The Minister of Science and Technology issues this Circular

stipulating the method for determining the localization rate for automobiles

Pursuant to the Law on Legislative Regulatory Documents issued on June 22, 2015;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;

Pursuant to Decree No. 116/2017/NĐ-CP dated October 17, 2017 of the Government on conditions for production, assembly, importation, and warranty and maintenance services for automobiles;

Pursuant to Decree No. 57/2020/NĐ-CP dated May 25, 2020of the Government amending and supplementing certain articles of Decree No. 122/2016/NĐ-CP dated September 1, 2016 of the Government on the Export Tariff, Import Tariff with Preferential Rates, List of Goods and Absolute Tax Rates, Mixed Tax Rates, and Import Tariffs outside Quota Tariff Rates and Decree No. 125/2017/NĐ-CP dated November 16, 2017 amending and supplementing certain articles of Decree No. 122/2016/NĐ-CP;

Pursuant to Decree No. 95/2017/NĐ-CP dated August 16, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Director of the Department of Evaluation, Appraisal, and Technology Inspection and the Director of the Legal Department;

The Minister of Science and Technology issues this Circular to repeal legal normative documents issued by the Minister of Science and Technology stipulating the method for determining the localization rate for automobiles.

Repeal all legislative regulatory documents as follows:

1. Circular No. 05/2000/TT-BXD dated June 27, 2000 of the Minister of Construction guiding the implementation of support for people participating in revolutionary activities before the August Revolution of 1945 to improve housing pursuant to Decision No. 20/2000/QĐ-TTg dated February 3, 2000 of the Prime Minister.

1. Decision No. 28/2004/QĐ-BKHCN dated October 1, 2004 of the Minister of Science and Technology on the method for determining the localization rate for automobiles;

2. Decision No. 05/2005/QĐ-BKHCN dated May 11, 2005 of the Minister of Science and Technology amending and supplementing Decision No. 28/2004/QĐ-BKHCN dated October 1, 2004 of the Minister of Science and Technology on the method for determining the localization rate for automobiles;

3. Circular No. 05/2012/TT-BKHCN dated March 12, 2012 of the Minister of Science and Technology amending and supplementing Article 1 of Decision No. 05/2005/QĐ-BKHCN dated May 11, 2005 of the Minister of Science and Technology amending and supplementing Decision No. 28/2004/QĐ-BKHCN dated October 1, 2004 on the method for determining the localization rate for automobiles.

Article 2. Implementation clause

This Circular takes effect from October 1, 2022./.
