DECREE

Regulations on physical education and sports activities in schools

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Education Law dated June 14, 2005 and the Law amending and supplementing certain articles of the Education Law dated November 25, 2009;

Pursuant to the Law on Physical Culture and Sports dated November 29, 2006;

Pursuant to the Higher Education Law on June 18, 2012;

Pursuant to the Law on Vocational Education dated November 27, 2014;

promulgates a Decree stipulating the criteria for stratification, ranking framework, and ranking standards for higher education institutions.

The Government promulgates this Decree on physical education and sports activities in schools.

Article 1. Scope of Regulation and Applicability

1. This Decree stipulates physical education and sports activities in schools.

2. This Decree applies to educational institutions within the national education system, including: kindergartens, primary schools, secondary schools, high schools, general education schools with multiple levels, vocational colleges, universities, academies, regional universities, and national universities (hereinafter referred to collectively as "schools") and related organizations and individuals.

3. This Decree does not apply to physical education at specialized sports training schools.

Article 2. Position and objectives of physical education and sports activities in schools

1. Physical education in schools is a compulsory subject within the curriculum of each level of education and training, aimed at equipping children, students, and university students with basic movement knowledge and skills, forming habits of physical exercise and sports to enhance health, develop physical strength and stature, contributing to achieving comprehensive educational goals.

2. Sports activities in schools are voluntary activities for students and university students, organized in extracurricular formats such as sports clubs, groups, or individually according to interests, gender, age, and health conditions, aiming to improve movement skills, support physical education goals through sports practice and competition, provide opportunities for students and university students to enjoy play and entertainment, develop sports talents, and identify and nurture sports abilities and talents.

Article 3. Curriculum for Physical Education Subject

1. The curriculum for the Physical Education subject is part of the general education curriculum, vocational education curriculum, and higher education curriculum; the physical education content in the preschool education program reflects the physical education goals; it specifies standards for knowledge and skills, scope, and structure of physical education content, methods and forms of organizing physical education activities, and ways to assess the implementation results of the Physical Education subject at each educational level or training level.

2. Authority to issue the curriculum for the Physical Education subject

a) The Minister of Education and Training issues the curriculum for the Physical Education subject within the general education curriculum and the physical education content within the preschool education curriculum;

b) The Rectors of universities and academies and Principals of universities are responsible for developing, reviewing, and issuing the school's training programs, including the Physical Education subject curriculum in accordance with the regulations of the Minister of Education and Training;

c) The Principals of vocational colleges and intermediate-level colleges are responsible for developing, reviewing, and issuing the school's training programs, including the Physical Education subject curriculum in accordance with the regulations of the head of the central state management agency for vocational education.

Article 4. Physical Education Teachers and Coaches

1. Physical education teachers and coaches must meet the standards and qualifications for educators as stipulated in Articles 70 and 77 of the Education Law.

2. Physical education teachers and coaches shall exercise their rights, fulfill their obligations, and enjoy benefits and policies for educators as well as special preferential policies as prescribed by the Prime Minister.

4. Provincial People's Committees and municipal people's committees under the central government manage job positions, including those for physical education teachers and coaches for public schools within their jurisdiction.

5. Schools shall ensure the presence of physical education teachers and coaches to implement the Physical Education subject curriculum as prescribed by the Education Law, the Higher Education Law, the Vocational Education Law, and related legal documents.

Article 5. Sports Activities and Sports Competitions

1. Sports Activities

b) The Minister of Education and Training shall guide the content of sports activities in primary schools, lower secondary schools, upper secondary schools, general schools with multiple levels; universities, academies, regional universities, and national universities.

2. Sports Competitions

Sports competitions include:

a) National and international student and youth sports congresses;

b) National and international student and youth sports tournaments.

3. Authority to Decide on Sports Competitions

b) The Prime Minister shall decide on hosting international student and youth sports congresses and tournaments in Vietnam upon the proposal of the Minister of Education and Training.

Article 6. Financial Resources and Facilities for Physical Education and Sports Activities in Schools

1. Financial resources for physical education and sports activities in schools shall be guaranteed from the state budget according to the current budget classification; from the income of educational institutions; from donations by organizations and individuals; and from other lawful sources.

2. Facilities for physical education and sports activities in schools include: training fields, multi-purpose training halls, gyms, swimming pools, equipment, and safety conditions to effectively implement the Physical Education subject curriculum and sports activities appropriate to each level of education or training.

3. Ministries, sectors, and people's committees at all levels shall balance the budget to invest in and construct facilities to meet the requirements for equipment serving physical education and sports activities for public schools under their direct supervision; create favorable conditions for schools to use sports facilities in their locality to serve physical education and sports activities in schools.

4. People's committees at all levels shall plan land funds for physical education and sports activities in schools according to national standards; implement preferential policies on land, tax, and credit for private schools to enable these schools to build facilities for physical education and sports activities in schools.

5. Schools shall ensure investment in construction and proper use of facilities for physical education and sports activities in accordance with the provisions of the Education Law, the Higher Education Law, the Physical Education and Sports Law, the Vocational Education Law, and current legal documents.

Article 7. Socialization of physical education and sports activities in schools

1. The State encourages and creates conditions for organizations and individuals to invest and contribute resources to build infrastructure, provide equipment and training tools for sports competitions to serve physical education and sports activities in schools.

2. Organizations and individuals contributing resources to invest in building infrastructure serving physical education and sports activities in schools shall enjoy preferential policies on tax, credit, land, and their legitimate rights shall be protected according to current laws.

3. Educational management agencies at all levels and schools have the responsibility to support and create conditions for sports clubs and student sports associations to operate, thereby enhancing the effectiveness of physical education and sports activities in schools.

4. Encouragement is given to investment in facilities serving physical education and sports activities in schools through public-private partnership models.

Article 8. Effective Date

This Decree takes effect from July 1, 2015.

Article 9. Responsibility for implementation

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government shall be responsible for enforcing this Decree./.
