CIRCULAR

Providing detailed implementation ADJUSTMENT of certain provisions of the Law on Competition and Rewards

for for the Justice Sector

Pursuant to the Law on Competition and Rewards in 20222;

On the basis of Decree No. 98/2022/NĐ-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

The Minister of Justice promulgates this Circular providing detailed implementation of certain provisions of the Law on Competition and Rewards for the Justice Sector.

Article 1. Scope of Regulation and Applicability

1. This Circular provides detailed implementation of Clause 4 Article 24, Clause 3 Article 26, Clause 3 Article 27, Clause 3 Article 28, Clause 6 Article 74, Clause 2 Article 75, and Clause 6 Article 84 of the Law on Competition and Rewards in 2022.

2. This Circular applies to collectives and individuals specifically identified in competition movements; collectives and individuals performing tasks related to the fields of work of the Justice Sector; collectives and individuals contributing to the development of the Ministry of Justice and the Justice Sector.

Article 2. Criteria for awarding the title "Advanced Worker"

1. The title "Advanced Worker" shall be awarded annually to individual officials, civil servants, public officials, and workers under the Ministry of Justice and civil servants and workers under local enforcement agencies who meet the following criteria:

a) Ensuring progress and meeting the requirements of assigned tasks for the year, evaluated at the level of satisfactorily completing tasks or higher;

b) Having self-reliance, self-strengthening spirit, unity, mutual assistance, actively responding and participating in practical and effective competition movements launched by the Justice Sector, agencies, and units.

2. Maternity leave according to regulations shall be counted towards the evaluation for the title "Advanced Worker".

Article 3. Criteria and subjects for awarding the title "Competition Flag of the Justice Sector"

1. The title "Competition Flag of the Justice Sector" shall be awarded annually to collective units under the Ministry of Justice, Department of Justice, Enforcement Agency, and Enforcement Sub-Department leading the competition movement of the Cluster of Units under the Ministry of Justice, Department of Justice Clusters, Provincial Enforcement Agencies Clusters, and the Cluster of Enforcement Sub-Districts, recognized and honored by the Clusters and Groups, and meeting the following criteria:

a) Exceeding competition targets and assigned tasks for the year based on evaluation criteria for agencies and units issued by the Minister of Justice; being outstanding exemplary collectives in the Justice Sector with many innovations and remarkable achievements; serving as models for other collectives in the Justice Sector to emulate;

b) Internal solidarity; clean and strong party organizations and mass organizations; actively practicing thrift, combating waste, corruption, and other social evils; actively responding and participating in practical and effective competition movements launched by the Justice Sector, Clusters, Groups, agencies, and units.

2. The title "Competition Flag of the Justice Sector" shall be awarded to collective units under the Ministry, Department of Justice, Enforcement Agency, and Enforcement Sub-District leading specialized competition movements launched by the Justice Sector for three years or more when summarizing the movement.

Article 4. Criteria and Recipients for Awarding the Title "Outstanding Labor Collective"

The title "Outstanding Labor Collective" shall be awarded annually to collectives that are units under the Ministry of Justice; Civil Enforcement Bureaus and Civil Enforcement Branches; and department-level collectives equivalent to those under the Ministry of Justice and Civil Enforcement Bureaus which meet the following criteria:

1. Successfully completing assigned tasks with excellence; innovating and achieving outstanding results, including all criteria regarding the completion of assigned tasks being rated as "Excellent."

2. Actively participating in campaigns initiated by the Ministry of Justice, the Department of Justice, and other agencies in an effective and practical manner.

3. All individuals within the collective successfully complete their assigned tasks, with at least 70% of them receiving the title "Advanced Worker."

Clause 4. Having an individual who has received the title "Model Worker at the Base Level."

5. Internal unity, exemplary compliance with the Party's guidelines, state policies, and laws.

Article 5. Criteria and Recipients for Awarding the Title "Advanced Labor Collective"

The title "Advanced Labor Collective" shall be awarded annually to collectives that are units under the Ministry of Justice; Civil Enforcement Bureaus and Civil Enforcement Branches; and department-level collectives equivalent to those under the Ministry of Justice and Civil Enforcement Bureaus which meet the following criteria:

1. Successfully completing assigned tasks; all criteria regarding the completion of assigned tasks being rated as "Good" or higher.

2. Regularly participating in campaigns initiated by the Ministry of Justice, the Department of Justice, and other agencies in a practical and effective manner.

3. At least 70% of individuals within the collective receive the title "Advanced Worker," and there are no individuals disciplined with warnings or higher.

4. Internal unity, compliance with the Party's guidelines, state policies, and laws.

Article 6. Criteria for Awarding or Posthumously Awarding the "Certificate of Merit from the Minister of Justice"

1. The "Certificate of Merit from the Minister of Justice" shall be awarded or posthumously awarded to individuals who are officials, civil servants, public employees, workers under the Ministry of Justice; civil servants and workers under local enforcement agencies; public employees, officials, and workers under provincial Departments of Justice, Justice Departments, and individual officials who are civil registry officers at commune level; individuals belonging to legal affairs organizations of Ministries, agencies at the level of ministries, government agencies, specialized agencies under provincial People's Committees; individuals specifically identified in the plan for initiating campaigns according to specific themes and individuals performing tasks related to the work areas of the Justice sector, who comply well with the Party's guidelines, state policies, and laws, and meet one of the following criteria:

a) Achieving outstanding results in regular annual campaigns or thematic campaigns initiated by the Ministry of Justice and the Department of Justice;

b) Achieving many merits or outstanding achievements with significant impact in one of the areas under the management of the Ministry of Justice and the Department of Justice;

c) Contributions to economic and social development, application of scientific and technological progress, social work, humanitarian aid;

d) Being consecutively awarded the title "Model Worker at the Grassroots Level" twice or having been recognized as completing tasks excellently for two consecutive years or more, during which time two recognized and effectively applied initiatives were implemented within the organization based on the recommendation and evaluation of the initiative committee established by the head of the organization, or two scientific topics, scientific projects, and technological works have been accepted and effectively applied within the organization.

