Circular No. 11/2019/TT-BGTVT amends and supplements some articles of Circular No. 24/2018/TT-BGTVT dated May 7, 2018, issued by the Minister of Transport on the construction of train schedules and traffic management for railway transport.

Amending and supplementing some articles of Circular No. 24/2018/TT-BGTVT dated May 7, 2018, issued by the Minister of Transport on the construction of train schedules and traffic management for railway transport

At the proposal of the Director of the Personnel Organization Department and the Director of the Vietnam Registration Bureau;

Pursuant to the Price Law dated June 20, 2012;

Pursuant to Decree No. 177/2013/NĐ-CP dated November 14, 2013, promulgated by the Government detailing and guiding the implementation of certain provisions of the Law on Prices, and Decree No. 149/2016/NĐ-CP dated November 11, 2016, promulgated by the Government amending and supplementing certain provisions of Decree No. 177/2013/NĐ-CP;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Transport Department and the Director of the Vietnam Railway Administration;

The Minister of Transport hereby issues this Circular amending and supplementing some articles of Circular No. 24/2018/TT-BGTVT dated  May 7, 2018, issued by the Minister of Transport on the construction of train schedules and traffic management for railway transport.

Article 1. Amending and supplementing certain Articles of Circular No. 24/2018/TT-BGTVT dated May 7, 2018, issued by the Minister of Transport on the construction of train schedules and traffic management for railway transport

1. Amend and supplement Article 17 as follows:

 “Article 17. Price of traffic management services for railway transport

1. The pricing of traffic management services for railway transport on infrastructure funded by the State shall be set as a maximum price for passenger trains and freight trains on each route.

2. The scale of maximum prices for traffic management services for railway transport shall be issued together with this Circular.”

2. Amend and supplement Clause 1 of Article 21 as follows:

“1. When factors forming the price of traffic management services for railway transport fluctuate, affecting production and living conditions, the competent state agency for railways or the enterprise operating national railway infrastructure may request or propose adjustments to the maximum price plan for traffic management services for railway transport. The enterprise operating national railway infrastructure shall be responsible for building the price adjustment plan to be reviewed by the Vietnam Railway Administration; the Ministry of Transport shall decide on the maximum price for traffic management services for railway transport after consulting the Ministry of Finance.”

Article 2. Abolished Provisions

Abolish Clause 3 of Article 18 of Circular No. 24/2018/TT-BGTVT dated May 7, 2018, issued by the Minister of Transport on the construction of train schedules and traffic management for railway transport.

Article 3. Implementation Provisions

1. This Circular takes effect from May 1, 2019.

2. The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, the Heads of Departments, the Director of the Vietnam Railway Administration, and the Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular./.
