DIRECTIVE

Regarding the drafting of the Competition and Anti-Monopoly Law

 

At its fourth session of the tenth term, the National Assembly issued Resolution No. 19/1998/QH10 on December 20, 1998, concerning the legislative program for Laws and Ordinances in 1999, assigning the Ministry of Trade to lead the drafting of the Competition and Anti-Monopoly Law project.

Competition and Monopoly are fundamental concepts closely associated with a market economy, thus legal provisions regarding competition and monopoly, once promulgated, will be significant legal institutions within the economic legal system, contributing to the establishment of a legal framework that ensures healthy, transparent, and highly effective economic relations while also ensuring strict state management, protecting public interests, and safeguarding the legitimate rights and interests of traders in business operations.

Therefore, following the Commercial Law, the Competition and Anti-Monopoly Law project is a major project of particular importance in the economic legal system, for which the Ministry of Trade has been assigned the responsibility to lead the drafting.

In accordance with Resolution No. 19/1998/QH10 of the tenth National Assembly dated December 20, 1998, to swiftly implement the drafting of the Competition and Anti-Monopoly Law project effectively and within the scheduled timeframe, the Minister of Trade issues the following directive:

1. The drafting team and editorial group must have detailed and specific plans for organizing research on information and materials related to the Law project, preparing outlines, compiling, and revising the draft, soliciting opinions from relevant agencies, organizations, and individuals, and other tasks supporting the drafting process.

2. Departments, Bureaus, Institutes, Committees, and Offices with leaders and specialists participating in the drafting team and editorial group must provide favorable conditions in terms of time and work to enable these leaders and specialists to participate in drafting the Law project according to schedule and ensure high quality.

3. The Ministry's Office must provide material support for the work of the drafting team and editorial group.

4. Departments, Bureaus, Institutes, Committees, and Offices under the Ministry must provide support and cooperate with the editorial group in exchanging and providing information related to the Law project.

The heads of the drafting teams, the Director of the Office, and the Directors of the Departments, Bureaus, and Institutes under the Ministry are responsible for implementing this Directive.
