REGULATIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE STATE COMMITTEE FOR VIETNAMESE OVERSEAS AFFAIRS UNDER THE MINISTRY OF FOREIGN AFFAIRS

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 26/2017/NĐ-CP dated March 14, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;

At the proposal of the Minister of Foreign Affairs;

The Prime Minister issues this Decision to regulate the functions, tasks, powers, and organizational structure of the State Committee for Vietnamese Overseas Affairs under the Ministry of Foreign Affairs.

Article 1. Position and Functions

1. The State Committee for Vietnamese Overseas Affairs (hereinafter referred to as the Committee) is a general department under the Ministry of Foreign Affairs, assisting the Minister of Foreign Affairs in performing state management functions regarding overseas Vietnamese affairs.

Article 2. The Committee has legal personality, bears the State Emblem seal, and is entitled to open an account at the State Treasury in accordance with the law, with its headquarters located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

Clause 1. To advise and assist the Minister of Foreign Affairs in presenting to the Government, the Prime Minister, and competent authorities:

a) Draft laws and draft resolutions of the National Assembly; draft ordinances and draft resolutions of the Standing Committee of the National Assembly; draft decrees and resolutions of the Government; draft decisions and directives of the Prime Minister on overseas Vietnamese affairs;

b) Strategies, long-term plans, national target programs; action programs, important projects of the Government concerning overseas Vietnamese affairs.

Clause 2. To submit to the Minister of Foreign Affairs for consideration and decision:

a) Draft circulars, decisions, directives, and other documents concerning overseas Vietnamese affairs;

b) Long-term, medium-term, and annual plans on overseas Vietnamese affairs.

Clause 3. To implement policies, laws, strategies, plans, programs, projects concerning overseas Vietnamese affairs after they have been issued or approved by competent authorities.

4. Provide professional guidance on overseas Vietnamese affairs within its authority.

5. Summarize and evaluate the situation of overseas Vietnamese communities; support and create favorable conditions for overseas Vietnamese to stabilize their lives, integrate into local societies, promote national solidarity, maintain Vietnamese cultural identity; mobilize and attract overseas Vietnamese resources to serve national development; organize, support, and guide overseas Vietnamese organizations and individuals in their relations with domestic entities.

6. Inform and disseminate the Party's guidelines, state policies and laws, and the country's situation to overseas Vietnamese.

7. Implement international cooperation related to overseas Vietnamese affairs in accordance with the law.

8. Manage social organizations related to overseas Vietnamese in accordance with the law.

9. Carry out commendation work in overseas Vietnamese affairs.

10. Conduct inspections and checks on the implementation of legal provisions in the field of overseas Vietnamese affairs within its jurisdiction.

11. Implement administrative reform according to the goals and contents of the approved state administrative reform program.

12. Manage organizational structures and staffing; implement salary systems and other incentive policies, training, commendation, and disciplinary measures for civil servants and employees under the Committee's jurisdiction in accordance with the law and the delegation of the Minister of Foreign Affairs.

13. Manage finances and assets assigned and organize the implementation of the state budget allocated in accordance with the law.

14. Organize citizen reception, handle complaints and denunciations, and prevent corruption, thrift, and waste in accordance with the law.

15. Perform other tasks and powers delegated by the Minister of Foreign Affairs or stipulated by law.

Article 3. Organizational Structure

Item 1. Research and Synthesis Department.

2. Information and Culture Department.

3. Economic, Science, and Technology Relations Department.

4. Legal Departmentpolicies - Inspection.

5. Office.

6. Homeland Magazine.

The organizations specified from Clause 1 to Clause 5 of this Article are administrative organizations assisting the Director of the Committee in performing state management functions; Homeland Magazine is a public service unit directly under the Committee. The Office shall be organized into five divisions.

The issuance of specific regulations on functions, tasks, powers, and organizational structure; appointment and removal of heads and deputy heads of units under the Committee shall be carried out in accordance with the law and the delegation of the Minister of Foreign Affairs.

Article 4. Leadership of the Committee

1. The Committee has a Director and not more than four Deputy Directors.

2. The Director of the Committee shall be appointed and removed by the Minister of Foreign Affairs and shall be responsible to the Minister of Foreign Affairs for all activities of the Committee. The Minister of Foreign Affairs shall appoint a Deputy Minister to serve as the Director of the Committee.

3. Deputy Directors of the Committee shall be appointed and removed by the Minister of Foreign Affairs upon the recommendation of the Director of the Committee and shall be responsible to the Director of the Committee for the areas of work assigned.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from April 5, 2019; replacing Decision No. 102/2008/QĐ-TTg dated July 18, 2008 of the Prime Minister regulating the functions, tasks, powers, and organizational structure of the State Committee for Vietnamese Overseas Affairs under the Ministry of Foreign Affairs.

2. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial and centrally-administered city People's Committees, Directors of the State Committee for Vietnamese Overseas Affairs, and relevant agencies and organizations shall be responsible for implementing this Decision.
