DIRECTIVE

On Rectifying the Management and Utilization of Non-Governmental Foreign Aid

In recent times, since the implementation of the Regulation on the Management and Utilization of Non-Governmental Foreign Aid (annexed to Decision No. 64/2001/QD-TTg dated April 26, 2001 of the Prime Minister), the management and utilization of non-governmental foreign aid have generally shown positive changes, contributing to enhancing the effectiveness of this source of aid. However, during the implementation process, some ministries, sectors, localities, and mass organizations have not fully complied with the provisions of Decision No. 64/2001/QD-TTg of the Prime Minister, continuing to accept goods that have been used without quality confirmation; goods sent to Vietnam before being permitted by competent state authorities; some projects approved beyond their authority, and after approval, they did not submit (or submitted incomplete) files to central management agencies. These issues have complicated the management work and deviated from the purpose of accepting and utilizing non-governmental foreign aid.

To address these limitations, enhance the effectiveness of the management and utilization of non-governmental foreign aid, the Prime Minister requests the ministers, heads of ministerial-level agencies, heads of government agencies, chairpersons of provincial/municipal People's Committees under the central government, and mass organizations to strictly direct subordinate agencies and units to implement the provisions of Decision No. 64/2001/QD-TTg of the Prime Minister, and immediately carry out the following actions:

1. Aid projects must be established, reviewed, and approved according to the prescribed procedures. Projects approved beyond the authority will not be enforceable (if the project is ongoing, it must be suspended and re-approved according to regulations). After the project is approved, the decision approving the project (along with related documents and files) must be submitted to the Ministry of Planning and Investment and the Ministry of Finance within the specified time frame. The Ministry of Planning and Investment is responsible for closely monitoring this work and reporting violations to the Prime Minister for timely handling.

2. Goods belonging to the list of prohibited imports as stipulated by the Prime Minister (issued in Decision No. 46/2001/QD-TTg dated April 4, 2001) will not be considered for acceptance. Only goods with valid documentation and quality confirmation from the competent authority of the donor country will be considered for aid. Aid goods can only be sent to Vietnam after receiving permission from the competent authority. For consignments of used aid goods that do not comply with the above regulations but were shipped before the issuance of this Directive and are still en route to Vietnamese ports (must have a confirmation of the shipment date on the bill of lading), they will be considered but must undergo quality inspection by a Vietnamese quality inspection agency. The Ministry of Finance is responsible for closely supervising the acceptance of aid goods, identifying violations for handling or referring them to the competent authority for consideration and handling.

3. The Vietnam Friendship Association shall take the lead and coordinate with the Ministry of Foreign Affairs to promptly and comprehensively inform donors (with or without representative offices in Vietnam) about the provisions of Decision No. 64/2001/QD-TTg of the Prime Minister to facilitate cooperation during the implementation of aid to Vietnam.

Ministers, heads of ministerial-level agencies, heads of government agencies, chairpersons of provincial/municipal People's Committees under the central government, heads of central agencies of mass organizations, and people's organizations are responsible for strictly implementing this Directive./.
