THE MINISTER OF POST AND TELECOMMUNICATIONS

Pursuant to the Government Decree No. 90/2002/NĐ-CP dated November 11, 2002 on the functions, tasks, powers, and organizational structure of the Ministry of Post and Telecommunications;

Pursuant to the Government Decree No. 12/2006/NĐ-CP dated January 23, 2006 detailing and guiding the implementation of the Law on Trade regarding international trade activities and foreign trade agency activities;

Pursuant to the Government Decree No. 71/2007/NĐ-CP dated May 3, 2007 detailing and guiding the implementation of certain provisions of the Law on Information Technology concerning the information technology industry;

On the proposal of the Director of the Department of Information Technology Industry,

DECISION:

Article 1. Amending and supplementing Decision No. 20/2006/QĐ-BBCVT dated June 30, 2006 of the Minister of Post and Telecommunications on the issuance of the List of Used Information Technology Products Prohibited from Import as follows:

1. The List of Used Information Technology Products Prohibited from Import shall be amended as follows: Remove "Laptop, HS Code 8471.30.20" from the List of Used Information Technology Products Prohibited from Import.

2. Amending and supplementing the Notes section of the List of Used Information Technology Products Prohibited from Import as follows:

"* Notes:
1. The list is established based on the Goods List and HS Codes in the Export and Import Tariff.
2. Used computer screens, liquid crystal display (LCD) screens, and plasma screens are not included in this list.
3. Used spare parts and accessories of products listed herein are also prohibited from importation except for ink cartridges that have been cleaned and meet the conditions or standards for importation according to environmental protection laws, trade laws, and other relevant laws.
4. This list does not apply to used information technology products imported for warranty and maintenance services for foreign countries. Enterprises engaged in warranty and maintenance services for foreign countries must ensure the re-export of all products together with waste generated during the warranty and maintenance process.
5. This list does not apply to used specialized information technology products and systems, specifically as follows:
a) Specialized information technology products and systems are machines or machine combinations used as production tools in specific industries including industrial production, telecommunications, information technology industry, measurement, automation, healthcare, biology, and other sectors; or used to control, operate, manage, and test the operation of part or all of a production system. These machines and equipment can be imported individually or as part of a production system or assembly line; b) To be eligible for importation, these machines and machine combinations must be confirmed by the Ministry of Post and Telecommunications as specialized information technology products or systems."

Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette.

Article 3. The Heads of the Office, Inspectorate, Departments, Bureaus, Units under the Ministry, and organizations and individuals producing and trading in information technology products and services are responsible for implementing this Decision./.
