Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
Pursuant to Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government stipulating the organization of specialized agencies under provincial people's committees and central city people's committees, and Decree No. 107/2020/NĐ-CP dated September 14, 2020 of the Government amending and supplementing certain articles of Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government stipulating the organization of specialized agencies under provincial people's committees and central city people's committees;
Pursuant to Decree No. 37/2014/NĐ-CP dated May 5, 2014 of the Government stipulating the organization of specialized agencies under district, town, and provincial city people's committees and Decree No. 108/2020/NĐ-CP dated September 14, 2020 of the Government amending and supplementing certain articles of Decree No. 37/2014/NĐ-CP dated May 5, 2014 of the Government stipulating the organization of specialized agencies under district, town, and provincial city people's committees;
The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.
The Minister of Labor, Invalids, and Social Affairs promulgates this Circular guiding the functions, tasks, and authorities of the Department of Labor, Invalids, and Social Affairs under the provincial people's committee and central city people's committee (hereinafter referred to collectively as provincial level) and the Labor, Invalids, and Social Affairs Office under the district, town, and provincial city people's committee (hereinafter referred to collectively as district level).
PART I
DEPARTMENT OF LABOR, INVALIDS AND SOCIAL AFFAIRS
Article 1. Position and Functions
1. The Department of Labor, Invalids, and Social Affairs is a specialized agency under the provincial people's committee, performing the function of advising and assisting the provincial people's committee in managing state affairs regarding labor, wages, employment in the business sector; vocational education (excluding teacher training); social insurance; occupational safety and health; persons with meritorious service; social assistance; children; gender equality; prevention and control of social evils (hereinafter collectively referred to as the labor, persons with meritorious service, and social sectors) and according to the division of work or delegation of authority from the provincial people's committee, the Chairman of the provincial people's committee.
2. The Department of Labor, Invalids, and Social Affairs has legal personality, has a seal and bank account in accordance with the provisions of the law; it is subject to the direction and management of organizational structure, staffing, and personnel work by the provincial people's committee; at the same time, it is subject to the direction, inspection, and guidance on professional matters by the Ministry of Labor, Invalids, and Social Affairs.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit to the provincial People's Committee:
a) Draft decisions of the provincial people's committee related to the industry and field within the scope of management of the Department of Labor, Invalids, and Social Affairs and other documents as assigned by the provincial people's committee;
b) Draft plans for developing industries and fields; programs and measures to organize the implementation of tasks related to industries and fields within the province's jurisdiction of the Department of Labor, Invalids, and Social Affairs;
c) Draft decisions on the delegation of management tasks and powers in the industry and field to the Department of Labor, Invalids, and Social Affairs and the district people's committee;
d) Draft decisions specifying the functions, tasks, powers, and organizational structure of the Department of Labor, Invalids, and Social Affairs; draft decisions specifying the functions, tasks, powers, and organizational structure of the enforcement bureaus under the Department of Labor, Invalids, and Social Affairs (if any);
đ) Draft decisions on implementing the socialization of activities providing public services in the industry and field within the authority of the provincial people's committee and according to the delegation from higher-level state agencies.
2. Submitting to the Chairman of the Provincial People's Committee:
a) Drafting documents within the authority to issue by the Chairman of the Provincial People's Committee as assigned;
b) Draft decisions on the functions, tasks, powers, and organizational structure of public service units under the Department of Labor, Invalids, and Social Affairs.
3. Implement regulatory legal documents, planning, programs, projects, and plans after approval; provide information, propaganda, guidance, dissemination, education, and monitoring the implementation of laws concerning the fields within the delegated state management jurisdiction of the Department of Labor, Invalids, and Social Affairs.
