PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 15/2008/NĐ-CP dated February 4, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;.

Considering the proposal of the Minister of Foreign Affairs,

DECISION:

Article 1. Position and Functions

1. The State Reception Agency is an organization under the Ministry of Foreign Affairs, assisting the Minister of Foreign Affairs in performing state management functions regarding foreign reception work.

2. The State Reception Agency is a Class I Bureau, having legal personality, bearing the National Emblem seal, and being entitled to open accounts at the State Treasury in accordance with the provisions of the law, with its headquarters located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Advising and assisting the Minister of Foreign Affairs in researching, proposing, and drafting regulations on foreign reception work for the Minister of Foreign Affairs to issue or submit to competent authorities for issuance:

a) Studying Vietnamese and international reception practices;

b) Taking the lead and coordinating with relevant agencies in drafting legal normative documents on foreign reception work.

c) Taking the lead in drafting, guiding, and inspecting the implementation of regulations on diplomatic protocol in the reception of foreign guests.

d) Taking the lead and coordinating with relevant agencies in drafting, guiding, and inspecting the implementation of regulations and preferential treatment and exemption regimes for diplomatic missions, consular offices, United Nations agencies, and intergovernmental international organizations in Vietnam and their members.

đ) Taking the lead in drafting, guiding, and inspecting the implementation of regulations on correspondence in foreign relations.

2. Advising and assisting the Minister of Foreign Affairs in directing, guiding, and inspecting the implementation of legal normative documents on foreign reception work.

3. Proposing to the Minister of Foreign Affairs to advise Party and State leaders, the National Assembly, and the Government on foreign reception work:

a) Policies, plans, and measures to improve and enhance foreign reception work in line with the Party and State's foreign policy and international practices;

b) Diplomatic protocols in the reception of foreign guests and the organization of important events in Vietnam or abroad organized by Vietnam.

4. Implementing foreign reception work:

a) Taking the lead in reception and logistical arrangements for high-level delegations from foreign countries and international organizations visiting Vietnam at the invitation of State and Government leaders and guests invited by Party and National Assembly leaders when requested;

b) Taking the lead in reception and logistical arrangements for high-level delegations of State and Government leaders traveling to visit, work, or attend international conferences abroad and high-level delegations of Party and National Assembly leaders traveling to visit, work, or attend international conferences abroad when requested;

c) Taking the lead in reception for the organization of high-level international conferences hosted by the Vietnamese State in Vietnam;

d) Taking the lead in reception for the participation of Party, State, Government, and National Assembly leaders in foreign reception activities organized by diplomatic missions, consular offices, United Nations agencies, and intergovernmental international organizations in Vietnam;

đ) Taking the lead and coordinating with relevant agencies to organize attendance by heads of diplomatic missions, consular offices, United Nations agencies, and intergovernmental international organizations in Vietnam at events hosted by the Vietnamese State and Government;

e) Taking the lead and coordinating with relevant agencies to implement procedures for approval, response to approval, reception, and organization of the presentation of credentials and organization of visits by foreign special envoys to localities in Vietnam;

g) Taking the lead and coordinating with relevant agencies to manage and implement preferential treatment and exemption regimes for diplomatic missions, consular offices, United Nations agencies, and intergovernmental international organizations in Vietnam in accordance with Vietnamese laws, international treaties to which Vietnam is a party, and international practice;

h) Taking the lead and coordinating with relevant units of the Ministry of Foreign Affairs to carry out diplomatic reception procedures for the appointment of special envoys of the Socialist Republic of Vietnam to foreign countries and international organizations at the United Nations and intergovernmental international organizations;

i) Taking the lead and coordinating with relevant agencies to notify decisions of State and Government leaders and Vietnamese legal provisions related to foreign reception work to diplomatic missions, consular offices, United Nations agencies, and intergovernmental international organizations in Vietnam;

k) Guiding, managing, and coordinating with relevant agencies to ensure preferential treatment and exemption regimes granted by other countries to Vietnamese diplomatic missions abroad and at international organizations in compliance with international law;

l) Coordinating with relevant agencies to organize important events of Vietnam that invite senior international guests and diplomatic delegations.

5. Taking the lead and coordinating with relevant agencies to organize training in reception services for officials, civil servants, and employees in the Foreign Service, staff of Vietnamese diplomatic missions abroad, and other agencies and organizations upon request.

6. Managing organizational structures, staffing, finances, and assets allocated in accordance with the law and the delegation of the Ministry of Foreign Affairs.

7. Performing other tasks delegated or assigned by the Minister of Foreign Affairs.

đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;

1. Protocol Department.

2. Preferential Treatment and Exemption Department.

3. General Department - Research.

4. Office;

These organizations assist the Director of the State Reception Agency in performing state management functions.

The issuance of the operational regulations, specifying the functions, tasks, authorities, organizational structure, appointment, and removal of the heads and deputy heads of units under the National Reception Agency shall be carried out in accordance with the provisions of the law and the delegation of authority by the Minister of Foreign Affairs.

The staffing of officials, civil servants, and public employees of the National Reception Agency shall be decided by the Minister of Foreign Affairs within the total staffing quota of the Ministry of Foreign Affairs.

Article 4. Leadership of the Department

1. The National Reception Agency has a Director and not more than three Deputy Directors.

2. The Director shall be appointed and removed by the Minister of Foreign Affairs, who is responsible to the Minister of Foreign Affairs for all activities of the National Reception Agency.

3. The Deputy Directors shall be appointed, removed, and dismissed by the Minister of Foreign Affairs upon the proposal of the Director and are responsible to the Director for their assigned areas of work.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall revoke any previous provisions that conflict with this Decision.

2. The Ministers, Heads of Ministries at the level of ministerial departments, Heads of government agencies, Chairpersons of provincial People's Committees under the central government, the Director of the National Reception Agency, and related agencies, organizations, and individuals shall be responsible for implementing this Decision./.
