Guidelines for quarterly health check-ups for workers at business establishments that are easily exploited for prostitution activities.

Pursuant to Article 11 and Article 27 of Decree No. 178/2004/NĐ-CP dated October 15, 2004, detailing certain provisions of the Ordinance on Prevention and Control of Prostitution.
After reaching an agreement with the Ministry of Labor, Invalids and Social Affairs through Circular No. 1915/LDTBXH-PCTNXH dated June 7, 2006, the Ministry of Health and the Ministry of Finance provide guidelines for quarterly health check-ups for workers at business establishments that are easily exploited for prostitution activities (hereinafter referred to as business establishments).
I. SCOPE OF REGULATION AND APPLICABLE OBJECTS

This Circular guides the operations of healthcare facilities under the health sector and the responsibilities of employers regarding quarterly health check-ups for workers employed at business establishments.

a) General hospitals at the district level and above (hereinafter referred to as hospitals) must have sufficient doctors and necessary technical equipment to conduct health examinations according to the specialties specified in the Quarterly Health Examination Booklet for Workers (hereinafter referred to as the Health Examination Booklet) - Appendix No. 1 attached hereto.
b) Business establishments shall include activities within the list of workplaces and jobs as stipulated in Joint Circular No. 21/2004/TTLT-BLĐTBXH-BYT dated December 9, 2004, issued by the Ministry of Labor, Invalids and Social Affairs and the Ministry of Health, guiding and specifying the list of workplaces and jobs not employing workers under 18 years old in business establishments that are easily exploited for prostitution activities.
c) Workers such as waitresses, service staff, dancers... (hereinafter collectively referred to as workers) working at business establishments as defined in point b, Clause 2 of this Section.
II. ORGANIZATION OF HEALTH CHECK-UPS
1. For Hospitals
a) General Principles:
- Hospitals shall carry out quarterly health check-ups for workers upon request from business establishments.
- The health check-up and certification process for workers shall be conducted according to the contents specified in the Health Examination Booklet attached hereto as Appendix No. 1.
- Hospitals organizing health check-ups must be responsible for treating workers suffering from diseases listed in Appendix No. 2 attached hereto and shall charge hospital fees according to current regulations; if the treatment exceeds their professional capacity or at the request of the worker or employer, the hospital must arrange for transfer to another facility according to current regulations.
- Statistical work, reporting, and archiving of results of quarterly health check-ups for workers must comply with medical regulations and be included in the hospital's general professional activity plan.
b) Organization of Health Check-Ups:
- Doctors specializing in dermatology, infectious diseases, internal medicine, obstetrics and gynecology, laboratory tests, diagnostic imaging, and other relevant specialties.
- The director or deputy director in charge of professional matters at the hospital shall be responsible for concluding the health status.
c) Responsibilities of Hospitals Conducting Health Check-Ups:
- Completing administrative procedures for health check-ups and issuing appointment cards for result delivery.
- Conducting clinical examinations and performing ancillary clinical tests according to the contents in the Health Examination Booklet.
- Conducting additional examinations and tests as required by the specialty.
- Based on the conclusions of the specialists, the director or deputy director in charge of professional matters at the hospital shall conclude the health status of the worker, sign and stamp the booklet and the position seal.
- Within seven days after conducting the health check-up for workers, the hospital shall deliver the Health Examination Booklet and ancillary clinical test results to the employer of the business establishment.
- In cases where workers suffer from one or more diseases listed in Appendix No. 2 attached hereto, the hospital director shall notify the employer of the business establishment about the health condition of the worker; simultaneously, they shall notify in writing the provincial or municipal labor department and the district, city, or town-level labor department where the main office of the business establishment is located for monitoring and management.
2. For Business Establishments
a) Organizing quarterly health check-ups for workers every three months according to these guidelines.
If a worker has already undergone a quarterly health check-up coinciding with the regular health check-up for workers at business establishments, the employer shall organize supplementary health check-ups for the worker based on the contents specified in Appendix No. 1 attached hereto.
b) Contacting and signing contracts with hospitals to organize health check-ups for workers.
c) Paying examination fees and ancillary clinical test costs to the hospital according to legal regulations.
d) Notifying each worker individually about their health check-up results.
e) Based on the health conclusion in the Health Examination Booklet, if a worker suffers from one or more diseases listed in Appendix No. 2 attached hereto, the employer of the business establishment must arrange for the worker to receive treatment at healthcare facilities and bear the responsibility for monitoring and supervising the treatment; if the disease does not improve, they must reassign the worker to a suitable job outside the workplace and job types specified in point b, Clause 2, Section I of this Circular.
III. FEES FOR HEALTH CHECK-UPS AND ANCILLARY CLINICAL TEST COSTS
1. The fee for health check-ups and ancillary clinical test costs: According to the current hospital fee system.
2. For hospitals: Fees for health check-ups and ancillary clinical test costs are part of the hospital's revenue, managed and utilized according to state regulations on hospital fees.
3. For business establishments with workers undergoing health check-ups: Fees for health check-ups and ancillary clinical test costs shall be recorded as part of the service cost.
4. The treatment costs for workers shall be implemented in accordance with the current regulations on health insurance benefits or workers shall pay out-of-pocket according to the current hospital fee regime.
IV. IMPLEMENTATION
1. The People's Committees of provinces and centrally governed cities shall direct the Health Departments to coordinate with the Labor, Invalids, and Social Affairs Departments and relevant agencies to disseminate this Circular to hospitals and service business establishments; develop programs and plans for regular and spot inspections and audits of the implementation of this Circular; ensure quarterly health check-ups for workers; and take measures to manage workers at service business establishments who suffer from diseases specified in Appendix No. 2 attached hereto.
2. The Ministry of Health and the Health Departments of provinces and centrally governed cities shall have the responsibility to guide and direct hospitals under their jurisdiction to implement quarterly health check-ups for workers employed at service business establishments.
The Labor, Invalids, and Social Affairs Departments of provinces and centrally governed cities shall have the responsibility to direct and guide labor, invalids, and social affairs agencies at all levels and organizations to manage workers through the signing of labor contracts and the results of quarterly health check-ups of workers at service business establishments as stipulated in this Circular and related labor and employment laws and regulations.
3. Hospitals conducting quarterly health check-ups for workers shall be responsible for organizing research on the content of quarterly health check-ups for workers as provided in this Circular and related health sector regulations; preparing health check-up records for service business establishments.
4. Service business establishments shall organize quarterly health check-ups for workers in accordance with the provisions; keep and secure health check-up records; report to competent authorities when required. In cases where workers are not working at the establishment, the owner of the service business establishment shall hand over the quarterly health check-up records to the workers for management.
V. IMPLEMENTATION PROVISIONS
This Circular shall take effect fifteen days from the date of publication in the Official Gazette. Previous provisions contrary to this Circular shall be abolished.
During the implementation process, if there are difficulties or obstacles, they should be reported to the relevant ministries for study and resolution.
