THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Article 16 of Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Considering the proposal of the Director of the Department of Personnel Organization,
DECISION:
Article 1. Position and Functions
The International Cooperation Department is the advisory and consolidating body assisting the Minister of Agriculture and Rural Development in performing state management functions in the field of international cooperation and integration within the scope of the Ministry's state management.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Take the lead in drafting strategies, mechanisms, policies, long-term plans, five-year plans, annual plans, programs, projects, and proposals regarding international cooperation, integration, and external affairs within the scope of the Ministry’s management for submission to the Minister.
2. Take the lead in drafting normative legal documents and international treaties related to international cooperation, integration, and external affairs of the sector for submission to the Minister; management regulations for programs and projects funded by foreign sources, outbound and inbound delegations, reception of foreign guests, international conferences, seminars, and other external activities of the sector.
3. Take the lead in preparing the budget for annual outbound and inbound delegations, international conferences, and seminars; organizing delegations led by Ministry officials for overseas missions and welcoming and working with official foreign delegations of the Ministry. Supervise and urge the payment of annual membership fees for international and regional organizations under the Ministry.
4. Take the lead in coordinating with sponsors and relevant agencies in preparing, building, reviewing, negotiating, proposing implementation agencies, and supervising programs and projects funded by Official Development Assistance (ODA), and non-governmental organizations from abroad (INGO).
5. Promote and manage direct foreign investment (FDI) programs and projects in the sector. Take the lead in proposing and managing overseas investment programs and projects managed by the Ministry.
6. Take the lead in managing the content, contacts, transactions, exchange of diplomatic letters, and introducing programs and projects to diplomatic representative offices, international organizations, sponsors, foreign partners, and enterprises to expand markets, attract investment capital, and promote international cooperation.
7. Take the lead in proposing, preparing, negotiating, and submitting to the Minister for signing and joining international treaties, agreements, and international organizations related to the sector, and organize inspections of treaty implementation.
8. Take the lead in proposing, preparing, negotiating, and submitting to the Minister for signing and joining international treaties, agreements, and international organizations related to the sector, and organize inspections of treaty implementation.
9. Monitor, supervise, evaluate, and compile reports according to regulations on the implementation of international integration, ODA, FDI, and INGO support within the scope of the Ministry's management.
10. Guide, monitor, inspect, supervise, evaluate, and compile reports according to regulations on the implementation of international treaties, plans, programs, projects, and cooperative initiatives in international economic integration of the sector; exit-entry activities, activities involving foreigners and Ministry staff, international conferences, and seminars within the scope of the Ministry's state management; provision of external information by the Ministry as prescribed by law; content and programs of international cooperation of subordinate agencies and units of the Ministry, study and work delegations, and expert cooperation abroad according to the division of responsibilities and regulations of the Ministry.
11. Monitor, compile, and submit solutions on international cooperation and integration, resolve disputes, complaints, and conflicts involving foreign elements, issues related to laws and international treaties within the scope of the Ministry's management.
12. Participate and coordinate with relevant agencies within the Ministry in preparing, building, reviewing, approving, negotiating project proposals, basic investigations, planning, development investments in agriculture, forestry, salt industry, fisheries, water resources, rural development, and expanding international markets according to the division of responsibilities by the Minister.
13. Manage the civil servant and officer workforce, files, assets, and other resources assigned according to regulations.
14. Serve as the permanent member of councils, sub-committees, committees, regional, bilateral, multilateral cooperation bodies, border, maritime, and ocean cooperation, negotiation, and economic integration bodies of the Ministry.
15. Manage the National Inquiry Office on Food Safety and Animal and Plant Quarantine (Vietnam SPS Office).
16. Manage international support partners in the agricultural and rural development sector according to the division of responsibilities by the Minister.
17. Organize the implementation of administrative reform according to the program and plan of the Ministry and the division of responsibilities by the Minister.
18. Perform other tasks assigned by the Minister.
Article 3. Organizational Structure
1. Leadership of the Department:
The leadership of the Department consists of the Director and Deputy Directors appointed by the Minister of Agriculture and Rural Development according to regulations.
The Director manages the operations of the Department and is responsible before the Minister of Agriculture and Rural Development and the law for the Department's activities.
Deputy Directors assist the Director in overseeing certain areas of work according to the Director's assignment and are responsible before the Director and the law for the assigned tasks.
2. Specialized functional divisions:
a) Bilateral Cooperation Division;
b) Multilateral Cooperation Division;
c) Integration and Investment Division;
d) General Affairs Division;
đ) Vietnam SPS Office.
The heads and deputy heads of the divisions at points a, b, c, and d of Clause 2 of this Article shall be appointed by the Minister of Agriculture and Rural Development according to regulations. The Director of the International Cooperation Department will specify the functions and tasks of the Divisions according to the division of responsibilities of the Ministry.
The Vietnam SPS Office operates according to current regulations of the Prime Minister and the Minister of Agriculture and Rural Development.
3. Civil servants of the Department are responsible for performing assigned tasks; they have obligations and rights as prescribed by law.
The Director is responsible for directing the development, issuance, and implementation of the Operating Regulations of the Department; arranging civil servants in accordance with their positions, standards, job descriptions, and assigned tasks.
Article 4. Effective date
This Decision shall take effect fifteen days from the date of publication in the Official Gazette. The Decision No. 84/2003/QĐ-BNN dated September 4, 2003, issued by the Minister of Agriculture and Rural Development on the functions, tasks, authorities, and organizational structure of the Department of International Cooperation, and any previous provisions that conflict with this Decision, are hereby repealed.
Article 5. Responsibilities for Implementation
The Director of the Department of International Cooperation, the Head of the Ministry's Office, the Directors of Departments, the Heads of Bureaus, the Inspector General of the Ministry, and the Heads of related agencies and units are responsible for implementing this Decision.
