Provisions on conditions for Motor Vehicle Inspection Centers

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

The Minister of Transport shall stipulate the conditions for Motor Vehicle Inspection Centers as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular sets forth the technical infrastructure and human resource conditions of Motor Vehicle Inspection Centers.

Article 2. Applicability

This Circular applies to agencies, organizations, and individuals related to the establishment and operation of Motor Vehicle Inspection Centers (hereinafter referred to as Centers).

Chapter II

TECHNICAL INFRASTRUCTURE

Article 3. Location of the Center

The location for constructing the Center must be in accordance with planning, having convenient traffic routes for motor vehicles (hereinafter referred to as motor vehicles) to enter and exit for inspection.

Article 4. Construction Area of the Center

1. The minimum area of the inspection workshop shall be as follows:

For Centers with multiple inspection assembly lines, the inspection workshop must have a minimum area for each assembly line according to the table above.

2. The parking lot and access road area for a Center with one inspection assembly line must be at least 5.5 times the minimum area of the corresponding inspection workshop.

In cases where the Center has multiple inspection assembly lines, from the second assembly line onwards, the parking lot and access road areas must increase by 1.5 times compared to the corresponding area of the first assembly line.

3. The minimum office building area is 90 m.

Article 5. Requirements for Buildings, Workshops, and Parking Lots

1. The Center's ground floor must have a drainage system ensuring that the Center does not flood.

2. The inspection workshop must have exhaust gas extraction systems, ventilation systems, lighting systems suitable for inspection requirements, preventing water from splashing onto equipment during rain, ensuring industrial hygiene, labor safety, and fire prevention according to current regulations. For workshops equipped with assembly lines for inspecting vehicles with axle load up to 13,000 kg, the clear height must not be less than 4.5 meters.

3. Office buildings must be arranged reasonably, ensuring effective supervision of inspection work and convenience for transactions.

4. The minimum road width for motor vehicle entry and exit must comply with the regulations for Class II roads in plains, with a road surface width of no less than three meters and a turning radius of no less than twelve meters to ensure smooth entry and exit of vehicles.

5. The parking lot must comply with the regulations for Class III roads in plains as specified in Vietnam Standard TCVN: 4054 - Road Design Requirements.

Article 6. Inspection Equipment

1. The type of equipment installed in the inspection assembly line must be approved by the state management agency responsible for inspection work to ensure uniformity across the national network of Motor Vehicle Inspection Centers.

2. A minimum set of inspection equipment for one assembly line must include the following:

a) Brake testing equipment;

b) Weight measuring equipment;

c) Lateral slip measuring equipment with sensors recording results only when a vehicle enters and exits the equipment;

d) Exhaust gas analysis equipment;

đ) Smoke measurement equipment;

e) Noise measuring equipment for vehicles and horn volume;

g) Headlight testing equipment;

h) Undercarriage inspection support equipment;

i) Lifts for inspecting chassis and undercarriage components. If lifts are not used, they may be replaced by car underbody inspection pits.

Dimensions of the inspection pit for vehicles with axle load up to 2,000 kg: length 6,000 mm, width 600 mm, and minimum depth 1,300 mm; dimensions of the inspection pit for vehicles with axle load up to 13,000 kg: length 12,000 mm, width 750 mm, and minimum depth 1,200 mm.

The position of the pit must be consistent with the design of the inspection assembly line, with convenient access and emergency exits in case of accidents. The pit must have adequate lighting and jacking tools to adjust the distance between the inspector and the underside of the vehicle.

3. Inspection equipment in the assembly line must have a unified control program capable of controlling the operation of the equipment according to the inspection process, setting evaluation standards, establishing inspection sequences based on the layout of inspection equipment; the database of the program must be secure and connected to the management program of the state management agency responsible for inspection work.

4. For Centers with multiple assembly lines, a minimum of one noise measuring device for vehicles must be provided.

5. It is encouraged to provide generators to supply power to inspection equipment in case of electrical failures.

Article 7. Inspection Equipment in the Inspection Line

Each inspection line must have at least the following equipment:

1. Tire pressure inspection equipment;

2. Equipment to measure remaining tire tread height;

3. Lighting device;

4. Special inspection hammer;

5. Length measuring tape;

6. Lift suitable for the type of vehicle being inspected.

Chapter III

INFORMATION EQUIPMENT, DATA STORAGE AND TRANSMISSION

Article 8. Information Equipment, Data Storage and Transmission

1. At each inspection station, there must be equipment for entering, storing, and transmitting inspection result data. These devices must be connected to an internal network to ensure data storage and transmission.

2. The server of the Motor Vehicle Inspection Center must be connected to the server of the state management agency responsible for inspection work to regularly transmit and report inspection data.

Article 9. Other Equipment of the Inspection Center

In addition to the equipment and tools specified in Articles 6, 7, and Article 8 of this Circular, the Inspection Center must have the following equipment:

1. Telephone machine;

2. Fax machine;

3. Photocopy machine;

4. Office computer;

5. Printer;

6. Surveillance camera and vehicle photographing device; this device must be connected to the center's LAN, displaying the time of photography on the image and directly transmitting images to the waiting room of the person bringing the vehicle for inspection;

7. Fire prevention and firefighting equipment;

8. Publicly posted boards and charts regarding inspection fees, center regulations, and other relevant provisions.

Chapter IV

STAFF OF THE INSPECTION CENTER

Article 10. Positions Working at the Inspection Center

1. Positions working at the Inspection Center include:

a) Director, Deputy Director;

b) Chain supervisor;

c) Vehicle inspectors according to the requirements of the state management agency responsible for inspection work;

d) Technical staff including accountants, cashiers, file clerks, and computer operators.

2. The number of vehicle inspectors at one Inspection Center depends on the number of chains and inspection capacity as prescribed by the state management agency responsible for inspection work, but at a minimum as follows:

Article 11. Qualifications for Positions Working at the Inspection Center

1. The Director and Deputy Director of the Inspection Center must be vehicle inspectors with at least three years of inspection experience. When appointing Directors and Deputy Directors, there must be a written agreement from the state management agency responsible for inspection work.

2. Chain supervisors must be vehicle inspectors with at least two years of inspection experience.

3. Motor vehicle inspectors must be recognized and issued an inspector card by the state management agency responsible for inspection work.

4. Technical staff must be guided and trained in motor vehicle inspection procedures by the state management agency responsible for inspection work.

5. During the process of inspecting motor vehicles, inspectors and technical staff must attend refresher courses to update and enhance their professional knowledge.

6. Staff of the Inspection Center must be fully equipped with personal protective gear when working.

1. This Circular takes effect 45 days from the date of signature and revokes Decision No. 50/2005/QĐ-BGTVT dated October 12, 2005, issued by the Minister of Transport on the Standards for Motor Vehicle Inspection Centers, registration number: 22 TCN 226-05.

Chapter V

EFFECTIVE DATE AND IMPLEMENTATION

Article 12. Effective Date

2. Motor Vehicle Inspection Centers established before the effective date of this Circular must supplement all inspection equipment for each inspection line and update the control program for equipment no later than three years from the effective date of this Circular.

1. The Vietnam Vehicle Registration Agency is the State Management Agency responsible for inspection work and is responsible for organizing the implementation of this Circular.

Article 13. Implementation Organization

2. The Heads of the Ministry’s Office, the Inspector General, the Heads of Departments, the Director of the Vietnam Vehicle Registration Agency, the Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.

2. The Heads of the Ministry’s Office, the Inspectorate of the Ministry, the Directors of all Departments, the Director of the Vietnam Motor Vehicle Quality Assurance Agency, the Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.
