Decision No. 109/2002/QĐ-TTg On the establishment of the Government Steering Committee for delimitation and demarcation of land borders between Vietnam and China

DECISION

Regarding the establishment of the Government Boundary Commission for delimitation and demarcation of the land border between Vietnam and ChinaTo implement the Resolution of the National Assembly on June 9, 2000 approving the Land Border Treaty between the Socialist Republic of Vietnam and the People's Republic of China; 

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

At the proposal of the Minister of Foreign Affairs and the Minister of Interior,

The Government Boundary Commission for delimitation and demarcation of the land border between Vietnam and China (hereinafter referred to as the Boundary Commission) shall be established with the following members:

DECISION:

Article 1. Chairman: Comrade Vu Khoan,

Deputy Prime Minister.Permanent member: Comrade Le Cong Phung, Deputy Minister of Foreign Affairs, Director of the Border Committee under the Ministry of Foreign Affairs.

- 1 Deputy Minister of Defense;

Members:

- 1 Deputy Minister of Planning and Investment;

- 1 Deputy Minister of Finance;

- 1 Deputy Minister of Public Security;

- 1 Deputy Head of the Government Office;

- 1 Deputy Minister of Agriculture and Rural Development;

- 1 Deputy Minister of Construction;

- 1 Deputy Minister of Natural Resources and Environment;

- 1 Commander of the Border Guard Force;

- Each of the provinces of Lai Chau, Lao Cai, Ha Giang, Cao Bang, Lang Son, and Quang Ninh: 1 Deputy Chairman of the Provincial People's Committee.

The Ministers, Heads of agencies, and Chairmen of the People's Committees of the aforementioned provinces shall report the names of the persons nominated to join the Boundary Commission to the Chairman of the Commission within ten days from the date this Decision takes effect.

The Boundary Commission has the following tasks and powers:

Article 2. 1. Directing the implementation of the Land Border Treaty between Vietnam and China, resolving remaining issues in the Land Border Treaty between Vietnam and China, and emerging issues during the process of delimitation and demarcation, proposing appropriate policies and measures to competent authorities of the Party and State;

2. Directing and resolving inter-ministerial issues and important contents in the process of delimitation and demarcation, coordinating border protection, ensuring national defense security, and strictly managing the border while promoting economic and social development in border areas;

3. Directing the formulation and implementation of an overall plan for delimitation and demarcation along the land border between Vietnam and China to accurately transfer the boundary line from the Treaty to the ground;

4. Directing bilateral negotiations to complete legal and technical documents, guiding ministries, sectors, and localities to fully implement the contents during the preparatory phase of delimitation and demarcation;

5. Directing, handling, inspecting, and supervising ministries, sectors, and localities in performing the assigned delimitation and demarcation tasks; organizing contracts among ministries, sectors, and localities to resolve emerging issues in the organization and implementation of delimitation and demarcation;

6. Directing the drafting and signing of the Supplementary Agreement and map of the land border between Vietnam and China; publishing the Supplementary Agreement and accompanying map; building a database for border management; directing localities to resolve issues related to land handover and adjustment according to the delimited and demarcated border line; 7. Organizing the delimitation and demarcation force including cadres and soldiers from relevant ministries, sectors, and localities who have high discipline, good professional qualifications, and sufficient strength to complete the assigned tasks;

8. Requesting ministries, sectors, and localities to report on the progress and results of delimitation and demarcation tasks, providing information related to complex emerging issues during the process of delimitation and demarcation; reporting periodic monthly, quarterly, and annual work and urgent, important issues exceeding the authority of the Commission to the Central Committee Secretariat and the Prime Minister.

The Border Committee under the Ministry of Foreign Affairs is the permanent body of the Government Boundary Commission for delimitation and demarcation.

The Government Boundary Commission for delimitation and demarcation may use the seals of the Government and the Ministry of Foreign Affairs, and have its own budget. The Chairman of the Commission shall issue regulations on the operation and use of the budget of the Commission.

Article 3. The Chairman of the Government Boundary Commission for delimitation and demarcation shall guide the establishment and direct the activities of the provincial Boundary Commissions and relevant ministries and sectors.

Article 4. The Government Boundary Delimitation and Marker Establishment Steering Committee uses the seals of the Government and the Ministry of Foreign Affairs, and has its own budget. The Chairman of the Steering Committee issues regulations on the operation and use of the budget of the Committee.

Article 5. The Chairman of the Government Boundary Delimitation and Marker Establishment Steering Committee guides the establishment and directs the operations of the boundary delimitation and marker establishment steering committees at local levels and relevant ministries and sectors.

Article 6. This Decision shall take effect from the date of signature. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of People's Committees of the provinces of Lai Chau, Lao Cai, Ha Giang, Cao Bang, Lang Son, and Quang Ninh are responsible for implementing this Decision.This Decision takes effect from the date of signature. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of the provinces of Lai Châu, Lào Cai, Hà Giang, Cao Bằng, Lạng Sơn, and Quảng Ninh are responsible for implementing this Decision.
