Decision No. 11/2013/QD-TTg Prohibits Exporting, Importing, and Trading Specimens of Certain Wild Animal Species Listed in Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES)

Prohibits export, import, and trade in specimens of certain wild animal species listed in the Appendices to the Convention on International Trade in Endangered Species of Wild Fauna and Flora Hereinafter referred to as the CITES Convention

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Forest Protection and Development Law dated December 3, 2004;

Pursuant to the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

Pursuant to Decree No. 82/2006/NĐ-CP dated August 10, 2006 of the Government on management of activities related to export, import, re-export, import from sea, transit, breeding, growing, and artificial cultivation of endangered, precious, and rare wild animal and plant species;

At the proposal of the Minister of Agriculture and Rural Development;

The Prime Minister issues this Decision prohibiting export, import, and trade in specimens of certain wild animal species listed in the Appendices to the CITES Convention,

Article 1. Prohibits export, import, and trade in specimens of wild animal species listed in the Appendices to the CITES Convention, except for cases provided for in Article 2 of this Decision:

1. Specimens of white rhinoceros (Ceratotherium simum) and products made from white rhinoceros.

2. Specimens of black rhinoceros (Diceros bicornis) and products made from black rhinoceros.

3. Specimens of African elephant (Loxodonta africana) and products made from African elephant.

Article 2. Specimens specified in Article 1 of this Decision may be imported in the following cases:

1. Specimens for diplomatic purposes, scientific research, biodiversity conservation facilities, zoo exhibitions; non-commercial circus performances, law enforcement; exchange of specimens between CITES Management Authorities of member countries.

2. Specimens for non-commercial purposes that meet the conditions for import under agreements between the CITES Management Authority of Vietnam and the CITES Management Authority of the exporting country.

3. Specimens that have been granted CITES import permits before this Decision takes effect.

Article 3. Handling of violations

Organizations and individuals violating the provisions of this Decision shall be subject to criminal or administrative penalties according to current laws governing the management, protection, trade, transportation, export, and import of wild animal and plant species.

Article 4. Implementation Provisions

This Decision shall take effect from March 15, 2013.

2. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision./.
