JOINT CIRCULAR

Guidelines for Adjusting Wages and Granting Allowances in Enterprises và cấp phó trong doanh nghiệp

Implementing Decree No. 10/2000/ND-CP dated March 27, 2000 of the Government on labor regulations stipulating the minimum wage in enterprises, after receiving opinions from the Vietnam General Confederation of Labor, the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Finance have issued guidelines for adjusting wages in enterprises as follows:

I. APPLICABLE OBJECTS

- Workers employed in state-owned enterprises operating under the Law on State-Owned Enterprises, including: production and trading enterprises; public welfare enterprises; enterprises under the armed forces; organizations and units permitted to engage in production, trading, and services under administrative agencies, public institutions, the Party, mass organizations, and associations that self-finance;

- Workers employed in enterprises operating under the Enterprise Law, including: Joint Stock Companies, Limited Liability Companies, Joint Ventures, and Private Enterprises;

(The above organizations are referred to collectively as enterprises)

II. METHODS FOR ADJUSTING WAGE LEVELS

1. For enterprises currently applying wage scales and allowances established by the State based on salary coefficients and ranks prescribed in Decree No. 26/CP dated May 23, 1993, Decree No. 110/1997/ND-CP dated November 18, 1997 of the Government, and the minimum level prescribed in Decree No. 10/2000/ND-CP dated March 27, 2000 of the Government, the base for calculating social insurance premiums, health insurance premiums, overtime pay, night work pay, continuous work pay, annual leave pay, and other benefits as prescribed by the State shall be adjusted as follows:

d. For industries where the State has specified bonus levels within the wage, they shall be recalculated based on the minimum wage of VND 180,000/month.

2. For state-owned enterprises when applying an adjustment factor not exceeding 1.5 times the general minimum wage set by the State (from January 1, 2000 to VND 180,000/month) as the basis for calculating unit prices for wages, they must ensure the conditions stipulated in Article 1 of Decree No. 28/CP dated March 28, 1997 of the Government and Circular No. 13/LDTBX-TT dated October 4, 1997 of the Ministry of Labor, War Invalids and Social Affairs guiding the method of building unit prices for wages and managing income in state-owned enterprises.

3. For enterprises that independently establish wage scales according to labor laws, the basis shall be the minimum wage of VND 180,000/month, and enterprises shall recalculate labor contracts, serving as the basis for payment, and adjust social insurance, health insurance, overtime pay, shift work pay, intermittent work pay, annual leave pay, and other benefits as prescribed by the State.

4. The meal allowance stipulated in Circular No. 15/1999/TT-BLDTBX dated June 22, 1999 of the Ministry of Labor, War Invalids and Social Affairs shall not exceed the minimum wage of VND 180,000/month from January 1, 2000.

III. IMPLEMENTATION

1. Ministries managing sectors, provincial people's committees directly under the central government, and chairmen of management boards of state-owned corporations 91/TTg are responsible for directing and supervising the implementation of this circular by enterprises in accordance with the correct provisions.

2. For state-owned enterprises, when determining unit prices for wages and calculating midday meals based on the minimum wage of VND 180,000/month in annual production and business plans, active measures should be taken to increase labor productivity, improve efficiency, link increases in workers' income to profit increases, and strengthen contributions to the State as prescribed in relevant documents.

3. This circular takes effect from January 1, 2000. Previous regulations contrary to those in this circular are abolished.

In the process of implementation, any questions or suggestions should be reported to the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Finance for consideration and resolution.