4. In the field of employment:
a) Organize the implementation of long-term and annual strategies, programs, plans, projects, and proposals on employment, job creation support, labor market development, employment services, unemployment insurance, recruitment, and labor management in Vietnam according to the guidelines of competent authorities; collect, store, compile, analyze, forecast, disseminate, and manage local labor market information;
b) Guide and implement policies supporting job creation and unemployment insurance as prescribed by law;
c) Manage state affairs concerning organizations providing employment services in accordance with the law; organize the issuance, extension, reissue, or revocation of licenses for businesses operating employment services in accordance with the law and according to the division of work or delegation of authority from the provincial people's committee;
d) Approve the demand for foreign workers; confirm non-eligibility for work permits; issue, reissue, extend, and revoke work permits for foreign workers working in Vietnam in accordance with labor law regulations;
đ) Manage organizations delegated, authorized, tasked, commissioned, or tendered by the Department of Labor, Invalids, and Social Affairs for recruitment, management of Vietnamese workers working for foreign organizations and individuals;
e) Manage state affairs concerning foreign workers working in Vietnam and the recruitment, management of Vietnamese workers working for foreign organizations and individuals within the local jurisdiction.
5. In the field of Vietnamese workers going abroad to work under contracts:
a) Provide information on policies and laws regarding Vietnamese workers going abroad to work under contracts directly concluded to Vietnamese workers going abroad to work under labor contracts.
b) Confirm the registration of contracts for receiving interns for enterprises sending Vietnamese workers abroad for training and skill enhancement programs lasting less than ninety days; confirm the registration of labor contracts for Vietnamese workers going to work abroad under direct employment contracts.
c) Provide information on the labor market and recruitment needs of employers so that workers returning from abroad can choose suitable jobs matching their accumulated knowledge, skills, experience, and occupational qualifications after working overseas.
d) Support workers upon return to access voluntary social and psychological counseling services to facilitate integration. 59/2019/NĐ-CP into society.
6. In the field of vocational education (excluding teacher training):

a) Implement the planning of the vocational education institution network, plans, programs, projects, and development initiatives for vocational education in the locality after approval; organize and manage the system of vocational education institutions; guide and inspect the implementation of the self-governance mechanism for public vocational education institutions within its jurisdiction.
b) Guide and implement legal regulations concerning vocational education.
c) Guide and implement training, capacity building, and utilization of vocational education management staff and teachers; organize teaching contests among vocational education teachers, provincial-level self-made training equipment competitions, and related competitions for vocational education program students.
d) Organize the establishment, division, separation, merger, dissolution, renaming of intermediate vocational schools and vocational training centers; the establishment and recognition of private intermediate vocational schools and vocational training centers with foreign investment operating non-profit; the establishment and suspension of branch operations of intermediate vocational schools; the recognition and revocation of the principal positions in private intermediate vocational schools and vocational training centers; the recognition of the board of directors in private intermediate vocational schools; the issuance, suspension, and revocation of certificates of operation in vocational education and training and international training cooperation for intermediate vocational schools, vocational training centers, and enterprises.

a) Guide and implement legal provisions regarding labor contracts, labor discipline, material responsibility, workplace dialogue, collective bargaining, collective labor agreements, labor disputes and strikes, and the treatment of workers during enterprise restructuring, organization, sale, leasing, conversion, ownership transfer, asset usage rights transfer, enterprise liquidation, bankruptcy; state-owned enterprise reform, efficiency improvement.
b) Guide the implementation of legal provisions concerning wage systems in production and business areas.
c) Guide the implementation of legal provisions concerning female workers and gender equality, senior workers, disabled workers, underage workers, domestic workers, and other specific groups.
d) Guide and implement legal provisions concerning labor dispatch at the local level.
