Regulations on professional standards, professional certificates of seafarers and the minimum safe manning of Vietnamese ships

and the minimum safe manning of Vietnamese ships

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;

Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers 1978, as amended in 2010, to which Vietnam is a party.

The Minister of Transport issues this Circular regulating the professional standards, professional certificates of seafarers and the minimum safe manning of Vietnamese ships.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular regulates the professional standards, professional certificates of seafarers and the minimum safe manning of Vietnamese ships.

Article 2. Applicability

1. This Circular applies to agencies, organizations, individuals, and seafarers related to the professional standards, professional certificates of seafarers and the minimum safe manning of Vietnamese ships.

2. This Circular applies to government service vessels in cases specifically provided for in this Circular.

Article 3. Explanation of Terms

In this Circular, the following terms shall be understood as follows:

1. STCW Convention means the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers 1978, as amended in 2010;

2. STCW Code means the Code accompanying the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers 1978 and its amendments;

3. Master means the person with the highest command authority on board the ship;

4. Chief Officer means the officer next in rank to the master and is the person commanding the ship when the master is unable to perform his duties;

5. Deck Officer means an officer with the specified professional qualifications as stipulated in the provisions of Chapter II of the STCW Convention;

6. Chief Engineer means a senior engineer officer responsible for the ship's main propulsion machinery and operation and maintenance of electrical and mechanical equipment on board;

7. Second Engineer means the officer next in rank to the chief engineer and is responsible for the ship's main propulsion machinery and operation and maintenance of electrical and mechanical equipment on board when the chief engineer is unable to perform his duties;

8. Engine Officer means an officer with the specified professional qualifications as stipulated in the provisions of Rules III/1, III/2 or III/3 of the STCW Convention;

9. Electrical Engineer Officer means an officer with the specified professional qualifications as stipulated in the provisions of Rule III/6 of the STCW Convention;

10. Radio Operator (hereinafter referred to as R/T) means an officer with the specified professional qualifications as stipulated in the provisions of Chapter IV of the STCW Convention;

11. Electrician means a seafarer with the specified professional qualifications as stipulated in the provisions of Rule III/7 of the STCW Convention;

12. Oil Tanker means a ship constructed and used for the carriage of oil and oil products;

13. Chemical Tanker means a ship constructed or converted and used for the carriage of chemicals listed in Chapter 17 of the International Code for the Construction and Equipment of Ships Carrying Dangerous Chemicals in Bulk (IBC Code);

14. Gas Carrier means a ship constructed or converted and used for the carriage of liquefied gases as defined in Chapter 19 of the International Code for the Construction and Equipment of Ships Carrying Liquefied Gases in Bulk (IGC Code);

15. Passenger Ship means a ship as defined in the International Convention for the Safety of Life at Sea 1974, as amended (SOLAS 1974);

16. Ro-Ro Passenger Ship means a passenger ship with Ro-Ro spaces or special spaces as defined in the International Convention for the Safety of Life at Sea 1974, as amended (SOLAS 1974);

17. Near-coastal voyage means the voyage of a ship with a gross tonnage under 500 GT within the territorial waters bounded by straight lines connecting the following coordinates: 12000’N, 100000’E; 23000’N, 100000’E; 23000’N, 114020’E; 12000’N, 114000’E; 12000’N, 116000’E; 07000’N, 116000’E and 07000’N, 102030’E. In addition, voyages of ships in waters within the sovereignty and continental shelf of Vietnam are also considered as coastal voyages;

18. Training Record Book means the logbook issued to seafarers with a university degree undergoing training as deck officers on ships of 500 GT and above, or engine officers on ships with main engine power of 750 kW and above; it also means the logbook issued to seafarers with a college or vocational college degree undergoing 36 months of training as electrical engineering officers as required in Table A-III/6 of the STCW Code;

19. Period of training means the time spent by seafarers working on board ships according to a training program consistent with the STCW Convention;

20. Probationary period means the time spent by seafarers performing their designated duties on ships of the corresponding class under the supervision of an officer;

21. Time served in a position means the time spent working in a position consistent with the certificate of competency issued;

22. Sea service time means the time spent by seafarers or trainees working or undergoing training on board ships;

23. Month means month according to the Gregorian calendar or 30 days composed of periods less than one month;

24. Function means a group of tasks, responsibilities and duties prescribed in the STCW Code necessary for the operation of the ship, safety of life at sea or protection of the marine environment;

25. the date means the shipowner or any other organization or individual such as the manager or bareboat charterer who accepts responsibility from the shipowner for the operation of the ship and those who agree to undertake all such tasks and responsibilities for the company in accordance with these regulations;

26. Certificate of Competency (hereinafter abbreviated as CC) is a certificate issued to seafarers in accordance with the STCW Convention;

27. Certificate of Proficiency (hereinafter abbreviated as CP) is a certificate issued to seafarers in accordance with the STCW Convention;

28. Confirmation of Recognition of Certificate of Competency means a confirmation document issued by the Director of the Vietnam Maritime Administration to foreign seafarers holding a Certificate of Competency issued in accordance with the STCW Convention to work on Vietnamese ships;

29. Certificate of Issuance of Certificate means a confirmation document issued by the Director of the Vietnam Maritime Administration to seafarers who have been issued a certificate of completion of the relevant training course by the head of the training institution in accordance with Rule IV/2 and Rule V/1 of the STCW Convention;

30. Watchkeeping Rating Other Than As Watchkeeping Rating means a seafarer with the specified professional qualifications as stipulated in the provisions of Rule II/4 of the STCW Convention and completing specialized training courses as prescribed by the Ministry of Transport;

31. Able Seaman Watchkeeping Rating means a seafarer with the specified professional qualifications as stipulated in the provisions of Rule II/4 and Rule II/5 of the STCW Convention and completing specialized training courses as prescribed by the Ministry of Transport;

32. Engine Room Rating Oiler means a seafarer with the specified professional qualifications as stipulated in the provisions of Rule III/4 of the STCW Convention and completing specialized training courses as prescribed by the Ministry of Transport;

33. Able Seaman Watchkeeper means a seafarer with the specified professional qualifications as stipulated in the provisions of Rule III/4 and Rule III/5 of the STCW Convention and completing specialized training courses as prescribed by the Ministry of Transport.

