 DIRECTIVE

ON INVESTING IN THE CONSTRUCTION OF OFFICE BUILDINGS FOR STATE MANAGEMENT ORGANIZATIONS

In recent years, the management of investment and construction of office buildings for agencies has initially become systematic, with construction quality being ensured; most projects for constructing new office buildings for agencies have implemented cost-saving measures in construction and equipment procurement, especially expensive equipment (such as elevators, central air conditioning systems...).

However, up to now, most Ministries, sectors, and localities still lack planning and plans for building office systems. The implementation of regulations on office construction by some Ministries, sectors, and localities is not strict. Only 166 out of 593 projects (accounting for 28%) for constructing new offices in provinces and centrally-administered cities from 1997 to 1999 complied with regulations; architectural management and construction unit prices are not stringent. The application of investment norms and design standards is inconsistent, leading to significant differences in investment costs, designs, construction scales, and capital investments among offices of certain agencies in the same area. Some agencies construct offices with overly large scales compared to usage norms.

Currently, many agency offices constructed long ago have severely deteriorated, failing to ensure safety for users or meet work requirements. Many agencies are renting or borrowing houses for work purposes, causing financial burdens on the state budget, thus the current need for investing in the construction of office buildings remains quite substantial.

State budget investment funds remain very limited and cannot meet the short-term requirements for constructing office buildings for Ministries, sectors, and localities. To ensure uniformity in managing office construction and common working conditions for state management agencies, the Prime Minister instructs Ministries, sectors, provincial people's committees under the Central Government to implement regulations on office construction as follows:

1. For agencies and units whose office buildings have severely deteriorated, failing to ensure safety, and whose current workspace area is below 70% of the standard stipulated in Decision No. 147/1999/QĐ-TTg dated July 5, 1999 of the Prime Minister, they must prepare project proposals for review and decision-making by competent authorities regarding renovation, upgrading, or supplementary construction according to current regulations.

2. For newly separated localities, newly established agencies without office buildings, currently renting, borrowing, or using temporary houses for work, based on approved urban planning, they should actively balance and mobilize various sources of funding for office construction but must not exceed the prescribed workspace area standards. If multiple agencies require new office construction, localities are encouraged to build inter-agency office complexes to save on investment capital.

3. For central agencies managed vertically (including overseas representative agencies), they must develop a system-wide office planning scheme consistent with staffing levels, current workspace area standards, and available funding sources. Utilizing model designs, they should construct durable office buildings suitable for local administrative district planning to save on investment capital and land use while ensuring compatibility in working conditions and interior furnishings between central and local agencies in the same area.

4. Starting from 2000, Ministers, Heads of Ministries equivalent to Ministries, and Chairpersons of provincial people's committees under the Central Government shall be responsible for investment policies, plans, and the use of allocated state budget funds and other lawful sources for new construction, repair, and maintenance of office buildings (excluding projects in Group A) for agencies and units under their management.

Office construction investment projects must comply with current investment and construction management regulations.

5. The Minister of Planning and Investment shall be responsible for monitoring and inspecting compliance with office construction regulations by Ministries, sectors, and localities; having the authority to request Ministers, Heads of Ministries equivalent to Ministries, and Chairpersons of provincial people's committees under the Central Government to review and adjust projects if new office construction arrangements by Ministries, sectors, and localities do not conform to regulations.

6. The Ministry of Construction shall promptly study and issue model designs for administrative office buildings as a basis for selection and construction.

7. By October each year, Ministers, Heads of Ministries equivalent to Ministries, and Chairpersons of provincial people's committees under the Central Government shall report to the Prime Minister on the implementation of office construction investment within their respective Ministries, agencies, and localities, simultaneously sending reports to the Ministry of Planning and Investment, the Ministry of Finance, and the Ministry of Construction.