8. In the field of social insurance:

a) Guide and implement legal provisions concerning social insurance within the local area according to legal provisions and assignments or delegations from the provincial People's Committee.
b) Advise the provincial People's Committee to propose solutions (if necessary) to relevant ministries and sectors to resolve social insurance issues within their authority.
c) Receive applications and determine the number of workers temporarily suspended from contributing to the pension and death benefit fund for agencies, units, organizations, and enterprises managed by the provincial People's Committee.
d) Lead and coordinate with the Social Insurance Agency and related agencies to implement social insurance awareness campaigns in accordance with the characteristics of different target groups based on the Social Insurance Awareness Campaign Plan approved by the Ministry of Labor, Invalids, and Social Affairs.
a) Directing and organizing the implementation of legal provisions on labor safety and hygiene; on working hours and rest periods within the local area; Month of Action for Labor Safety and Hygiene;
9. In the field of occupational safety and health:
a) Guide and implement legal provisions concerning occupational safety and health, working hours, rest periods within the local area; Occupational Safety and Health Action Month.
b) Guide and implement management and quality control of special products and goods related to occupational safety and health; receive applications and process procedures for declaring conformity of special products and goods related to occupational safety and health.
d) Guide the implementation of preventive measures and risk sharing regarding workplace accidents and occupational diseases within the jurisdiction; organize the collection and storage of information on workplace accident situations; publish, evaluate workplace accident situations and serious technical incidents affecting workplace safety and hygiene occurring locally;
e) Receive documents reporting the organization of overtime work from over 200 to 300 hours in a year by enterprises, agencies, organizations, and individuals employing labor within the management area;
10. Regarding the field of persons with meritorious service:
a) Guide and organize the implementation of legal provisions for persons with meritorious service to the revolution and their dependents;
b) Implement the planning of social care facilities for nurturing and treating persons with meritorious service to the revolution, memorials for martyrs, and martyrs' graves; manage memorials for martyrs and martyrs' graves according to the classification level within the jurisdiction;
c) Chair and coordinate the organization of receiving and burying the remains of martyrs according to assigned or classified levels; provide information and notify about martyrs' graves; visit and move the remains of martyrs;
d) Manage the subjects, subject files, and funding for implementing preferential policies and benefits for persons with meritorious service to the revolution and their dependents;
đ) Guide and organize movements "Repaying Gratitude"; manage and utilize the "Repaying Gratitude" Fund at the provincial level;
11. Regarding the field of social assistance:
a) Guide and organize the implementation of social assistance systems, poverty reduction policies; legal provisions and policies for the elderly, disabled, poor households, near-poor households, low-income individuals, and other social assistance subjects;
b) Guide and organize the implementation of the National Target Program on Sustainable Poverty Reduction according to authority; programs, projects, and plans concerning social work, the elderly, the disabled, social assistance subjects, poverty reduction, labor health services, and other social assistance fields;
c) Organize the construction of a network of social assistance facilities, provide social work services; guide the reception of social assistance subjects into social assistance facilities and back to their families;
d) Aggregate and statistically compile data on social assistance subjects, the elderly, the disabled, mentally ill individuals, autistic children, individuals with mental disorders, poor households, near-poor households, and other social assistance subjects;
12. Regarding the field of children:
a) Guide and organize the implementation of policies, laws, programs, plans, models, and projects concerning: child protection; children's participation in child-related issues; prevention and control of child accidents and injuries; care and nurturing of children in special circumstances; building communes, towns, and wards suitable for children; Month of Action for Children;
b) Coordinate the implementation of children's rights consistent with local characteristics and conditions; propose resource allocation to ensure the implementation of children's rights and protection at the local level; organize and manage activities of child protection service facilities according to authority; support and intervene in cases where children are harmed or at risk of violence, exploitation, abandonment, and those in special circumstances;
c) Monitor and evaluate the implementation of children's rights according to legal provisions; propose the integration of child-related goals and indicators when the locality builds development strategies and plans; prepare annual or ad hoc reports on the implementation of children's rights and resolution of child-related issues at the local level;
13. Regarding the field of preventing and combating social evils:
a) Carry out regular tasks related to preventing prostitution, supporting harm reduction, and community reintegration for sex workers;