Chapter II

PROFESSIONAL STANDARDS OF SEAFARERS

Article 4. Professional standards for captains and chief officers of vessels with a gross tonnage of 500 GT or more

Captains and chief officers of vessels with a gross tonnage of 500 GT or more must meet the professional standards specified in Sections A-II/1, A-II/2, A-IV/2, and A-VIII/2 of the STCW Code regarding the following functions:

1. Navigation at the management level;

2. Cargo handling and stowage at the management level;

3. Control of vessel operations and care for persons on board at the management level;

4. Communication at the operational level.

Article 5. Professional standards for captains and chief officers of vessels with a gross tonnage of 50 GT to less than 500 GT operating in near coastal waters and captains of vessels with a gross tonnage of less than 50 GT

Captains and chief officers of vessels with a gross tonnage of 50 GT to less than 500 GT operating in near coastal waters and captains of vessels with a gross tonnage of less than 50 GT must meet the professional standards specified in Sections A-II/3, A-IV/2, and A-VIII/2 of the STCW Code regarding the following functions:

1. Navigation at the management level;

2. Cargo handling and stowage at the management level;

3. Control of vessel operations and care for persons on board at the management level;

4. Communication at the operational level.

Article 6. Professional standards for deck officers of vessels with a gross tonnage of 500 GT or more

Deck officers of vessels with a gross tonnage of 500 GT or more must meet the professional standards specified in Sections A-II/1, A-IV/2, and A-VIII/2 of the STCW Code regarding the following functions:

1. Navigation at operational level;

2. Cargo handling and stowage at operational level;

3. Control of vessel operations and care for persons on board at the operational level;

4. Communication at the operational level.

Article 7. Professional standards for deck officers of vessels with a gross tonnage of 50 GT to less than 500 GT operating in near coastal waters

Deck officers of vessels with a gross tonnage of 50 GT to less than 500 GT operating in near coastal waters must meet the professional standards specified in Sections A-II/3, A-IV/2, and A-VIII/2 of the STCW Code regarding the following functions:

1. Navigation at operational level;

2. Cargo handling and stowage at operational level;

3. Control of vessel operations and care for persons on board at the operational level;

4. Communication at the operational level.

Article 8. Professional standards for watchkeeping ratings

1. Professional standards for watchkeeping rating OS

Watchkeeping rating OS must meet the professional standards specified in Section A-II/4 of the STCW Code regarding maritime functions at the assistance level.

2. Professional standards for watchkeeping rating AB

Watchkeeping rating AB must meet the professional standards specified in Sections A-II/4 and A-II/5 of the STCW Code regarding the following functions:

a) Maritime functions at the assistance level;

b) Cargo handling and stowage functions at the assistance level;

c) Control of vessel operations and care for persons on board at the assistance level;

d) Maintenance and repair functions at the assistance level.

Article 9. Professional standards for chief engineers and second engineers of vessels with main engine power of 750 KW or more

Chief engineers and second engineers of vessels with main engine power of 750 KW or more must meet the professional standards specified in Sections A-III/1, A-III/2, and A-VIII/2 of the STCW Code regarding the following functions:

1. Marine engineering technology at the management level;

2. Electrical, electronic, and machinery control technology at management level;

3. Maintenance and repair at management level;

4. Control of vessel operations and care for persons on board at the management level.

Article 10. Professional standards for chief engineers and second engineers of vessels with main engine power from 75 KW to less than 750 KW and chief engineers of vessels with main engine power under 75 KW

Chief engineers and second engineers of vessels with main engine power from 75 KW to less than 750 KW and chief engineers of vessels with main engine power under 75 KW must meet the professional standards according to the training program prescribed by the Minister of Transport regarding the following functions:

1. Marine engineering technology at the management level;

2. Electrical, electronic, and machinery control technology at management level;

3. Maintenance and repair at management level;

4. Control of vessel operations and care for persons on board at the management level.

Article 11. Professional standards for engineer officers of vessels with main engine power of 750 KW or more

Engineer officers of vessels with main engine power of 750 KW or more must meet the professional standards specified in Sections A-III/1 and A-VIII/2 of the STCW Code regarding the following functions:

1. Marine engineering technology at the operational level;

2. Electrical, electronic, and machinery control technology at operational level;

3. Maintenance and repair at operational level;

4. Control of vessel operations and care for persons on board at the operational level.

Article 12. Professional standards for officers of vessels with main engine power from 75 kW to less than 750 kW

Officers of vessels with main engine power from 75 kW to less than 750 kW must meet the professional standards set out in the training program prescribed by the Minister of Transport regarding the following functions:

1. Marine engineering technology at the operational level;

2. Electrical, electronic, and machinery control technology at operational level;

3. Maintenance and repair at operational level;

4. Control of vessel operations and care for persons on board at the operational level.

Article 13. Professional standards for watch engineers

1. Professional standards for watch engineer Oiler:

Watch engineer Oiler must meet the professional standards specified in Section A-III/4 of the STCW Convention concerning the technical function of marine machinery at the assistance level.

2. Professional standards for watch engineer AB:

Watch engineer AB must meet the professional standards specified in Section A-III/4 and Section A-III/5 of the STCW Convention concerning the following functions:

a) Technical function of marine machinery at the assistance level;

b) Electrical, electronic, and control engineering at the assistance level;

c) Maintenance and repair at the assistance level;

d) Control of vessel operations and care of persons on board at the assistance level.