2. The "Certificate of Merit from the Minister of Justice" shall be awarded or posthumously awarded to business leaders, intellectuals, and scientists who comply well with the Party's guidelines, state policies, and laws, and meet one of the criteria stipulated in Clause 1 of this Article or have made contributions to the development of the Ministry of Justice and the Department of Justice recognized by the Ministry of Justice.

3. The "Certificate of Merit from the Minister of Justice" shall be awarded to collectives that are units under the Ministry of Justice; Civil Enforcement Bureaus; Civil Enforcement Branches; department-level collectives equivalent to those under the Ministry of Justice and Civil Enforcement Bureaus; collectives that are Provincial Departments of Justice, Justice Departments, and department-level collectives equivalent to those under Provincial Departments of Justice; legal affairs organizations of Ministries, agencies at the level of ministries, government agencies, specialized agencies under provincial People's Committees; collectives specifically identified in the plan for initiating campaigns according to specific themes and collectives performing tasks related to the work areas of the Justice sector, who comply well with the Party's guidelines, state policies, and laws, internal unity, and meet one of the following criteria:

a) Achieving outstanding results in regular annual campaigns or thematic campaigns initiated by the Ministry of Justice and the Department of Justice;

b) Achieving outstanding and sudden merits with significant impact in each area under the management of the Ministry of Justice and the Department of Justice;

c) Contributions to economic and social development, application of scientific and technological progress, social work, humanitarian aid;

d) Being consecutively recognized as completing tasks excellently for two years or receiving the title "Outstanding Labor Collective" twice, implementing grassroots democracy well, organizing campaigns effectively; caring for the material and spiritual life of the collective; practicing thrift and combating waste and corruption.

4. The "Certificate of Merit from the Minister of Justice" shall be awarded to enterprises and other economic organizations that comply well with the Party's guidelines, state policies, and laws, and meet one of the criteria stipulated in Clause 3 of this Article or have made contributions to the development of the Ministry of Justice and the Department of Justice recognized by the Ministry of Justice.

Article 7. Criteria for awarding Certificates of Merit

1. The Certificate of Merit of the Head of the agency or unit with legal personality under and subordinate to the Ministry of Justice shall be awarded to individuals within their jurisdiction who meet one of the following criteria:

a) Achieving outstanding results recognized in the competition movement initiated by the agency or unit;

b) Achieving exceptional results;

c) Completing tasks at a good level or higher; having good moral character, maintaining internal unity; setting a good example in implementing Party policies, State laws, internal regulations, and work rules of the agency or unit; actively participating in competition movements organized and launched by the agency or unit; practicing thrift and combating waste.

2. The Certificate of Merit of the Head of the agency or unit with legal personality under and subordinate to the Ministry of Justice shall be awarded to groups within their jurisdiction who meet one of the following criteria:

a) Achieving outstanding results recognized in the competition movement initiated by the agency or unit;

b) Achieving exceptional results;

c) Completing tasks at a good level or higher; maintaining internal unity, setting a good example in implementing Party policies, State laws, effectively practicing grassroots democracy, organizing well the competition movements, practicing thrift, and combating waste.

3. The Certificate of Merit of the head of educational institutions under the Ministry of Justice shall be awarded to individuals and groups studying at such institutions according to the provisions of the Minister of Education and Training.

Article 8. Quantity of files for recommending awards of commendation titles and forms of reward within the authority of the Minister of Justice

The file for recommending awards of commendation titles and forms of reward within the authority of the Minister of Justice includes 01 set (original) and electronic documents of the award file, except for documents containing state secrets.

Article 9. Effective Date

1. This Circular takes effect from February 12, 2024.

2. Circular No. 05/2018/TT-BTP dated June 7, 2018, guiding the competition and reward activities in the judicial sector issued by the Minister of Justice shall cease to be effective from the date this Circular takes effect.

3. In cases where the legal normative documents referred to in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued documents.

Article 10. Implementation Organization

1. The Competition and Reward Council of the Judicial Sector, Heads of agencies under the Ministry of Justice, Directors of Provincial Justice Departments, Heads of Civil Enforcement Agencies of provinces and centrally-administered cities, Leaders of Competition Groups, Leaders of Competition Clusters within their assigned duties and powers and related agencies, organizations, units, and individuals shall be responsible for organizing and implementing this Circular.

2. The Cadre and Civil Servant Organization Department shall take the lead, coordinating with relevant agencies under the Ministry of Justice to assist the Minister of Justice in providing guidance, inspection, and urging agencies under the Ministry of Justice and Provincial Justice Departments of provinces and centrally-administered cities to organize and implement this Circular.

3. The Civil Enforcement Agency General Department shall take the lead, coordinating with the Cadre and Civil Servant Organization Department to assist the Minister of Justice in providing guidance, inspection, and urging civil enforcement agencies at local levels to organize and implement this Circular.