b) Guide and organize the implementation of legal provisions concerning policies and solutions to prevent prostitution, drug rehabilitation, and post-rehabilitation management; support victims of trafficking returning to community reintegration according to assignment or delegation by the Provincial People's Committee;
c) Guide the organization and operation of drug rehabilitation facilities and victim support facilities according to legal provisions and assignments or delegations by the Provincial People's Committee;
d) Promote and disseminate policies and laws on drug rehabilitation; prevention of prostitution;
14. Regarding the field of gender equality:
a) Guide, organize the implementation, and inspect the implementation of legal provisions on gender equality and prevention and response to gender-based violence at the local level;
b) Guide the integration of gender equality and prevention and response to gender-based violence into the development and implementation of local economic and social development strategies, plans, and programs; advise on organizing the implementation of measures to promote gender equality and prevent and respond to gender-based violence consistent with local economic and social conditions;
c) Guide and organize the implementation of gender equality strategies, programs, plans, models, and projects; Month of Action for Gender Equality and Prevention and Response to Gender-Based Violence;
15. Manage enterprises, collective economic organizations, private economic organizations, associations, and non-governmental organizations within the scope of specialized industries and fields according to legal regulations;
16. Guide the implementation of self-management mechanisms for public service units under the industry and field management according to legal regulations; manage the activities of public and non-public service units within the scope of industry and field management;
17. Implement international cooperation in the managed industry and field according to assignments or delegations by the Provincial People's Committee;
18. Guide professional and business matters within the industry and field management for the Department of Labor, Invalids, and Social Affairs under the District People's Committee and professional positions under the Commune, Town, and Ward People's Committees;
19. Organize research, application of scientific and technological progress; build databases, information systems, and archives to serve state administration and professional and business activities in the assigned field.
20. Implement the administrative reform program of the Department of Labor, Invalids and Social Affairs in accordance with the administrative reform objectives and programs of the provincial People's Committee.
21. Inspect and audit within the assigned sectors and fields concerning organizations and individuals in their implementation of legal regulations; handle complaints and denunciations; prevent corruption and waste in accordance with legal provisions and as delegated or authorized by the provincial People's Committee and the Chairman of the provincial People's Committee.
22. Organize the provision of public services in the labor, war invalids, and social affairs sector under the management of the Department of Labor, Invalids and Social Affairs.
23. Provide regular and urgent information and reports on the implementation of assigned tasks to the provincial People's Committee and the Ministry of Labor, Invalids and Social Affairs.
24. Define the functions, tasks, authorities, organizational structure, and working relationships of units under the Department of Labor, Invalids and Social Affairs in accordance with the provisions of this Circular and the regulations of the provincial People's Committee.
25. Manage the organizational structure, civil servant quota, job position structure, and number of staff in public service units according to occupational titles; implement salary systems and incentive policies, training, rewards, and disciplinary measures for civil servants, public officials, and workers under its jurisdiction in accordance with legal provisions and as delegated or authorized by the provincial People's Committee.
26. Manage and be responsible for financial resources and assets allocated in accordance with legal provisions and as delegated, classified, or authorized by the provincial People's Committee.
27. Perform other tasks assigned by the provincial People's Committee and the Chairman of the provincial People's Committee and as stipulated by law.
Chapter II
LABOR, INVALIDS AND SOCIAL AFFAIRS DEPARTMENT
Article 3. Position and Functions
1. The Labor, Invalids and Social Affairs Department is a specialized agency under the People's Committee of the district, responsible for advising and assisting the district People's Committee in managing state administration in the areas of labor, wages in business operations and employment; vocational education (excluding teacher training); social insurance; occupational safety and health; war invalids; social assistance; children; gender equality; prevention and control of social evils in accordance with legal provisions; contributing to ensuring the unity of management in the industry or field of work at the local level.
2. The Labor, Invalids and Social Affairs Department has legal personality, possesses a seal and bank account; it is subject to the direction and management of the district People's Committee regarding organization, job positions, civil servant quotas, and personnel work, while also being subject to professional guidance and supervision from the Department of Labor, Invalids and Social Affairs.
