CIRCULAR
Regulations on the List of Radio Equipment Exempt from Frequency Usage Licenses
Technical Conditions and Operation Requirements
WHEREAS, the Law on Radio Frequency Spectrum dated November 23, 2009;
Pursuant to Decision No. 71/2013/QĐ-TTg dated November 21, 2013 of the Prime Minister promulgating the National Radio Frequency Band Plan;
Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Considering the proposal of the Director of the Radio Frequency Management Department,
The Minister of Information and Communications issues this Circular stipulating the list of radio equipment exempt from frequency usage licenses, technical conditions, and operation requirements.
Article 1. Scope of Regulation and Applicability
1. This Circular stipulates the list and technical conditions, operation requirements for radio equipment exempt from frequency usage licenses.
2. This Circular applies to organizations and individuals managing, using, producing, importing, and trading radio equipment exempt from frequency usage licenses for use in Vietnam.
3. This Circular does not apply to radio equipment produced or imported for national defense and security purposes by armed forces. The production, importation, and use of such radio equipment shall be regulated by the Ministry of Defense and the Ministry of Public Security in accordance with relevant national technical standards.
Article 2. Interpretation of Terms
In this Circular, the following terms are understood as follows:
1. Short Range Device (SRD) is a radio device that transmits and/or receives signals unidirectionally or bidirectionally with limited potential to cause harmful interference to other radio devices.
2. Non-Specific Short Range Device (NSRD) includes SRDs meeting specified technical and operational conditions, regardless of their application or intended use.
3. Cordless Phone is a terminal telephone connected to the public switched telephone network (PSTN) through a two-wire interface. This device consists of two separate units connected via a wireless interface:
Central unit (also called base station or mother unit): fixedly installed and connected to the PSTN's two-wire telephone lines, using an integrated antenna. An integrated antenna is a fixed antenna designed and located inside or outside the device and is part of it.
Mobile unit (which may include multiple mobile units, also called child units): handheld unit equipped with an integrated antenna. The mobile unit carries the telephone subscription number of the central unit.
4. Medical Implant Communication System (MICS) and Medical Implant Telemetry System (MITS)
The Medical Implant Communication System (hereinafter referred to as MICS) and the Medical Implant Telemetry System (hereinafter referred to as MITS) are systems comprising medical implant devices within the human body and external wireless communication devices used to exchange data with the implants within a distance of two meters, which then transmit the data to a processing center and to the physician via telecommunications networks.
In the MICS system, there is bidirectional data exchange between the implant and the wireless communication device. In the MITS system, there is only unidirectional data transmission from the implant to the wireless communication device at pre-programmed times.
5. Radio Frequency Identification (RFID) DeviceRadio Frequency Identification (RFID))
The RFID device uses radio waves to automatically identify, track, and manage goods, people, animals, and other applications. The RFID device consists of two separate units connected via a wireless interface:
- Radio Tag (RF tag) carrying an electronic chip, powered or not powered, attached to the object to be identified. The electronic chip contains information about the object.
- Radio Frequency Reader (RF Reader) emits a specific frequency to activate the RF tag, which then transmits the tag's information. This information is received by the reader and transferred to the data processing system.
RFID devices are used in distribution, transportation, retail, healthcare, traffic, or mobile applications (smart advertising).
6. Radio Detection and Alarm Device
The Radio Detection and Alarm Device includes a sensor and a control system connected via a wireless interface.
Some typical Radio Detection and Alarm Devices: anti-theft devices, motion detectors, metal detectors.
7. Wireless Audio Device
The Wireless Audio Device includes devices using radio waves to transmit sound over short distances.
Some typical Wireless Audio Devices: body-worn wireless microphones, handheld wireless microphones, wireless headphones, personal FM transmitters, hearing aids.
8. Remote Control Device
The Remote Control Device includes devices using radio waves to control models, industrial, and household controls.
Some typical Remote Control Devices: remote control for aerial models like model airplanes, remote control for ground and water models like model cars and boats, remote control for industrial and household use like car door and garage door controls.
9. Wireless Local Area Network (WLAN) Device
The Wireless Local Area Network (WLAN) Device, hereinafter referred to as "WLAN Device," is used to establish a wireless local network or to connect directly to each other instead of using cables.
Certain typical WLAN devices include: access points, wireless routers, wireless network cards, and devices integrated with radio modules according to the IEEE 802.11 standard (excluding wireless bridges used to connect between WLAN networks).
