MINISTER OF EDUCATION AND TRAINING

Pursuant to Government Decree No. 43/2000/NĐ-CP dated August 30, 2000 detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of Ministries and ministerial-level agencies;

At the proposal of the Director of the Personnel and Organization Department and the Director of the Secondary Education Department,

DECISION:

Article 1: Now hereby promulgates with this Decision the "Rules on the Organization and Operation of the Departmental Council".

Article 2: This Decision shall take effect fifteen days from the date of signature.

Article 3: The Heads of the Office, Directors of the Personnel and Organization Department, Planning and Finance Department, Secondary Education Department, Primary Education Department, Directors of Departments of Education and Training, and heads of related units are responsible for implementing this Decision.

REGULATIONS

Organization and operation of the Departmental Council


(Issued pursuant to Decision No. 11/2001/QD-BGDĐT dated April 16, 2001 of the Minister of Education and Training)

Chapter 1
FUNCTIONS, DUTIES AND RIGHTS OF THE DEPARTMENTAL COUNCIL

Article 1. Functions:

The Departmental Council is a specialized advisory body that provides opinions, identifies, proposes, and recommends to the Minister issues related to the content and teaching methods of subjects at various levels of general education.

Article 2. Duties:

1) Participate in evaluating the curriculum of subjects to ensure their scientific nature, pedagogical quality, systematic structure, and consistency within general education levels as well as in relation to other subjects and levels.

2) Participate in recommending authors to write textbooks, participate in evaluating textbooks, teaching guides, and models of teaching aids for subjects.

3) Participate in reviewing research works and topics on innovative teaching methods for subjects to be applied in general education schools.

4) Identify and propose issues related to the content and teaching methods of subjects in general education schools.

Article 3. Rights:

1) Propose and recommend to the Minister measures to ensure the scientific nature, pedagogical quality, and practicality of subject teaching in general education schools, thereby improving the quality and effectiveness of teaching.

2) Receive necessary information and materials from relevant units within the Ministry for the activities of the Council.

3) Visit classes, observe lessons of subjects in general education schools, and attend seminars on the content and teaching methods of subjects when necessary.

Chapter 2
ORGANIZATION OF THE DEPARTMENTAL COUNCIL

Article 4. The Departmental Council is organized according to each subject in general education schools.

Article 5. Members of the Departmental Council include:

- Chairperson of the Council

- Deputy Chairperson of the Council

- Secretary of the Council

- Council members.

The total number of Council members ranges from 5 to 21 (depending on the requirements of the subject). The Standing Body of the Council consists of the Chairperson, Deputy Chairperson, and Secretary. The members of the Council are decided by the Minister.

Article 6. Duties of the Chairperson of the Departmental Council:

1) Organize the implementation of the duties and rights of the Council, assign specific responsibilities to Council members; prepare the agenda and content of Council meetings.

2) Convene Council meetings or Standing Body meetings and decide on inviting collaborating members to attend meetings when necessary.

3) Handle matters related to the duties and rights of the Council between two meetings.

4) Approve reports, minutes, and recommendations of the Council after each meeting.

Article 7. Duties of the Deputy Chairperson of the Department Council:

The Deputy Chairperson of the Department Council is responsible for the tasks assigned by the Chairperson, represents the Chairperson to manage and resolve matters of the Council when the Chairperson is absent.

Article 8. Duties of the Secretary of the Department Council:

1) Assist the Chairperson and Deputy Chairperson of the Council in preparing the content, program, and working conditions for the meetings of the Council.

2) Record fully and faithfully all opinions expressed at the Council's meetings, draft minutes, write reports and recommendations of the Council for approval by the Chairperson and Deputy Chairperson of the Council.

3) Ensure regular communication between the Ministry and the Council, between the Chairperson, Deputy Chairperson, and members in the Council's common work, and working relations with relevant agencies.

Article 9. Members of the Department Council:

1- Members of the Department Council include:

a) Experts in the field, selected from within the Ministry's agencies, institutes, and schools under the Ministry, among excellent teachers or outstanding administrative staff at the grassroots level.

b) Depending on work requirements, the Minister may invite some experts from outside the Education and Training sector to be members of the Council, but not exceeding one quarter of the total number of Council members.

2- The selection of Council members must ensure the necessary requirements regarding qualifications, capacity (scientific and pedagogical), moral character, reputation, understanding of practical issues, and health conditions to participate in the Council's activities.

3- Members of the Department Council have the duty to participate in the implementation of the functions, duties, and powers of the Department Council according to the assignment by the Chairperson of the Council.

Article 10. Term of Office of the Department Council:

The term of office of the Department Council is a maximum of three years. During the term of the Council, missing members can be supplemented based on requirements and assigned tasks; members who fail to fulfill the tasks assigned by the Council will be proposed for removal by the General Meeting of the Council and decided upon by the Minister.

Chapter 3
WORKING PROCEDURES OF THE DEPARTMENT COUNCIL

Article 11. Regular Meetings:

The Council convenes regularly twice a year (at the end of the second and fourth quarters annually) called by the Chairperson of the Council and may convene extraordinary meetings at the request of the Minister.

Article 12. Content of Meetings (regular or extraordinary):

1) Review the work between two meetings and propose the content of activities until the next meeting.

2) Resolve urgent tasks assigned by the Minister (during extraordinary meetings).

3) Identify, propose, and recommend to the Minister issues related to the quality of teaching and learning in the subject.

4) Provide information on educational science related to the Council's tasks.

Article 13: In case it is impossible to organize a meeting, the Chairperson of the Department Council may seek opinions of the Council members on issues related to the Council's tasks.

Chapter 4
WORKING CONDITIONS OF THE DEPARTMENT COUNCIL

Article 14. Budget:

Financial resources ensuring the operation of the Department Councils are allocated in the state budget for the management expenses of the Ministry's agency and are used for the following expenditure items:

1) Remuneration for part-time labor, allowances for speakers and collaborators.

2) Expenses for organizing expert consultations.

3) Expenses for office supplies, travel expenses, and conference fees.

The expenditure, settlement, and finalization of the budget of the Department Council are carried out in accordance with current state regulations, standards, quotas, and provisions.

Article 15. Working means:

1. The Institute of Educational Science, the agency assigned the task of organizing the compilation of textbooks, and the Education Publishing House shall be responsible for providing timely and complete materials on current curricula and textbooks to the Subject Councils to serve their activities.

2. The Ministry's Office shall be responsible for arranging other necessary working conditions for the meetings of the Subject Councils.

Chapter 5
RELATIONSHIP WITH FUNCTIONAL UNITS

Article 16. The Primary Education Department and the Secondary General Education Department shall be responsible for informing the relevant Subject Councils of the Ministry’s work requirements, receiving proposals and recommendations from the Subject Councils for the Minister to consider and resolve.

Article 17. Functional units of the Ministry shall cooperate and create conditions for the Subject Councils to operate effectively in accordance with the spirit of this Regulation.
