On supporting National Artisans and Outstanding Artisans with low income and difficult circumstances

Căn cứ Luật T, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP ficer Ch"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."pursuant to the Government's Resolution dated December 25, 2001;

Based on the Cultural Heritage Law dated June 29, 2000i and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law dated June 18, 2009;amendThe Minister of Labor, Invalids and Social Affairs,1 hereby promulgates this Decree on supporting National Artisans and Outstanding Artisans with low income and difficult circumstances., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP This Circular stipulates on classification, guidance, and support for technical specialties; technical catalogues; quality assessment of medical examination and treatment facilities; registration for health insurance medical examination and treatment and patient transfer among medical examination and treatment facilities under the Ministry of National Defense.onThis Decree stipulates monthly living allowances, health insurance, and funeral cost support for National Artisans and Outstanding Artisans with low income and difficult circumstances.amendArticle 1. National Artisans and Outstanding Artisans who have been conferred by the State and belong to households with average monthly per capita income lower than the minimum wage set by the Government (at the time of issuing this Decree, it is 1,150,000 VND), including:

At the proposal of the Minister of Finance,ina) Women aged 55 years or older and men aged 60 years or older without persons obligated to provide maintenance;

h"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."b) Persons with severe or extremely severe disabilities;ỗ c) Persons suffering from one of the diseases requiring long-term treatment as specified by the Ministry of Health;No.d) Other subjects not falling under the categories mentioned in Points a, b, and c above.. Article 2. Agencies, organizations, and individuals related to the implementation of support for National Artisans and Outstanding Artisans with low income and difficult circumstances as prescribed in this Decree.shall Article 3. Monthly Living Allowance Levels

Article 1. Scope of Regulation

1. A level of 1,000,000 VND shall be applied to subjects specified in Points a, b, and c Clause 1 Article 2 of this Decree belonging to households with average monthly per capita income below 50% of the minimum wage.

Article 2. Applicability

2. A level of 850,000 VND shall be applied to the following subjects:

a) Subjects specified in Points a, b, and c Clause 1 Article 2 of this Decree belonging to households with average monthly per capita income from 50% of the minimum wage up to but not exceeding the minimum wage;

b) Subjects specified in Point d Clause 1 Article 2 of this Decree belonging to households with average monthly per capita income below 50% of the minimum wage.

3. A level of 700,000 VND shall be applied to subjects specified in Point d Clause 1 Article 2 of this Decree belonging to households with average monthly per capita income from 50% of the minimum wage up to but not exceeding the minimum wage.

Article 4. Health Insurance

Subjects specified in Clause 1 Article 2 of this Decree shall be supported with health insurance as follows:

1. They shall be covered by the state budget for health insurance at the same contribution rate as those in poor households (the contribution rate at the time of issuing this Decree is 4.5% of the minimum wage set by the Government).

2. They shall enjoy health insurance benefits when seeking medical care at the same level as those in poor households according to the laws on health insurance.

When subjects specified in Clause 1 Article 2 of this Decree die, the agencies, organizations, or individuals directly organizing their funerals shall be supported with funeral costs amounting to 7,000,000 VND.

Article 5. Application Principles

Subjects specified in Clause 1 Article 2 of this Decree, if entitled to different levels of monthly allowances, health insurance, and funeral cost support under various documents, shall only be entitled to the highest level provided in one document.

3. The amount of seven hundred thousand dong shall be applied to the subjects specified in Point d Clause 1 Article 2 of this Decree who belong to households with average monthly per capita income from fifty percent of the minimum wage base to below the minimum wage base.

Article 4. Health Insurance

The subjects specified in Clause 1 Article 2 of this Decree shall be supported in health insurance as follows:

1. The State budget shall contribute to health insurance for them at the contribution rate applicable to persons belonging to poor households (the contribution rate at the time of issuance of this Decree is four point five percent of the minimum wage base as prescribed by the Government).

2. They shall enjoy health insurance when seeking medical treatment or receiving healthcare at the benefit level applicable to persons belonging to poor households under the laws on health insurance.

Article 5. Funeral Expense Support

When the subjects specified in Clause 1 Article 2 of this Decree die, the state shall support funeral expenses of seven million dong for the agencies, organizations, or individuals directly organizing the funeral.

Article 6. Principles of Application

The subjects specified in Clause 1 Article 2 of this Decree shall receive the highest monthly allowance, health insurance, and funeral expense support among different regulations with various levels, at one regulation.

