CIRCULAR

REGULATIONS ON THE LIST OF PRODUCTS AND GOODS WITH POTENTIAL TO CAUSE SAFETY HAZARDS UNDER THE RESPONSIBILITY OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Pursuant to the Law on Telecommunications dated November 23, 2009;

WHEREAS, the Law on Radio Frequency Spectrum dated November 23, 2009;

Pursuant to the Law on Information Technology dated June 29, 2006;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing certain provisions of the Law on Product Quality, Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP of the Government detailing certain provisions of the Law on Product Quality;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to the proposal of the Director of the Science and Technology Department,

The Minister of Information and Communications issues this Circular regulating the List of products and goods with potential to cause safety hazards under the responsibility of the Ministry of Information and Communications.

Article 1. Scope of Regulation

1. This Circular regulates the List of products and goods with potential to cause safety hazards under the responsibility of the Ministry of Information and Communications (hereinafter referred to as the List of products and goods group 2) and principles for managing products and goods group 2.

2. This Circular applies only to products and goods described in the List of products and goods group 2.

Article 2. Applicability

This Circular applies to:

1. Organizations and individuals engaged in production and business of products and goods listed in the List of products and goods group 2 in Vietnam.

2. Organizations and individuals engaged in activities related to quality management of products and goods listed in the List of products and goods group 2 in Vietnam.

Article 3. List of Products and Goods Group 2

1. The List of products and goods group 2 and forms of management are regulated as follows:

a) "List of information and communication technology products and goods that must be certified and declared to meet standards" is stipulated in Appendix I of this Circular.

b) "List of information and communication technology products and goods that must be declared to meet standards" is stipulated in Appendix II of this Circular.

2. The Ministry of Information and Communications shall review, amend, and supplement the List of products and goods group 2 periodically, in accordance with state management policies.

Article 4. Principles for Managing Products and Goods Group 2

1. Quality management of products and goods listed in the List of products and goods group 2 shall be carried out in accordance with the regulations of the Ministry of Information and Communications on certification and declaration to meet standards and quality inspection for information and communication technology products and goods and corresponding technical regulations.

2. Products and goods listed in the List of products and goods group 2 that integrate functions of other products and goods listed in the List of products and goods group 2 must fully certify and declare to meet all applicable technical standards for integrated products and goods.

3. Products and goods listed in the List of products and goods group 2 subject to two or more national technical standards must certify and declare to meet standards in accordance with the provisions of those technical standards.

4. In cases where technical standards promulgated before the effective date of this Circular provide different regulations on certification and declaration to meet standards compared to the provisions of this Circular, such regulations must be implemented according to the provisions of this Circular.

5. In cases where new technical standards amend, supplement, or replace technical standards specified in the List of products and goods group 2, the provisions of the new technical standards shall apply.

Article 5. Implementation Provisions

1. This Circular takes effect from July 1, 2020 and replaces Circular No. 05/2019/TT-BTTTT dated July 9, 2019 of the Minister of Information and Communications regulating the List of products and goods with potential to cause safety hazards under the responsibility of the Ministry of Information and Communications.

2. Certificates of conformity and notifications of acceptance of declarations of conformity issued before the effective date of this Circular and still within their validity period shall continue to be applied until the effective date of new technical standards replacing the technical standards and standards mentioned in the certificates of conformity and notifications of acceptance of declarations of conformity.

Article 6. Implementation Organization

1. The Director of the Office, Heads of the Science and Technology Department, Heads of agencies and units under the Ministry of Information and Communications, and relevant organizations and individuals are responsible for implementing this Circular.

2. During the application of technical standards and testing, organizations and individuals have the responsibility to promptly reflect any difficulties and implement according to the guidance of the Ministry of Information and Communications (Science and Technology Department).

3. In case of disputes regarding the determination of HS code for imported goods that are products and goods with potential to cause safety hazards within the scope of regulation of this Circular, the Ministry of Information and Communications will coordinate with the Ministry of Finance (General Customs Department) to resolve them uniformly./.

Note: The implementation of conformity declaration for products and goods specified in Appendix II for certain specific cases is regulated as follows:

(*) For QCVN 63:2012/BTTTT: it is not mandatory to declare conformity for requirements and characteristics related to DVB-T; the standard TCVN 7600:2010 mentioned in the regulation is not applicable.

(**) For QCVN 101:2016/BTTTT: only mandatory to declare conformity for safety characteristics as stipulated in Article 2.6 of the regulation; it is not mandatory to declare conformity for transportation requirements as stipulated in Article 2.6.2.7 of the regulation.

(***) For these QCVNs, the electromagnetic compatibility requirements mentioned in the regulations are not applicable.

(****) Imported marine radar equipment for ships is exempted from quality inspection under Resolution 99/NQ-CP dated November 13, 2019 of the Government, but must still implement conformity declaration before use.

(*****) Short-range radio transmitting and transmitting-receiving equipment refers to short-range radio equipment defined in Circular No. 46/2016/TT-BTTTT dated December 26, 2016 of the Minister of Information and Communications on the List of Radio Equipment Exempted from Frequency Usage Licenses, Technical Conditions, and Operation Regulations, amended and supplemented by Circular No. 18/2018/TT-BTTTT dated December 20, 2018 of the Minister of Information and Communications. Conformity declaration shall be implemented only when the equipment complies with the frequency band and technical conditions and operation regulations as prescribed.