10. Telemetry Device
A telemetry device automatically displays or records measurement parameters and controls the functions of other devices through a radio interface.
11. Wireless Video Transmitter
A wireless video transmitter is used to transmit image data to a processing system via a radio interface.
Some typical wireless video transmitters include: wireless webcams, wireless cameras, and wireless video transmitters connected via a USB port from a computer.
12. Marine Vessel Radio Equipment
Marine vessel radio equipment is used for communication between fishing vessels operating in Vietnam's maritime areas.
13. Receiver-only Radio Equipment It is a radio device that only has the function of receiving radio frequency signals.
14. Broadband Data Transmission Equipment It is a radio device used for broadband transmission applications in mobile networks IMT-Advanced (LTE-Advanced technology and subsequent versions) using the frequency band 5150-5350 MHz, 5470-5850 MHz with a minimum channel bandwidth of 20 MHz, or for high-speed access up to gigabits per second in wireless local area networks (WLAN), wireless personal area networks (WPAN: Wireless Personal Area Network) operating within the 57-66 GHz frequency range.
15. Automotive Radar It is a short-range radar device used for traffic information applications such as cruise control, detection, warning, and collision avoidance between vehicles and surrounding objects.
16. Low-Power Walkie-Talkie It is a mobile radio terminal device capable of receiving and transmitting voice signals within a limited area (for example, a building, campus).
17. Ultra-Wideband Communication Device (UWB) It is a short-range radio device used for transmitting information at GHz frequencies with a signal bandwidth exceeding 500 MHz.
18. Inductive Loop It is a device that transmits signals based on electromagnetic field principles and operates at low frequencies.
19. Automatic Identification System (AIS)Automatic Identification System) It is a radio device used in marine safety systems installed and used on ships, boats, and other motorized or non-motorized vessels to enhance the efficiency of traffic management and collision avoidance operations on water or underwater.
20. Emergency Position Indicating Radio Beacon (EPIRB) It is a radio emergency position beacon using the frequency band 406-406.1 MHz, installed and used on vessels operating on water or underwater, including ships, boats, and other motorized or non-motorized vessels.
21. Search and Rescue Radar Transponder (SART) It is a radio device used for maritime search and rescue purposes, operating at the 9 GHz frequency band.
22. Automatic Identification System Search and Rescue Radar Transponder (AIS-SART) It is a radio device belonging to the category of maritime support equipment used by search and rescue agencies to locate life-saving equipment or distressed vessels during search and rescue operations.
Article 3. The list of radio equipment exempt from frequency usage permits and technical and operational conditions accompanying it
1. The list of radio equipment exempt from frequency usage permits (hereinafter referred to as the List) is specified in Appendix 1 issued together with this Circular.
2. Technical and operational conditions for radio equipment exempt from frequency usage permits are specified in Appendices 2 to 19 issued together with this Circular.
Article 4. Exemption from frequency usage permits
Radio equipment listed in the List that complies with the general provisions set forth in Article 5 and meets the corresponding technical and operational conditions specified in Appendices 2 to 19 issued together with this Circular shall be exempt from frequency usage permits.
Article 5. General Provisions
The following conditions apply generally to radio equipment exempt from frequency usage permits:
1. Radio equipment exempt from frequency usage permits must accept the possibility of harmful interference from radio equipment authorized to use frequency usage permits, radio equipment permitted by management authorities to operate.
In the event that radio equipment exempt from frequency usage permits causes harmful interference to radio equipment authorized to use frequency usage permits, radio equipment permitted by management authorities to operate, organizations and individuals must immediately cease operation and may only resume operation once the interference has been resolved.
2. Radio equipment exempt from frequency usage permits must accept interference caused by radio frequency energy applications in industry, science, and medicine (ISM-Industrial, Scientific and Medical) when using the following bands designated for ISM:
- Band 13,553 to 13,567 MHz;
- Band 26,957 to 27,283 MHz;
- Band 40,66 to 40,70 MHz;
- Band 2400 to 2483,5 MHz;
d) Band 5725 to 5875 MHz;
- Band 24000 to 24250 MHz.
3. Organizations and individuals producing or importing radio equipment exempt from frequency usage permits are responsible for complying with legal regulations on importation, certification, conformity declaration, and ensuring that the equipment meets the technical and operational conditions according to the relevant Appendices of this Circular.