Article 14. Professional standards for electrical technical officers

Electrical technical officers must meet the professional standards specified in Section A-III/6 of the STCW Convention concerning the following functions:

1. Electrical, electronic, and control engineering at the operational level;

2. Maintenance and repair at the operational level;

3. Control of vessel operations and care of persons on board at the operational level.

Article 15. Professional standards for electrical technicians

Electrical technicians must meet the professional standards specified in Section A-III/7 of the STCW Convention concerning the following functions:

1. Electrical, electronic, and control engineering at the assistance level;

2. Maintenance and repair at the assistance level;

3. Control of vessel operations and care of persons on board at the assistance level.

Chapter III

SEAFARER SPECIALIST CERTIFICATES

Section 1

TYPES OF SPECIALIST CERTIFICATES

Article 16. Classification of professional certificates

The professional certificates for seafarers on Vietnamese vessels include the following types:

1. GCNKNCM;

2. GCNHLNV:

a) Certificate of Basic Vocational Training (hereinafter referred to as GCNHLNVCB);

b) Certificate of Specialized Vocational Training (hereinafter referred to as GCNHLNVĐB);

c) Certificate of Professional Vocational Training (hereinafter referred to as GCNHLNVCM).

Article 17. Certificate of professional capability

1. GCNKNCM is issued by the Director of the Vietnam Maritime Administration to seafarers to assume positions as prescribed in this Circular, relevant regulations of Vietnamese law, and in accordance with the provisions of the STCW Convention.

2. GCNKNCM is valid for use not exceeding five years from the date of issuance.

Article 18. Certificate of basic vocational training

1. GCNHLNVCB is issued by the training institution to seafarers who have completed the basic vocational training program on survival techniques, fire prevention and extinguishing, basic medical first aid, life safety, and social responsibility in accordance with the provisions of the STCW Convention.

2. GCNHLNVCB is valid for use not exceeding five years from the date of issuance.

Article 19. Certificate of specialized vocational training

1. GCNHLNVĐB is issued by the training institution to seafarers who have completed one of the specialized vocational training programs in accordance with the provisions of the STCW Convention as follows:

a) Basic oil tanker, chemical tanker, liquefied gas carrier;

b) Advanced oil tanker, chemical tanker, liquefied gas carrier;

c) Crowd management for passenger ships and Ro-Ro passenger ships;

d) Safety training for direct service personnel on passenger ship and Ro-Ro passenger ship decks;

đ) Passenger safety, cargo safety, and hull integrity training for passenger ships and Ro-Ro passenger ships;

e) Crisis management and human response on passenger ships and Ro-Ro passenger ships.

2. The specialized vocational training certificate is valid for use for five years from the date of issuance.

Article 20. Certificate of Professional Training

1. The Certificate of Professional Training (CPPT) shall be issued by training institutions to seafarers who have completed one of the following professional training programs in accordance with the provisions of the STCW Convention:

c) Global Maritime Distress and Safety System (GMDSS): General Operator's Certificate (GOC), Restricted Operator's Certificate (ROC);

d) Advanced firefighting;

đ) First aid;

e) Medical care;

g) Lifeboat, rescue boat;

h) High-speed rescue boat.

2. The GOC and ROC Proficiency Training Certificates are valid for use for five years from the date of issuance; other Proficiency Training Certificates have no time limit for use.

h) High-speed rescue boats;

i) Maritime security awareness;

j) Seafarers with specific maritime security duties;

k) Marine Security Officer;

l) Management of bridge watchkeeping resources;

m) Management of engine room watchkeeping resources;

n) Maritime English;

o) Electronic navigation charts;

p) Ship safety management.

2. The CPPT shall be valid for five years from the date of issuance.

Section 2. CONDITIONS FOR ISSUING THE CERTIFICATE OF SPECIAL COMPETENCE

Article 21. General Conditions

3. In the following cases, additional courses not previously taken or insufficiently covered must be supplemented:

a) Graduating from a specialized field as prescribed in Clause 2 of this Article at other schools;

2. Graduation from a specialized marine navigation or marine machinery operation program or marine electrical engineering program at specialized maritime training institutions;

c) Graduating from inland waterway navigation or inland waterway engine operation at a specialized inland waterway school;

4. Having a valid file as prescribed in Article 43 of this Decision;

5. Meeting the professional requirements and time periods for assuming positions corresponding to each position as prescribed in Articles 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, and 33 of this Decision.

c) Graduation from a specialized inland waterway vessel control or inland waterway vessel machinery operation or inland waterway vessel electrical engineering program at specialized inland waterway training institutions.

4. Possessing a valid file in accordance with the provisions of Section 5 of this Circular;

5. Meeting the professional and time requirements corresponding to each position as stipulated in Articles 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, and 39 of this Circular.

Article 22. Conditions for Issuing the Certificate of Special Competence for Master and Chief Officer of Ships of 3,000 Gross Tonnage (GT) and Above

1. Professional conditions:

a) Graduation from a bachelor's degree program in marine navigation; in case of graduation from a college or vocational college program in marine navigation with a study period of 36 months, they must complete the advanced training program prescribed by the Ministry of Transport;

b) Possessing a level 3 Maritime English or equivalent to certificate C or higher;

c) Completing the professional refresher course as prescribed by the Ministry of Transport and passing the officer examination at the level of managing ships of 3,000 GT and above.

2. Qualification Requirements:

a) For Chief Officer: having at least 24 months of experience in the position of Deck Officer on ships of 500 GT and above;

b) For Master:

- Having at least 24 months of experience in the position of Chief Officer on ships of 3,000 GT and above, or having at least 12 months of experience in the position of Master on ships of 500 GT to less than 3,000 GT and at least 12 months of experience in the position of Chief Officer on ships of 3,000 GT and above;

- Passing the examination for Master of ships of 3,000 GT and above.

Article 23. Conditions for Issuing the Certificate of Special Competence for Master and Chief Officer of Ships of 500 GT to Less Than 3,000 GT

1. Professional conditions:

a) Graduation from a college or vocational college program in marine navigation with a study period of 36 months; in case of graduation from a specialized vocational college program in marine navigation with a study period of less than 36 months or a vocational college program with a study period of 24 months, they must complete the advanced training program prescribed by the Ministry of Transport;

b) Possessing a level 2 Maritime English or equivalent to certificate B or higher;

c) Completing the professional refresher course as prescribed by the Ministry of Transport and passing the officer examination at the level of managing ships of 500 GT to less than 3,000 GT.