Article 7. Documents for Monthly Living Allowance Benefit Review

1. The documents for monthly living allowance benefit include:

a) Application form for monthly living allowance benefit and health insurance according to Model No. 01 issued together with this Decree;

b) Certified copy from the original or copy (accompanied by the original for verification) of the Decision awarding the title "People's Artist" or "Outstanding Artist" of the person applying for monthly living allowance benefit and health insurance;

c) Certified copy from the original or copy (accompanied by the original for verification) of one of the following documents:

- Identity card for the subject specified in Point a Clause 1 Article 2 of this Decree;

- Disability certificate for the subject specified in Point b Clause 1 Article 2 of this Decree;

- Discharge certificate (in case of inpatient treatment) or Consultation Report or Consultation Minutes or Medical Record of the hospital or Health Examination and Treatment Booklet established and operated in accordance with the law on medical examination and treatment (in case of outpatient treatment) showing that the subject specified in Point c Clause 1 Article 2 of this Decree is being treated for a disease requiring long-term treatment.

2. The documents for requesting funeral cost support include:

a) Application form for funeral cost support of the organization, individual directly organizing the funeral according to Model No. 3a or No. 3b issued together with this Decree;

b) Certified copy from the original or copy (accompanied by the original for verification) of the Death Certificate issued by the competent authority.

Article 8. Adjustment, Suspension, Termination of Monthly Living Allowance Benefit; Suspension of Health Insurance Contributions, Recovery of Health Insurance Card

1. The adjustment of the monthly living allowance benefit level shall be implemented when there is a change in the type of subject specified in Clause 1 Article 2 of this Decree or a change in the average monthly income of the household.

2. Suspension of monthly living allowance benefit and temporary suspension of state health insurance contributions for the subjects specified in Clause 1 Article 2 of this Decree shall apply in the following cases:

a) Individuals serving a prison sentence;

b) Individuals subject to compulsory educational measures or compulsory drug rehabilitation measures under administrative violation handling laws.

3. Termination of monthly living allowance benefit and recovery of health insurance card for the subjects specified in Clause 1 Article 2 of this Decree shall apply in the following cases:

a) Individuals voluntarily submit a request to terminate the monthly living allowance benefit and health insurance;

b) Individuals no longer fall within the scope of subjects specified in Clause 1 Article 2 of this Decree;

c) Revocation of the Decision conferring the title or revocation of the state-awarded title;

d) Individuals who have died or been declared missing by the court;

đ) Individuals residing abroad.

Article 9. Procedures for Enjoyment, Adjustment, and Termination of Monthly Living Allowance Benefit

1. Enjoyment of Monthly Living Allowance Benefit

a) The subjects specified in Clause 1 Article 2 of this Decree shall submit one set of documents to the People's Committee of the commune, ward, town (hereinafter referred to as the commune level) where they are registered as permanent residents.

b) Within five working days from the date of receiving complete documents, the People's Committee at the commune level shall be responsible for checking and verifying against the originals the documents specified in Points b and c Clause 1 Article 7 of this Decree; establish a list of subjects applying for monthly living allowance benefit according to Model No. 05a issued together with this Decree and publicly display the list at the People's Committee office and through local information media; the public display period is ten days.

Within five working days from the end of the public display period, the People's Committee at the commune level shall issue a letter requesting the Chairman of the People's Committee at the district level to make a decision, accompanied by the list and documents of each eligible subject for monthly living allowance benefit; for those subjects not eligible for monthly living allowance benefit, a written notification shall be issued explaining the reasons to the subjects.

c) Within seven working days from the date of receiving complete documents, the Chairman of the People's Committee at the district level shall examine and issue a decision granting monthly living allowance benefit to eligible subjects; if the subjects are not eligible for monthly living allowance benefit, a written notification shall be issued explaining the reasons to the People's Committee at the commune level to inform the subjects.

2. Adjustment of Monthly Living Allowance Benefit

a) Individuals currently enjoying monthly living allowance benefit who need to adjust their benefit level according to Clause 1 Article 8 of this Decree shall submit one set of documents to the People's Committee at the commune level where they are registered as permanent residents, including: Application form for adjustment of monthly living allowance benefit according to Model No. 02 issued together with this Decree; certified copy from the original or copy (accompanied by the original for verification) of one of the documents related to the changes specified in Points b and c Clause 1 Article 7 of this Decree (if applicable).

b) Within five working days from the date of receiving complete documents, the People's Committee at the commune level shall be responsible for checking and verifying against the originals the documents specified in Points b and c Clause 1 Article 7 of this Decree; establish a list of subjects adjusting their monthly living allowance benefit according to Model No. 05b issued together with this Decree and publicly display the list at the People's Committee office and through local information media; the public display period is ten days.

