CIRCULAR
Guidelines for Implementing Certain Provisions Related to Administrative Procedures in the Film Industry

Pursuant to the Cinema Law on June 29, 2006, and the Law Amending and Supplementing Certain Articles of the Cinema Law on June 18, 2009;
Pursuant to Decree No. 54/2010/ND-CP dated May 21, 2010 of the Government detailing the implementation of certain articles of the Cinema Law on June 29, 2006 and the Law Amending and Supplementing Certain Articles of the Cinema Law on June 18, 2009;
The Ministry of Culture, Sports and Tourism issues guidelines for implementing certain provisions related to administrative procedures in the film industry as follows:
Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
1. This Circular guides the simplification of administrative procedures in the film industry, including:
Article 1. Scope of Regulation and Applicability
a) The procedure for issuing certificates of eligibility for film production business;
b) The procedure for issuing permits for domestic organizations to cooperate or form joint ventures with foreign organizations or individuals in film production and provision of film production services;
c) The procedure for organizing the screening and introduction of foreign films in Vietnam;
d) The procedure for organizing Vietnamese Film Days abroad;
đ) The procedure for issuing permits for establishing representative offices of foreign film establishments in Vietnam;
e) The procedure for permitting the establishment of representative offices of Vietnamese film establishments abroad;
g) The procedure for permitting the organization of specialized or themed film festivals;
h) The procedure for issuing permits for the distribution of films.
2. This Circular applies to organizations and individuals implementing administrative procedures in the film industry as specified in Clause 1 of this Article.
Article 2. Procedure for Issuing Certificates of Eligibility for Film Production Business
Organizations wishing to obtain a Certificate of Eligibility for Film Production Business shall submit directly or send by post one (01) set of application documents to the Cinema Department. The application includes:
1. Application Form (Form No. 1);
2. Official confirmation of the statutory capital from the competent authority;
3. Curriculum vitae of the proposed General Director or Chief Executive Officer of the film production enterprise, confirmed by the competent authority.
Article 3. Procedure for Issuing Permits for Domestic Organizations to Cooperate or Form Joint Ventures with Foreign Organizations or Individuals in Film Production and Provision of Film Production Services
Domestic film establishments with film production functions wishing to cooperate or form joint ventures with foreign organizations or individuals in film production and provision of film production services shall submit directly or send by post one (01) set of application documents to the Cinema Department. The application includes:
1. Application of the domestic film establishment (Form No. 2);
2. Literary script in Vietnamese and foreign language.
Article 4. Procedure for Organizing the Screening and Introduction of Foreign Films in Vietnam
Vietnamese organizations and individuals, foreign organizations and individuals wishing to organize the screening and introduction of foreign films in Vietnam shall submit directly or send by post one (01) set of application documents to the Cinema Department. The application includes:
1. Application Form (Form No. 3) or diplomatic note (for diplomatic missions);
2. Vietnamese translation of the film synopsis;
3. Sample film intended for screening and introduction.
Article 5. Procedure for Organizing Vietnamese Film Days Abroad
Film establishments wishing to organize Vietnamese Film Days abroad shall submit directly or send by post one (01) application (Form No. 4) to the Cinema Department.
Film bases that wish to organize Vietnamese Film Days abroad shall submit directly or send by post one (01) application form (Form No. 4) to the Cinema Department.
Article 6. Procedure for Issuing a License to Establish a Representative Office of a Foreign Film Institution in Vietnam
A foreign film institution wishing to establish a representative office in Vietnam shall submit directly or send by post one (01) set of application documents to the Cinema Department. The application includes:
1. A request form in both Vietnamese and English (Form No. 5);
2. A document confirming the legal status of the foreign film institution issued by the competent authority of the foreign country;
3. Financial statements audited or other equivalent documents proving that the foreign film institution has existed and operated in the most recent fiscal year;
4. A copy of the charter of the foreign film institution's operations.
Article 7. Procedure for Permitting the Establishment of a Representative Office of a Vietnamese Film Institution Abroad
A Vietnamese film institution wishing to establish a representative office abroad shall submit directly or send by post one (01) set of application documents to the Cinema Department. The application includes:
1. A request form (Form No. 6);
2. A document approving the establishment of a representative office issued by the competent national management agency of the host country.
Article 8. Procedure for Permitting the Organization of Specialized Film Festivals
An organization wishing to organize specialized film festivals shall submit directly or send by post one (01) set of application documents to the Cinema Department. The application includes:
1. A request form (Form No. 7);
2. The festival charter.
Article 9. Procedure for Issuing a Film Distribution License
A film institution requesting a film distribution license shall submit directly or send by post one (01) set of application documents to the competent national management agency regarding cinema. The review and issuance of a film distribution license shall be carried out in accordance with the provisions of Decision No. 49/2008/QĐ-BVHTTDL dated July 9, 2008, issued by the Minister of Culture, Sports and Tourism on the regulations for reviewing and issuing film distribution licenses.
Article 10. Effectiveness
This Circular takes effect from October 15, 2011.
Article 11. Implementation
During implementation, if there are any difficulties, organizations and individuals are requested to promptly report them to the Ministry of Culture, Sports and Tourism for study and resolution./.
