Decree No. 11/2022/ND-CP amends and supplements some articles of Decree No. 103/2020/ND-CP dated September 4, 2020, of the Government on certification of fragrant rice varieties for export to the European Union to guide the implementation of certification of fragrant rice varieties for export to the European Union and the United Kingdom and Northern Ireland.

DECREE

AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE GOVERNMENTAL DECREE NO. 103/2020/NĐ-CP OF SEPTEMBER 4, 2020 ON RICE VARIETY CERTIFICATION FOR EXPORT TO THE EUROPEAN UNION TO GUIDE THE IMPLEMENTATION OF RICE VARIETY CERTIFICATION FOR EXPORT TO THE EUROPEAN UNION AND THE UNITED KINGDOM AND NORTHERN IRELAND

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the ASEAN Framework Agreement on Facilitation of Intra-Regional Land Transport signed on December 10, 2009;

Pursuant to Resolution No. 102/2020/QH14 dated June 8, 2020 of the National Assembly approving the Free Trade Agreement between the Socialist Republic of Vietnam and the European Union (EVFTA);

To implement the Free Trade Agreement between the Socialist Republic of Vietnam and the United Kingdom and Northern Ireland (UKVFTA) effective from 0of the Government's Decree No. 104/2022/NĐ-CP dated December 21, 2022 amending and supplementing certain provisions of related decrees concerning the submission and presentation of household registration books and temporary residence certificates when performing administrative procedures and providing public services; Example 5: Comrade Hoang Tuan Manh, aged 32, Senior Lieutenant, Company Commander, with 14 years and 02 months of service in the military (calculated as 14% seniority), due to unit merger and unable to be reassigned, was discharged to his place of origin from April 1, 2025. The monthly social insurance contribution wage of the month immediately preceding discharge (March 2025) for Comrade Manh is: 2021;

At the proposal of the Minister of Agriculture and Rural Development;

The Government promulgates this Decree amending and supplementing certain provisions of Governmental Decree No. 103/2020/NĐ-CP dated September 4, 2020 on rice variety certification for export to the European Union to guide the implementation of rice variety certification for export to the European Union and the United Kingdom and Northern Ireland.

Article 1. Amending and supplementing certain provisions of Governmental Decree No. 103/2020/NĐ-CP dated September 4, 2020 on rice variety certification for export to the European Union (hereinafter referred to as Decree No. 103/2020/NĐ-CP) to guide the implementation of rice variety certification for export to the European Union and the United Kingdom and Northern Ireland

1. Amend and supplement Article 1 as follows:

"Article 1. Scope of Regulation

This Decree provides for rice variety certification for aromatic rice listed in Point 8 Subsection 1 Section B Annex 2-A of the Free Trade Agreement between Vietnam and the European Union (hereinafter referred to as the EVFTA) which enjoys duty-free import quota when exported to the European Union under the framework of the EVFTA and exported to the United Kingdom and Northern Ireland under the framework of the Free Trade Agreement between Vietnam and the United Kingdom and Northern Ireland (hereinafter referred to as the UKVFTA).

2. Amending and supplementing Clause 1 of Article 3 as follows:

"1. Aromatic rice is the type of rice listed in Point 8 Subsection 1 Section B Annex 2-A of the EVFTA. The list of aromatic rice for export to the European Union (hereinafter referred to as EU) shall be amended and supplemented according to the Decision of the EVFTA Trade Committee; the list of aromatic rice for export to the United Kingdom and Northern Ireland (hereinafter referred to as UK) shall be amended and supplemented according to the Decision of the UKVFTA Trade Committee."

3. Amending and supplementing Point b of Clause 1 of Article 7 as follows:

"b) The Rice Variety Certification Form must be fully filled out with information from Item 1 to Item 9 according to the model prescribed in Appendix VI issued together with Decree No. 103/2020/NĐ-CP for aromatic rice exported to EU or Appendix VIa issued together with this Decree for aromatic rice exported to UK."

4. Amending and supplementing Point b Clause 2 Article 7 as follows:

"b) Within five working days from the date of receiving valid application files, the Crop Cultivation Department shall organize the examination and certification of Item 10 of the Rice Variety Certification Form prescribed in Appendix VI issued together with Decree No. 103/2020/NĐ-CP for aromatic rice exported to EU or Appendix VIa issued together with this Decree for aromatic rice exported to UK; in case of non-certification, a written response with clear reasons must be provided."

5. Amending and supplementing Point b Clause 2 Article 8 as follows:

"b) The Reissue Rice Variety Certification Form must be fully filled out with information from Item 1 to Item 9 according to the model prescribed in Appendix VII issued together with Decree No. 103/2020/NĐ-CP for aromatic rice exported to EU or Appendix VIIa issued together with this Decree for aromatic rice exported to UK."

6. Amending and supplementing Point b Clause 3 Article 8 as follows:

"b) Within three working days from the date of receiving valid application files, the Crop Cultivation Department shall organize the examination and reissue certification of Item 10 of the Reissue Rice Variety Certification Form prescribed in Appendix VII issued together with Decree No. 103/2020/NĐ-CP for aromatic rice exported to EU or Appendix VIIa issued together with this Decree for aromatic rice exported to UK; in case of non-reissue certification, a written response with clear reasons must be provided."

7. Amending and supplementing Clause 2 Article 12 as follows:

"2. Announcing on the electronic portal of the Crop Cultivation Department, Ministry of Agriculture and Rural Development the list of testing organizations; the name of organizations and individuals certified for rice variety, Rice Variety Certification Forms issued or revoked; the updated and amended aromatic rice export list to EU according to the Decision of the EVFTA Trade Committee; the updated and amended aromatic rice export list to UK according to the Decision of the UKVFTA Trade Committee."

8. Supplementing Appendices VIa and VIIa issued together with this Decree.

9. Replacing Appendix V issued together with Decree No. 103/2020/NĐ-CP with Appendix V issued together with this Decree.

10. Abolishing Appendix I issued together with Decree No. 103/2020/NĐ-CP.

Article 2. Implementation

1. This Decree takes effect from the date of issuance.

2. Transitional Provisions

For aromatic rice produced before the effective date of this Decree for export to the UK, the application file for rice variety certification of organizations and individuals shall be implemented according to Point a Clause 1 Article 7 of Decree No. 103/2020/NĐ-CP and Clause 3 Article 1 of this Decree; the application file for reissue rice variety certification shall be implemented according to Point a Clause 2 Article 8 of Decree No. 103/2020/NĐ-CP and Clause 5 Article 1 of this Decree until March 31, 2022.

3. The Minister, Head of ministerial-level agencies, Head of agencies under the Government, Chairman of People's Committees of provinces and centrally governed cities, relevant organizations and individuals are responsible for implementing this Decree.