Within five working days from the end of the public display period, the People's Committee at the commune level shall issue a letter requesting the Chairman of the People's Committee at the district level to make a decision, accompanied by the list and documents of each eligible subject for adjustment of monthly living allowance benefit; for those subjects not eligible for adjustment of monthly living allowance benefit, a written notification shall be issued explaining the reasons to the subjects.

c) Within seven working days from the date of receiving all necessary documents, the Chairman of the People's Committee at the district level shall examine and issue a decision to adjust the monthly living allowance for those who meet the conditions for adjustment of the monthly living allowance; in cases where the individual does not meet the conditions for adjustment of the monthly living allowance, a written notification with clear reasons shall be provided to the People's Committee at the commune level for responding to the individual.

3. Suspension of Monthly Living Allowance

a) The Chairman of the People's Committee at the commune level where the person receiving the monthly living allowance is registered as a permanent resident shall submit a written request to the People's Committee at the district level to decide on suspending the monthly living allowance when the person receiving the monthly living allowance must serve a prison sentence or is subject to compulsory educational measures or compulsory drug rehabilitation measures.

b) Within seven working days from the date of receipt of the written request from the Chairman of the People's Committee at the commune level, the Chairman of the People's Committee at the district level shall examine and issue a decision to suspend the monthly living allowance.

4. Termination of Monthly Living Allowance

a) A person voluntarily terminating the monthly living allowance shall submit a Request for Termination of Monthly Living Allowance according to Model 04 issued together with this Decree to the People's Committee at the commune level where they are registered as a permanent resident. Within five working days from the date of receipt of the Request for Termination of Monthly Living Allowance, the Chairman of the People's Committee at the commune level shall submit a written request to the People's Committee at the district level to decide on terminating the monthly living allowance. Within seven working days from the date of receipt of the written request from the Chairman of the People's Committee at the commune level, the Chairman of the People's Committee at the district level shall examine and issue a decision to terminate the monthly living allowance.

b) When the person receiving the monthly living allowance falls under any of the circumstances specified in Points b, c, d, and đ Clause 3 Article 8 of this Decree, the Chairman of the People's Committee at the commune level where the person receiving the monthly living allowance is registered as a permanent resident shall submit a written request to the People's Committee at the district level to decide on terminating the monthly living allowance. Within seven working days from the date of receipt of the written request from the Chairman of the People's Committee at the commune level, the Chairman of the People's Committee at the district level shall examine and issue a decision to terminate the monthly living allowance.

Article 10. Procedures and formalities for issuing health insurance cards, suspending health insurance contributions, and recovering health insurance cards

1. The procedures and formalities for issuing health insurance cards for the subjects specified in Clause 1 Article 2 of this Decree shall be carried out in accordance with the laws on health insurance as for members of poor households.

2. The procedures and formalities for the State to suspend health insurance contributions for the cases specified in Clause 2 Article 8, and to recover health insurance cards for the cases specified in Clause 3 Article 8 of this Decree shall be carried out in accordance with the laws on health insurance.

Article 11. Procedures and formalities for resolving funeral expense support

1. The organization, entity, or individual directly organizing the funeral shall submit one set of application documents for funeral expense support to the People's Committee at the district level where the funeral is organized.

2. Within seven working days from the date of receiving all necessary documents, the Chairman of the People's Committee at the district level shall decide on supporting funeral expenses; if the place where the funeral is organized is not within the district, county, town, or provincial city where the recipient of the monthly living allowance is registered, the decision on supporting funeral expenses must be sent to the People's Committee at the district level where the recipient of the monthly living allowance is registered.

Article 12. Implementation Funding

1. The state budget shall ensure the funding for implementing the monthly living allowance, health insurance, and funeral expense support as stipulated in this Decree.

2. The preparation, execution, and settlement of the budget for the monthly living allowance, health insurance, and funeral expense support shall be carried out in accordance with the laws on the state budget.

Article 13. Implementation Organization

1. The Ministry of Labor, Invalids, and Social Affairs shall implement inspections and audits of the implementation of the provisions of this Decree.

2. People's Committees of provinces and centrally governed cities shall be responsible for:

a) Organize the implementation of the provisions of this Decree;

b) Inspect and audit the implementation of the provisions of this Decree in localities;

c) No later than January 15 each year, compile the situation and report on the implementation of the provisions of this Decree in the previous year in the locality to the Ministry of Labor, Invalids, and Social Affairs.

Article 14. Effectiveness and responsibility for implementation

1. This Decree takes effect from January 1, 2016.

2. Point c Clause 1 Article 10 Decree No. 98/2010/NĐ-CP dated September 21, 2010 of the Government detailing the implementation of certain provisions of the Cultural Heritage Law and the Law amending and supplementing certain provisions of the Cultural Heritage Law shall cease to be effective from the date this Decree takes effect.

3. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decree./.