2. Qualification Requirements:

a) For Chief Officer: having at least 24 months of experience in the position of Deck Officer on ships of 500 GT and above;

b) For Master:

- Having at least 24 months of experience in the position of Chief Officer on ships of 500 GT to less than 3,000 GT, or having at least 12 months of experience in the position of Master on near-coastal ships of 50 GT to less than 500 GT and at least 12 months of experience in the position of Chief Officer on ships of 500 GT to less than 3,000 GT;

- Passing the examination for Master of ships of 500 GT to less than 3,000 GT.

Article 24. Conditions for Issuing the Certificate of Competency for Masters and Chief Officers of Ships from 50 GT to less than 500 GT not Operating in Coastal Waters

Masters and Chief Officers of ships from 50 GT to less than 500 GT not operating in coastal waters must hold a Certificate of Competency of Masters and Chief Officers of ships from 500 GT and above.

Article 25. Conditions for Issuing the Certificate of Competency for Masters and Chief Officers of Ships from 50 GT to less than 500 GT Operating in Coastal Waters

1. Professional conditions:

a) Graduated from a marine engineering program at a vocational college or technical college with a training period of less than 36 months, or from a vocational secondary school with a training period of 24 months; in cases where the graduate has completed a marine engineering program at a vocational secondary school with a training period of less than 24 months or a long-term vocational training program from 12 to less than 24 months, they must complete the advanced training program prescribed by the Ministry of Transport;

b) Possess Maritime English proficiency level 1 or equivalent to English certification level A or higher;

c) Complete the short-term vocational training program as prescribed by the Ministry of Transport and pass the officer examination according to the management level of ships from 50 GT to less than 500 GT.

2. Qualification Requirements:

a) For Chief Officers: have a minimum of 24 months of experience serving in the position of deck officer on ships from 50 GT to less than 500 GT operating in coastal waters;

b) For Masters: have a minimum of 24 months of experience serving in the position of Chief Officer on ships from 50 GT to less than 500 GT operating in coastal waters.

Article 26. Conditions for Issuing the Certificate of Competency for Masters of Ships under 50 GT

1. Professional conditions:

a) Completion of secondary education;

b) Complete the short-term specialized training program in ship operation and pass the examination as prescribed by the Ministry of Transport; in cases where the graduate has completed a specialized training program in ship operation at a vocational secondary school level, only passing the examination is required.

2. Sea service time requirement: have at least 12 months of sea service.

Article 27. Conditions for Issuing the Certificate of Competency for Deck Officers of Ships from 500 GT and Above

1. Professional conditions:

a) Graduated from a marine engineering program at a college or technical college with a training period of 36 months; in cases where the graduate has completed a marine engineering program at a vocational college or technical college with a training period of less than 36 months or a vocational secondary school with a training period of 24 months, they must complete the advanced training program prescribed by the Ministry of Transport;

b) Possess Maritime English proficiency level 2 or equivalent to English certification level B or higher;

c) Pass the examination for deck officers on ships from 500 GT and above.

2. Time requirements for holding the position:

a) Have a minimum of 12 months of recorded internship in the "Training Record Book" according to the training program that meets the requirements of Section A-II/1 of the STCW Convention, or have a minimum of 36 months of sea service on ships from 500 GT and above, including at least 6 months serving in the role of duty seaman;

b) In cases where the individual has served as a deck officer on ships from 50 GT to less than 500 GT operating in coastal waters, they must have at least 6 months of sea service on ships from 500 GT and above.

Article 28. Conditions for Issuing the Certificate of Competency for Deck Officers of Ships from 50 GT to less than 500 GT not Operating in Coastal Waters

Deck officers of ships from 50 GT to less than 500 GT not operating in coastal waters must hold a Certificate of Competency of Deck Officers of ships from 500 GT and above as stipulated in Article 27 of this Circular.

Article 29. Conditions for issuing a Certificate of Professional Competence for Deck Officers on vessels from 50 GT to less than 500 GT

1. Professional conditions:

a) Graduated in the marine navigation major at a vocational college level with a training period of less than 36 months or a vocational school level with a training period of 24 months; in cases where the graduate has completed a vocational school program in marine navigation with a training period of less than 24 months or a long-term vocational training program of less than 24 months, they must complete the advanced training program prescribed by the Ministry of Transport;

b) Possess Maritime English proficiency level 1 or equivalent to English certification level A or higher;

c) Achieve the results of the Deck Officer examination for vessels from 50 GT to less than 500 GT.

2. Time condition for holding the position: have a minimum of 36 months of sea service on vessels of 50 GT or more.

Article 30. Conditions for issuing a Certificate of Professional Competence for Chief Engineer and Second Engineer on vessels with main engine power of 3,000 kW or more

1. Professional conditions:

a) Graduated in the marine engineering major at a bachelor's degree level; in cases where the graduate has completed a vocational college or vocational college program in marine engineering with a training period of 36 months, they must complete the advanced training program prescribed by the Ministry of Transport;

b) Possess a Maritime English proficiency level 3 or equivalent to a certificate C or higher;

c) Complete the professional development program as prescribed by the Ministry of Transport and achieve the results of the Officer examination for vessels with main engine power of 3,000 kW or more.

2. Qualification Requirements:

a) For Second Engineer: have a minimum of 24 months of experience in holding the position of Engineer Officer on vessels with main engine power of 750 kW or more;

b) For Chief Engineer:

- Have a minimum of 24 months of experience in holding the position of Second Engineer on vessels with main engine power of 3,000 kW or more, or hold the position of Chief Engineer on vessels with main engine power from 750 kW to less than 3,000 kW for a minimum of 12 months and hold the position of Second Engineer on vessels with main engine power of 3,000 kW or more for a minimum of 12 months;

- Achieve the results of the Chief Engineer examination for vessels with main engine power of 3,000 kW or more.