Article 4. Tasks and Powers
1. Submit draft decisions; planning and development programs for the medium term and annually; programs and measures to organize the implementation of administrative reform tasks within the assigned state management scope; draft documents specifying the functions, tasks, authorities, and organizational structure of the Labor, Invalids and Social Affairs Department under the district People's Committee to the district People's Committee for approval.
2. Submit draft documents in the fields of labor, war invalids, and social affairs within the authority of the district People's Committee Chairman for approval as assigned.
3. Implement approved legal documents, plans, and programs; provide information, propaganda, dissemination, and legal education in the assigned labor, war invalids, and social affairs fields; monitor the enforcement of laws.
4. Assist the district People's Committee in managing state administration in accordance with legal provisions over collective economic organizations, private enterprises, associations, and non-governmental organizations operating in the labor, war invalids, and social affairs fields.
5. Guide and inspect the implementation of legal provisions for social assistance facilities, vocational education institutions, employment service organizations, drug rehabilitation centers, victim support facilities, gender equality service providers, violence prevention and response services based on gender, and child assistance facilities in accordance with legal provisions and as assigned or authorized.
6. Manage memorials and war hero gravesites within the assigned classification.
7. Receive applications and determine the number of workers temporarily suspended from social insurance contributions from agencies, units, organizations, and businesses under the district People's Committee's management; manage state administration in social insurance within the local area in accordance with legal provisions and as delegated or authorized by the district People's Committee; review, check, and verify lists of social health insurance beneficiaries managed by the Ministry of Labor, Invalids and Social Affairs.
8. Provide professional guidance on labor, war invalids, and social affairs to cadres and civil servants in communes, wards, and towns within the area.
9. Coordinate with departments and mass organizations to build a nationwide movement to care for and assist war invalids and social policy beneficiaries.
10. Inspect within the assigned sectors and fields concerning organizations and individuals in their implementation of legal regulations; handle complaints and denunciations; prevent corruption and waste in accordance with legal provisions and as delegated by the district People's Committee.
11. Organize the application of scientific and technological progress; establish information and archival systems to serve state management and professional work of the district specialized agency.
12. Provide regular and urgent information and reports on the implementation of assigned tasks in accordance with the regulations of the district People's Committee and the Department of Labor, Invalids and Social Affairs.
13. Manage the organizational structure, job positions, civil servant quotas, civil service grade structures, implement salary systems, policies, incentive schemes, rewards, disciplinary measures, and professional training for civil servants within the scope of management as prescribed by law, according to the assignment of the People's Committee at the district level.
14. Manage and be responsible for the financial affairs and assets of the Labor - War Invalids and Social Affairs Office in accordance with the law and according to the assignment of the People's Committee at the district level.
15. Perform other tasks assigned by the People's Committee at the district level or as prescribed by law.
Chapter III
IMPLEMENTATION
Article 5. Effective Date
1. This Circular takes effect from November 15, 2021.
2. This Circular replaces Circular Joint Circular No. 37/2015/TTLT-BLDTBXH-BNV dated October 2, 2015, issued by the Ministry of Labor - War Invalids and Social Affairs and the Ministry of Home Affairs guiding the functions, tasks, authorities, and organizational structure of the Department of Labor - War Invalids and Social Affairs under the People's Committees of provinces and centrally-run cities, and the Labor - War Invalids and Social Affairs Offices under the People's Committees of districts, towns, and provincial-level cities.
Article 6. Responsibility for Implementation
1. The provincial People's Committee and the Chairman of the provincial People's Committee are responsible for directing and organizing the implementation of this Circular.
2. During the implementation of this Circular, if there are any difficulties, it is recommended that the People's Committees of provinces and centrally-run cities, and relevant agencies, organizations, and individuals report to the Ministry of Labor - War Invalids and Social Affairs for consideration and resolution./.
