REGULATIONS ON CONDITIONS FOR EDUCATIONAL AND RESEARCH INSTITUTIONS TO ORGANIZE AND IMPLEMENT CONTINUING EDUCATION PROGRAMS FOR CIVIL SERVANTS IN THE CULTURE, SPORTS, AND TOURISM SECTOR
Pursuant to the Civil Servant Law No. 58/2010/QH12 dated November 15, 2010;
Pursuant to Clause 8, Article 40 of the Government Decree No. 101/2017/NĐ-CP dated September 1, 2017 on training and continuing education for civil servants and public officials;
Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017, of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
At the proposal of the Director of the Cadre and Civil Servant Department,
The Minister of Culture, Sports and Tourism issues this Circular stipulating the conditions for educational and research institutions to organize and implement continuing education programs for civil servants in the culture, sports, and tourism sector.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Circular stipulates the conditions for educational and research institutions to organize and implement continuing education programs for civil servants in the culture, sports, and tourism sector, including: conditions regarding the program and training materials; lecturers; physical facilities and practical bases; and the experience in organizing training and continuing education of such educational and research institutions.
2. This Circular applies to:
a) Educational and research institutions include: academies, research institutes, universities, colleges, and secondary vocational schools that offer majors in culture, sports, and tourism;
b) Relevant agencies, organizations, and individuals
Article 3. Purpose of Capacity Building
1. To enhance the professional knowledge, skills, and occupational ethics of civil servants in the culture, sports, and tourism sector.
2. To meet the occupational title standards prescribed by law as a basis for considering promotion and participating in promotion examinations according to occupational title standards and implementing other related policies.
Chapter II
CONDITIONS FOR EDUCATIONAL AND RESEARCH INSTITUTIONS TO ORGANIZE AND IMPLEMENT CONTINUING EDUCATION PROGRAMS FOR CIVIL SERVANTS IN THE CULTURE, SPORTS, AND TOURISM SECTOR
Article 3. Continuing Education Programs
1. Continuing education programs based on occupational title standards for civil servants in the culture, sports, and tourism sector, including specialties such as Libraries, Cultural Heritage, Community Culture, Fine Arts, Performing Arts and Cinema, Physical Education and Sports, and other specialties issued by the Ministry of Culture, Sports and Tourism in accordance with the law.
2. Continuing education programs based on job position requirements, specialized knowledge, and skills for civil servants in the culture, sports, and tourism sector, issued by the Ministry of Culture, Sports and Tourism or provincial/municipal People's Committees.
Article 4. Training Materials
1. Educational and research institutions shall use one of the following continuing education materials:
a) Continuing education materials based on occupational title standards for civil servants in the culture, sports, and tourism sector, which have been issued in accordance with the continuing education programs stipulated in Clause 1, Article 3 of this Circular;
b) Continuing education materials based on job position requirements, specialized knowledge, and skills for civil servants in the culture, sports, and tourism sector, which have been issued in accordance with the law.
2. Training materials must be developed based on occupational title standards for specialized civil servants, regularly updated, and consistent with corresponding continuing education programs for civil servants; they must meet the practical needs of occupational activities for civil servants in the culture, sports, and tourism sector.
Article 5. Lecturers
1. Lecturers from educational and research institutions, part-time lecturers, and invited guest lecturers must meet the lecturer standards for training and continuing education of civil servants and public officials as stipulated in Articles 34 and 35 of the Government Decree No. 101/2017/NĐ-CP dated September 1, 2017 on training and continuing education for civil servants and public officials.
2. Lecturers from educational and research institutions must be sufficient to teach at least 70% of the assigned continuing education program workload.
3. Invited guest lecturers must have appropriate professional qualifications, management skills, and experience in line with the continuing education program.
Article 6. Material and practical facilities
1. Must have sufficient classrooms, functional rooms, and necessary equipment to meet the requirements for theoretical teaching and practical training of vocational skills in the cultural, sports, and tourism sectors.
2. Must have adequate information resources, including books, textbooks, lectures, and related materials to serve the work of training civil servants in the cultural, sports, and tourism sectors.
3. Must have an electronic information website providing and updating information on the list of lecturers, the catalog of materials for each training program, and having a database system to store information about courses and participants.
Article 7. Experience in organizing training and retraining
The training and research institution must have at least three years of experience in organizing retraining for civil servants, or be organized to train at the intermediate level or higher in relevant fields or specialties related to the retraining programs according to the occupational titles of civil servants in the cultural, sports, and tourism sectors.
Chapter III
IMPLEMENTATION
Article 8. Responsibilities of Ministries, Ministerial-Level Agencies, Government Agencies, Central Political-Social Organizations, Provincial People's Committees, and Centrally-Administered Municipal People's Committees
1. Assign tasks to training and research institutions under their management authority to implement specific retraining programs according to the occupational titles of civil servants in the cultural, sports, and tourism sectors; retraining programs based on job position requirements, specialized knowledge, and skills of civil servants; submit lists to the Ministry of Culture, Sports and Tourism for consolidation, monitoring, and management.
2. Annually, compile and submit reports on the results of retraining civil servants in the cultural, sports, and tourism sectors to the Ministry of Culture, Sports and Tourism (through the Department of Organization and Cadres) before December 31 for monitoring and management.
Article 9. Responsibilities of training and research institutions assigned retraining tasks
1. Prepare or select training materials for civil servants in the cultural, sports, and tourism sectors that are appropriate to the retraining programs issued by the Ministry of Culture, Sports and Tourism and for each target group; provide reference materials to support teaching and learning.
2. Develop plans and organize retraining for civil servants in the cultural, sports, and tourism sectors for each target group in accordance with legal regulations.
3. Decide on the list of students admitted, manage the learning process, evaluate learning outcomes, and recognize learning results of students in accordance with legal regulations.
Article 10. Responsibilities of agencies and units with participants in retraining
1. Annually, develop plans for retraining civil servants in the cultural, sports, and tourism sectors within their management authority; report to the direct supervisory agency and coordinate with the training and research institution to organize retraining according to the plan.
2. Have the responsibility to manage files; ensure the standards of participants sent for retraining as prescribed.
Article 11. Effective date:
This Circular takes effect from January 1, 2020.
Article 12. Responsibility for Implementation
1. Ministries, ministerial-level agencies, government agencies, central political-social organizations, provincial People's Committees, and other relevant organizations and individuals are responsible for implementing this Circular.
2. In the process of implementation, if there are difficulties or obstacles, it is recommended that agencies, organizations, and individuals reflect these issues to the Ministry of Culture, Sports and Tourism for consideration and resolution./.