Article 31. Conditions for issuing a Certificate of Professional Competence for Chief Engineer and Second Engineer on vessels with main engine power from 750 kW to less than 3,000 kW

1. Professional conditions:

a) Graduated in the marine engineering major at a vocational college or vocational college level with a training period of 36 months; in cases where the graduate has completed a vocational college program in marine engineering with a training period of less than 36 months or a vocational school program with a training period of 24 months, they must complete the advanced training program prescribed by the Ministry of Transport;

b) Possessing a level 2 Maritime English or equivalent to certificate B or higher;

c) Complete the professional development program as prescribed by the Ministry of Transport and achieve the results of the Officer examination for vessels with main engine power from 750 kW to less than 3,000 kW.

2. Qualification Requirements:

a) For Second Engineer: have a minimum of 24 months of experience in holding the position of Engineer Officer on vessels with main engine power of 750 kW or more;

b) For Chief Engineer:

- Have a minimum of 24 months of experience in holding the position of Second Engineer on vessels with main engine power from 750 kW to less than 3,000 kW, or hold the position of Chief Engineer on vessels with main engine power from 75 kW to less than 750 kW for a minimum of 12 months and hold the position of Second Engineer on vessels with main engine power from 750 kW to less than 3,000 kW for a minimum of 12 months;

- Achieve the results of the Chief Engineer examination for vessels with main engine power from 750 kW to less than 3,000 kW.

Article 32. Conditions for issuing a Certificate of Professional Competence for Chief Engineer and Second Engineer on vessels with main engine power from 75 kW to less than 750 kW

1. Professional conditions:

a) Graduated in marine machinery operation major at a vocational college or technical secondary school with a training period of 24 months, or a vocational college with a training period of less than 36 months; in cases where graduated in marine machinery operation major at a technical secondary school with a training period of less than 24 months or long-term vocational training with a period of less than 24 months, must complete the advanced training program prescribed by the Ministry of Transport;

b) Possess Maritime English proficiency level 1 or equivalent to English certification level A or higher;

c) Completed the vocational training program as prescribed by the Ministry of Transport and achieved the results of the officer examination according to the management level of vessels with main engine power from 75 kW to less than 750 kW.

2. Time requirements for holding the position:

a) For Second Engineer: have served in the position of marine machinery officer on vessels with main engine power from 75 kW to less than 750 kW for a minimum of 24 months;

b) For Chief Engineer: have served in the position of Second Engineer on vessels with main engine power from 75 kW to less than 750 kW for a minimum of 24 months or served in the position of marine machinery officer on vessels with main engine power from 75 kW to less than 750 kW for a minimum of 36 months.

Article 33. Conditions for issuing a Certificate of Professional Competence for Chief Engineer on vessels with main engine power below 75 kW

1. Professional conditions:

a) Completion of secondary education;

b) Completed a short-term specialized training program in marine machinery operation and achieved the examination results as prescribed by the Ministry of Transport; in cases where already graduated in marine machinery operation major at a basic vocational school, only need to achieve the examination results.

2. Sea service time requirement: have at least 12 months of sea service.

Article 34. Conditions for issuing a Certificate of Professional Competence for Marine Machinery Officer on vessels with main engine power of 750 kW or more

1. Professional conditions:

a) Graduated in the marine engineering major at a vocational college or vocational college level with a training period of 36 months; in cases where the graduate has completed a vocational college program in marine engineering with a training period of less than 36 months or a vocational school program with a training period of 24 months, they must complete the advanced training program prescribed by the Ministry of Transport;

b) Possessing a level 2 Maritime English or equivalent to certificate B or higher;

c) Achieved the results of the examination for Marine Machinery Officer on vessels with main engine power of 750 kW or more.

2. Time requirements for holding the position:

a) Have a minimum of 12 months of internship recorded in the "Training Record Book" according to the training program meeting the requirements of Section A-III/1 of the STCW Convention or have a minimum of 36 months of sea service on vessels with main engine power of 750 kW or more, including at least 6 months serving in the duty engineer watchkeeping position;

Article 35. Conditions for issuing a Certificate of Professional Competence for Marine Machinery Officer on vessels with main engine power from 75 kW to less than 750 kW

1. Professional conditions:

a) Graduated in marine machinery operation major at a vocational college, vocational college with a training period of less than 36 months, or technical secondary school with a training period of 24 months; in cases where graduated in marine machinery operation major at a technical secondary school with a training period of less than 24 months or long-term vocational training with a training period of less than 24 months, must complete the advanced training program prescribed by the Ministry of Transport;

b) Possess Maritime English proficiency level 1 or equivalent to English certification level A or higher;

c) Achieved the results of the examination for Marine Machinery Officer on vessels with main engine power from 75 kW to less than 750 kW.

2. Service time conditions for holding the position: have a minimum of 36 months of sea service on vessels with main engine power of 75 kW or more.

Article 36. Conditions for Issuing the Certificate of Professional Competence for Watch Ratings on Deck

1. Watch Rating on Deck OS:

a) Graduated from a marine deck operations program at a vocational intermediate level with training duration under 24 months; in case of graduation from a marine deck operations program at a vocational basic level, must complete the advanced training program prescribed by the Ministry of Transport;

b) Hold a certificate of basic vocational training;

c) Hold a certificate of security awareness vocational training on board ships; d) Have at least six months of sea service or two months of watch rating on deck OS apprenticeship.

d) Has at least six months of sea time or two months of on-call watchkeeping seaman training.

2. Watch Rating on Deck AB:

a) Graduated from a marine deck operations program at a vocational intermediate level with training duration under 24 months; in case of graduation from a marine deck operations program at a vocational basic level, must complete the advanced training program prescribed by the Ministry of Transport;

b) Hold a certificate of basic vocational training;

c) Hold a certificate of security awareness vocational training on board ships;

d) Have at least eighteen months of sea service or twelve months of watch rating on deck AB apprenticeship.

