Based on the Education Law dated June 14, 2005; the Law Amending and Supplementing Certain Provisions of the Education Law dated November 25, 2009;
Based on the Higher Education Law dated June 18, 2012;
Based on Decree No. 69/2017/NĐ-CP dated May 25, 2017thereof of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates criteria for identifying specialized goods directly serving education.
Article 2. This Circular applies to preschool education, general education, teacher training colleges, teacher training colleges, universities, academies, university institutions (hereinafter referred to as educational institutions); organizations and individuals related to the import of specialized goods directly serving education.
Article 2. Interpretation of Terms
The terms used in this Circular shall be understood as follows:
Specialized goods directly serving education are goods used for nurturing, caring, teaching, learning, and scientific research activities of teachers and students in educational institutions; including: equipment, machinery, materials, tools, chemicals, supplies, toys, books, learning materials, education and training programs, textbooks, magazines, technology chains, and other goods.
Learning materials are physical means for storing, carrying, or reflecting learning and research content. Learning materials can be used in traditional forms (pictures, card images) and electronic learning materials. Electronic learning materials are digitized learning materials according to a specific format and script, stored on electronic devices such as CDs, USB drives, computers, computer networks to serve teaching and learning purposes. Digitization formats may include text, data tables, audio, images, video, computer software, and combinations thereof.
Article 3. Criteria for Identifying Specialized Goods Directly Serving Education
Specialized goods directly serving education shall meet the following criteria:
Point 1. Goods comply with current Vietnamese laws.
Point 2. Goods have a special construction and usage function, only used in educational institutions.
Point 3. Goods are included in the list of teaching equipment for preschool and general education issued by the Minister of Education and Training or are part of procurement and bidding lists under approved investment projects and scientific research tasks in educational institutions according to current Vietnamese laws.
Point 4. Goods ensure pedagogical suitability, align with educational goals and programs at various levels and training degrees; ensuring the objectives of scientific research tasks.
Point 5. Goods are consistent with the development trends of advanced science and technology in the region and worldwide.
Article 4. Effective date
This Circular takes effect from May 22, 2018.
During implementation, if there are difficulties, organizations and individuals are requested to report to the Ministry of Education and Training for study and resolution.
Article 5. Responsibilities for Implementation
The Head of the Office, the Director of the Material and Infrastructure Department, the Director of the Planning and Finance Department, the Heads of relevant units under the Ministry of Education and Training; the Directors of provincial education and training departments, the Heads of educational institutions; related organizations and individuals are responsible for implementing this Circular./.
