Issuing the List of Prohibited Active Ingredients and Restricted Scope of Use in Insecticides and Disinfectants for Domestic and Medical Purposes

Pursuant to the Government's Decree No. 75/2017/NĐ-CP dated June 20, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Decree No. 91/2016/NĐ-CP dated July 1, 2016 of the Government on the management of chemicals, insecticides, and disinfectants for domestic and medical purposes;

At the proposal of the Director of the Health Environment Management Department,

The Minister of Health issues this Circular on issuing the List of Prohibited Active Ingredients and Restricted Scope of Use in Insecticides and Disinfectants for Domestic and Medical Purposes.

Article 1. Scope of Regulation

This Circular issues the List of Prohibited Active Ingredients and Restricted Scope of Use in Insecticides and Disinfectants for Domestic and Medical Purposes (hereinafter referred to as insecticides and disinfectants for domestic and medical purposes).

Article 2. Applicability

This Circular applies to agencies, organizations, and individuals involved in trading, production, business operations, and registration of circulation of insecticides and disinfectants for domestic and medical purposes in Vietnam and related organizations and individuals.

Article 3. List of Active Ingredients

1. Issuing the List of Prohibited Active Ingredients in Insecticides and Disinfectants for Domestic and Medical Purposes as stipulated in Appendix No. 01 attached to this Circular.

2. Issuing the List of Active Ingredients with Restricted Scope of Use in Insecticides and Disinfectants for Domestic and Medical Purposes as stipulated in Appendix No. 02 attached to this Circular.

Article 4. Effective date

1. This Circular takes effect from August 20, 2020.

2. Circular No. 47/2017/TT-BYT dated December 22, 2017 of the Minister of Health on issuing the List of Prohibited Active Ingredients and Restricted Scope of Use in Insecticides and Disinfectants for Domestic and Medical Purposes in Vietnam shall cease to be effective from the date this Circular comes into force.

Article 5. Transitional Provisions

1. Insecticides and disinfectants for domestic and medical purposes that have been registered for circulation before the date this Circular takes effect may continue to be produced and imported for a maximum period of one year, and sold and used for a maximum period of two years from the date this Circular takes effect under the following circumstances:

a) Insecticides and disinfectants for domestic and medical purposes containing one of the active ingredients Chlorpyrifos ethyl, Hexythiazox, Fipronil, Beta-cyfluthrin, Cyfluthrin, Trichlorfon, Diazinon, Acephate, Malathion, and Methanol as stipulated in Appendix No. 01 attached to this Circular;

b) Insecticides and disinfectants for domestic and medical purposes containing one of the active ingredients Emamectin benzoate and Spinosad with a scope of use not in accordance with the restricted scope of use provisions set out in Appendix No. 02 attached to this Circular.

2. From the date this Circular takes effect, all new applications, processing, and review of registration files for insecticides and disinfectants for domestic and medical purposes submitted before the date this Circular takes effect containing one of the active ingredients Chlorpyrifos ethyl, Hexythiazox, Fipronil, Beta-cyfluthrin, Cyfluthrin, Trichlorfon, Diazinon, Acephate, Malathion, and Methanol will be halted.

3. Insecticides and disinfectants for domestic and medical purposes containing the active ingredients specified in Appendix No. 02 attached to this Circular that have been registered for circulation before the date this Circular takes effect may only advertise their products according to the scope of use indicated on the registration certificate. If they wish to advertise a broader scope of use as specified in Appendix No. 02 attached to this Circular, the registrant must submit an additional registration application in accordance with Decree No. 91/2016/NĐ-CP dated July 1, 2016 of the Government on the management of chemicals, insecticides, and disinfectants for domestic and medical purposes and Decree No. 155/2018/NĐ-CP dated November 12, 2018 of the Government amending and supplementing certain regulations related to investment and business conditions under the Ministry of Health's jurisdiction.

Article 6. Responsibility for Implementation

1. The Director of the Department of Environmental Health Management is responsible for implementing this Circular.

2. The Heads of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, Directors of Bureaus, General Directors of General Bureaus, the Ministry’s Office, the Inspectorate of the Ministry, the Directors of Provincial Health Services under central cities, the Heads of Health Services of sectors, and relevant agencies, organizations, and individuals are responsible for enforcing this Circular.

During implementation, if there are difficulties or obstacles, agencies, organizations, and individuals should promptly report them to the Ministry of Health for consideration and resolution./.