Article 37. Conditions for Issuing the Certificate of Professional Competence for Watch Ratings on Engine Room

1. Watch Rating on Engine Room Oiler:

a) Graduated from a marine engine operations program at a vocational intermediate level with training duration under 24 months; in case of graduation from a marine engine operations program at a vocational basic level, must complete the advanced training program prescribed by the Ministry of Transport;

b) Hold a certificate of basic vocational training;

c) Hold a certificate of security awareness vocational training on board ships;

d) Have at least six months of sea service or two months of watch rating on engine room Oiler apprenticeship.

2. Watch Rating on Engine Room AB:

a) Graduated from a marine engine operations program at a vocational intermediate level with training duration under 24 months; in case of graduation from a marine engine operations program at a vocational basic level, must complete the advanced training program prescribed by the Ministry of Transport;

b) Hold a certificate of basic vocational training;

c) Hold a certificate of security awareness vocational training on board ships;

d) Have at least eighteen months of sea service or twelve months of watch rating on engine room AB apprenticeship.

Article 38. Conditions for Issuing the Certificate of Professional Competence for Engineering Officer

1. Professional conditions:

a) Graduated from a marine electrical engineering program at a college or vocational college level with training duration of 36 months; in case of graduation from a marine electrical engineering program at a vocational professional intermediate level, vocational college level with training duration under 36 months or vocational intermediate level with training duration of 24 months, must complete the advanced training program prescribed by the Ministry of Transport;

b) Possessing a level 2 Maritime English or equivalent to certificate B or higher;

c) Complete the vocational training program as prescribed by the Ministry of Transport and pass the examination for marine electrical engineering officer;

2. Duration of holding the position: have at least twelve months of internship recorded in the "Training Record Book" according to the training program meeting the requirements set out in Table A-III/6 of the STCW Convention or have at least thirty-six months of sea service.

Article 39. Conditions for Issuing the Certificate of Professional Competence for Electrical Rating

1. Graduated from a marine electrical engineering program at a vocational intermediate level with training duration under 24 months; in case of graduation from a marine electrical engineering program at a vocational basic level, must complete the advanced training program prescribed by the Ministry of Transport;

2. Hold a certificate of basic vocational training;

3. Hold a certificate of security awareness vocational training on board ships;

4. Have at least six months of sea service or three months of electrical rating apprenticeship.

Section 3. ORGANIZATION OF ENGINEERING OFFICER EXAMINATIONS

Article 40. Examination Board for Engineering Officers

1. The Examination Board for Engineering Officers (hereinafter referred to as the Examination Board) shall be established by the Director of the Vietnam Maritime Administration, consisting of five to seven members: the Chairman of the Examination Board is the leadership of the Vietnam Maritime Administration; the members are representatives of the Department of Organization and Cadres - Ministry of Transport, representatives of some related functional departments of the Vietnam Maritime Administration, heads of training and education institutions.

2. The Examination Board has the following tasks:

a) Advise the Director of the Vietnam Maritime Administration to decide: list of candidates; establishment of the Examination Committee for the engineering officer examination (hereinafter referred to as the Examination Committee) to organize and supervise the examination and grading; selection of examination questions for each rank; recognition of examination results;

b) Organize, inspect, and supervise the conduct of examinations.

c) Compiling and reporting the examination results;

d) Handling violations of examination regulations.

Article 41. Examination Board

1. The Examination Committee shall be established by the Director of the Vietnam Maritime Administration based on the proposal of the Chairman of the Examination Board.

2. The number of members of the Examination Board depends on the number of candidates but must be at least three members, of which at least one-third of the members of the board do not directly participate in teaching. Members of the Examination Board are captains, chief engineers, experts in the maritime field, management field, teachers with pedagogical skills, competence, experience, and professional qualifications corresponding to the level and expertise required for each course.

3. Duties of the Examination Board:

a) Strictly, fairly, accurately, and correctly asking and grading exams to assess the candidates' level;

b) Detecting errors in the exam questions and promptly proposing adjustments to the Examination Board;

c) Detecting and recommending to the Chairman of the Examination Board negative phenomena during the examination for prompt resolution.

Article 42. Chief Instructor

1. Chief Instructors at training institutions or on ships are individuals with experience and professional qualifications, trained in instructional methods according to programs approved by the Ministry of Transport and certified by the Vietnam Maritime Administration as Chief Instructors.

2. Chief Instructors must have experience, professional qualifications, and appropriate instructor certificates for the relevant courses; if simulation is used during the course, they must hold certificates compatible with the simulation program they teach.

3. Only Chief Instructors or those holding foreign-issued Chief Instructor certificates that comply with the 1978 STCW Convention as amended in 2010 may be assigned to instruct corresponding courses; train seafarers and record practical training logs on board ships.

Section 4. TRAINING AND TRAINING INSTITUTIONS

Article 43. Basic Vocational Training and Security Awareness Training

1. Graduates from specialized maritime training institutions shall be issued Certificates of Basic Vocational Training and Certificates of Security Awareness Training by such institutions.

2. Seafarers who have not undergone basic vocational training or security awareness training must complete the prescribed training programs and obtain certificates from the training institutions.

Article 44. Specialized Vocational Training

1. Specialized vocational training applies to seafarers working on oil tankers, chemical carriers, liquefied gas carriers, passenger ships, and Ro-Ro passenger ships.

2. Specialized vocational training for seafarers working on oil tankers, chemical carriers, and liquefied gas carriers includes basic vocational training and advanced vocational training.

3. Specialized vocational training for seafarers working on passenger ships and Ro-Ro passenger ships includes training on safety for direct service staff in passenger areas; passenger safety, cargo safety, and hull integrity; crowd management and crisis management.

4. For oil tankers, chemical carriers, and liquefied gas carriers, Certificates of Familiarization Training are issued to seafarers who have completed the familiarization training program and passed the examination as required.

5. For oil tankers, chemical carriers, and liquefied gas carriers, Certificates of Advanced Vocational Training are issued to captains, chief engineers, first officers, second engineers, officers, and other crew members responsible for cargo handling and care who have completed the advanced vocational training program and passed the examination as required.

