifteen days from the date of signature. All previous regulations that conflict with this Decision are hereby abolished.
Article 14. Ministers of the Ministries of Finance, Public Security, Planning and Investment, Chairmen of the People's Committees of provinces and centrally-administered cities, and relevant agencies are responsible for implementing this Decision./.