4. Organizations and individuals operating or using radio equipment with integrated remote control functions in aircraft models must comply with legal regulations on flight permit issuance.
5. Organizations and individuals using radio equipment solely exempt from frequency usage permits must comply with telecommunications, radio frequency, and other related legal regulations; shall not use the received information for illegal purposes.
Article 6. Transitional Provisions and Effective Date
1. Radio equipment that complies with Circular No. 03/2012/TT-BTTTT dated March 20, 2012 of the Ministry of Information and Communications on "List of radio equipment exempted from frequency usage permits, technical conditions, and operation" but no longer meets the provisions of this Circular shall continue to be used but must cease operation when causing harmful interference to radio equipment authorized to use radio frequencies.
2. Low-power handheld transceivers listed in Appendix 1 of this Circular, under the corresponding frequency conditions, technical conditions, and operations specified in Appendices 2 and 18 of this Circular, shall be exempted from radio frequency usage permits from January 1, 2020.
3. No new permits shall be issued for radio equipment using the 446-446.2 MHz band with power exceeding 500 mW from the date this Circular takes effect.
Article 7. Implementation Provisions
1. This Circular takes effect from February 14, 2017 and replaces Circular No. 03/2012/TT-BTTTT dated March 20, 2012 of the Minister of Information and Communications on "List of radio equipment exempted from frequency usage permits, technical conditions, and operation."
2. The Director of the Office, the Director of the Frequency Management Department, the Heads of agencies and units under the Ministry of Information and Communications, and related organizations and individuals are responsible for implementing this Circular.
3. During implementation, if there are difficulties, organizations and individuals should promptly report to the Ministry of Information and Communications (Frequency Management Department) for guidance or review and amendment.

Type of Radio Equipment)
1. The conditions regarding frequency and radiation limits include the following contents:
Frequency Band: specifying the frequency band limit for operation for license-exempt radio equipment corresponding to the relevant radio frequency.
Type of Radio Equipment or Radio Application: specifying the name of the type of radio equipment or radio application listed in Appendix 1 that is permitted to be used.
Main Radiation: specifying the maximum power emission limit (except for SART equipment which specifies the minimum transmission power) and expressed in terms of effective radiated power or equivalent isotropic radiated power for the license-exempt radio equipment corresponding to the relevant radio frequency.
Spurious emissions: specifying the maximum power emission limit for spurious emissions or the minimum reduction in spurious emissions for the license-exempt radio equipment corresponding to the relevant radio frequency.

1.1. Conditions for using the safety and rescue channel
1.1.1. In emergency situations where there is danger to life and property at sea, in addition to using channel 9 (dedicated for safety and rescue information), organizations and individuals sending distress signals may also broadcast on any channel listed in the frequency channel allocation table.
1.1.2. Upon receiving distress signals, radio stations must immediately cease transmission on frequencies that could interfere with distress communications and continuously monitor the distress call frequency; respond and provide immediate assistance, while reporting to search and rescue authorities.
1.2. Conditions for using the call channel
1.2.1. The call channel (channels 11 and 19) is exclusively for initiating calls between fishing vessels.
1.2.2. The call channel can be used for a maximum of one minute. The calling station identifies itself and the called station's name (repeated three times) on the call channel. Immediately upon receiving a response from the called station, the calling station initiates a switch to a communication channel; communication should not continue on the call channel.
1.3. Conditions for using the communication channel
1.3.1. The communication channel is selected from among 37 channels according to the frequency channel allocation table (excluding safety and rescue channels and call channels). If interference occurs due to another station during operation, switching to another communication channel to avoid interference is allowed.
1.3.2. The communication channel can be used for a maximum of five minutes. If longer communication is necessary, after five minutes of communication, a one-minute pause must be observed before continuing.
1.4. Users of wireless transmitting devices shall not engage in the following behaviors:
1.4.1. Using power exceeding the limited transmission power specified in this Annex.
1.4.2. Causing harmful interference to the safety and rescue channel.
1.4.3. Using the safety and rescue channel for call initiation and communication.
1.4.4. Using the call channel for communication (except for distress signals).
1.4.5. Occupying the communication channel continuously for more than five minutes or transmitting any carrier signal between calls.
1.4.6. Continuously transmitting call signals, identification signals on the call channel for more than one minute.
1.4.7. Simultaneously transmitting identification signals on two or more frequencies when communicating with only one station.