6. For passenger ships and Ro-Ro passenger ships, Certificates of Specialized Vocational Training are issued upon completion of one or more of the following training programs:

a) Captains, first officers, officers, and crew members tasked with assisting passengers in emergency situations have completed the crowd management training program and passed the examination as required;

b) Captains, first officers, chief engineers, second engineers, and crew members responsible for passenger embarkation and disembarkation, cargo handling, securing, and opening and closing side, bow, and stern doors have completed the passenger safety, cargo safety, and hull integrity training program and passed the examination as required;

c) Captains, first officers, chief engineers, second engineers, and crew members responsible for passenger safety in emergency situations have completed the crisis management and emergency response training program and passed the examination as required;

d) Crew members directly serving passengers in passenger areas have completed the safety training program and passed the examination as required.

Article 45. Professional Training

1. Radar Observation and Plotting: The certificate of professional training on radar observation and plotting shall be issued to captains, chief mates, and deck officers who have completed the relevant course and passed the examination as prescribed.

2. ARPA: The certificate of professional training on ARPA shall be issued to captains, chief mates, and deck officers who have completed the relevant course and passed the examination as prescribed.

3. GMDSS:

a) General Operator's Certificate (GOC): The general operator's certificate shall be issued to captains, chief mates, and deck officers working on ships equipped with GMDSS operating in areas A2, A3, and A4 who have completed the general operator's course and passed the examination as prescribed by the Minister of Information and Communications.

b) Restricted Operator's Certificate (ROC): The restricted operator's certificate shall be issued to captains, chief mates, and deck officers working on ships equipped with GMDSS operating in area A1 who have completed the restricted operator's course and passed the examination as prescribed.

4. Electronic Chart Display and Information System (ECDIS): The certificate of professional training on electronic chart display and information system shall be issued to captains, chief mates, and deck officers who have completed the relevant course and passed the examination as prescribed.

5. Maritime English: The maritime English certificate shall be issued to seafarers who have completed the maritime English course and passed the examination as prescribed.

6. Bridge Resource Management: The certificate of professional training on bridge resource management shall be issued to captains, chief mates, and deck officers who have completed the relevant course and passed the examination as prescribed.

7. Engine Room Resource Management: The certificate of professional training on engine room resource management shall be issued to chief engineers, second engineers, and engine officers who have completed the relevant course and passed the examination as prescribed.

8. Ship Security Awareness: The certificate of professional training on ship security awareness shall be issued to seafarers who have completed the ship security awareness course and passed the examination as prescribed.

9. Specific Security Duties for Seafarers: The certificate of professional training on specific security duties for seafarers shall be issued to seafarers who have completed the course on specific security duties for seafarers and passed the examination as prescribed.

10. Ship Security Officer: The certificate of professional training on ship security officer shall be issued to captains, chief mates, and deck officers who have completed the relevant course and passed the examination as prescribed.

11. Advanced Fire Fighting: The certificate of professional training on advanced fire fighting shall be issued to deck officers, engine officers who have completed the advanced fire fighting training program and passed the examination as prescribed.

12. First Aid: The certificate of professional training on first aid shall be issued to deck officers, engine officers who have completed the first aid training program and passed the examination as prescribed.

13. Medical Care: The certificate of professional training on medical care shall be issued to captains, chief mates, and seafarers responsible for medical care on board who have completed the relevant training program and passed the examination as prescribed.

14. Lifeboat and Rescue Boat: The certificate of professional training on lifeboat and rescue boat shall be issued to deck officers, engine officers, boatswains, and motormen who have completed the relevant training program and passed the examination as prescribed.

15. Fast Rescue Boat: The certificate of professional training on fast rescue boat shall be issued to deck officers, engine officers, boatswains, and motormen working on ships equipped with fast rescue boats who have completed the relevant training program and passed the examination as prescribed.

Seafarers wishing to obtain the certificate of professional training on fast rescue boat must hold the certificate of professional training on lifeboat and rescue boat.

16. Ship Safety Management: The certificate of professional training on ship safety management shall be issued to those who have completed the ship safety management course and passed the examination as prescribed.

Article 46. Training Institutions

1. A training institution is a school or center for training that has legal personality, its own seal and account, and is approved by the Minister of Transport on the basis of meeting the following conditions:

a) Having sufficient instructors, teachers, and trainers who meet the standards required for each training program;

b) Having training programs and teaching materials in accordance with the regulations of the Ministry of Transport, consistent with the model courses of the International Maritime Organization (IMO Model Course);

c) Meeting the technical infrastructure and equipment requirements for training as stipulated in each training program issued by the Ministry of Transport, consistent with the equipment specified in the IMO Model Courses;

d) Possessing an ISO quality management system certification.

2. Training institutions shall be responsible for:

a) Organizing training according to approved programs;

b) Organizing examinations and evaluating examination results;

c) Issuing Certificates of Competency Training;

d) Annually reporting to the Vietnam Maritime Administration on the training situation, issuance of Certificates of Competency Training, and internal assessment in accordance with the provisions of the STCW Convention and its amendments.

3. Within a period of five years, training institutions must undergo independent evaluation in accordance with the provisions of the STCW Convention and its amendments.

Article 47. Confirmation of Issuance of Certificates

Vietnamese seafarers who have been issued Special Competency Training Certificates for familiarization and advanced training on oil tankers, chemical carriers, liquefied gas carriers, GOC, and ROC by training institutions must be issued a Certificate of Confirmation of Issuance of Certificates by the Vietnam Maritime Administration.

Section 5. PROCEDURES FOR ISSUING, EXTENDING, REISSUING, RECOGNIZING AND CONFIRMING SPECIAL COMPETENCY CERTIFICATES AND SEAFARER TRAINING CERTIFICATES

Article 48. Procedures for Issuing Certificates Confirming Seafarer Competency Certificates

1. The subject of issuance is foreign seafarers working on Vietnamese-flagged vessels.

Article 50. Procedure for Extending the Professional Competence Certificate

1. The administrative procedure subject is seafarers who have a Professional Competence Certificate that has expired and meet the following conditions:

a) Within the working age and meeting health standards as prescribed;

b) Have held a position corresponding to the Professional Competence Certificate for a total of 12 months or more within five years; if this period is not met, they must undergo a three-month probationary period according to the position of the Professional Competence Certificate in the six months immediately preceding the extension request.

2. Organizations and individuals submit one set of application files for extending the Professional Competence Certificate directly at the Vietnam Maritime Administration or send it via postal service. The file includes:

a) A seafarer's application form according to Form V attached hereto or a management organization's application document according to Form VI of this Circular;

b) The original expired Professional Competence Certificate (in cases where seafarers working away from home cannot submit the original expired certificate, they must submit it within seven days from the date of returning to Vietnam);

b) In case of receiving the file through the postal system, if the file does not comply with the required provisions, the Vietnam Maritime Administration will notify in writing no later than two working days from the date of receipt of the file;

c) If the file does not meet the conditions for extending the Professional Competence Certificate according to regulations, respond in writing and specify the reasons;

d) Within three working days from the date of receiving all required files, the Vietnam Maritime Administration will issue the Professional Competence Certificate according to the model specified in Form I of this Circular.

4. Fees and charges: the fee for extending the Professional Competence Certificate shall be implemented according to the regulations of the Ministry of Finance.

Article 53. Procedures for reissuing certificates of professional competence, certificates of issuance of certificates, certificates recognizing certificates of professional competence, certificates of training instructors

1. The subject of administrative procedures is seafarers who have certificates of professional competence, certificates of issuance of certificates, certificates recognizing certificates of professional competence, certificates of training instructors (hereinafter referred to as certificates) that are damaged, contain incorrect information, or are lost.

2. Organizations and individuals submit one set of application files for reissuing certificates directly at the Vietnam Maritime Administration or send them through postal service. The file includes:

a) The application form of the seafarer according to the model in Appendix XI or the request document of the seafarer management organization according to the model in Appendix XII of this Circular;

b) The original certificate that is damaged or contains incorrect information;

c) Legal documents proving corrections for cases with incorrect information;

d) Two color photos, size 3x4 cm, ID card style taken within six months.

3. The Vietnam Maritime Administration receives the file, checks the components and quantity of the file according to regulations, registers it in the logbook, and schedules the result delivery within the prescribed time limit:

a) In case of direct submission, if the file does not comply with the required provisions, return the file and guide organizations and individuals to complete the file according to regulations;

b) In case of receiving the file through the postal system, if the file does not comply with the required provisions, the Vietnam Maritime Administration will notify in writing no later than two working days from the date of receipt of the file;

c) In case the file does not meet the conditions for reissuing certificates as prescribed, it must be replied in writing and clearly state the reasons;

d) Within three working days from the date of receiving the complete file as prescribed, the Vietnam Maritime Administration shall reissue the certificate according to the model prescribed in Appendix I of this Circular.

4. Fees and charges: the fee for reissuing certificates shall be implemented in accordance with the regulations of the Ministry of Finance.

Article 54. Revocation of Seafarer's Professional Certificates

Seafarer's professional certificates will be revoked in cases where seafarers forge application documents to take exams or tamper with, forge, buy, sell, or rent professional certificates. The Director of the Vietnam Maritime Administration decides on revocation.

g) A declaration of sea service time (no confirmation from the seafarer management organization is required) according to the model in Appendix XIV of this Circular;

h) Certified copies of seafarer's logbooks;

i) Two color photos, size 3x4 cm, ID card style taken within six months.

3. Training institutions accept applications, check the components and quantity of the files as prescribed, record them in the register, and notify organizations and individuals of the results. In case the files do not comply with the regulations, training institutions guide organizations and individuals to complete the files as prescribed. If they do not meet the conditions to attend advanced training courses, vocational training courses, or officer examinations as prescribed, they must be notified and the reasons clearly stated.

4. Within ten working days from the date of receiving the complete files as prescribed, training institutions submit one set of files directly to the Vietnam Maritime Administration or send them through postal service. The file includes:

a) The request document of the training institution regarding the review of the list of trainees attending advanced training courses, vocational training courses, and officer examinations; shipmasters and chief engineers according to the model in Appendix XV of this Circular;

b) One set of trainee files (attached).

5. The Vietnam Maritime Administration accepts the files, checks, reviews the files, and issues decisions on those who meet the conditions to attend training courses, examinations. In case they do not meet the conditions, they must be notified and the reasons clearly stated.

6. Based on the examination results of officers, shipmasters, and chief engineers reported by the Examination Board, the Vietnam Maritime Administration issues a decision recognizing the examination results of officers, shipmasters, and chief engineers and issuing professional capability certificates within five working days.

7. Fees and charges: the fee for reviewing the list of trainees attending advanced training courses, vocational training courses, officer examinations, shipmaster and chief engineer examinations, and issuing professional capability certificates shall be implemented in accordance with the regulations of the Ministry of Finance.

2. Based on technical characteristics, degree of automation, and operational areas of the vessel, the Ship Registration Authority shall determine the minimum safety manning framework suitable for the actual operation of the vessel.

The assignment of positions for Vietnamese vessels must comply with the following requirements:

Holders of the Seafarer's Competency Certificate corresponding to the position they hold.

Crew members assigned to oil tankers, chemical carriers, liquefied gas carriers, Ro-Ro ships must hold the appropriate Seafarer's Competency Certificate.

Principles for assigning positions in certain cases regarding the assignment of positions for chief engineers, deck officers, pilots, search and rescue personnel, and maritime police operations shall be carried out in accordance with the guidelines of the Ministry of Transport.

In cases where the vessel increases its size, technical characteristics, or operational area, the person in charge of the vessel may temporarily assign two substitute chief engineers or deck officers to ensure the vessel can continue its voyage until reaching the next port.

Article 59. Implementation organization

1. The Vietnam Maritime Administration is responsible for organizing the implementation of this Circular in coordination with relevant agencies.

2. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of the relevant Departments, the Director of the Vietnam Maritime Administration, the heads of agencies, organizations, and individuals related to this matter shall be responsible for implementing this Circular./.
